Deputies say they identifed themselves before forcing entry into the home. Rosemond fired one shot hitting Deputy Dave Dempsey in the head before deputies returned fire. The lawsuit filed on thursday alleges the shooting resulted from excessive force. And that deputies hadnt been invited into the home. 3 Deputy Dempsey spent more than month in the hospital after suffering that gunshot to the head. He is at home but still has a long road to recovery. Rosemonds family says they are praying for his health but say the lawsuit has nothing to him.
