>> a long day in court for the mayor sheila dixon on the first day of the trial. why jury selection could be the deciding factor. >> charger concerns. the defect calling millions to be recalled. >> and in flight naps for pilots. why some belief they could actually improve airline safety. >> hello, i am jeff barnd. >> and i am jennifer gilbert. the u.s. supreme court denies a request to block the execution of convicted sniper john allen muhammad. scheduled to be put to death tomorrow night in virginia for one of the sniper shootings that terrorized the dc metro region in 2002. >> we are in virginia where tomorrow's execution is set to take place. jeff, what can you tell us tonight? >> well, in less than 24 hours, john allen muhammad is set to die here by lethal injection. today the u.s. supreme court refused to block his execution. it comes some seven years after and his teenage accomplice terrorized the dc area. john allen muhammad sent to death row for the murder of dean my years. all along myer's family never demanded death for john allen muhammad. >> we do not intend to be beaten by this. we do not hold hatred for anyone. we despise the actions that were taken. but the perpetrators were human beings just like ourselves. >> well, members of the myer's family said they would be here tomorrow night at 9:00. to witness this execution. we're live in southern virginia tonight. jeff abell fox 45 news "late edition". >> well families of his victims will be there for the execution. but his ex-wife won't be. mildred muhammad said john flipped a switch after his time serving in desert storm. short time later she filed for divorce. then she moved to maryland with the kids. hoping that muhammad would never find them. >> i knew he was going to kill me. and i was fearful for my life. but i never, ever thought that he would go to this length. never. ever. it still boggles my mind. >> she doesn't think her ex husband is mentally ill. she believes the sniper shooting spree was planned and motivated by vengeance against her. >> stay with fox 45 news for complete coverage of the scheduled execution of john allen muhammad. we will have live reports from our crew in virginia throughout the day tomorrow. >> day two for the trial of mayor sheila dixon is set for tomorrow of course. the mayor left the courthouse at 7:00 tonight after day one. trial stems from a four year investigation into city hall corruption. dixon pled not guilty to stealing gift cards intended for the needy. cards donated by two developers, one of which is the mayor's former boyfriend. >> today was jury selection of course. jurors began today filling out a questionnaire about their background. this particular case. and mayor sheila dixon. more than 20 jurors claim they would be bias because of the intense media coverage. the same number also admitted to being victims of theft. >> i am a prosecutor. i want jurors that will be highly educated, analytical. and looking at the evidence. if i am a defense lawyer, i want people that can identify with my client. >> the mayor spent 12 hours in court today. but her staffed the business of running the city of baltimore will go without any interruptions whatsoever. >> this is a monday like every other day. for the city. you know, city keeps on moving. and as are we. >> last week the mayor's office said dixon would be in court as much as possible during her trial. >> here is a closer look at the charges mayor sheila dixon faces. faces two counts of felony theft of gift cards worth more than $500. eve of the counts carries 15 years in prison and $25,000 fine. she faces one count of theft of gift cards valued at less than $500. that carries a possible 18 months in prison. and $500 fine. she faces three counts of fraudulent misappropriation. each of those counts carries a possible five years in prison. and she faces one count of misconduct in office. mayor is expected to face another trial on perjury charges, that is expected to be march 1st. >> that brings us to the question of the day. can mayor sheila dixon maintain her reputation after the trial is over? so far 22 percent say yes. and 78 percent say no. one viewer responds on our website writing mayor sheila dixon reputation has been tarnished for some time now. she will not come out with her reputation intact. >> and you can read a lot more about mayor sheila dixon's trial. go to foxbaltimore.com and click on the icon at the top of the page. >> the man accused of the fort hood texas massacre will be charged in the u.s. military court. this as hospital officials report that major malik nadal hasan is now out of a coma. off vicinity later and able to speak tonight. hasan accused of the shooting at fort hood texas that killed 13. and injured nearly 30 others. 15 soldiers still remain hospitalized tonight. >> meantime we're learning more about his ties to a virginia mosque. it is the same mosque where two of the 9/11 hijackers worshiped. still it is not known whether malik nadal hasan knew the hijackers. he leaders of the mosque condemn the attack. >> there is no justification for someone to say because i was called a name or someone pulled a bumper sticker off my car that i can go out and take two handguns and begin to kill my co-workers. >> the current spiritual leader of the mosque said he hasn't been contact by the fbi between ties between san and 2 of the 9/11 hijackers. >> sad news for recent graduates at mount st. joe in south baltimore. john evans that graduated in may has died. he had just completed a 10-mile march at virginia military institute on saturday. when he collapsed. autopsy is underway. funeral is planned for saturday in howard county. >> police in anne arundel county need your help to identify some robbery suspects. police think the people pictured here are responsible for robbing a pnc bank in crofton on november 6. they think this robbery could be connected to one back on october 29. at a credit up in glen burnie. anyone with information should call metro crime stoppers. >> weather felt like september rather than november. nice. >> vytas reid is here to let us know how long it will last. >> for a few you more hours. >> that's it? >> know kia is recalling 14 million of its cell phone chargers, according to the company, the charger's plastic covers may become loose and expose wiring. that could cause an electric shock if they are touched while plugged into a socket. the know kia chargers are models ac 3 e, and ac 3 u. made between june 15 and august 9 of this year. model ac 4 u is also being recalled. it was manufactured between april 13 and october 25 of this year. so far there has been no reports of injuries related to the faulty chargers. know kia has set up a website to get chargers for free. check out the recall and register for a new charger going to our website foxbaltimore.com and click on "news links". >> i am judy kurtz and that's tonight's "word on the web". >> napping on the job. coming up on the "late edition". why some experts think it is the perfect way to cut down on pilot fatigue. >> and after four losses in five games. my sunglasses.
