first right to that travel ban decision. a federal court deciding unanimously to keep president trump's executive order on hold for now. our chief white house correspondent jon karl is here with those details for us, good morning, jon. >> good morning. no doubt this is a big setback for the white house but the president is vowing to fight on and confident that he will ultimately prevail. just minutes after the court shot him down, president trump was defiant. >> it's a political decision. we have a situation where the security of our country is at stake. and it's a very, very serious situation, so we look forward as i just said to seeing them in court. >> reporter: the president insisted his executive order was essential to protecting america from another terrorist attack. but the three appeals court judges refuse to reinstate ban writing, quote, the government has pointed to no evidence that any alien from any of the countries named in the order has perpetrated a terrorist attack in the united states. the president's order banning entry into the united states from seven majority muslim countries set off chaos at airports hours after it went into effect two weeks ago. the appeals court ruled the ban imposed, quote, substantial injuries and even irreparable harms to families and travelers. the washington state lawyer who brought the case celebrated the decision. >> we are a nation of laws. those laws apply to everybody in our country and that includes the president of the united states. >> reporter: democrats applauded the court's decision. senate democratic leader chuck schumer challenging the president to, quote, see the writing on the wall. abandon the proposal, roll up his sleeves and come up with a real bipartisan plan to keep us safe. the court's decision is the biggest challenge to president trump's authority so far. but he seems unfazed. >> do you think this undercuts the early days of your presidency. >> no, this is just a decision that came do you know but we are going to win the case. >> reporter: among those applauding the court's decision is hillary clinton. she weighed in with a rare post-election tweet saying simply, 3-0. robin. that's obviously reference to the fact it was unanimous. all three judges ruling against the president. >> what does the white house do now? >> it was a temporary restraining order that put the ban on hold while the legal challenge goes forward. they can try to fight to get that temporary restraining order lifted or just get to the court and fight on the fundamentals of the case. i think they'll do that. they're very confident they can win on the fundamentals of the president's right to do this executive order. >> let's get more from dan abrams. terry moran as well and let me begin with you. 3-0, unanimous but a sweeping decision. >> it was so broad. i mean the court criticized the court criticized the way the order was publicly defended so you see language in here and as john just talked about, for example, saying that the administration is absolutely wrong that the court has no place in this at all. one of the administration's biggest arguments was this shouldn't be reviewable by a court. this is a national security question. the court saying that's absolutely not true. so, you look at it again and again. every argument that the administration made, particularly on something like the seven countries these pose a particular risk and the court saying there's no evidence of that. that's important because they had to demonstrate why there was immediate harm because, again, we're talking about the timing here. >> and terry moran, one thing the court didn't do is reach a decision on whether or not this discriminates against muslims. >> reporter: that's right. they declined to reach that question but they raised it in a really interesting way, george. what they said the states say that this ban was intended to treat them with disfavor and the courts said, well, we aren't going to reach that, it is clear that the president's own comments on the campaign trail on twitter and the comments of his associates like rudy giuliani who said this was a muslim ban could fairly be considered under statistic precedent as evidence of intent that they intended to discriminate against muslims. that's big if it stands. >> dan, on the process do you agree they'll forgo opinion of the supreme court on the restaining order itself and go straight to the substance in the district court. >> it's the right decision to make particularly if the president wants to be right that they want to try to win, right, because there are two options sort of temporarily. they could go to the entire ninth circuit court of appeals and say, we want the whole court to hear this. this is just a three-court panel. some people do that. that's unlikely i think in this particular scenario. the other go to the supreme court and appeal this. the problem there is they need five of those eight votes to overturn the stay. i think they'll recognize that's unlikely and so they may say, this with of the courts. we're going to want to litigate this and there are technical reason, by the way, based on the ninth circuit's ruling that it's time to hear the whole case. >> thanks very much. in other words, it's not over. far from over. the president also firing back about the criticism he received from his supreme court nominees saying those remarks were misrepresented. let's go to our senior white house correspondent cecilia vega for more on all that. good morning, cecilia. >> reporter: robin, good morning to you. there is a war of words playing out here at the white house right now. as you mentioned the president said the supreme court pick has been misrepresented but others on capitol hill right now are sticking to their story. they say judge gorsuch made it very clear he is not happy with the president's words against fellow judges. this morning, president trump waking up to that ruling from the very judges he criticized. >> a bad high school student would understand this. >> reporter: and it is that ridicule that now has his own supreme court nominee firing back calling the president's and demoralizing. but president trump isn't buying it. >> his comments were misrepresented. >> reporter: president trump blasting the democratic senator who went public with gorsuch's words after their private meeting but that senator and others including a republican and even gorsuch's own spokesman all say the judge expressed dismay about the president's words. the white house not backing down. are you saying that demoralizing and disheartening was not specifically about the president's comments and what he said and if so -- >> no, i think the judge literally made it very clear -- >> three senators have come out and said they corroborated the statement and his spokesperson. >> senator ayotte made it clear he was commenting in general about attacks on the judiciary. that was it plain and simple. >> reporter: counselor to the president kellyanne conway fielding questions of her own after this in the briefing room. >> go buy ivanka's stuff. i'll give a free commercial here. you can find it >> reporter: critics pouncing saying she is in violation of government ethics, bipartisan lawmakers on the house oversight committee recommending conway be disciplined. >> it was over the top and wholly unacceptable. >> reporter: overnight conway on defense saying president trump has her back. >> he supports me 100%. in fact, it was a very heartening moment. all i can say to america's women is at some point in your life you ought to have a boss who treated me the way that the president of the united states treated me today. >> reporter: now sean spicer says kellyanne conway has been counseled but sources are telling us president trump is taking issue with that assessment telling aides that counsel makes it sound like kellyanne conway is in trouble for what she said when, in fact, the president does stand by her, he feels like she was just defending ivanka trump after the brand at nordstrom was dropped, robin. >> but still, cecilia, we heard many reports that the government ethics site crashed after she made those remarks. >> reporter: this is the agency that basically helps avoiding conflicts of interest and you're right, it crashed and, listen to what they tweeted. they said it crashed after an extraordinary volume of contacts from citizens about recent events. the site was down for hours and that crash happened right after kellyanne conway made those comments about ivanka's brand, robin. >> all right, cecilia. that office could still recommend further discipline. another top white house official in hot water. that's mike flynn. "the washington post" reported that his contacts with the russians before the inauguration were inappropriate, possibly illegal. let's bring in our chief global affairs anchor, martha raddatz. at issue whether he was sending a signal about sanctions imposed about the election hacking. >> reporter: was the incoming national security adviser telling the russians not to worry about those sanctions because things would change when trump became president. u.s. citizens should not be negotiating with a foreign government under law. flynn never denied he had ambassador. but as recently as wednesday according to "the washington post" said, no, when asked if sanctions were discussed. "the post" said that changed yesterday when a spokesman back add way from the denial saying while flynn couldn't remember discussing sanctions he's not certain sanctions did not come up, george. >> martha, he made those same denials to his colleagues in the white house. listen to vice president mike pence a few weeks back. >> i talked to general flynn yesterday. and the conversations that took place at that time were not in any way related to new u.s. sanctions against russia or the expulsion of diplomats. >> the vice president was put in a tough spot. real credibility problem. >> reporter: certainly does. vice president pence said at the time he had spoken to flynn about this. i suspect he and others will want to know what why flynn now appears to have changed his mind, george. >> meantime, martha, major reversal from president trump on play during the transition. he had a phone call with the chinese leader last night. >> reporter: yeah, this seems quite the turnaround. the president, of course, making huge waves after his call with taiwan's president, the first in decades, that angered china. now president trump has officially recognized the one china policy. i don't think he would have gotten anywhere with china had that not happened, george. >> that was the precondition for more talks. martha raddatz, thanks very much. >> it certainly was. the latest on president trump's confirmation battles. overnight representative tom price confirmed as the next health and human services secretary. but the president's nominee for labor secretary is now under fire. let's go to our congressional correspondent mary bruce who is there on capitol hill. good morning, mary. >> reporter: good morning, robin. well, we've seen tense battles. this may be the most bruising yet. andrew puzder still hasn't had a hearing but the leader is withdraw his nomination. chuck schumer saying that puzder is the most anti-worker nominee for labor secretary ever and this isn't just democrats voicing concerns, while most republicans are digging in to get him confirmed we're already seeing several hinting they may not support him and overnight that other big confirmation you mentioned, this came down to a vote at 2:00 a.m. this morning. but this morning tom price now confirmed for hhs secretary. robin. >> a lot of long hours there on the hill. mary, thank you. we move on to that breaking news out of france where four people including a 16-year-old girl have been arrested for plotting a terror attack, explosives on the scene. abc's lama hasan has the latest. good morning, llama. >> reporter: good morning. this morning the french interior minister saying an imminent terror attack has been foiled after police swooped in and arrested four people in the south of france. three men aged between 21 and 34 years old as well as a 16-year-old girl were detained. three are suspected of planning a violent act on french soil. now, police searchi where they were arrested found explosives and other equipment. discovering 71 grams of tatp, a powerful explosive used by isis militants and also the same explosive used in the recent deadly paris and brussels attacks. the suspects were known to french authorities and were already under surveillance. these latest arrests come a week after a 29-year-old egyptian man attacked soldiers at the louvre museum. this is a country on edge, france at its highest alert level with hundreds of thousands of police and soldiers on the streets and it remains under a continuing state of emergency. >> a country truly under siege. thanks very much. michael. >> thank you, george. now to the big chill in the northeast after that major snowstorm. adrienne bankert is in south boston where they got nearly a foot of snow and good morning to you, adrienne. how are you doing out there? >> i would say she is fearless like her mom. she'll get on any roller coaster you put in front of her. she can work me like her mom used to work people. we could stand next to her and look like twins and the first thing they'll say is anna nicole, spitting image of the mother. >> reporter: dannielynn is a classic fifth grader obsessed with snapchat. >> wow, so beautiful. >> reporter: fast food. what's your favorite? >> french fries. >> reporter: dreams of travel. >> i want to go to washington, d. i want to see all the monuments. >> reporter: unlike her mom who relished the spotlight dannielynn is shy though always up for a good time. today at an indoor amusement mark with cousin chloe, her dad remains single but ten years after anna nicole's death he's beginning a new chapter starting with redecorating. last time i saw a lot of anna nicole stuff. >> there's no anna nicole stuff. >> reporter: yet in dannielynn's room he couldn't part with the colorful clothes her mother bought even before she was pregnant. they weren't all baby clothes. >> not really. she was planning way ahead. >> thinking way ahead. >> this was her little outfit from the guess campaign. >> reporter: sharing something special with her mother but it was a one time thing. >> i've had companies call me since then and ask me for her to model and the answer is no. it. she wants to be a kid. >> reporter: she's a girl scout, owner of a pet lizard and every night there's that pesky homework. normal moments her father cherishes. what's the big lesson out of anna's life? >> keep things simple. >> reporter: through her artwork dannielynn expresses a connection with the mother she's never known. the 10-year-old's words about her drawing brings her dad to tears. >> i'll let you read it. i can't read it. >> ever since my mother's death a friend of hers said she would send me pretty butterflies so butterflies chase me everywhere and i let the butterfly come out of my pencil and fly on my paper with its wings of love. it's beautiful. so, this is the way she thinks of her mother. being here with her through beautiful butterflies. >> it's her dealing with it on her own way at her own pace. i think it takes a strong little girl to write something like that. >> he's a single parent and larry is doing his very best to shield his daughter from too much media attention including social media. he's only allowing her to do snapchat just now. as for that nasty paternity scandal which dannielynn never knew anything about, it happened just after she was born, well, she and her dad believe it or not are very friendly with howard k. stern, the man who challenged larry for paternity. he says once it was all determined, he and howard joined forces to help raise dannielynn, so everything they could do to try to give this girl just a very calm life. >> we remember when they were both here some years ago and just very, you know, approachable little girl and very sweet and how larry how he broke down when you read the letter like that. but people do still want to know about the money that the fortune that she had. >> and, well, everybody remembers that big court case and so forth. they never got a penny of the estate from j. howard marshall, the elderly man she was married he says they do well. he has a job. he's a photographer and dabbles in real estate but does not have a huge fortune. he's just trying to make it and obsessed with her pet lizard. billy bob joe sr. jr. >> they live in kentucky. oh, wow. she seems so happy and loved. >> very, very much loved. >> the most important. >> and mostly out of the public glare, that's what's most important i think for him. >> okay, but not tonight because you can see deborah's full report, anna nicole smith:beauty lost" on abc tonight. new clues in the mysterious death of that american tourist found on a trail in panama. now the question is could her case be linked to another?
