elizabeth it happened right across harvard street on the sidewalk here in brookline. police say the 37-year-old firefighter put a homeless man in the hospital. there are two sides to every story joe ward apparently did not want to share his side with us tonight. according to the police report obtained by fox 25, ward lives in this multifamily building in dorchester. when nobody answered his door a neighbor told us he was likely in the unit below. >> no comment. >> reporter: ward doesn't have to face us but he will have to face a judge for what happened late sunday night. brookline police say ward severely beat a homeless man because the man didn't order his burrito fast enough. your reaction may be similar to the ones we heard. >> under no circumstances should another human being treat another human being like that. >> to hear that from a up a homeless person is disconcerting. >> reporter: ward berated homeless man inside the restaurant and attacked him outside. one witness says ward pushed, punched and kicked the victim and then threw food and a glass bottle at the man while he was on the ground. another witness says ward straddled him and threw five to seven punches with both hands till a girl started yelling at him. >> that's absolutely horrendous. >> reporter: the town administrator provided fox 25 with a statement that reads the town is aware of firefighter ward's arrest and he has been placed on administrative leave. immediately pending further investigation the town will not be making any further statements at this time. ward is charged with assault and battery with a dangerous weapon. police say the dangerous weapon that was bottle he allegedly threw. he was arrested a few blocks from here and he did provide a statement to police. events that's new look at the high temperatures you're right 76 boston well above the average. with. clear skies for now to our south and to our west there are two areas of rain. this one to our south is coming northward right at southeastern massachusetts and the front to our west also pushing our way during the day tomorrow. here's the timeline of what you can expect. rain breaking out in showers through with those rainshowers arriving at least a threat of rain arriving by about 6:00 in the morning. then we'll have some sun breaking out but still the threat of showers too day tomorrow. i'll have a reporter:dy indeed. a student apparently found the notebook which contained this list while in class. this list is at the same time outlandish and disturbing. for some parents it's raised questions about how the school handled it. >> this child wrote a list of names of people she wants dead. >> reporter: a notebook passenger that's caused major concern at nashua high school north of new hampshire. parents say it lists the name of several students along with how they will die and when. the methods are pretty gruesome. nail removal, cannibalism and poison. >> as a mom it has to be a small world to want to make a list that. >> reporter: the sophomore the list. >> but it still makes her nerve to us think somebody dislikes her so much that they would put her on that >> reporter: the school found out about the list late last week in a letter to parents provided to fox 25 the principal says the student wrote up the list based on a japanese cartoon. according to story the book is perceived to have some kind of magical power to cause harm to the person listed. fox 25 attempted to talk with numerous school officials including the assistant principal who they say left a message inviting them to a meeting tuesday morning. they hope to get some answers from that meeting but they also say there needs to be a fundamental change. >> it's not okay. it's not okay to wish death upon somebody no matter how much they have wronged you or how upset or hurt you are. more hurt doesn't fix it. >> reporter: now they tell fox 25 that they're not interested in engaging in a witch-hunt here to ferret out who this young lady who was wrote up this list. all they're interested in is making sure there's a policy in place in the schools that will prevent an incident like this. fox 25 news. tonight the search is on for a suspect in a violent gas station robbery in bedford. it happened sunday night at the shell station on great road. the suspect walked in wearing a mask and holding a knife. >> there was a scuffle and the clerk was cut in the hand. >> that suspect is believed to be armed and dangerous. if you have seen him call police right away. there's a woman recovering after being thrown from a horse in topfield. skyfox was flying over the scene this afternoon. that woman ended up having to be flown to the hospital and from what we're told from fire officials they say it looks like she broke both her legs. the former patriots player aaron hernandez will be back in court tomorrow. the hearing is a continuation from last week when his lawyers tried to get a witness intimidation charge dismissed. that witness is hernandez's former right hand man alexander bradley. lawyers are also trying to get evidence dismissed before hernandez is tried for double murder in boston. happening now police are searching tonight for that person of interest in a string of robberies also in a sexual assault all happening in dorchester. we first showed you this surveillance video over the weekend. police say the man in that red shirt there threatened and robbed two men. now this happened on september 27th. about an hour later and a mile away a woman was sexually assaulted. a startling discovery in manchester, new hampshire, the body for a woman missing for weeks found hidden inso aid crawl space in her own home. 5:00 and 6:00. her roommate killed himself just about a week ago. >> sue hutchinson disappeared three weeks ago. new hampshire investigators believe she was in her home the entire time cleverly hidden until sunday night. >> the family they were there last night they smelled what they described as a strange odor. they called the police department and firnt. >> reporter: assistant attorney general says when when investigators arrived they localized the snowfall an entrance of the home entered a closet and found a crawl space. inside they found the body of the 57-year-old mother they believe she's likely been there since september 20th. her killer police say hutchinson's roommate 36-year-old stephen. investigators say hutchinson was only trying to help him when she allowed him to move into her apartment. now they're examining if he entire time. >> we're certainly looking at whether or not he had been stealing. >> reporter: he died from a self-inflicted gunshot wound police found him last week in this twoosbury hotel. -- 2006bury hotel. >> that that many times to go through the system. >> my heartaches. >> the investigators had searched home to try to find any signs of violence in the home and nothing had turned up nothing still has turned up. >> reporter: sadly investigators say finding her sooner wouldn't have changed the outcome of this case. investigators say they do have a theory on how sue hutchinson died but they could tell you that brockton police as well as massachusetts state police detectives are working on this case. at least 15 rounds were fired. one man was shot now neighbors are forced to live in fear. brockton. brockton's mayor tells us people in two cars were shooting at each other. one man was shot twice and taken to an area hospital. >> the thing i can tell you is the victim is well-known to police and extremely uncooperative. >> reporter: neighbors told us they are set up innocent people were so scared they quickly walked away to seek shelter. >> my main concern is the safety of the residents not involved in this. >> reporter: folks around here want these criminals to handle their business elsewhere. tonight fox 25 has learned that the victim will survive. he is at a local hospital. in the meantime, brockton police detectives know who their suspect is. they want to get him off of the streets before that person can hurt an innocent for now we are live at boston police headquarters. malini basu, fox 25 news. officials are investigating after a revere man died. officers say they found the 38-year-old man bleeding and combative sunday night after he broke into an apartment building. we're told the man fought against the officers and a taser was used with no apparent effect. he restained and taken to a hospital where he died. the big changes are coming to the way that auburn housing authority operates on the death of a 2-year-old foster child. she was living in housing with her foster mother at the time of her death. now the housing authority says it wants better communication with d.c.f. because there were six children in her home. the chairman of the authority tells the telegram it's also installing cameras in its properties and changes the way units are inspected. they have also set up a tip line. they don't have to leave their name when they call it. actor randy quaide had a new role today dmest a vermont courtroom. the judge put both of them in hiked up mount washington on scund with a friend when they tried to take the railway down it was soldout so the pair started hiking back down. woo injured his ankle and could no longer walk. boston you can't expect 70s and 80s to last all autumn long. not everyone will get wet from this but there will be showers around shsomething we will be tracking the other thing we've been tracking is a front to our west. but it's a cold front it's just west of toronto and extends all the way back here just west of charleston in between charleston and cincinnati that cold front is on its way towards us. a couple areas to track and here's the timeline. these clouds moving in during the morning overnight tonight and some showers starting to make their way towards the coast. there could be showers even in the interior massachusetts but they really start to thicken up here. this is your highest potential here. that means some heavy downpours can occur here in the south shore and on cape cod and the islands for your morning drive. this will continue to scoot off towards the northeast and give you a break by late in the morning even some sunshine popping out off to the west. overnight tonight with the clouds starting to roll on in temperature also have a chance to drop through the 50s most locations especially inside 495 go out beyond 495 with a few towns in the upper 40s southeast vermont. but not the chillyist night we have seen so far. certainly not the chillyist we'll see this weekend. still expecting mid-70s somerville, cambridge to brookline into the 70s low to mid-70s on the south shore winds are coming from the south or ahead of that front still getting into the low 70s as well above average certainly for out north shore i expect the same thing 71 for ipswich and 73 in southern new hampshire in nashua tomorrow afternoon. let's fast forward a bit more through the afternoon some breaks of sun ahead of that front. this front now seeming to want to keep the showers very close it to. a couple can break out during the evening drive but most will stay dry. the morning commute impacted mostly southeastern massachusetts evening commute not impacted much at all if at all. but that front still has to pass through. we just showers along it. we clear out behind that front into wednesday morning you are waking up to sunshine you see that here. but during the day with the clouds starting to billow up there can be a couple showers that pop up. less of a threat than we have tomorrow but there is a threat in that transition day on wednesday. behind that front the cooler air starts on come on in. you will see it in the seven-day forecast here. we'll get more sunshine by thursday but be cooler only about 62 . then by friday 62 but with some rain moving in and the coolest air of the season starting to come toward us especially by this upcoming weekend on saturday and on sunday. i'm expecting temperatures in the morning especially to be dropping into the 30s this will be the coldest air we've seen so far. it will be a frosty morning on sunday but then on monday the potential for a killing freeze to work on in as temperature also average around 30 it means there will be some upper 20s. in just a few minutes i'm expecting the latest timeline to come in. i'll have that four coming up. police in new hampshire are investigating allegations that a registered sex offender approached a young girl in a bookstore. that girl's father called offers after he claims the suspect was checking his daughter out. fox 25's catherine kathryn spoke to that sex offender who denies those allegations she's live in manchester, new hampshire. kathryn? >> reporter: manchester police here tell me that this case remains under investigation by their detectives. but they have not charged that man with any crime. tonight he told me that he is the real victim. >> the way he was talking to her it just wasn't appropriate. >> reporter: this manchester father speaking out about of his daughter's safety. >> i was glad i made the call. of that. >> reporter: the fwhur we are hiding to protect his daughter's identity was in this barnes & noble last month when he says james sorensen approached his 6-year-old in the children's book section. sorensen is a registered sex offender who served time for sexual assault on a child under 13. >> i hate he checked her up and down with his eyes. there's no other way to explain it. >> reporter: the father claims sorensen then asked was. he says oh, you're here with the pretty girl. i said yes, i am. >> reporter: that led the father to call 9-1-1 and sorensen in the store. according to a police report when offers arrived and asked sorensen about checking out the young girl he admitted that he had. police say sorensen called her a pretty little girl but said he would never do anything he didn't want to go back to jail. at sorensen's nashua home tonight he denied the allegations. sorensen told me he never approached the little girl and was just making conversation with her father. the girl's father told us he just wants all parents to be reminded to always keep a close eye on their children. >> listen to your gut. if you feel that there's a danger around your kids then call the police. >> reporter: sorensen tell me he felt the father eag attitude toward him was "uncalled for and that the publicity surrounding this incident has caused him to use his job." manchester police say they have warned sorensen about his behavior he has since been banned from both the barnes & noble here and the store in nashua. live in manchester, kathryn burcham, fox 25 news. apparently a bear has taken up residence in a groton neighborhood. this guy showed up in her yard on hill road a few times in late september. she says he also visited several times since july. the bears are clearly on the prowl for food and the whole experience is a little nerve-racking. >> you said he was like a small bear. >> in the wide accused of crashing into a state police cruiser. a sergeant was conducting a traffic stop when 62-year-old catherine d'angelo's car hit his cruiser. both taken to the hospital for minor injuries. d'angelo appeared to be heavily medicated at the time of the crash. emergency crews had to use the jaws of life on this rollover in peabody. you can see a trash truck rolled over and landing in a ditch. at least one person was trapped inside that wreckage so special tools had to be brought in to free him. no word if that person was hurt or what caused the crash. a textbook triggers a haz-mat situation at the university of new hampshire. police say a haz-mat team had to be called in after a strong odor and smoke were noticed in spalding hall. crews went in to check it out. officials say it turns out that someone hut an old textbook into a microwave. a string of break-ins under investigation on the cape. it happened three times in about 10 days. all the break-ins happened around route 39 near crossroad. we do know police are looking closely at surveillance images for possible suspect. education will be top of mind this week for lawmakers on beacon hill. most of the bills are related to charter schools. this comes not long after governor charlie baker unveiled a bill to allow the state to add or expand up to 12 charter schools in the state. public hearings are scheduled for tomorrow at the state house. this week millions of high school students across the country will get their first look at the new version of p-sat. the p-sat is taken by sore mores and juniors. it's used to select students for national merit scholarships. the exam is wednesday. we have reported on drones coming close to airports and even wildfires up next the bill that could make flying drones too close to restricted areas a federal crime. a local woman mauled by a pit bull. police forced to put down two of those dogs. >> we heard the ambulance coming and then we saw police vehicles coming police say a police officer shot and killed two pit bull dogs. it all happened saturday 39-year-old denise calling police telling them one dog was attacking her. >> we heard the ambulance coming, and then we saw police vehicles coming, and then we heard three shots. >> reporter: according to police an officer and paramed hicks to break through a locked door to get inside. and once inside the police officer saw the woman being mauled bay large gray pit bull. a second pit bull police say aggressively ran towards the officer who shot and killed the first dog jumped off the woman and aggressively approached the officer and he shot and killed too. people here tell me they complained to police about those dogs. >> it doesn't surprise me from what i've heard. i've seen the dogs. >> reporter: this neighbor tells me one of the pit bulls was often loose in the neighborhood. she filed a complaint after confronting the owner. >> i said if i see your dog out there again tied to a tree with no water and no shelter i'm going to report you. >> what did he say? >> he didn't say anything. >> reporter: neighbors tell me they do not think that the woman who was attacked actually lived in that woman she not on the enof the dogs. she is in the hospital. at last check she's in stable condition. no word yet if any charges will be filed against the owner of those dogs. bob word, fox 25 news. charlie baker will file recommendations on how to combat the state's opioid crisis. look into the problem said addiction should be considered a serious medical treatment and barriers to treatment should be removed. deaths from opioid-related overdoses have almost doubled in the past five years. e-cigarettes are sometimes advertised as a healthier alternative to cigarettes but in maine they will soon be treated just like traditional tobacco. lawmakers say the issue is a matter of public health. a new bill tries to put several restrictions on flying drones in restricted areas. it's called the safe drone act and introduced after hundreds of incidents where drones came too close to planes or crews battling wildfires. the law would make flying a drone a federal misdemeanor. but opponents say lawmakers need to be careful here of putting too many restrictions. >> the benefits of drones now outweigh the potential pitfalls of folks that are using them for the wrong reasons. >> the f.a.a. says the number of airline pilots sightings has risen from 238 to 650 in the first half of this year. a medical miracle. a little girl in need of a big lifesaving operation. two month-old abigail jones was born with what doctors thought was an inoperable brain tumor. doctors told her to take her home and love her but her time was limited. today abigail reached a milestone thanks to the team at boston children's hospital. >> this is sweet wonderful abigail jones. >> reporter: abigail is just two months old. but her doctors in florida never thought she would survive this long. >> they prepared us for her to die then they prepared for us to die during the birth or immediately after. planned her funeral, what we were going to do with her ashes. >> reporter: abigail was diagnosed in the womb with an aggressive and what they thought was an inoperable brain tumor. her parents did not want to get up to her. they sent her mri scans to boston children's hospital for an opinion. the family quickly -- a low grade tumor you know they can definitively say it is not cancerous and it's not going to kill her. >> reporter: abigail had successful surgery this past thursday.
