state is allowing the shelter to stay open. afor what you reported, i'm sickened. >> that local home is operated by your tax dollars, but last month, we expose the vulnerable members of our community are living in the worst conditions. >> we've been staying on top of the investigation. kristin, you obtained photos of what it's like inside that adult care facility >> reporter: yeah. i've got them what's just as disturbing is that the state of ohio continues to allow them to operate even though the conditions you're about to see have existed for years. >> there's no reason after i watched your report that the place is still open, none. >> reporter: once again, there are bugs. there is filth. there is down right disgust. still rake in hundreds of thousands of state and federal draft each year -- dollars each year because the state does not yank the license qi'm beg are for them to do something. >> reporter: it's a situation that baffles terry russell and angers him, too. he heads up the national alliance on mental illness of ohio. it advocates for the mentally ill and their families. >> they have been dealt a tough hand they're allowed to live in these conditions. >> reporter: they're condition that's date back at least 7 years when he visited care circle's three homes here on east 89th street and was shocked to see the inside. fast forward to our recent investigation when ed described life as a resident there two years ago. >> this is the fly droppings on the mat -- mattress cover. photos were taken by disability rights ohio, a nonprofit that acts as the state's protection arm for people with disabilities. there was their 6th unannounced visit in the last 18 months. each time, they tell us they find the same grim conditions. each time, they report their findings back to the state. >> i think they should be closed within 24 hours >> reporter: they are licensed by the ohio mental health and addiction services. they tell me they are taking any potential violations seriously and remaining active against the facilities. now, i called one of care circle's owners for comment, but she hung up on me. it's important to note that the leaders in the mental health field tell medical a majority of adult care facilities are clean and operated in good faith with the exception being care circle. abecause of our initial investigation, we have care circle, placed them elsewhere. aonly on news 5, a family demanded answers saying the actions of cleveland police may have contributed to a man's death. he was shot and inside a van heading to metro health when officers pulled them over. we spoke with the man's mother tonight and james, you've uncovered more of what happened. >> reporter: yeah. friends were speeding when they were bringing 42-year-old kevin mcqueen suffering wound to metro health. they were pulled over by police and according to a police report, it took some time and it wasn't until a commanding officer got to that scene that mcqueen was taken to the hospital. >> they detained my son. them 15 minutes could have meant saving his life. >> reporter: that's the question from pearl murphy, her mcqueen died from a gunshot wound but only after his friends transporting him to the hospital were pulled over by cleveland police. a police report reveals the car was speeding. officers say two men jumped out of the car and headed towards police. they were ordered to the ground, and police noticed mcqueen in the backseat with a gunshot wound to his chest. police administered first aid but didn't let mcqueen get to the hospital sergeant showed up sometime later. mcqueen died at the hospital shortly after. according to police, there is body camera foot an that would reveal how long this man was pulled over for and how long mcqueen had to wait before getting to the hospital. they will not release the body camera footage until the investigation into his homicide is complete. reporting outside of division 2 headquarters, news 5. aso we they should have handled the situation. we will continue our team coverage now. sara, you uncovered the guidelines for officers. >> reporter: that's right. this right here sheds light on what officers are supposed to do. it is the cpd medical trauma response. check out page 2. it says officers can wait for an ambulance or immediately take an injured person to the hospital. officers did call ems mcqueen, but they couldn't explain why officers decided to hop in his friend's van to get to the hospital instead. i also talked to ross. he told me he was blown away by how this was handled. he said things can go south quickly and it's generally safer to wait for an ambulance. on your side, news 5. athank you. get a check on your weather. johnson, what's up?
