repaired. i'm told that two switches have to be replaced. all of that, the railroad is hoping to have done by 4:00, 5:00 tonight roughly. if that is not done, i'm told they will revert to the plan that they had in effect for the morning rush hour and they will reopen the main line one track at least to get trains out of new york city to points east. again, that is if they don't get all of this work done in time for the evening rush hour. again, they are crossing their fingers. they have 150 rail workers out here and hoping to have it done by the evening rush hour. we will stay on top of the jersey high school football player caught on camera hitting an opponent with his helmet. we learned that the linden student has been permanently kicked off the team. this happened during a game friday night. the player ripped off the helmet of a player from imacculata high school, then hits him with the helmet. the student is in the process of being suspended and placed on home instruction pending the outside come of a criminal investigation. the player that did not retaliate had to receive ten stitches. one of two-day care workers accused of force feeding and pushing children went before a judge. sarah dawber said she did nothing wrong. kristin thorne shared this video on total weighter leaving after the arraignment -- twitter leaving after the arraignment. >> reporter: sarah dawber's attorney says this is nothing more than a complaint brought forth by a disgruntled employee. sarah dawber went before a judge facing charges of endangering the welfare of a child. she pled not guilty. she was released without bail. the 23-year-old had nothing to say to us as she left court. a few moments ago her attorney said the complaint made against her was brought for the by a disgruntled female worker who felt left out with the other women that worked at the day care center. one of the other women that worked there was kathleen culver who is also facing charges. the two women are accused of slamming children to the ground and force feeding them. this allegedly happened at side by side child care in in southampton. dawber's attorney did allude to me that something did happen between dawber and a child but it did not go to the level of what this alleged disgruntled coworker told authorities. he said prosecutors are relying on the statements of one woman and that dawber is devastated. >> she is terribly upset. this is not something, once the bell has been running that you can escape. it will follow her the rest of her life. this is the third day care center she worked at. she has an impeccable reputation. >> yeah. that is something we heard when we were out there two weeks ago. parents standing behind the two women, standing behind the day care center. silver is jersey, two people are dead following a single vehicle crash on route 18 this morning. newscopter 7 was over the seen in colts neck as police investigated. officials say a truck veered off the roadway and overturned into the median. three people were ejected. two of them were pronounced dead at the scene. a third is now in the hospital. police in brooklyn searching for the man that they say tried to rape a woman after choking her with a cord. it happened after they walked together to a cobble hill store yesterday morning. the suspect offered to buy the victim soda and cigarettes. when they walked out of the store, police say he attacked her with a cord and tried to cut off her clothes with a knife. police say he ran off when the woman screamed. comedian jon stewart is on capitol hill lobbying congress to extend funding to first responders who became sick working at ground zero after 9/11. >> why is it incumbent upon our first responders to have to consistently push to get the benefits that are coming to them purely for their acts of valor in a wartime situation. this is insanity. >> many say stewart was instrumental in 2010 in raising awareness about the issue on the daily homes and other buildings have been destroyed. about 9,000 buildings are threatened. 13,000 people have evacuated, partly by using back fires, firefighters have brought the fire to about 30% one of the men they say spit on the driver and the driver spit back. when the men got on the bus those words turned into fists with punches thrown. at one point the driver threw a garbage can at a transgender person. off the coast of alaska, the u.s. coast guard rescued three people from a broken down fishing boat sunday. they had to jump into the water before rescuers could hoyt them to safety -- hoist them to safety. they called for help after having engine problems. the boat ran aground shortly after the rescue. a daring and record breaking stunt was caught on camera in australia. cane peterson walked on a high wire nearly 1,000 feet in the air and no net. he suffered a leg cramp while walking between the two peaks of a skyscraper in melbourne. talk about bad timing. that forced him to sit down. he managed to stand back up and complete what was the highest tight rope walk in the country's history. there are bad times to get a leg cramp and there are bad times. i want to think the mccar these recently hired regina christopher to take care of their son and dog. they found them on a nanny camera. the woman spent more than $5,000 on their credit cards and stole their identity to open two other cards. >> i could not believe i was so gullible to have let a complete stranger into my house and left her at home alone with my child. >> scary stuff. the family called police who say christopher's real name is actually gina groves and she is a career criminal with warrants in four counties. unbelievable. >> much more news straight ahead in our next half hour. the new york city burly appeared in court. they say he was operating the drone when it crashed in the stands during a tennis match darla miles is in kew gardens with the details. >> reporter: as you mentioned, he was in court this morning for that desk at appearance ticket he got for the drone crash at the u.s. open. according to his attorney, he was excited to use the drone and there was a tennis match called the u.s. open going on at the same time. did your client fly the zone specifically to take photos of the u.s. open? that's the big question? >> absolutely not. he has no interest in tennis. he was there to photograph the sun setting at flushing meadow park. >> reporter: a drone headed to flushing meadow park but instead crash landing at louis armstrong stadium during the u.s. open. >> he feels horrible about the experience. court wednesday morning. he told police the drone was brand-new and it was his first time using it. but it lost communication with the remote control and kept flying. >> the drone malfunctioned. there was no malice intent. >> reporter: an attorney for the teacher says he had hoped to use the drone in his classroom. >> he is a teacher, science technology engineering. that's his passion. his goal was to try to understand and appreciate how he can use the drone to bring that into the school, into his school and into his teaching curriculum to further inspire students. >> reporter: now he still faces reckless endangerment charges. nothing was resolved this morning. his case was continued until october. reporting live in kew gardens, darla miles, channel 7 eyewitness news. >> darla, goes thank you. new at noon, a sketch has been released of a suspect wanted for sexually assaulting two women in new jersey. prosecutors say the suspect followed a woman from broad avenue to second avenue in palisades park last tuesday. he hit the victim from behind, knocked her to the ground and groped her. three days later prosecutors say he attacked another woman the same way. two homeless women are behind bars in connection with nine bank robberies. police say michael sincinella robbed one bank and tried to rob others. the other man, 41-year-old derrick almo hit three banks in the past two weeks police say making off with nearly $5,000. the two men know each other but were not working together. new at noon, the federal emergency management agency is extending the deadline for homeowners to challenge their superstorm sandy flood damage claims. the 30-day extension came before yesterday's deadline. fema said more than 20,000 homeowners asked for reviews. the agency says 459 claims worth $7.3 million have been approved so far. now to the deadly floods out west. at least 12 people are dead there. one person is missing. heavy rains causing the deadly conditions from california to utah. marci gonzales has the story. search teams are out in utah looking for several hikers missing after yesterday's deadly flash flooding. >> we are hoping but right now it's not looking good. >> reporter: about 20 miles away another search effort. the national guard brought in to help for the final victim from this heart wrenching seen. >> oh, my goodness. >> reporter: two vehicles packed with three women and 13 children washed away in monday's sudden severe rush of water. >> heart wrenching to see them go over and i couldn't do anything about it. >> reporter: only three were found alive. residents in this small town of hildale, home to the polygamist sext ones run by warren jeffs mourned. >> to me the heavenly father's way of bringing us together. >> reporter: the same system moved west leading to dramatic rescues in southern california. >> we found two victims in the water. >> reporter: ten people, including this man and his dog pulled from the rushing water. >> we had to climb up a tree to wait it out. >> reporter: the wettest september day in 75 years. this retaining wall washed away. >> it will tip over. >> this semi on a that owns it is a lucky person for sure. switching gears a bit, a horrible scene on a highway. two students killed when a school bus rolls off an overpass. a new york investor wants to gamble on the show boat in jersey. a legal agreement prevents it from being anything but a casino. the family of one of the two students killed in a texas school bus crash says they plan to sue both drivers involved in that tragedy. the bus went through a guardrail and plunged off the overpass yesterday in houston landing on its side. its front end was heavily damaged and the roof caved in. a female student died at the scene and another died at a hospital. the victim's families are stunned. >> gorgeous, full of life, this was going to tampa bay her senior year. she was a momma's baby and a daddy's girl. >> two other students and the school bus driver were hurt. police say the driver was -- who caused the wreck is a teacher. they questioned and released her. the competition is on for the 2024 olympics. four european bids against a two-time host from the united states. the international olympic committee announced los angeles once again is being considered to host the summer olympics. l.a. hosted the summer games in 1932 and 1984. rome, paris, hamburg and budapest are in the running. the winning city will be announced next year. some could be getting an olympic size payout. the which might well earn johnny depp his first oscar. he has been dominated three times before. >> next, a new movie is called pure evil but it has nothing to do with criminals. back in the 1970s, a daredevil named evel knievel captivated the nation with his stunts such as jumping the snake river canyon on his motorcycle. now comes word channing tatum will play him in a film. he was a household name 40 years ago thanks to stunts so dangerous he claimed he broke a total of 400 bones in his body. the movie is still some ways away because the script is still being written. the real guy died eight years ago and you have to be certain age, dave, shirleen to remember when he was a household name and his posters were on the walls because this guy's hey day was in the 70s into the 80s. >> you
