tonight's big story: watching and waiting. a new effort is underway to free steven avery from prison. and avery's supporters ... are hoping for a bombshell. we'll soon know what his new attorney has planned ... to try to ry to free the convicd murderer. fox six's jenna sachs is live in the newsroom ... with what's ahead. an important deadline is approaching. steven ave file a motion in his case ... but we're hearing she may do it sooner. a netflix series put steven avery back in the headlines ... now it's up to his new lawyer ... to prove he's innocent. in a tweet last month ... attorney kathleen zellner promised "a tsumani dassey ... have been in prison for nearly a decade ... convicted of the murder of theresa halbach. through her tweets ... zellner hints at her case ... of "planted evidence" "cellphone tower records" ... and dna "samples." she even hints at a new suspect. zellner is expected to file a motion... as early as thursday. protests in manitowoc followed the netflix documentary. if avery's motion is filed this week ... it will come two weeks after a federal judge overturned dassey's convict days to decide whether to retry dassey ... or whether he'll be released from prison. now the question is ... will steven avery's case ... see new life as well? there are still many in manitowoc who believe firmly in avery's guilt ... i expect we'll hear from them in the coming days as well. but avery's new attorney has a record of success ... she's helped exonerate 17 people of wrongful convictions. reporting live in the newsroom. jenna sachs. fox 6 news. in the wake of last week's unrest-- a state representative is calling for changes to the make-up of the milwaukee police department. that means hiring more officers from certain zip codes. fox 6's ashley sears is here to explain. state representative leon young--wants to see m-p-d be more representative of the people it polices. and he's calling for 40 percent of new milwaukee police hires to come from low income zip codes. between police and the people-- it is a reoccurring issue-- coming to a head just last week-- sherman park unrest-- has a city and state looking for solutions-- 10:57 the status quo cannot continue on. state representative leon young believes he has an answer. he addressed issues at a panel discussion wednesday. 12:08 if you hire more people, african americans, from the somebody who is coming from the outside. representative young says he will be proposing legislation that would require 40 percent of all new milwaukee police officer hires-- to come from low income zip codes. 12:17 maybe they can do a better job of communicating with a suspect and maybe not resort to deadly force. 10:46 i certainly dont oppose it at all. alderman bob donovan is the chair of the milwaukee common council helped draft a safety action plan-- that calls for hiring 280 new officers. 10:54 i would ask leon if he has qualified candidates to offer to the milwaukee police department. i think they would welcome them with open arms. donovan says--a zip code alone does not qualify someone to be an officer- 14:26 i would hope that our police department hires people nothing else. we reached out to milwaukee police department for comment-- but we were referred to the fire and police commission... to answer hiring questions. this proposal is in the very early stages and has not yet been introduced. brad? a teenager is seriously wounded in a shooting -- just feet away from where sylville smith was shot and killed earlier this month. police say the 19-year was sitting in a car when he was shot last night near 44th and auer. this happened at that same intersection smith was shot by a milwaukee police officer on august 13th. longtime residents in the area say the violence has to stop. lets try to come together and see an ending point to all of this frustration thats going on because the way its being done is not actually the way its supposed to be done. but he's expected to survive. police are still investigating. good news tonight - "we are encouraging our community to contribute to one of the many relief funds currently being established for italy. the glorioso family and employees offer condolences to those that have lost friends, family, and even from here in wisconsin -- there are ways you can make a difference for those in italy. you'll find options for providing support and resources for earthquake victims on the links page of our website -- fox six now dot com, or your fox six news mobile app. and we'll be monitoring the quake damage overnight - tune into fox 6 wakeup for the latest. we're on from 4:30 to 9am. some scary moments for a baseball fan at miller park. tonight - there is new talk about how best to keep fans safe. fox6s rachelle baillon has the update. :during the second inning of tuesday nights brewers game, a line drive flew down the third baseline and clocked a fan on the left ear. the game was delayed for a couple of minutes. then medical personnel carried the fan out on a stretcher and this isnt the first time a fans been injured by the action. prior to the start of this season, the brewers followed major league baseballs recommendation that protective netting be extended to the inside edge of the dugouts. three teams chose to extend the netting further, to the full length of both dugouts. we asked the brewers if there were any discussions about extending the miller park netting even further than its current location. in an email, a spokesman says 'fan safety is paramount and we always evaluate what address fan safety and preserve a great entertainment environment'. 'i think i would like to see the netting all the way around the ballpark because that way youre going to make sure that everybody leaves in the exact same repair that they came.' while some fans say theyd like to see more protection, others say the chance of a ball coming your way is part of the fun of attending a game. 'i play baseball too so yeah im amped for it to come my way im catching everything that comes my way.' certain seats come with more risk than others, which is why some fans say they 'right now while my kids are young we sit up super high so we dont have the chance of the foul balls hitting us.' rach tag: as for the fan who was hit tuesday night, a brewers spokesman tells us she was conscious and alert after being hit by the ball. she was taken to the hospital, but no other information about her condition has been released. reporting live tonight at miller park, rachelle baillon fox6 news. latisha anderson, the pornstar known as darcy tyler, is back in wisconsin. shes being held in the sheboygan county jail for disappearing with reported anderson allegedly fled the state in january with her 2-year-old son. the father of that little boy spent months looking for him. the u-s marshals tracked anderson to california where father and son were reunited. andersons now facing charges of interfering with child custody. she was in court wednesday for a preliminary hearing. her bail is 25 hundred dollars a two year old boy is dead and his mother tells fox6 it didn't have to happen. though a window when it fell down on him. fox6's myra sanchick talked to the little boy's mother who says she believes a simple thing would have saved her child. he just loved to go outside , loved to play, loved to run. tuesday afternoon michael mccoy the third may have had the though of running and playing on his mind when he crawled feet first through an open window at a house near fortieth and wright. before he cleared the window the and what am i going to tell my daughter, she doesn't have her brother any more? the mother says baby michael's thirteen year old uncle was watching him at the grandmother's home, but fell asleep. when he awoke many looked for the child, but it took at least a half hour before they discovered michael dangling from the window. the mother says the boy's grandmother asked the landlord to put on screens. i just feel if he would have put screens on the my son would have been looking out the window not hanging out of it the city of milwaukee department of neighborhood services says there should have been a screen on the window. i still can't grasp the fact my son's not here no more and a mother wants other parents to know what can happen. put screens on, locks on the windows . yes there's a lesson in this i'm just asking people please if you have little children please just put screens on the windows because this is just a tragedy that loaded carts -- and spent the day hauling supplies into the residence halls. the elevators and hallways are always crowded during move-in... but marquette president mike lovell says this year might be the craziest yet. "we're so this class. it's one rr ones we've had in years. it's about eight percent larger than last years'." most of the new students are but lovell says this year saw a spike in business majors. speaking of getting new homes - the cats and dogs at madacc are living in all new facilities! but theyre still looking for forever homes - so now the shelter is adopting out some animals for free! fox6s deandra corinthios has the story. summer at an animal shelter is tough. "we get 30 to 50 animals a day and if we are lucky we return or year at madacc "so we can never keep up with the overflow." but shelter leaders can make the animals more comfortable they just completed a 3 million dollar renovation. a huge outdoor play area.. a surgical suite... and brand new kennels. "there used to be 45 cats in this room, now there are 16 so post renovation they have been able to double their living space which is reducing the animals stress as well as disease" "since weve expanded our adoption program and so many animals are spending more time here it was better quality of life." madacc is running 'adoptapolooza ' ...an adoption promotion through the end of october...hoping to place more animals in forever homes. fees for adult cats are waived...and adult pit bull mixes are 45 dollars. " we have every shape and size cat and dog you could possibly imagine" some dogs..who've been at the shelter for a few weeks ...are free. "they dont necessarily have behavior issues or they arent difficult to adopt they have just been fill out an adoption application online or at the shelter.
