81 in montgomery county. icy conditions is making travel pretty difficult this morning. thanks for starting your tuesday with good day virginia. i'm january keaton. and i'm kyle benjamin. happening right now: thousands across southwest and central virginia are in the dark. here's a live look at the current a-e-p outage with 23-hundred the dark. in roanoke county, you're looking at 2- thousand people without power. henry and franklin county also seeing high numbers as well. 41-hundred in franklin and 22-hundred in henry. you'll also want to take some praticial steps if your power does happen to go out. stay away from all downed lines or sparking equipment. unplug major appliances to protect them when power comes back on. leave a light turned on so you know when power is restored. virginia's roads have turned slick and deadly. so far, there have been three reported fatal crashes across the commonwealth. if you don't have to be out on the roads, stay home! those three deadly accidents happened in the richmond metro area. one in henrico county, the others in chesterfield and fauquier county. locally in the salem division, four crashes the roads are just terrible this morning. the rain right now is making things much much a live look this morning many of you asking when will the roads be cleared or why hasn't *your* street been touched. this morning, we have answers from the virginia department of transportation. the top five snow removal questions... and their answers. first up-- when will the roads be cleared? vdot's goal is to make all state-maintained roads passable within 48 hours after a winter storm ends. which roads gets commonwealth? those include: interstates and most primary roads snow emergency routes and finally, other secondary roads and residential streets. which roads is vdot responsible for clearing? except for arlington and henrico counties, vdot is responsible for clearing all state-maintained roads. who is responsible for clearing my sidewalk? residents must clear their own sidewalks. and finally, why do plows leave snow in my driveway? plowing can cause snow to accumulate in gutters and on this might sound like a dumb question, but do you know how to properly shovel snow? vdot has put together a tutuorial with some tips and tricks for you! we've got that linked on our website, just head to virginia first dot-com. ahead on good day virginia: former new york governor elliot spitzer could be in trouble again.we will tell you why...plus... "justice saclia's sudden death in the middle of a jammed pack supreme court term raised many difficult questions.. i'm wfxr news is your local election headquarters. jeb bush, who has struggled with the political baggage attached to his famous last name, has finally come to a place where his family is south carolina. former preisdent george w. bush stumped for his younger brother for the first time monday night, attending a rally in north charleston. that rally comes after jeb bush's most forceful debate performance of the campaign, when he pushed back on donald trump for attacking his brother's national security record. the south carolina primary has become one of several key, "early-state" presidential primaries. it'll take place at the end of the month, just days before the virginia primary. the sudden death of supreme court justice antonin scalia in the middle of a jammed pack supreme court term raised raises many questions.the biggest and most pressing-- what happens next?fox's chief legal correspondent shannon bream runs us through the possibilities from washington. justice antonin scalia's sudden death leaves the supreme court with a gaping hole in the middle of a term jam-packed with hot button issues.dupree says: "the timing throws everything into a state of uncertainly. 13:30:52 first to consider - what happens to the cases the court has already heard, privately voted on - but has not yet publicly released an opinion- including disputes over voting rights, affirmative action and a key case on whether public school forced to financially support a union they want nothing to do with?i/iidupree says: "/ithere are a lot of cases that the court had reached a tentative decision on and now they very well will have to go back and see if the loss of justice scalia changes the outcome. there were cases no doubt had been assigned to justice scalia to write the opinion which will now need to be ressigned. and of course in cases the loss of justice scalia could mean that the outcome will change." for cases that wind up locked in a tie without scalia's vote - the chief justice could announce the cases will be held over, even re-heard once the bench is back to being fully staffed with nine justices *or* if the court issues a tie decision, it simply leaves the lower court ruling in place. there are also critical cases the court has *yet to hear - including one challenging restrictions the state of texas has placed on abortion clinics, a case brought by religious groups fighting against being forced to comply with obamacare's contraceptive mandate and the multi-state challenge to the president's use of executive action on immigration.wynra says: "these big cases are coming up before the court, and there will only be eight justices, to hear them.. which makes it harder for the court really to do its business as usual without a new justice being confirmed." court-watchers expect that chief justice roberts will take his time deciding what to do on a case-by-case basis. the court was already scheduled to meet in a private conference this friday and is set to begin hearing a new round of cases one week from an investigation is underway this morning into whether or not former new york governor elliot spitzer assaulted a woman at a ritzy new york city hotel.the woman claims the former governor got angry that the woman wanted to go back home to russia.she says the fight turned violent when spitzer pushed her and put his hands around her throat. a quote there is no truth to the allegation. if you have a nut allergy-- you know how dangerous just being close to them is for you...coming up on good day virginia:we have some good news--- there's a new treatment out there that could help. i get out of work and i go to the store, and somebody's, smellin' around, "mmm! i smell cookies." i say, "oh no, you just smell me. i just got out of work. that's honey bunches of oats, that's all." treatment option: imagine coming into contact with the food you're allergic too and that allergy going away. that could soon be a reality after a recent study out of duke university. collin for about 3 million americans, something as a trip to the grocery store could end up as a trip to the hospital due to exposure to food allergens. but a study at duke university from 2009 shows support for a method that actually promotes contact with these sometimes deadly substances.the study shows that over time, children who consume small amounts of their allergens may eventually build a tolerance.dr. minh-thu le at cox medical's allergy center says she is frequently asked about the unusual treatment by patients who heard about it through some outside source. "when you have somebody that is caring about their own health, and will be willing to research it, and want to know. we want to talk to our patients about that and give them good information because there is a lot of misinformation out there, especially on the internet," says dr. le.but le says this method could be very dangerous if conducted at home."i would not do this at home on your own. peanut allergy can cause anaphylaxis and death and we wouldn't want that to happen to anyone's child," said le.in fact, le says her team at cox doesn't promote the method at all, due to a lack of information on the long term effects."the things that have been done about the landmark studies, like the 2009 one, they're not ready for primetime because we can't know what's going to happen to these kids in 10, 15, 20 years. what if we give them the peanut product, but now instead of having anaphylaxis, they're just having swelling in their esophagus," she said. in the meantime, cox is sticking to traditional methods."right now the alternative is avoidance, and carrying an epi pen and getting the most education you that was collin lingo reporting. experts say more testing and research will need to be done to determine an exact immunity to the peanuts. they're vermont's most famous and probably favorite men!now ben and jerry's is swirling up a different spin on ice cream! we've got those details in two ben and jerry's is famous for its ice cream. but now, it's trying a different spin on dessert.the ice cream savants created a series of non-dairy treats for vegans and those who are lactose intolerant.keele smith explains. when you hear ben and jerry's-- ice cream likely comes to mind.but the company is ditching the cream in its new line of non-dairy desserts. keaton. we're taking you on the road this morning as icy conditions will certainly slow down your morning commute. this is a live look along interstate 81 in wythe county. wfxr's monitoring conditions for us this morning. she joins us the roads are icy. the snow in combination with that freezing rain has made slushy mess on the roads, sideways, and in driveways. the roads and sidewalks are very slick, so drive cautiously. vdot has done a great job of clearing the snow off the interstates and primary roads, but with the rain the roads continue to be dangerous. valley metro continues to operate on their snow routes this morning. blacksburg transit will return to full service today. virginia is not the only one dealing with winter weather, from record-shattering cold to more rain, tents outside to accommodate everyone. the machete attack injured four people. police tracked down the attacker. police shot and killed the suspect during the arrest attempt. new this morning: jodi arias will not be seeing any visitors in prison for the next six months. the 35- year-old is serving a life sentence for murdering her boyfriend. officials say arias called a correctional she was denied a haircut. arias will have to demonstrate at least 180 days of good behavior in order to see visitors again. unhappy comcast customers complained on social media after widespread service outages monday.the t-v and internet provider recieved a lot of negative attention online.customers demanded the company "get more employees and offer same-day help." comcast said it fixed the problem and restored all serveices 8 hours later. the v-a has been plagued by long wait times. numerous reforms also intended to improve access to care. but the problem continues to mount. "the appointment was canceled and made for two more months. and he got a little angry and said, "you know what? that's six months. six months i'm waitin' to see somebody." next on good day virginia: why the continued backlog wants to see done! lawmaker wants and the department of veteran affairs is still facing a lot of criticism over the delays in medical care for veterans. as cnn's drew griffin reports, despite billions of dollars in emergency funds, veterans across the country and right here in virginia continue to wait, sometimes months for care. el paso's va clinic had one of the worst wait lists in the entire country with one of the worst-wait list stories turned 45. but he's not alone. there are many, many men that are in his same boat. we had one psychiatrist, and she wasn't available all the time.
