Tonight, learning new information about the Jerry Sandusky sex abuse scandal, regulations stemming from a lawsuit between penn state and the Insurance Company. Nbc 10 joining us now with details, rosemary . What weve learned through this suit is that joe may have first become aware of sanduskys abuse 40 years ago in 1976, but thats not all. Weve been Digging Deeper into the Court Documents today, and talking to a legal expert about penn states insurance policy. Jerry continues to be a source of serious controversy for penn state. According to a new court order, theres allegations of abuse against the former assistant football coach dating back to 1976, 87, and 88. Its what happened after that in the 90s that may be revealing. The court order says there was abuse or molestation exclusion in the 19921999 insurance policies. Whats that mean . Well, between snooun and 1999 only the company was exempt from paying claims involving university employees, and penn state would be responsible. In 1992, for whatever reason, history or specific knowledge of whaf what was going on at the university, they wrote exclusions into their policies. Reporter mike oneil, a civil attorney in center city is not involved in this lawsuit with state, but has litigated many Insurance Coverage cases. He explains its to the unreasonable that an Insurance Company might have that kind of exclusion in its policies with schools, church, or other institutions, but the fact that this exclusion with penn state only lasted until 1999 raises questions. Whats interesting and what the court notes is that in 1999, forward, this exclusion did not exist within the policies for penn state. It also coincides with mr. Sandusky leaving the employee of penn state university. The judge et writes it is interesting, although a coincidence that the abuse or molestation exclusion ceased to be employed in the Company Policies the same year that sandusky retired from psu. Now, again, wed be guessing why it happened, but it certainly, as court noted, interesting that from 1999 forward they stopped using the exclusion within their policies. Reporter i did reach out to the Insurance Company covering penn state. They did not want to comment. If the lawsuit proceeds to trial, we may learn more if that insurance exemption is common and why in this case it ended after sandusky retired.
