agree with obama. o'malley's says he remains confident that voters will allow a gay marriage if the referendum makes the ballot. he says marylanders are likely to expand the rights if given the chance. we would like to know what you think. if it does reach a referendum, how would you vote? >> jurors are deciding the case about a consultant to did the robo call that they said was intended to keep black voters at home. another was convicted on similar charges in november. jayne miller has more. >> they began around 3:00 this afternoon. was it a criminal action, or was it part of the politicians running for cover. i have not done any work and about 20 months. >> state prosecutors asked the jurors to convict him on fraud, for writing election day 2012 robo call that said that the election was close before it was. the law says you cannot trick me. the rejected the claim it was not his fault that the call had no authority in line and saying that the devil made me do it is not a legal defense. a top campaign official and an election. a lawyer used charts and strain to make up the evidence, and then cut the string to say the evidence went nowhere. they say the attempt was too embarrassed them, saying that they were doing it because he chose not to be in the club. >> if you want to be in the miller club or the martin o'malley club, i just do not want to be in the club. i video about a beating of a tourist downtown. more than half of the charges filed by the state's attorney's office have been dropped. the four people charged were accused of assault following the attack on the man. the man was stripped and beaten before being robbed in front of the circuit court house on north calvert street. so far, 13 of the charges have been dropped. officials tell us that after a review with the state's attorney's office, prosecutors have amended the charges. >> keep your eyes open for possible showers and storms this evening. chief meteorologist tom tasselmyer is tracking the weather. >> we are looking for some rain approaching us from the south korean skies have been generally cloudy, temperatures relatively mild, but in downtown baltimore, you can see that there is nothing more than a sprinkle, and that is likely drawing up before it hits the ground. most of this initially will be light. there is a heavier shower down in poolesville in virginia, and it looks like they could see it rommel of thunder down that way. the bulk of the rain is to come later tonight. it increases into richmond, norfolk, north carolina, some showers coming up along interstate 95. that is what we are keeping our eye on. the showers approach from the south and west. we will check the complete forecast coming up in a few minutes. >> in tonight's education alert, every year, thousands of baltimore city students that attended title one schools can sign up for free to bring up, -- free tutoring help. explain what a title one school is. >> they receive free or reduced lunches. it is the law. local school systems, like baltimore city, must offer students extra academic help before or after school. it is called s.e.s. they say the program is not flexible enough to help all students. >> i think some kids only benefit from tutoring. not every kid does. somehow, 20% has to be set aside, because we do not even spend that money every year. we have to give it back to the state. >> here is what he is talking about. in 2010, the program had a $12 million budget, but it only served 41 schools and about 5700 students, and money left over had to be returned, but some parents a before changes are made, the school system needs to make sure that the students who need the services are not being left out. >> a lot of parents use these services not only for the benefit of extra tutoring for students that may be suffering but also so they have productive activity for the students after school. >> i am not that familiar with it, but i feel it is productive, so therefore i believe the benefits are, so therefore they should not cut it. >> the budget was being cut this year by $7 million. school officials say this is all the more reason to take a second look at this program. >> the problem that i have is this idea that i should be setting aside money that we do not ever get to spend, have no control over, and meanwhile, a school may be losing an after- school program or a teacher. >> the state board of education has supplied a waiver, which it approved would give the city more flexibility. >> last fall, president obama gave states the go ahead under on the inner harbor, and skyteam 11 is above the highly anticipated high wire act. he will try to attempt to cross the harbor on a one-inch-thick wire cable, part of the promotion for a new ripley's believe it or not auditorium, which is scheduled to open at the pavilion, but it is also part of his practice run, if you will. if he makes this hot feat, he will be crossing niagara falls on june 15. what we are witnessing right now should take about 15 minutes. on 11 news will remain above the scene as the act continues, and we will continue to bring you live updates. there he goes. he has just stepped out and is starting to cross. he is the seventh generation of the family, and he says is inspiration goes to his grandfather and started this. they started in europe and did a number of different things, walking the wire. they were a circus act for a while. interesting to note, his grandfather actually walked across the ann arbor back in 1973. his whole family involved, he does have a wife and three children. the children are part of their act as well. >> i can imagine that everybody is holding their breath. he is about 90 feet. >> it was overcast, and it was just as long as there is not lightning, and he was good to go. >> he wears a special pair of moccasins, and she makes all of them. >> this pavillion, that is going to be the site of a new ripley's believe it or not auditorium, and the cable is attached to the pavilion, and he is walking the sum of 300 feet to a barge that is in the inner harbor. you can see this it is angled of boards. it is easier to walk on a cable that is angled up words as opposed to down. when it is pointing down, sometimes your momentum will carry you forward. it is as easy as this can be. it is easier to walk up boards. -- upwards. this is like holding your hands out. this helps a great deal. you can see the crowd is in the background. and of the standing there for quite some time. they saw the cable go up, and they probably heard about this wire walk taking place, earlier. wanting to get a good seat for it. >> it is interesting, a few minutes ago when he said he told rob roblin, he died in a fall when he was on a walk because of the rigging not done properly, and so they are making sure that it is done right. this is just a small thing like this you stay up there, or if you fall and die. will the way, the ripley's be the 32nd location for them. a lot of different things. it should do well for them down there and be like st. pavillion. nik is from the famous family that is famous for its high wire acts. this will be his final performance before his historic attempt to walk across niagara falls on june 15. he will go to baltimore and go directly to niagara falls to start training for that dangerous high wire act, and this is no walk in the park here either. >> he makes it look easy, it does not? >> he does. at one point, he will be some 300 feet over the inner harbor. >> and he has recreated so many andts grandfathers's feat, his grandfather did that back in 1973. i was not hear them, but he likes to go and do things that his grandfather has done. >> let's get a vantage point from down on the ground, where rob roblin is. -- are people's mouths hanging open? >> you can see the cable giving. it will move. nik was telling me earlier. you really have to the unbelievable balance, and he was talking earlier about the physical condition. you have to have very strong feet and calf muscles, and he works out five days a week to stay in top shape. this may be the first time ever where he walks to a barge. he left ripley's believe it or not auditorium, odd-itorium, and there is a bucket from a crane, and they will drop him down. he is about three-quarters of the way up to the top, and at the top, it is probably around 90 feet, maybe around 100, 80 to 100 feet to the water. he is of their a pretty good bit. this is longer than a football field. this is very precise. this is that he is not afraid. he is not frightened when he gets up there, but he has the utmost respect, because he has respect for the skill and the art. one mistake, and that is it. there are no nets. it is an amazing scene. you can see captain roy flying over. now be is going to get down. all right. and refused to give them back. tonight, a judge ordered a contempt order. >> she came from trinidad and they got married, and in 2010, divorce proceedings got ugly. >> he is so full of energy. when he sees me, his eyes light up. mine little girl is such a little girl. she is so gentle and soft. >> his face brightens when talking about his children, the four-year-old and two-year-old. he has not been able to see them in years. in divorce proceedings with his wife, he says against a court order and without his knowledge, she packed up the kids and took them to trinidad, her native country. >> it was a real. -- it was surreal. >> he has been trying to get them back ever since. there was a court order that says if she does not bring them back, she will be fined $1,000 per day. >> we are hoping that the mother will recognize the order. she has not yet in two years. >> trinidad has signed paperwork that says they will recognize things and other countries. access has been restricted, and sometimes he is not allowed to leave the hotel. >> they jump out of for arms and come running to me. i cherish every moment, every second that i am with them. >> but stange says he is concerned about their welfare. he has no idea how they are being cared for, and he wants them home in baltimore. the lawyer said they will go to the state department for help and go through the legal system in trinidad to get the courts there to enforce the order. >> i want my children to know that their daddy loves them very much, and i will never, never stop fighting for them. >> all of these legal thanks. here is a look at some of our other top stories. president obama declared his support for gay marriage. he says he now favors the right for same-sex couples to be able to marry. the announcement comes days after vice president joe biden's comments that he, too, was absolutely comfortable with a gay marriage. jury deliberations are underway in a trial of a former political consultant accused of writing a vote suppression robo call during that election. the prosecution asked to convict him for his work and try to suggest that the voting was opened -- was closed before the polls closed. and there is the case of the st. patrick's day beating and robbery, where the four people accused were a charged with assault following an attack on a tourist from virginia. the victim was stripped and beaten before being dropped. so far, 13 of the 24 charges have been dropped. >> 11 news is monitoring and watching a death defying stunt above the in here harbor downtown. nik harbor. karl walked a bit furtther, 600 feet, and nik did it differently, walking to a barge. he is back home having a good time. i do not know where he is right now. this is the warm-up for his walk across niagara falls. no one has ever done that before. that is a long walk across niagara falls, and that is going to happen on june 15. this is the last performance until that performance at niagara inch elsewhere. and the normal is 72. the record below 36. and check this out. there was a trace of snow on the state back in 1923. that is the latest in the season we have officially had snow flurries in the baltimore area. there was some hail measured in 1951. , may 9,this 1920's 1923, was the latest date of snow, so i think we can officially say the snow is over. there is some cooler air behind this rain coming in for the next couple of days, and maybe some thunder tonight, lingering to midnight, a gradual clearing up as we go towards morning. it will be cold tomorrow morning, maybe some sprinkles and showers passing through tomorrow afternoon. 49 in the northwest suburbs. in northwest wind at 6 to 12. the deeper into the night we go, the better the chance for some wet weather.
