outages. in the last hour, we learned the blimp is on the ground and secure. somehow it broke loose if maryland around 12:20 p.m. this afternoon and f-16's were scrambled to track it. >> mark: power outages in bloom bloomburg, pennsylvania, classes cancelled there because of the outage. and this blimp dragged a huge tether line which blew out the power line. no word on how it came loose and no one was hurt. >> elizabeth: breaking news in the bella bonds case, tonight we learned the department of children and families prematuring closed their case involving the 2-year-old. >> mark: that's a key finding in a scathing new report0\/` from the state office of the child advocate. fox 25 news's kerry kavanaugh is live in boston with what the child advocate says should have triggered higher level kerry? >> the reporter: the child advocates report came at the request of governor charlie baker, now, 30 days later, we have seven pages, saying that dcf was familiar with this mother's history, new of allegations of neglect, but twice, closed, open cases involving baby bella anyway. missteps and miscommunications, 2-year-old bella bondzhu*xz was in the middle of a maze of dcf workers, their cases and her own mother. >> that deeper dive for information did not appear to have occurred. >> the reporter: the state office of the child advocate today released a report that conclude the dcf prematurely closed two neglect cases involving the little girl. her body was found in a trash bag on deer island in june. her mother, rochelle bond, now charged as an accessory to her murder. her boyfriend, michael mccarthy, charged with the 2-year-old's death. >> they were opportunities for further checking, especially because of the mixed information that was available. >> the report says dcf workers were using information about bella's family that had been gathered six years before she was born. it says, rochelle bonds was in state corrections facilities, no fewer than 12 times. before bella was born, dcf had terminated rochelle bonds' parental rights to two other children. the report says her history of arrests, substance abuse, mental health issues and instability plus the prior termination of rights, should have triggered higher level of conferences at dcf. just two years ago, dcf implemented sweeping changes after jeremiah oliver was found in a suitcase along the side of the highway. new failsafes were put in place, but it appears even those failed bella. >> i think it is impossible for anyone to say that continued involvement with the department would have prevented the tragedy that happened in that case. >> the reporter: we reached out to dcf for reaction to this report, we have yet to hear back. when we do, we'll pass that along. now, the child at secretary of state says rochelle bond, the mom here, was through a revolving door of state agencies, why she says this shows another problem, an issue between these agencies, not communicating and and -- anarchist group against the new york police department. a possibility of a group attacking officers on halloween warning was sent throughout the country. they are threatening to carry otis epps were hit by a bee-bee or a pellet of >> the reporter: it's unclear right now, elizabeth, these attacks taking place here along route 5 thee, that attack with the woman happened in neighboring hanover, just yesterday afternoon. now, these attacks on this stretch of 53, taking place over the last few days, starting on saturday afternoon, they include the south shore bank here on route 53, a nearby pizzeria and another business just up the road. then, yesterday afternoon, that woman was driving down 53, near the hanover police department and she said suddenly she was hit by that bee-bee and spoke to fox 25 news it afternoon. >> suddenly, i heard a big bang, and a sting on the side of my head, and ikcyf looked at my window, and it was totally shattered. and i realized that i had just been shot. >> police have stepped up patrols in the area, we'll hear from them, and more from the victim coming up tonight on the fox 25 news at 6:00 p.m. live in for well, john monahan, fox 25 news. >> elizabeth: in fitchburg, police are looking for the person who shot out windows across a number of streets with a bee-bee gun. at least 16 cars and one house were hit by the bullets in the early morning hours of monday. police believe there are more victims out there, and now they're asking them to come forward. >> mark: boston police are asking for help tracking down a man wanted for a murder in brighton. detectives say 25-year-old gammada musa is a suspect in last week's shooting death of desmond joseph, joseph was killed late thursday night on telford street. fox 25 was on the scene as this was braking that more than. police warn that musa should be considered armed and dangerous. >> mark: another man who is armed and dangerous and on the case, david chase shot a man in manchester, new hampshire. rondon has tattooed hands and a visible neck burn and he may be traveling with his girlfriend who is not wanted at this time. call police if you see rondon but do not approach him. >> elizabeth: fierce flames tear through a building in lynn impacting dozens of people. this is a story you saw breaking on the fox 25 news this morning. investigators are still trying to figure out what sparked that fire. katherine katherine parrotta spoke with residents. >> that's everything i had, but at least i'm here. >> the court: for bernadette, this building was the place she just started calling home two months ago, home also to an aunt and niece, all of them left to pick up the pieces, escaping with their lives has their homes went up in flames. >> i saw smoke from like where is it coming from and when i looked down stairs, it was just -- i saw the back door and it was just lit up. >> the reporter: officials say the three alarm fire started around 11:00 p.m. last night. somewhere around the back of the build, quickly spreading up the walls. guzman first in thed something was wrong when she saw people restaurant. >> when i went upstairs to double check, as soon as i smelled the smoke, i literally ran out, like i literally just, i got to go get my mom. that was like my first thing and my dad. >> the reporter: firefighters say the time of the fire was a challenge. most residents were home. many sleeping. >> i came over here, my mom was sleeping and she just like literally came in, like her nightgown and everything, and everybody was in bed. >> the reporter: as firefighters worked to get the flames under control, residents kept warm if an mbta bus. the red cross working to help the 24 adults and seven children with nowhere to go. now, left to figure out what to do next. >> my mom has been in this building for 20 years, living here, and6;31%[ to start over for her, it's going to be the hardest thing they've ever done. she's got to take it one day tight. >> elizabeth: now that woman and her family were headed to a relative's home today to figure out what's going to happen for them next. she did tell me the fire alarms in this building worked, but people didn't respond to them right away. they thought maybe it was a false alarm. still, most people were able to run out of this building. firefighters did assist a couple of people in their way into an apartment on blake street. one man armed with a gun and another with a knife, took several things and ran from the apartment. they were last seen headed towards fox street. boston's china town is back open after a water main break. the area in hate 88 closed traffic in both directions for a few hours. we are waiting to hear what exactly caused the mess. >> in brockton, a hit while trying to cross the street alone is home tonight recovering from a broken leg. >> mark: worcester police say the boy got off a school bus on figure to everybody before making sure there was an adult to meet him. it's a story you saw breaking last night on the fox 25 news at 5:00 p.m. and tonight's fox 25's robert goulston has learned the bus driver is off the job. robert? >> the reporter: yes, this driver is on unpaid leave while this is all being sorted out. meanwhile, police are really trying to figure out how this 5-year-old got off a school bus with no adult supervision, and was allowed to cross this very busy street. >> when i saw his feet, that's when i pulled over. >> the reporter: amanda riviera has been hoping for the best, once she saw a little by taken away by an ambulance. >> my heart was being a and i >> the boy got off this transportation bus and tried to cross the street alone. he is a student at abbey carter school. the bus driver is not supposed to let the child off if there isn't an adult waiting, saying if no parent is there to meet the child, the bus driver is instructed to return the child to school at which time a parent will be contacted. if a parent plans any changes in the normal pickup and dropoff procedure, he or she must contact the school receptionist in advance. >> i just sang him the abc's until e.m.s. got there and no one knew his name and no one was talking. >> the soon to be certified nursing assistant was just happy she was able there to help. >> i'm glad he's ok, that's my main thing, that he's all right. >> the reporter: again, that boy is home tonight. the parent telling police that there was some confusion, typically the older sister picks up the boy at the bus stop and apparently, she stayed after school. again, police are still trying to sort out why the bus driver let him off. tonight at 6:00 p.m. though, would never cross this street themselves, because it's so dangerous. we'll have a little bit more on that part of the story tonight at 6:00 p.m. for now, live if worcester, robert goulston, fox 25 news. >> elizabeth: massachusetts schools may be putting students' privacy at risk in their effort to keep up with rapidly changing technology. it's something the american civil liberties union is concerned b. the aclu took a close look at 35 school districts across the state. we're told that 13 districts trust a third party to handle sensitive student information. some districts, which provide computer software for students, can activate realtime tracking and screen monitoring away from the classroom. two-thirds of the districts that issue devices can inspect them without notice. >> the reporter: before the weekend, we were talking about major hurricane patricia hitting mexico, moved into the deep south, caused all kinds of flooding and problems and that moisture, what's left of it is coming up the east coast and into new england. we're seeing the rain spreading in here now. it won't just be rain that comes with the storm system. let's start with that, that's the most immediate concern. it's raining on your evening drive and while it's not heavy enough to cause lives to come out of banks, but what will happen is there is localized flooding on the roadways. as you're driving around, you need to take care. had a report from steve, he's out in worcester county, he's a trusted weather spotted and getting slippery because of the leaves falling on the ground and getting wet, so driving can be slippery because of that. the leaves can plug up the storm drains and cause flooding. you might want to clean those out if you have some on your roadway, while the rain of a little lighter variety. heavy downpours happening, near the boston area, takes you off to the northwest and in this area, we're seeing some of that heavy rain. look at the yellow that's showing up. this takes you out of boston, charlestown, to somerville and in somerville, we're seeing some of that yellow showing up on live doppler radar and that's where some of the heavier rain is located. some of these streets will be tough to read. it's so bright with the yellow, coming through the town of somerville, showing some of that heavy rain as well. to the north shore, seeing some heavy activity here. manchester by the sea, you have some of that heavy rain that's moving right along the main thoroughfare through your area, there's 128, along grapevine road on to 128 and moving toward oldest ex road with some of the heavy downpour activity. middlesex county, this takes you into 495 and the acton foxborough area and north of acton in fact. this is 495 coming right through by sexting that yellow -- bisecting that yellow area. out-of-town, heavy rain for you as well. southwest new hampshire, heavy downpours in spots. not quite as bright as they were a knew minutes ago. southwest new hampshire, keene, didn't get the heaviest rain to come on by, because it shrunk, but there's heavy rain that can hit you and finally to the south of the boston, heavy rain. this is 198-23 toward the braintree split where the heaviest rain is happening, right at the braintree split. this is 93, the southeast expressway up through the city and route 3 southward through braintree proper and that's some of the heavy rain that's happening, as battery march park, up through 93, right there with some of that heavy rain too. so it's rain, and it's raining hard, it's going to get harder tonight. you see the bright colors lighting up on futurecast. the bright colors denoting the heaviest rain. watch what happens overnight and first thing in the morning. more heavy rain for the morning drive and some of the heaviest rain, south shore and out to cape cod, potentially thunderstorm activity here too and something shiri will be watching for first thing in the morning for any severe weather that could crop up from these. sun starts to break out as the heaviest is leaving cape cod. that sun could fire up a couple of other showers too. we'll have to watch for it tomorrow afternoon. it's not just the rain, we talked about the winds as well. winds so far have been gusting, there are the rainfall tote heals, 1-2 inches. i wanted to get to the wind, already seeing gust '20s to 30 miles per hour out here and the forecast is for these to ramp up tonight over 40, to 50 plus miles per hour overnight and first thing in the morning. that could cause damage in southeastern pitch to harrison, something we'll be aware of and watching for as well. a wind advisory is in place because of the potential for damage especially though in southeast massachusetts. that's going to be a concern with this storm system as it continues to come on through. now, satellite-radar picture shows all the rain coming on by right now, but really this rain will continue to move on through, as the storm progresses off to the north and east and the seven-day forecast, is going to show you that things are really going to get better as the week progresses and we get out of this, so here you are, with the seven day forecast. weekend always in view and i apologize for the computer hiccup. but bottom line, clear air friday and saturday with sunshine, half the rain leaves our area, that means things are looking good for the patriots game thursday night and halloween, an update straight ahead. >> raise. today's 9-4 hikes the annual salary by $9,000 to $99,500 per year, it is the first raise for the 13-member panel since 2006. these are the nine members of the council who voted in favor of the rains. we have don't have a hurricane or tropical storm coming our way, we have what's left over and sometimes that can cause problems especially when we're talking about the heavy rain we're seeing out there right now. boston, you're in some of the heavy rain. some of the areas around boston. when i switch over to live doppler radar, you can pick out the yellow where the heaviest rain is happening. lynn to peabody, over to wake field, north to north reading, marblehead, some of this heavy rain happening where you see the yellow on radar moving into the peabody area and some of the roadways being affected off cedar grove and jubilee drive and 128 and southward on to fall view and lynn street, broadway, heavy downpour activity as well. to the north of there, marlboro to box ford, along 95, and this takes you into the groveland area as well, near haverhill and look at some of thedbyqke heavy rain that's happeningping 133. 95 is on the right-hand side of your screen and this rain continues to come down hard. to southern new hampshire, we're seeing some of that into central new hampshire too. this is concord, this takes you to webster and franklin and new hampshire where it's coming down very hard and franklin, massachusetts, where we're seeing some downpours as well and over here to wrentham, heavy rain moving into the foxborough area. this is right on 495 in wrentham, passing the outlets, premium outlets boulevard, raining hard ride right near there. no doubt this is causing commute. the heavy rain will continue, it's going to get worse as the evening progresses, you see it into the morning hours. we need to talk about the strong winds to be expected later concerns. >> elizabeth: a brockton mother is facing charges tonight. police say that she became involved in a playground fight. >> mark: investigators say her 15-year-old daughter was also involved in this fight at brockton high school. our bob ward is live outside brockton district court and bob, both the mom and her daughter are facing charges. >> the reporter: yeah. that's right e. and police say, that daughter is facing charges for having -- using a taser gun in this fight. and using it on school grounds, so now, three people, the mother, the mother's boyfriend, and the mother's teenage daughter, all facing charges. this is 48-year-old maria monday tier row of brockton. she and her 26-year-old boyfriend, john davis, are facing charges for taking part in a disturbing brawl outside brockton high school tuesday morning. brockton police say montero and davis were walking with montero's 15-year-old daughter at brockton high whether the daughter got involved with a fight with another 15-year-old student during the lunch break. a teacher told police, a parent was out of control near the gym. when police arrived, the two teenage girls and maria montero were fully involved in the fight. one police officer said at one point, montero slammed the head of the girl fighting with her daughter, right into the concrete. an officer tried to separate montero from the other student, and heard a clicking sound and saw that montero's 15-year-old daughter was using a taser gun. police say the boyfriend, john davis, then tried to pull the police officer off of maria montero, montero and davis were both arrested and so was montero's teenage daughter on charges related to bringing that taser gun to school property. just a short time ago, i got off the phone with the superintendent's office in brockton and they're very grateful to the monitors who were outside the school when all this went down. those monitors, jumping in, helping as soon as they could and the superintendent's office said they really helped this bad situation spiral even further out of control. now, the mother and the boyfriend, they were released on personal recognizance. as i said, the 15-year-old daughter is facing charges for bringing that tase are gun to school. the school department also says that that 15-year-old girl will likely be severely disciplined. reporting live from brockton, bob warped, fox 25 news. >> elizabeth: thursday, is sentencing day for a former prep school student convicted of sexual assault. labrie used a 15-year-old girl after using a computer to lure her in. the high a death rove inmate's penalty phase retrial is moving forward as scheduled. this morning, a judge rejected motions filed by gary lee sampson's defense team challenging the legality of the death penalty in massachusetts. now, even though massachusetts abolished the death penalty, defendants can still be sentenced to death if federal court. in 2001, sampson killed 18-year-old jonathan rizzo and 59-year-old fill being mc mccloskey. >> mark: three thieves smashed lot of dough. teenager is accused of pouring hot soup all over a girl's head in the hallway of a high school in kingsborough. that alleged attack happened on october 15th, at the greater lowell technical high school. 16-year-old girl's family tells "lowell sun" the incident caused second degree burns. the 15-year-old boy could face assault and battery charges. the school officials are saying the boy received appropriate discipline. >> thousands of hens die if a barn fire in new hampshire. that fire breaking out at that time pete and jerry's organic hampshire. the fire started around 2:00 a.m. this morning. it didn't spread past the barn, which houses some 36,000 birds. no one was hurt and no word on what caused the fire. smoke and flames pouring out of morning commute. quite a site here on
