But as it went on, people began getting emotional, crying to themselves, you saw Colleen Ritzers mom there, before it all began, and also, philip chisms mother, who was on the other side of the courtroom, but also in the front row, she was doubled over, crying. This is really a tragedy for two families here. Colleen ritzers family, of course, losing colleen, all those years ago, and mrs. Chism, having to go through this involving her own son. Very, very difficult for both families. Tough day for so many people there in that courtroom. Now, despite the first degree murder conviction, chism does not face a mandatory sentence of life in prison without the explain that. Thats right. Still a juvenile. He was only 14 years old when this all took place. And the laws in the state have changed, there was an sjc ruling that juveniles cannot be given life, no parole sentences, no matter how heinous the crime. So philip chism at 16 years old, has been convicted if adult court, an adult charge of first degree murder, but he will be eligible for parole anywhere from 15 to 25 years. And it may even be longer than that, because the aggravated rape that he was convicted on, also carries a life sentence. This is the first time Something Like this has happened, the judge could stack these sentences up, consecutively, one after the other, as one life sentence is completed, the other one begins. Tell us how difficult it is to convince a jury to get a not guilty by reason of insanity verdict here in massachusetts. Its extremely difficult, the standard in massachusetts is whether or not at the time of the offense, conduct, the defendant was suffering from a mental disease or defect, that made him incapable of differentiating between right and wrong, or conforming his behavior to the dictates of the law. Once the defense raises that, the prosecution has to prove the opposite, that he was sane. But the fact is, these cases often involve very horrific charges, gruesome details, such as this case, thats a big challenge for Defense Attorneys to get past, plus you have a battle of experts, one undercuts the defense claim of insanity in many of these cases or lack of responsibility as we call them, and also for the most part, you admit that your client did commit the crime itself, and that gets the jury already very close to. Coming back with finding guilt in these charges. Very difficult. Very hard to get a lack of responsibility verdict in massachusetts. Brad, so much has been made of that Chilling School Surveillance Video played in this case. How critical of a role did that play in the trial . I think it was a very important piece of evidence, blair, because it established as the prosecution argued, this sort of consciousness of guilt, this understanding, that what mr. Chism was about to do, and was doing, was wrong. Putting on a mask, putting on gloves, stalking somebody, covering the body with leaves, all of these types of things, cleaning up, avoiding people outside, putting the body in a from the crime scene. To the prosecution, and as the jury likely found, this showed that mr. Chism was able to understand the difference between right and wrong, and thats why he took those steps. Vanessa and brad, because there is a first degree murder conviction, there will be an automatic appeal, right . Absolutely. All first degree murder convictions, in massachusetts, are automatically appealed to the Supreme Judicial Court of massachusetts. Other teen killers have been found guilty after arguing they were insane at the time of the killings they committed. A man from whalen killed his girlfriend in 2011. His defense claimed he suffered from a mental illness, but jurors, they didnt buy it. He was convicted of murder in 2013. And john ogden was 16 when he fatally stabbed another student his attorneys argued the special needs student was insane when he killed another boy. Jurors rejected that defense and he was convicted of first degree mid after two weeks of testimony. This case dates back to october of 2013. A timeline detailed by prosecutors, chism met with Colleen Ritzer after school had ended for the bay on october 22. He then followed her to the bathroom. Thats the video we were talking about where ritzer was murdered. Chism was report d missing by his mother that night. A short time later, ritzer was reported missing. Chism was tracked down by police around 12 30 a. M. , the following day, Colleen Ritzers body was found several hours later, after chism was questioned by officers.
