found. still his arrest today has shocked this small town. people here wondering how this all happened. >> reporter: the owner richard knight of u.s. a. ninja challenge paces nervously inside his gym after one of his instructors is charged with an alleged sex crime once one of the very students he was hired to teach. a spokesman says the owner is stunned. >> the instructor in question spoke to the police we had nocation that any charges would be filed. as we stand here today we're very surprised. >> reporter: the instructor is 23-year-old cameron beaten. he was arrested and released on $4,000 bail. according to police station, the alleged incident happened three weeks ago. >> a student was attempting to make a move on the rock climbing wall and the instructor reached out to assist because he thought she would fall. >> reporter: u.s.a. ninja challenge says beaten has worked for them since february. it's a gym that teaches kids how to go over obstacle courses. beaten passed a background check was also taught safety measures when dealing with children. >> we're shocked because there are many protocols here in place to prevent any type of inappropriate physical activity. >> this all came to light when beaten turned himself in at 2:00 p.m. friday afternoon. it was a shock to parents and the gym's owner. >> never notified by the student, or we were never contacted by the parents before they can work here. live in hooksett, new hampshire, tonight, john monahan, fox 25 news. an 11-year-old girl is saying she was sexually assaulted in south boston. new at 10:00, this happened just after 9:00 on gavin way. the victim telling police a hispanic man in his 20s approached her and grabbed her behind. the suspect allegedly apologized to the victim and then walked away. call police if you know anything about the incident. two little kids allegedly found all alone in a worcester apartment. on the fox 25 news at 6:00 we told you one of those children was as young as six months old. those kids are in state custody right now. >> reporter: that other child apparently not much old better one year old. both of those children are in state custody tonight but many questions remain, questions even from someone we spoke with who knows the children's mother. >> apartment 2. >> reporter: the 9-1-1 call came in about 9:00 a.m. neighbors living at 272 pleasant street in worcester concerned about the sound of babies crying in one of the apartments. >> she thinks no one is answering the door she can hear the baby crying. >> reporter: when worcester firefighters finally broke down the door they found two small children ages according to reports one-year-old and perhaps six months old. >> can't say nothing bad. >> reporter: he didn't want to show his face on camera but a neighbor who lives at 272 pleasant street and whose the children's mother says she always struck him as a good parent. >> she was a working mother and i see her put her kids in the van going to school every morning then i see her catching the bus going to work. >> reporter: one report says the children were in good health but filthy. d.c.f. took custody of the babies and issued a statement indicating the agency was investigating the situation and working with law enforcement on its investigation. >> unfortunately, it just happened the way it happened. but as long as the kids are all right just did what she has to do to get the kids back. >> all evidence have you seen this was a woman who loved her kids? >> a woman that loved her kids, definitely. >> reporter: worcester police normally update the media tonight we have received no updates so we do not know who these parents are, where they are, how long those babies were left alone, and we don't know if any charges will be filed. live in worcester, jim morelli, fox 25 news. police say in man 4-year-old thomas hogan of worcester is a suspect -- 40-year-old thomas hogan is accused of a woman's death. hogan misled him about his relationship on that woman. late wednesday night firefighters discovered a woman's body inside a burning car. people who knew hogan are in disbelief. >> you know they're good people, i mean. i nerve suspected anything like that. >> hoagen's home is less than two miles from the the judge held hogan on a $3,000 bail. meantime officials at plymouth county say they are looking at surveillance video to see if they can determine who dropped a woman's body off on train tracks. plymouth county d.a.'s office told fox 25 it does not appear that the body found there is connected to the case in worcester. investigators do believe that the woman was brought from somewhere else. what a friday to remember so warm we actually tied a record in boston. but fox 25's chief meteorologist kevin dlench are showers on the way in. >> still a few out there sharman we saw on the north shore coming into the lowell area. those fizzled on the north shore. he's the latest batch coming through southern is doing much better tonight. a man survived an inferno on his lobster boat off the coast of ipswich thanks to a survival suit. tim allen jumped from his boat when it caught on fire it waited 20 minutes in water for help while clinging to buoys and wearing a survival wetsuit. ers arers say that's what saved him along -- rescuers say that's what saved him along with onlookers that jumped in to help it. >> didn't look like a fire at the time then all of a sudden it turned black we raced in and pulled him out of the water. >> he said his boat simply overhead leading to the fire that destroyed cowboys ex-girlfriend and new transcripts from her interviews with police. alison reports. >> reporter: earlier this afternoon the sports blog deadspin posted an article and pictures they say detail the domestic violence between former carolina panther greg hardy and his ex-girlfriend nicole holder, 18 pictures show bruises, and marks on her back, neck, arms and legs. she said hardy caused the injuries in may, 2014, inside his uptown apartment. deadspin obtained transcripts hardy threw me into the bathroom i hit the back of the shower ball and fell into the bathtub where he pull me out. holder claimed hardy threw her on a futon covered with several guns this is a picture of the weapons posted on snapchat earlier that night. today i took the disturbing details to panther's officials. did the panthers know anything about these photos or this evidence? >> we can't comment on greg hardy. >> reporter: hardy's story differed greatly. he called 9-1-1 claiming to be the victim. hardy was convicted of assault but the d.a. later dismissed the case on appeal when prosecutors couldn't reach holder for the trial. all court records of the incident have disappeared with hardy's case ex-sponged as of yesterday. but on the internet it's very much alive. so that was alison lethos the reporting. >> the team did not have access to the photos before they signed hardy, he goes on to say in part "we do not condone domestic violence, we entered into the agreement with greg fully understanding that there would be scrutiny and criticism. we have given greg a second chance. a why in the double murder trial of aaron hernandez has denied a request to throw out evidence that evidence taken from an evidence that hernandez was believed to be driving the night two men were killed in boston. lawyers for the former patriot say the warrant was based on information from an untrustworthy witness. the judge ruled there was probable cause even without that witness. right now hernandez is serving a life sentence for the murder of odin lloyd and he's pleaded not guilty in the double murders in boston. a dangerous fugitive accused of a murder in lawrence could be back in the area. state police have just added alarcon to the most-wanted list he's wanted for a murder of a 21-year-old in a lawrence restaurant in may. only on fox 25 we sat down to learn more about the startling were then fired if i have seen him call the massachusetts state police violent fugitive apprehension section. >> windows broken tonight police are looking for what happened. two boston brothers have been indicted on hate crime charges in the beating of a homeless man they believe was an immigrant. scott were arrested back in august after they attacked a 58-year-old homeless man near the j.f.k. t station. one of the brothers allegedly told police after their arrest they were inspired by donald trump's view oil gration. trump has condemned the attack. the accused esplanade rapist has been ordered held without bail. he appeared in court today. he's accused of violently raping four women along the esplanade and in south boston between 2006 and 2010. the crimes had gone unsolved until this year when d.n.a. evidence matched the attacks to him. right now he is in prison serving time for assaulting a woman in cambridge while he was working as an uber driver. an uber driver tonight. they're fighting to have charges dropped against the driver. that all started with a youtube post. fox 25's kathryn burcham is live in portsmouth where that driver turned himself in to police today. >> reporter: the battle over whether uber drivers can legally pick up riders here in ports mouth has been a contention reaching all the way to city hall but christopher davis said he never imagined wiretapping. >> kind of surreal because i have never even been inside of a jail like that before. >> reporter: david drove for uber second time a second income for his growing family. he has been made this recording of an encounter with a bouncer outside this bar. the bouncer who was also a taxi driver and another taxi driver repeatedly told david to stop picking up customers. >> it's not law upper 40s this is more like it should be in november sadly not like today. >> a simple bump on the head turned one new hampshire woman's cruise vacation into a nightmare. when we first met her family in september we learned the 24-year-old was in a coma now we've learned she passed away. tonight her family is turning to fox 25. fox 25's erica richie sat down with them tonight. >> i just need to know what happened to her. >> reporter: the richie family in pembroke, new hampshire has been on a quest for answers since an early morning phone call on september 11th, to let them know their fwrour-year-old daughter christina was hurt. >> reporter: christina was on the cruise ship with her boyfriend en route to the bahamas when somehow she fell and hit her head. >> she had a massive stroke. >> reporter: three weeks later she died kicking the search for answer into high gear. the richie's say christina had no underlying medical condition to their knowledge and they claim the cruise line is remaining tight-lipped about the incident. saying they haven't released medical records as they requested or the surveillance footage if there is any. >> we just know that there was a timeline that she could have gotten help. we were told by one doctor two to four hour another doctor one to three hours. >> reporter: it was six to eight hours they say before christinea was taken off the >> why, why didn't get get off that ship sooner? >> have you brought that up with carnival? >> yes. several times. >> reporter: what has their response been? >> nothing. they just don't say anything. >> reporter: so now this heartbroken family is speaking up. hoping to change the way care is offered on the high seas. >> there needs to be more in place. ekg machines, cat scans, if they have room for a golf course they need have room for like a hospital room. >> reporter: i have been in contact with a carnival representative several times today most recently within the last hour he says that at this point in time the cruise line is only prepared to confirm that a fall did happen on the ship and that the passenger did receive medical attention before being brought to a hospital. the cruise line did also offer its condolences to christina's family. now i will continue to stay on top of this cruise line and find out any more information that i can digging deeper into the story stand trial he was found to be competent. chism is charged with raping and killing high school in 2013. nashua, new hampshire, police arrested a person they say is in the man in photograph wanted for a knife on october 16th and took money from the till. a man accused of threatening a mother and baby with a knife is being held without bail tonight. it's unyear when sparked the attack but david
