led me to conclude that we needed to be more thorough. >> reporter: that explains the rise in the use of those full-body scanners which some critics call an electronic strip search, and intimate pat-downs that pilots equate with sexual molestation. that prompted passenger protests like this one. >> if you touch my junk i'm going to have you arrested. >> reporter: after a flood of complaints one group won't have to undergo intensified searches. >> children 12 and under are exempted from the enhanced pat-downs. >> reporter: tsa officials say they're working on a system to exempt pilots, who already undergo extensive security checks. asked if pat-downs make him uncomfortable, pistol said -- >> yeah, so it was more invasive than what i was used to. >> reporter: but, he added, they're necessary. almost 400 body scan machines have been deployed in u.s. airports. magnetometers can identify metal but bombs cab made of liquid and other hard to detect materials. the government continues to receive intelligence suggesting terrorists are intent on smuggling bomb components on plane is bound for the u.s. the heightened security could hardly come at a worse time for the travel industry. now worried people will start canceling their holiday trips, depressing an already downtrodden economy. one of those political robo calls triggered the evacuation of several buildings at ft. bragg. army officials apparently mistook the automated call, which was in a haitian creole language, to be a bomb threat. investigators looked into the matter and say it appears to be a call to vote from a haitian political action question. bruce beresford-redman has been ordered to remain behind bars until his hearing. he's accused of killing his wife at a resort in mexico. court documents unveiled tuesday reveal they argued in the hours before her murder. miriam hernandez reports from los angeles. >> reporter: hollywood producer bruce beresford-redman appeared before a magistrate in the same t-shirt and blue jeans he had on when he was arrested. his only words in the hearing, "yes, your honor," to confirm his name. mexican federal police accuse him of aggravated homicide in the death of his wife monica. he was their sole suspect, yet it took 7 1/2 months to gather the evidence and clear the red tape. monica's sisters were in court to watch. >> this is just the beginning we are here ready to keep on fighting for the justice for my sister and for the love that we have for her. >> there certainly have been other crimes committed in that area, and in particular that same hotel. there were two other homicides at that same hotel. so we think that the police certainly should have looked for other suspects before they arrested our client. >> reporter: bruce's father had no comment leaving the courthouse. the federal complaint alleges that bruce had an affair. the trip to a conkuhn resort was to patch things up but they fought as monica learned he was still in touch with the mistress. witnesses say they saw fighting, heard screams, and the sound of something being dragged in the room at 6:00 a.m. bruce allegedly gave conflicting stories about the noise. first, that they had fought about the children's behavior. then, that it was their 3-year-old playing a noisy game. he claimed monica went shopping later that same morning and never came back. he waited until the next day to report her missing. >> there is no happy ending on this. you know? motors. but as chris mentioned in his report, taxpayers are still less than halfway from breaking even on the $50 billion government investment in that company. analysts say gm's stock price would need to increase 47% to reach a break-even point for taxpayers. the first guantanamo detainee to face civilian trial has been cleared of all but one of the counts stemming from bombings in africa. the defense claimed gilani was duped into helping al qaeda. the jury in new york found him guilty of conspiracy to destroy u.s. property, a charge that carries a minimum of 20 years in prison. a trial had been set as a test for obama administration push for civilian trials over military tribunals. as we know, millions of americans are getting ready to fly for the upcoming thanksgiving holiday. but that secretary of state hillary clinton said a delay threatens national security. >> for anyone to think that we can postpone it or we can avoid it is, i'm afraid, vastly underestimating the continuing threat that is posed to our country. >> what happens if we don't ratify the treaty? i think that seriously undermines the credibility of the american government. >> the treaty would shrink the u.s. and russian arsenals of strategic warheads and would also restart on the ground inspections that stopped when a previous treaty expired nearly a year ago. lisa murkowski has pulled off a major accomplishment. she becomes the first senator to win a write-in campaign in more than half a century. murkowski, the incumbent, finally declared victory in the alaska senate race last night in anchorage. her tea party-backed challenger joe miller has not yet conceded but republicans in the state are asking him to respect the will of the voters and withdraw. in the house, the balance of power has officially shifted. but the leadership of both parties is staying the same. ohio republican and the current house minority leader john boehner was elected by his colleagues to be the next speaker of the house. it's been expected for weeks. on top of that, outgoing speaker democrat nancy pelosi will be the minority leader when the new congress convenes in january. her victory came after fighting off a challenge from moderate democrat heath schuler. >> truly making a difference within our caucus. to ensure that the moderates are heard within the caucus and that we have a seat at the table. to get that many votes, i mean, that's a lot better than we expected. >> reporter: after being elected speaker, boehner told fellow republicans that the gop will be wiser and more focused on the priorities of the people and the democrats. the makers of those controversial alcoholic energy drinks that we've been hearing about for so long now have two weeks to respond to a banning order from the fda. >> as we first reported yesterday morning, the most well-known of those drinks, four loko, has already announced changes to its beverages. t.j. winick joins us with the latest details. >> reporter: good morning, rob and vinita. the head of the fda told me this is about protecting the public and that drinks which combine caffeine and alcohol simply are not safe. they are two ingredients that have been adding up to trouble. >> so we just started feeling -- just really bad. >> reporter: the fda's top doc announced an effective ban on energy drinks that contain both alcohol and caffeine, calling the calf 15 an unsafe food addtive. the makers of one of the drinks, four loko, already announced they would remove the caffeine from the drinks. the combination of alcohol and caffeine is safe, but that they didn't want to deal with a difficult and politically charged regulatory environment at both the state and federal levels. >> the caffeine can mask the signs of intoxication. it can make you feel like you're wide awake, that you aren't drunk, but in fact, your senses are impaired. >> reporter: in washington state, where a four loko ban goes into effect thursday, cans are flying off the shelves. jason harman wanted two cases before it's all gone. >> i don't want to drive out of state or wherever just to get them. just stock up now while i have the money. >> reporter: the ban comes too late for joe and vicki, who are suing four loko. on september 17th they claim their son jason, wired and drunk on the energy drink, accidentally shot himself in the head. having deemed them a health risk, the government can seize energy drinks which combine caffeine and alcohol if companies continue to make them. the search is on this morning in southern rhode island for a bear with an apparent sweet tooth. the big fellow went into a trap that was loaded with doughnuts and meat. he took the doughnuts but left the meat behind. then managed to break out couple are conscious of public expectations, in britain and abroad. but a royal wedding is a moment for national celebration. but a wedding on the lavish scale of william's mother and father is most unlikely. and st. paul's does not seem to be the focus of their attention. they're said to be mindful of the difficult economic conditions and to know this is a moment for the royal family to shoulder treasury is expected to get a $13 billion boost this morning when general motors stock finally goes on sale. >> diana alvear reports the initial public offering could wind up as the biggest in history. >> reporter: general motors is gearing up to make history on wall street. the automaker's initial public offering, ipo, sold $20 billion worth of shares at $33 a pop. investors can start trading them on the new york stock exchange on thursday morning. >> it's incredible levels of demand. we are seeing almost daily increases in how many shares are going to be selling. >> reporter: it's a major turnaround for a company that recently went through bankruptcy. >> this is a fundamentally different company than what it was two years ago. the cost structure is radically lower. it used to be general motors would break even in the united states if they sold 4 million cars a year. now they'll break even if they sell 2 million cars a year. >> reporter: a far more efficient gm unveiled a new model at the los angeles auto show and the company is making money again. analysts say the ipo could raise up to a record $23 billion if every share offered is snapped up. that will go a long way toward reimbursing the $50 billion taxpayers invested in the bailout. >> the impetus is on getting out as quickly as possible and thanks to the company's performance and the market that looks like it can happen very, very quickly indeed. >> reporter: over the next few years the government plans to sell off its remaining stake in gm. diana alvear, abc news, los angeles. the obama administration is pleased with general motors' rapid financial comeback but sales figures released by the government show that taxpayers are still less than halfway to the break-even point to recover the $50 billion federal investment. analysts are looking for gm shares to increase in value by 47% before the automaker breaks even. the house ethics committee will discuss possible punishments for congressman charlie rangel today. the veteran new york democrat was found guilty by the committee earlier this week. rangel could now face a house vote deploring his conduct, a fine, or the loss of certain privileges. >> alaska senator lisa murkowski is celebrating a rare victory this morning. she is the first senator to win a write-in campaign in more than five decades. the republican incumbent returned to anchorage to finally declare victory in the race. her tea party challenger joe miller who was backed by sarah palin has not yet conceded but party leaders are calling on him to do so. when the next congress begins in january the gop will be in charge of the house. but the leadership of both parties there will be the same. john hendren has results of yesterday's republican and democratic elections. >> the bill is passed. >> reporter: for the democrats, the captain did not go down with the ship. >> how would your ratings be if $75 million were spent against you? >> reporter: house democrats were devastated at the ballot box, losing more than 60 seat and control of the house. but they re-elected some familiar faces. >> i'm proud to be part of this leadership team. our consensus is that we go out there listening to the american people. it's about jobs, it's about reducing the deficit, and it's about fighting for the middle class. >> reporter: nancy pelosi goes from house speaker to minority leader. steny hoyer from majority leader to minority whip. james clyburn from whip to a newly created post, assistant minority leader. it happened despite an insurgent run against pelosi by heath schuler, conservative blue dog democrat who netted an impressive 43 votes to pelosi's 150. >> it's about truly making a difference in our caucus. to ensure that the moderates are heard within the caucus and that we have a seat at the table. to get that many votes, that's a lot better than we expected. >> reporter: republicans awarded the men who led them to victory at the polls. unanimously picking ohio congressman john boehner as the next speaker of the house and eric cantor as the number two republican, going from minority whip to majority leader. because the house speaker is next in line in presidential succession after vice president, the full house has to vote on boehner's selection but that is usually a formality. john hendren, abc news, washington. a florida woman who visited haiti is now the first american known to have died from the impoverished country's crisis with cholera. meanwhile, haitian protesters took to the streets for a third day of anti-u.n. demonstration. they blame u.n. peacekeepers for spreading the disease. more than 1,000 haitians have died in the cholera outbreak. things got rough at protests against tuition hikes for university of california students. the clashes on a san francisco campus took place after students tried to get into a university board of regents meeting. all of their anger stems from a plan to increase student fees by $822. 13 people, most of them students, were taken into custody. >> an officer started hitting me more, then an officer came over, took a pepper spray canister and sprayed us all. >> i understand there's real passion and emotion. but you know, all we can hope for is that they -- you know, that everybody behaves. >> four officers were injured. one of them had to be treated at a hospital. very interesting story here. surprising findings this morning from a new survey on marriage. just released by "time" magazine. the poll shows that 40% of americans believe marriage is an obsolete institution, up from 28% back in 1979. the survey also shows that wedded couples are wealthier than unmarried couples with incomes about 41% higher. and just 28% of americans say there is of the busiest travel days of the year the debate over tsa screening procedures is sky high, pun intended. >> at the center of the debate are those full-body scans and the aggressive pat-downs. is the tsa crossing the line? here's neal karlinsky. >> reporter: to hear the increasingly loud rallying cries you'd think america's airports have turned into one big peep show. hordes of suspecting passengers are being groped and molested. >> how is it the freest country in the history of the world is now subjecting their citizens to panty pat-downs. >> reporter: the field generals in this crusade against the tsa and its full-body scanners and enhanced pat-downs include a random passenger with a camera, a toddler, and a talk show host. john tyner from san diego is now known worldwide as the "don't touch my junk" guy for this video he recorded of his own tsa close encounter. >> it was just frightening. >> reporter: meg mcclain, a radio talk show host who claims she was singled out and handcuffed by the tsa. a moment captured on surveillance video. because she pushed back against the new security. >> they used full palms with fingers, they feel around your breasts, your genitalia. it's just completely dehumanizing. >> reporter: then there's the 3-year-old. a youtube video of a 3-year-old upset about having her teddy bear x-rayed while the tsa patted her down is for some the perfect example of airport security run amok. even though this isn't part of the new enhanced security. >> it is ridiculous that 100% of the people are being put through these very intrusive measures when you know that 100% of the people are not risks. >> reporter: the outcry is over these full body scanners that can see through clothing. the government says people's identities are protected but there have already been problems. >> bottom line is i think there is some test to be involved in this. in my opinion, i think they need to find something a little bit better. >> reporter: then there is the question of radiation. the government says the scanners are safe. pilots who have to pass through them on a daily basis aren't so sure. including the biggest hero pilot around, captain sully himself. >> i think it's unnecessary for the flight crews to go through them first, and second, i think it poses some radiation risk. >> reporter: but opting out of the scanners only causes more problems. now that enhanced pat-down techniques give agents the right to feel inside the legs, the front of a woman's bra, and more. >> you're going to be searched either way and you're going to be invaded either way. >> reporter: on capitol hill the tsa's chief acknowledged the new pat-downs are invasive. but he said they're necessary because the government has been able to smuggle items through normal security in its own tests more than they'd like to admit. >> the intelligence coupled with the repeated covert testing led me to conclude that we needed to be more thorough. >> and a little privacy goes out the window, you're okay with that? >> yeah, it's not like we're being strip searched to get on the plane. >> digitally strip searched. >> but it's not that extreme. so i'm comfortable with it. >> reporter: a recent cbs news poll shows americans overwhelmingly support the use of full-body x-rays, something hard to reconcile with the very vocal minority. >> enough people opt out, these tsa abuses will come to a standstill. >> reporter: a growing grassroots campaign is encouraging people to opt out of the full-body scanners next wednesday. the day before thanksgiving, and a slightly busy time in the nation's airports. the goal, to force the tsa to change its methods. >> raise holy hell. >> reporter: passengers hoping to force change through protests next week will likely find themselves in a very long line. i'm neal karlinsky in seattle. >> always something. this is literally the biggest backlash since 9/11. tsa says it's gotten more than 1,000 phone calls and e-mails just in the past week, people complaining about the new procedures. the scans and the pat-downs. >> i'm flying for thanksgiving, one of the big questions i wondered is, how much earlier am i going to have to show up? they're saying on average you can take about 30 seconds to get you through, now it could be two minutes. you still have to plan earlier because regardless of how it plays out now. earlier this week eva denied it. then they went online, yesterday she went on twitter, the statement she released said, where was it here. it is with great sadness that after seven years together tony and i have decided to divorce. we love each other deeply and pray for each other's happiness. she said that on twitter, he went on facebook, essentially said the same thing. this is the reason why. apparently tony wasn't the most faithful of husbands. shocking for a professional athlete. he apparently had a dalliance with his former teammate's wife. so that's kind of the reason. the guy was brent barry. the wife of parker's former spurs teammate brent barry, that apparently is the reason they split. it could have been two women as well. that's what she's told some people, it was more than one woman. so that marriage is over. >> let me guess, he's not commenting on the infidelity charges. >> from what i've heard on facebook he has not said anything about the infidelity charge yet. logging on to facebook making fun of bristol palin saying, you're only on the show, the show being "dancing with the stars," because of your mom. aggressive in the criticism of her. willow, the 16-year-old sister, got on the facebook website, used some homophobic slurs. now bristol is coming to her defense. will and i shouldn't have reacted to negative comments about our family. we apologize. on a nicer note, thank you for your support. the great competition in "dancing with the stars." she is rushing to her sister's defense. it's worth noting she also made a couple of comments
