collides with another car. this happened around 8:30 at the intersection of pratt and patience street. the officer was rushing to help another officer who was facing a man with a gun. both officers were hurt but we're told they will recover. no word on the other driver. the suspect was in fact arrested. armed and under the influence, a baltimore police officer accused of shooting and killing a man while on duty. there are questions whether officers should be armed while around alcohol. city hall is demanding action. >> reporter: the policy is when officers are off duty within city limits they must carry their weapon and use common sense. but city hall is saying common. >> it becomes a very diabolical ingredient right there. >> reporter: in june this off duty officer was charged with killing a -- witnesses say the cop was inside, we do not know if he was drinking. the city council is asking the commissioner to clarify the policy. he says it relies on common sense. >> you don't wear it while ice skating. if you go in and people have. >> reporter: some council members want to take thanks further by changing the policy. >> i think it's very important that there's a very clear policy about this. alcohol and weapons just don't mix. >> reporter: off duty cops have -- with their guns. >> do you think the alcohol sentence would be added to the [ indiscernible ] >> i'm not going to commit to that. i wasn't going to commit to that in there and i'm certainly not going to commit to it here, mostly because i don't think we have done enough deliberation and research with all the stake holders. >> reporter: the commissioner goes on to tell me that he is open to altering the policy if in fact that research shows that it would be a good idea. city council members tell me they still have to investigate. reporting live. okay, kelly, thank you. meanwhile officer remains behind bars pending a trial. and there's another concern for commissioner -- here's a problem recently made worse after a high number of officers left the force before their pensions took effect. according to the baltimore sun, 42 officers left in june. police say they believe there was a group of people inside the car that plunged into glen smalls river. emergency teams searched the river for hours last night. say they saw a group of teenagers get out of a car after it landed in the water and run away. the car had no tags and they are trying to -- cleared that officer of using excessive force. report on the debate over the officer's fate. >> you disrespected me, this badge and my department. >> reporter: this confrontation three years ago sparked a nationwide debate. did the officer use excessive force for a teen skateboarding. >> obviously your parents don't put a foot in your butt enough because you don't understand the meaning of respect. >> reporter: a trial board just ruled in the officer's favor. the head of the fop. >> yeah, the video may show to the average citizen that officer rivera may have done something he could have refrained from. but keep in mind, he didn't use any foul language, or any excessive force. >> reporter: they could fire him and the lawyer for the teenager has a suggestion. >> a serious evaluation has to be put in there to determine whether he does have the temperament for the job. >> reporter: wjz was first to sit down with the teen. >> he was getting bad at me, saying he was going to slap me upside the head and i was just going off with it. >> the comment of dude, how in god's name could that rise to the level of grabbing him, throwing him to the ground. >> officer rivera feels comfortable with the decision to suspend him for a number of days days. he wants to get back to doing his job. >> reporter: he has been on desk duty since the incident. he has been allowed to keep his gun due to death threats. reporting from the interharbor. >> reporter: officer rivera's lawyer refused to comment on this case. the usda worker who has been forced to resign has been offered a new job from the agency. after a video surfaced of what appeared to be her making racial remarks about a white farmer. but after a national outcry and more of the video was released showing she was talking about racial reconciliation, the white house apologized. she's still thinking about whether she will rejoin the agency. recently hurt in a bombing attack in india. the procedure was performed to remove shrapnel. two more surgeries are scheduled for later this week. emily's family says she is doing well and staying positive. the national transportation safety board is beginning its investigation into the turbulent flight from dc. >> reporter: shook up passengers stepped into the arms of family members after a scary flight. >> there's going to be turbulence up ahead and all of a sudden we just felt a huge jolt. >> reporter: united airlines flight headed from washington dc to to los angeles hit turbulence last night. passengers say the plane dropped 30 feet. 30 of the 265 people on board the boeing 777 were hurt, one person critically. the pilot made an emergency landing. >> he landed on someone else. >> reporter: federal authorities are here investigating what went wrong. a preliminary check showed no problems inside the plane and no obvious damage to the plane's exexterior. >> very disturbing to see something like that happen. she had a confusion on her head, so i hope she's okay. >> reporter: a special flight brought those stranded in denver to los angeles. >> it was scary, but everybody was really good. the crew was great. >>
