C. , 200 snow plows and 500 in northern virginia. When it gets more than three or four inches, everybody should stay off the road unless you have an s. U. V. And you know how to drive. Meanwhile area road contractors are stirring up what they hope will be the best snow fighters. District uses beet juice and brine to keep melting materials sticking. Maryland uses a salt and water mix. Pour it in the truck and spray it on the roads, pretreat the roads. Should keep it from freezing. Montgomery county is warning residents they need to clear sidewalks in front of homes and businesses within 24 hours of storm or face a 50 fine. When the snow falls, everybody who owns property next to a sidewalk has to keep that sidewalk clear. Biggest challenge, some of the worst snowfall will hit just in time for Tuesday Morning rush. And youre looking at a live picture of route 7 just off the dulles toll road. Those white stripes there, signs of the pretreating that is ongoing. The first is three lanes that have been shut down on the inner loop in greenbelt where a tractortrailer and a motorcycle collided. Were told the motorcycle driver was critically injured. Police hope to begin opening more lanes sometime in the next halfhour. Well keep you posted on that situation there. Also in maryland a man is dead after being struck by a marc train. Newschopper 7 is live over the scene right now at north summit avenue in gaithersburg. All the brunswick line traffic on the marc line has been suspended now. One marc train is stopped at rockville and another is holding at Silver Spring. Marc passengers are encouraged to use metro rail and bus services. Well let you know when that Service Resumes. Breaking news from Fairfax County where for the first time in almost a year and a half police have released details on a Police Shooting that left an unarmed man dead. Tom has been following this case from the beginning and live from fairfax with what hes learned about this officer involved. Tom . Well alison it took a legal fight but finally, some extra details are being released about this Police Involved shooting that left john gear of springfield dead last august. In august of 2013 we now know the name of the officer who fired the shot that killed him. That officers name is private first class adam torrez. According to a release weve just received from the county and Police Department here he hired a single shot that hit gear. Gear was standing in his doorway at the time. He went inside his home and shut the door according to this release and they say they offered cries of help to him and he did not reply. They went in quite some time later and he had bled out at that point from what weve learned from previous stories weve done. As you may remember this took a legal battle. Theres been a lot going on with this. And a lot of questions as to why this has taken so long to get information out there on this story. I just stepped out of a press conference that sharon boliva head of the county board here in Fairfax County was having. She says they have a policy in place that theyre now going to take a look at that basically said officers names and Police Involved shootings wont be released until its determined whether or not charges will be filed against the officer. In this case, the Commonwealth Attorney actually turned the case over to the federal government. That was over a year ago. And from there, theres been a loft frustration. We still dont have a result. Ultimately, the Attorney Generals Office said it had to go to court to get information it needed from the Fairfax County police and Fairfax County government. The Commonwealth Attorney had also said as we investigated this case that he couldnt get it was information that he needed from Fairfax County government as well as the police. There have been a lot of delays in this and a lot of criticism from Fairfax County and the Police Department as well. Today, finally, the name of the officer is out there. That said there are details we still dont know. For instance, this release i have in my hands right here does not explain why he fired that single shot. Does say, according to the police that gear had begun to lower his hands. He had been talking to police for about 30 minutes with his hands up. And he had begun to lower his hands. But he doesnt say here if the officer considered him a threat at that point and thats why. And it also doesnt say his hands were down. It just says he had begun to lower his hands. And just one shot fired. And again, the officer adam torres im told has been with Fairfax County for eight years. And currently, he is not on the streets but has been assigned differently as the Investigation Continues as it has for well over a year now in this case. Nearly two years after explosions ripped through the finish line of the Boston Marathon, jury selection is under way for the trial of one of the men accused of planting those bombs. Scott is live in the newsroom with what we learned about the case against Dzhokhar Tsarnaev. Scott . Yeah leon some say theres really no more significant terror trial in the u. S. Since the Oklahoma City bombing case and adding to the intrigue apparently a plea deal was discussed. A guilty plea in exchange for life in prison. But the Justice Department turning that down. Prosecutors want that conviction. And the Death Penalty. They are the families forever changed by the shock that was the Boston Marathon bombing. More than a dozen lost limbs. Three their lives. And hundreds hurt. Charged with the crime, Dzhokhar Tsarnaev who was caught and his brother killed along with an m. I. T. Police officer during the shootout. Certainly, it will bring up you know a lot of what happened. It will be nice to have it. Among those victims, erica brannig of townsend maryland. She was there to watch her mom cross the finish line and told our news partner wtop about the moment those two bombs exploded. I started to feel myself kind of slip away and i just sat there and i started talking to god and i said im not ready to go. Youre not going to take me. You need to find me help. Prayers answered. Others rushed to her. Using a belt as a tourniquet on her injured leg. And i found out later that i had my Blood Pressure drop so low to 70 10 that they had to resuscitate me. And then i woke up and i was lying on an operating table. Doctors had to amputate ericas left leg. Prosecutors say it is for her and hundreds of others that theyre now prepared for a trial that could take months. Its not a question of whether or not hes found guilty. The only question that remains is in the sentencing phase of the trial, will a jury of his peers sentence him to the Death Penalty . Were going to have much more on how long and difficult this trial will be coming up at 6 00. For example, lawyers are taking 12 yours and jurors and six alternates from a pool of maybe 1,200 or more. As for her shes had 21 surgeries with one more to go. She sounds like a true optimist talking about her new home new pet kitten and the former teacher is close to finishing graduate school. Leon . Man will spend 36 years in prison for a triple shooting that killed two maryland men and injured a third. 36yearold Jimmy Fleming was sentenced today and he pleaded guilty in september to two counts of voluntary manslaughter and aggravated assault. Back in july, prosecutors say that fleming was in a car with the victims in northeast washington when he opened fire. 20yearold derek price of Montgomery Village and 21yearold donchel thomas of District Heights were killed. A front seat passenger survived. A familiar name has entered the race to fill the ward eight d. C. Council seat held by marion barry until his death in december. This afternoon, Marion Christopher barry, son of the late former mayor, picked up petitions to add his name to the ballot for the special election. Christopher barry is one of 23 candidates seeking his fathers koups sill seat. Tonight at 6 00 well talk about what he sold sam ford about his race and his own checkered past. Speaking of politicians, some potential president ial candidates to potential prison inmate. Tomorrow is the sentencing for Bob Mcdonnell after his conviction on corruption charges. Northern Virginia Bureau chief Jeff Goldberg live in richmond tonight on the story and jeff, i understand that you spoke with the former governors sister. Thats right, leon. I spoke with her about 15 minutes ago. The governors sister whose name is also maureen says that Bob Mcdonnell is doing as well as can be expected at the moment. She tells me that the past few months he has really just tried to keep a routine and tried to keep things as normal as possible. The former governor spending today preparing with attorneys as well as spending time with his children and close friends. Walk the streets of richmond and you will find many people pulling for former governor Bob Mcdonnell. I think they should have more on him. I dont think he should go to prison. While predicting that judge James Spencer will deliver a harsh sentence. I think theyre going to put him in the pokey. The u. S. Probation office has recommended that mcdonnell face between 10 years and a month to 12 years and search months in prison. They are asking for 6,000 hours of Community Service and no prison time. Bob and Maureen Mcdonnell were found guilty in september of accepting nearly 180,000 in loans and gifts from former Star Scientific c. E. O. Johnny williams in exchange for granting williams access and influence. I think the chance that there is a sentence below the guideline range is a distinct possibility. Tomorrow the judge will likely hear from friends and family highlighting the former governor governors attributes while pleading for leniency. They were made in the form of nearly 450 letters sent to judge spencer including one from mcdonnells daughter jeanine who blamed the scandal on her mother maureen. She writes that this defense during the trial was not an attempt to throw her under the bus but unfortunately, was the reality. Adding my mom has had Mental Health issues for many years. She does not operate rationally. The richmond defense Attorney Says the most critical testimony will likely come from the former governor himself. Hell have to walk a fine line by showing respect for the jurys verdict, respect for the process, and for the court. While also not saying or doing things that are going to behinder his chances on appeal. And mcdonnells attorneys are expected to appeal the sentencing moments after it is handed down. Extending this Court Process at least a few more months. His team is also arguing that the former governor not be taken into custody after the sentencing and instead be allowed to remain free as the appeal process plays out. Sentencing is set here for tomorrow morning at 10 00 while the sentencing for Maureen Mcdonnell is set for february 20th. Todays bench trial involved smoots november arrest which was in ashburn to his then Girlfriend Told Police he grabbed her during an arcgument. Smoot denied the accusations. This small playground you see right here well the problem is it sits in what really amounts to a bit of a condo canyon and acts as kind of like an echo chamber. Too cold today for kids. But when its warmer this is what the playground sounds like way up on the top floor of this condo building behind closed windows. Sound bounces off the walls and actually the higher that you get, the louder that it is. The noisemakers. Little folks such as owen here. Hes a student at appletree Early Learning public charter school. 3 and 4yearolds spend a few hours a day on this small playground making what residents describe as big noise. For those who work at home or if youre sick one day, the noise can be like a little bit loud. Heres cell phone video a woman took after kids on the playground woke her up. Melissa finally says the volume frequently wakes her baby boy as well. Literally, youll hear screams and screeches as if they were in the bedroom right next to you. Appletree administrators say the playground is integral to the mixed use development. He said a couple of hours ago, he talked with his attorney gave the attorney authorization to try to come to some kind of agreement with appletree if if they dont reach some kind of agreement, this little dispute could end up in a courtroom.
