comment, public comment will be held after each item on the agenda.and i will call dave gunther. >>good afternoon. >>good afternoon. for the record my name is dave gunther i am the chairman for the treasure island sailing center board of board of directors. i will start with 3 recent eventsof the community access on clipper cove. 1st we will discuss the safe boating day and on may 10 we had a major milestone for the center. we issued over 3500 kidsom 31 different schoolsthat now attended at no cost to the city. these 3 stem classes were designed specifically to meet california core standards.this is the 1st time some of these kids a touch the water in the san francisco bay and they are excited about it. we mentioned the meeting support from bob back in emd and w these have been crucial in designing our new space and we are excited for that. what we do is provide environment nature and sailing. is time is clear on weekends which is great. and get right to use and usage. here is a breakdown of that division of the sailor, paddlers and kayakers on clifford cove in 2015.it's starting on the left you see the green area and this is for safety training and paddling and swimming on the right this would be for with multiple classing for the same time. this also gives current access to launching facilities and makes this unique. the last point is the 500 foot safety zone and that safety zone really only provides 5 minutes except the current in the wind provides less than 5 minutes so that is it. that is that my 3 minutes plus. thank you for your time. i'm always available just heard what was at stake and what will get lost if the marina is not being built. in less than a year you own this marina and own the displacement that occurs. 1st off, it's unfortunately a sarcastic congratulations that is due you have officially evicted the san francisco there's no longer a san francisco dragon boat coverage they have now move. numerous supervisors have never supported quite frankly they've never supported this marina. supervisor avalos,compos, kim, all have not supported this marina and i think that supervisor compos has probably written you a letter about this. the reason that dating and water ways refused to endorse. i'm sure that loan report is not in your packets. it went on and on and on. the staff agreed upon a conditional approval but even them the dpw refused this approval. your hearing different things from your staff and from the public and from the developers and that has to be yours to bear but i have a quick and short hand out and i hope you get to it. the basic problem is it back in 2005 there was a process to approve a marina. the proposed marina is 60% bigger. the developers claim that is the same because it has the same amount slips at a different arena in this proposed approval.this is the heart of the matter. the heart of the matter between the developers and public opinion about this arena and i hope you approve this marina. board. in the last 2 months since our april long island meeting we have had 2 additions of the treasure island flee on the last weekend as well as the tenants and subtenants of building 80 had a closing celebration as they vacated it. most of those tenants of lee's new spaces there the pasadena visa will be held through august, the rescue orphan mammal program provided tips and best practices for secure crawlspaces and points of intrusion and other access to buildingsto prevent access to raccoons andother animals that might have access to the property in the spring season. on may 26 the san francisco department of emergency management calo es and dem will be here today to provide an update on their tsunami prepared his work over the past year. volunteers also conducted a count on - island this past weekend on butterflies. species include the pipeline swallowtail, the western swallowtail, in the pipeline swallowtail is the only place in san francisco where that has been identified. we will also be hosting a project poll high school intern.and this is a recent graduate and they will be returning to the university of michigan this fall as a freshman.this is a program ran by the public utilities commission that caters to students interested in careers in engineering and the sciences. we did unfortunately have 3 power outages this last month one was caused by a booth that struck some lines at california and avenue h. the fspc are installing bird divers which are essentially reflectors which grow in the dark around the fields where geese tend to congregate to make the powerlines more visible. the other 2 power outages were the result of vandals that broke into vacant building 450 on the island. the former judge advocate general building and removed some electrical equipment that resulted in the power outage. we did meet in april with the new captain of the southern station and had a good dialogue with him darrell fong, and we will follow up with him regarding the recent vandalism problem as well as sideshows that continue to occur on the island. the fire antenna is now online and providing greatly improved service on the island for residents who happen to subscribe to verizon. unfortunately because of the phone technologies involved it is not having a similar impact on some the other services. the dog park improvements are under way. the new dog fence was installed in the new entrance bars are going in and will beinspected and be in by the end of june. we also installed new replacement signs at the treasure island playground denoting the park rules and regulations and improvements for the grocery store continue with the grocery store expecting to open in its new location in july. the treasure island nap cup celebrated in may at the treasure island vista and on the construction front and go bay is completing its vacant work on the building on oak where do island this week and that construction is expected to be completed next week. that should be going up at the end of this month around the barracks in july and be completed around august. the processing of permit packages through ppw, puc, through site and infrastructure packets. next week the ftc will provide an update on the resolutions and provide in invitation of intent. the lucas museum team is evaluating potential sites on the island and we are internallythrough the city evaluating potential implications of that development for both infrastructure as well as any impacts that would require any further environmental evaluation in any plan amendments that would the director of the center this afternoon and hopefully that will produce some progress that we will be able to touch on next month. >>thank you. >>any other questions? >>mr. beck, we know that we will be going but when did the renovations to the center happen? >>and where are we at now? >>we really began around january 2015 and the developer for the marina began to move forward with additional planning and communications begin with the sailing center in march 2016 i'm sorry 2015 was the 1st time that the sailing center put forth the idea or articulated the need for a 1600 square foot sailing area and it was july of last year that they came up with the idea came up with the idea of the 500 ft.2 buffer. so we have been back and forth with the sailing center with t i.e. trying to understand the needs of the sailing center and how we could potentially adapt to their facilities. >>thank you and i asked that question because i asked that specifically and i think it's very important for us and for the public and the stakeholders to understand that times instructed our to come together with our stakeholder in negotiations and everyone can come together but the timeline is very important because it some point when you come back to tell us where we are we again need to make sure that everyone is on this page and how we get to where we are. and thank you for that update and whenever you speak on that matter it is very important because people are beginning to look at this issue very close to now. but let it be said very clearly that yes, we take our jobs here very seriously and we still asked for the parties to go back to the drawing board and make something happen.and i don't think that there has been any other issue that has taken a timeline that is so and the marina. this is not the time to discuss it but certainly we want to make sure thatthat we are paying attention to this issue this is something that we are looking carefully at and we would like to see the sailing center go forward because you provide for men services for the city and at the same time you have a long-term commitment to the marina so we hope that you have productive give a description. i also have staff from the port here as well. >>thank you, on section 2 scope of the project we have accepted deletion of the line for the vision of the sculptures above and beyond what the port has covered with their self-insurance. the port will be in consultation with risk management in the city attorney and self-insurance is sufficient and we did not feel it would be necessary to require the port to have this additional layer of insurance in place. a revised copy of the loan agreementat the head of the meeting on page 1 you will see the language that we are stan hudak of the port of san francisco. i would like to say i am thrilled to be able to be here to speak to the commission. the port is thrilled and excited about the opportunity to display this historic sculpture in generosity of tida. i hope this is found as a win-win situation where the port does the art conservatory preservation on this and makes it suitable to be displayed in a public place these 2 sculptures. both in that temporary place at the port property and in future placement at treasure island and i hope it also provides a connection between the san francisco waterfront and treasure island with people having these sculptures in both places and it's likely that we would do some interpretive plaque explaining where it comes from and the relationship has to treasure island. if you have any question either of us would be happy to address those. >>dan, for the public could you please describe a little bit about the sculptures themselves. >>the sculptures are part of the worlds fair exhibition and they were done by an african-american artistand you're going to test my knowledge here. sgt. johnson is the artist and he was a san francisco sculpture and they are about 12 feet tall and 9 feet long and 3 feet wide. they are a cement-based piece of art. meaning like a stucco material with the cementitious cover of a male and female figure and they make prominent entry features. they will be located at the ports new cruise terminal at james herman cruise terminal at gate 27 at a prominent location so we have a basic infrastructure there and we need some improvement on the site to make this an appropriate destination for visitors as they can be greeted by these as they walk through the cruise terminal plaza. >>thank you very much any other questions? >>thank you for your presence here. the african american historical society is extremely excited with the opportunity to isplay these here. we are excited and we are willing to work with the port to make this happen andeven went further to look at all of the exhibits that we have in maybe we could collaborate with that and we could loan them to the port so that you could display them. let's make this work. there are others that we are aware ofand it may be that we can jointly educate the public on the legacy that all these individuals had made in their contribution to san francisco. their partnership is please. >>item number 7, resolution approving the budget of the treasure island development authority for fiscal years 2016-2018 and authorizing the treasure island director to enter into work orders for services with other city departments, professional service contracts and agreements with service providers. >> thank you members of the board.we are happy to be here to present this to you. we have some increases in costs as we continue to move through it the documents submitted by pic and then about a half $1 million of repairs to the wastewater plant. on the revenue side we are projecting commercial revenues to proceed projections by about 15%and the rest will go to rehabbing the units for vacant occupancy. this fiscal year we will exceed the current year revenues. this wasn't dissipated when we prepared last year's budget in this budget will be balanced by prior year fund balances to supplement current revenues. there will not be an opportunity to make a contribution to our revenues this year. for 2016 and 2017 some of the community programs that are going to be continuing next year are the ymca operations the treasure island clinic, the tie-dyed programs the tool works in custodial services program and rubicon's landscape management of the landscape on the island as well as the areas for the residential areas and neighborhoods. and there are also revenues being preserved in next year's budget. there will be a rebound in revenue next year despite the loss of several buildings. we are still projected toincrease slightly here with the residential leasing levels expected to return with levels consistent in past years. we will also be increasing the budget for the tie-dyed job broker program and that is a program that is funded by ticd we will pass those revenues on to tye dye.the system engineering for her services and development firm a and setting up funds for the arts commission for an art commission fun. elements that will be decreased in next year's budget will be tida revenue for a spell and the revenue details and the work orders in the last 2 items are not a reduction in service but adjusting the items to reflect past trends. this does not include in the budget 2 1/4 million dollars and we will make a final payment to the fcta. next year we do expect to exceed revenues but we expect to balance these revenues with our fund balance revenues without requiring tida to cover our total expenses. >>i be happy to answer any questions that you may have. >>thank you. any questions? >>thank you mr. beck. one question i have has to do with the inter-agency or our sister brother agencies. don't we have the ability to negotiate with them to make sure hat with the puc and things of that nature that we can recover some of those costs from them? >>our costs are committed to the staff hours that have been committed for the reviewed. it is for actual hours worked. it is not a lump sum. the structure that we have here on our program is similar in its concept to that employed on other projects like peers 70 development, mission bay candlestick point. the one difference being here are that because tida has the leasing revenues we are paying for those services directly and if we end up reaching that point where so many of our facilities have been lost to development that our revenues are no longer covering her expensive then they are required to fill our budget shortfall and other programs reimburse the city agencies directly for those services. >>thank you. i understand that. again my opinion or my comment is that they could absorb some of the cost because those agencies have a lot of money in their budgets but anyway the resolution is to approve the budget. >>mr. dunlop. >>thank you very much. i just wanted to note that the continuing programs in the community programs that we in the staff support for such a small section of san francisco we really do a lot of supportive work and i think it is great and obviously we will continue as the development goes forward in fact there will be opportunities to support the communities and i totally support the budget. thank you. >>before we take the item 8 please >>item 8 isa resolution authorizing the treasure island development authority to execute a grant application, grant agreement, and related documents necessary to file as a joint applicant with treasure island community development under the state of california's affordable housing and sustainable communities program, and to accept and expend funds as set forth in the grant application, subject to approval of the city's board of supervisors, and authorizing the treasure island director to enter into an indemnification agreement with treasure island community development.we did woy >> and with tie-dye to submit the final application.that i ahsc program s administered by the strategic growth council it is a target tax supported rent program and this is a part of transportation housing and infrastructure projects with specific objectives to help support the development of projects thatachieve greenhouse gas reductions in benefit disadvantaged communities. just a word since we been talking quite a bit in recent months about affordable housing and financing for affordable housing and the need for additional funds this application does not include funds for initial affordable housing units. that is because it is really a timing related issue. the 1st affordable housing projects will not begin construction in till 2018 and we want to be able to complete that work within the timeframe set in this year's grant application for the deadlines to expend funds in this years grants. but we do intend to expend for affordable housing funds in future cycles and we have an additional transportation scope that we will be able to include in future applications to bolster affordable housing as well. >>in terms of the scope of the application, the bulk of the improvements that are in the application are in transportation -related infrastructure. the 3 ac transit buses that are required to initiate initial transit service is anticipated to begin in 2019 through bus stops at the mobile homes and this will provide 4.8 miles of bike facilities 4.8 miles of bike facilities and 1.2 miles of additional bike facilities and a new bike share station that would be located adjacent to the ferry shelter. also there is construction of the ferry plaza itself with the seating and landscaping and all of the features that that will include as well as streetscape amenities throughout the initial sub phase areas including lighting, benches, bike racks, wayfinding and other street improvements. and then finally for many of us most excitedly we have been working with tie-dye to develop a concept for the and pull program. this is around tihdi regimen but also around tida regimen and the school. is to work with tihdi and timma for the initial operations of a shuttle program. the applications are due by the end of 20th of june and wewill be accepting any proceeds. >>thank you. let me just say that this program is one of the few state programs available for affordable housing and transportation unfortunately over the years that state has less and less affordable housing programs. i have worked with this program and with the state as this has been developed i'm glad that we are at least putting an application trying to get our share of the funds. we just wish that there was more funding available for the great need that we have in the city as well as all over california. i would like to note that david hsu who is our assemblyman in san francisco is the chair of the housing committee that this department is under so i think you have some good friends in sacramento and i hope that we will be successful with this application. the application just as mr. beck said is just for transportation but really what we are interested in is getting our share of funding in order to be able to subsidize the affordable housing because only through that inclusion of state and possibly federal tax credits are we going to be able to make our housing affordable enough for the people that we want to serve. so certainly i urge your support for this resolution. any comments? >>yes, given the expertise that we have here in the application i think would be very great if you could let us look at the draft so we can see how you put it together the package. one of the things that has already been established that the treasure island issued development of one of 6 projects worldwide in the us that has already been established as a global sustainable community development so there is no other project like that in california or anywhere. so we have that moving forward.tida has spent a considerable amount of time looking at the transportation infrastructure and we are still highly interested in no other project in the bay area can match the emphasis that we are putting into the transportation infrastructure and also the tihdi and the homeless initiative and the initiative on homeless development and housing. with our correspondence, the way we put this application together will be the key. we want to make sure that even given all the items that we have going forward that we had put an emphasis on the application. so, we would like to offer our expertise in helping to make that application a stellar one. okay mr. back? >> thanks kate. >>i think this is a wonderful program and i do hope that we get this 10 1/2 million dollars it would really help us to improve the infrastructure what are those funds already counted in our initial budget assumptions. if for example we do not get this approved, what would happen to the 3 bus stops in the 3 transit buses, what would happen to those? >>most of the scope that is part of this project are developer obligations under the dda. they would then be eligible for reimbursement for the ifd and cfd that are already formed and to the extent thatwe are able to draw more resources to the overall financing program thatprimarily consists of the ift and cfd to the extent that we are able to fully reimburse the tida eligible cost and the other thing at the ifd funds is our public financing program and also at the sea level program. and in the eventthat we get this reimbursement than this would mean that our budgets for these programs would flow to other programs. >>so to the extent that this is growing this could have an impact on several things. >>to the extent that it's growing the overall pie it will have a trickle-down effect on the other things that we need to fund.>>when will we know if we get this application approved? >>in october. mr. pancoast is here he and nelly fong have been instrumental in preparing this application. >>let's go get it. >>are there any other comments from the board. if not, from the public please? >> >>good afternoon commissioners sherry from treasure island homeless development initiative. yes we will be applying for funds in the future when the time is right for the affordable housing program we will be recording our efforts with the mayor's development housing. we will need affordable transit options for our residents and were excited be part of this application. we have met with this great program that we can use as a model and we can use as a project that we have already coordinated through the public defender's office and the mta to essentially do similar kind of work that we want to do which is providing supplemental transportation for people that have limited access to affordable transportation to do things like go to the doctor, pick up groceries, go to various schools, and so forth. so, we are really excited to be part of the application. we supported wholeheartedly. we would absolutely be trying to get every dime we could for affordable housing the future. thank you. >>another win of course is that all of these projects would be subject to the 25% hiring goal in the 50% san francisco hiring goal so all of these projects would be fully part of the whole job program that >> [chorus of ayes] >>the ayes have it.item 9 please. >>item 9 is presentation by san francisco department of emergency management on san francisco emergency response plan tsunami annex revisions and treasure island outreach. >> a tsunami is when 2 waves come together. us do not me is not one wave it is usually more than one wave in this nami is not the largest. it can last for hours and its damaging currents can last for several days. there is also a number of subsequent hazards that can result from a tsunami. there are numerous things that we have to plan for. in san francisco there are distant source, regional source and the resources the nominees. that depends on where we are from where the earthquake occurred.i near source would be like the tsunami that happened off the coast of alaska. we have had 54 tsunamis observed in san francisco since 1850 and in 18 yours it is a very very short of time in geological perspective so even though they are a low probability event they do have a high consequence so that is why we plan for them. we do make sure that we are prepared to handle the consequences. >>we utilize tsunami maps that were utilized by by the state by the ccsf. the maps are a combination of regional source tsunamis. and as you can see the map is entirely in inundation zone. so it's a worst-case scenario. how do we get information to the public? there is an emergency alert system that comes through the radio and television. there is an outdoor siren system and we do test them. there is alertsf which if something happens in the city if you sign up they will text or email you. there is a normal test that we do of our system in a textbased system of the social media that we use like twitter and it was supposed to be just an internal test but it went out to everybody that was described in the system. so within 3 minutes we came to that and we use that as an opportunity to educate people about tsunamis and promote alertsf as a tool. and also we will make mobile announcements if we have time to tell people to evacuate. all of these systems are great for dealing with a regional or a distance source tsunami. in a near source an army where we would have 15 minutes to inundation that would be generated by an earthquakeit would be very significant we know that there would be damage to infrastructure and impacts to personnel that have torun these systems. so, we have plans in place so that we have things in line before this would damage our infrastructure or impact of personnel. and also we would ask that we have evacuation plans to move everyone away from the water. we have a 2016 tsunami annex plan and that focuses on eoc and doc and we have really beefed up the outreach and education plan. there is a separate section in the plan related to treasure island there are some nuances to evacuating the island. we made a recommendation in the plan that ti be afforded priority as far as research allocation because there's so few ways off the allen. we worked with many sources in developing a priority to make a high resource priority plan and we've also worked with the fire and the police in several government agencies to put this plan into place. this is for evacuation only. another thing that we did was we began doing outreach on treasure island to different community organizations. we held meetings in march and april with job core and treasure island community development as well as community developers to talk about outreach strategies to the public and messaging and preparedness information and then just a couple weeks ago in may we did an open house for the public and we had experts they are to discuss emergency preparedness and this summer we will be beginning citywide to replace and augment the evacuation signage that you may see around the city. in treasure island we hope to start signage installations in early july and we have worked with developers so as there is changes in july they can be incorporated in the overall signage plan and they can be incorporated as well. that is all i have for the signage plan i'd be happy to answer any questions that you may have. >>thank you very much. that was very informative. do we have questions? >>yes. >>do you have the floor? >>thank you. thank you for the presentation. it is very helpful. it is very helpful and it's hard to imagine if we went underwater what could happen in these are for the future and god forbid anything would happen today but what if it does happen today or tomorrow? how would we react since we haven't done this? >>i think it will depend on where the synonymy is generated from. if we have 4 more hours we would start evacuating the island as much is possible although it really if everybody gets in a car and tries to get off island it once it would be very difficult so some of our outreach messaging has been around carpooling and people starting to get to know their neighbors as much as possible so that they can drive off the island. we would also encourage people in the messaging that we have done we have a near source tsunami right now you can walk to high ground off of treasure island and with the development even the extension of the bike path when that happens it will be another way for people to walk off the island. so, we are really looking forward to the ferrys and the bike path and the other world methods of transportation. >>if this were to happen tomorrow does wbi have literature to tell them what to do? >>yes. that's why we have the literature that we have to tell them what to do. we have done a synonymy walk on the island of something we've done on other parts of san francisco but we look forward to doing more outreach with other residents for exactly that purpose. because people can only be so dependent on city services. we have to be ready to take actions for ourselves. >>thank you. >>thank you very much amy. when you come here i know that you're having all these meetings and what it would be helpful at some point when you're speaking to us to give us a presentation on the outreach plan so it could be for lots of people that are now watching that are coming to the meetings and they could tell san francisco residents what we're talking about here. treasure island is already in the water so i presume or suspect that the waterfront in san francisco would also be affected so that comes into question then the evacuation and you mentioned something here that i wrote down if you have time. god forbid let's say the entire waterfront of san francisco is affected san francisco adopted these vision zero policy, where we have committed to work toward the goal of the zero traffic deaths by 2024. we have a long ways to go. every year about 30 people lose their lives and over 200 are seriously injured by traveling on our streets. these deaths and injuries are unacceptable and preventable. vision zero is about city officials, city employees, and community members working together and committing to create safer streets. what is been brought forth for your consideration today is to extend telematics into the majority of our cities leads of more than 3000 vehicles. in the last five years, we have spent nearly $77 million in litigation and settlement directly related to our cities fleet of vehicles. as elected officials, we are charged with an expected to be accountable for a public dollars. this is why last year i directed the budget legislative analyst to produce a report and old a hearing on this report and i was cosponsored by many of you. the benefits shown on this report in terms of safety improvements, savings and environmental benefits are clear. undeniably beneficial and proven. telematics has been used as a correct trained to improve driving habits, decrease inappropriate or unauthorized use, and has shown to have environmental benefits in reducing emissions in many locations in the united states. telematics sometimes are first added a black boxes. it is a technology that has gps along with capacities to collect information and data such as speed, hard braking or acceleration, mechanical diagnosis, could this technology is currently in early 9% of our city's fleet of vehicles. it has already proven to have increase safety by reducing the number of collisions. for example, mta conducted a pilot similar to not technology in one year reduce collisions by 50%. i want to thank the advocates who have the support of this legislation, including lot sf but by coalition the and vision zero coalition. i would also like to thank my staff, erika mae born, we saw this legislation through. now, what i'd like to mention here is that we are not including law enforcement officers at this point because there was some details to be worked out and i didn't want to start this process anymore for the rest of the fleets, but rest assured, i will be working with the-our city administrator google come up with airport in the next few months so we can move forward to include the law enforcement officers in this particular item. to follow legislation should it's critical we work towards our vision zero goals by changing our culture to smart and proven policies and to our language and how we speak about our goals. so, this is the reason i am making a motion for two minor amendment. you have a copy of that and that will be better aligned. these basically are minor language amendments, better align with our vision zero goals. so, on page 1 line 24, to reduce all traffic fatalities, and on page 2, line 13, the word accident, which may not be avoidable, is changed to collisions. so when i talk about accidents could talk about collisions, which we can work to address and reduce. so, colleagues, i hope you will all ensure that the city gets at least 100% of the appraiser market value when it sells or leases land. it also provides for third-party appraisal review of appraisers of certain threshold about you could i also think our enterprise departments further engagement on this legislation. as we all know the enterprise components which include the mta, the airport, and public utilities commission have some discretion to conduct a real property transactions on their own outside of the purview of our department of real estate. this legislation provides standard procedures for leases that enterprise the parties enter into without interfering with the core functions of these enterprise departments under the city charter. to that end, i have some brief amendment based on our conversations with court staff which you can find on page 8 of the subject legislation did i previously distributed copies to all of you specifically at page 8, line 7-10, we would like to amend to add the following language quote, unless the executive director of the port determines the real property under cold that the rental rate for the proposal lease meets or exceeds port commissions annually adopted parameter rental rate for such real property, at line 14, on the same page, remove the language, executive director of the port determines applying the market rent requirement would conflict with the port commissions annually adopted parameter rental rate for the proposed leases. that was dealt with in the previous amendment. finally, on line 12 of the same page, add a the language, the board of supervisors on high-resolution lesser a proper public purpose or three, and skip two line 16, commission or agency determines with director of property concurrence that an independent appropriately qualified real estate economic expert is better suited than appraiser to perform the rental analysis. if there's any questions, the representatives of the ports one hand with regard to those amendment. if not i like apply to ocii, the successor agency and the indeed invoke an appraisal statute under state law as you previously referenced. but relative to an appraisal process, the value of the property is what a knowledgeable buyer would pay a knowledgeable seller based on comparable sales of similar property. if those community benefits were to be deducted from that value you'd have to-derby and appraisal problem and somebody would have to assess the value of those community benefits which presumably would be a deduction from the praise for market value. >> president breed: okay. so if that happens, in the case of the successor agency which definitely has its own process, that happens for example in the case of the city is closing of any assets in the same capacity we are talking about making sure there's clear-there is a clear match to the appraised value though that the city ultimately doesn't lose any money? >> supervisor peskin: corrected ultimately it's a function of how the city through its department of real estate instructs an appraiser. for instance, in the case of what actually started this whole ball rolling 30 van nuys, if the city is demanding that the property include 20% of about this piece of legislation, which has been long come on time coming. i want to thank my cosponsor supervisor peskin. i want to thank a very broad coalition that includes a very diverse group of people who normally are not on the same side of this type of an issue. but, how we got here is after a long fight, including a pretty, i think, difficult fight at the ballot, but we decided to do and think about how to address the problems that clearly remain on this issue is to present as we have presented a pretty modest and a pretty simple proposal that essentially, try to preserve san francisco's housing. this legislation in a very simple way, mandates and that what web platforms that engage in short-term rentals reports, not hinder, the enforcement of our short-term rental object again, as a repeatedly have said, it's not about changing the current law. it is simply about enforcing that law. that is what supervisor peskin and i have put forward. also want to thank supervisor mar supervisor avalos for the cosponsorship. this proposal mandates that hosting platforms like airbnb their firehose has registered with the city before advertising their short-term rental on its website. if a hosting platform fails to do so , the platform itself will be penalized for up to $1000 a day . while the current law has set rules for hosts stipulating that all closeness register with the city, more than 75% of airbnb 7000, plus in san francisco have in fact not registered. in fact come up we have only received 1800 applications to open since the launch of the program and that's essentially 26% of the 7000 airbnb hosts we know. short-term rentals that have been issued are 1300 24 or 18.9% of the 7000 host with airbnb to last year's budget analysis report found that airbnb alone has taken up to 2000 entire units of housing, 2000, completely off the market. this is why we need to bring the hosting platforms into compliance. the one thing from our perspective that has been missing in the existing airbnb short-term rental law is corporate accountability. the weakness of the law is that corporate accountability is essentially nonexistent. it's not surprising, given that corporations that ultimately controls a large part of the market is the one that actually broke the law as we know it. i have met with many home shares, and let me say, once again, as we have repeatedly said supervisor peskin and i throughout this process we support capital host, mom and pop hosts, will not be impacted in any way because of this law. we are simply focusing the law and enforcement on the corporations. i want to address a couple of misconceptions about the legislation. some have claimed that the legislation would force platforms to police short-term rentals. that could not be further from the truth. if your rental car agency and you have to make sure the person that you rent that vehicle to actually has a license before you run them a car. that's exactly what we are asking the short-term rental platforms to do here. second, on a huge support of internet freedom and we were carefully not only with the city attorney, but also with online advocacy groups to make sure that this legislation passes legal muster. again, i want to thank the broad range of people who have formed this coalition. again, microsoft or supervisor peskin and his chief of staff sunny and glue, the tenants union, local two, juju, tenants together, san francisco apartment association, senior disability action, share better, housing rights committee, and many many more. also want to treasure island sailing center board of board of directors. i will start with 3 recent eventsof the community access on clipper cove. 1st we will discuss the safe boating day and on may 10 we had a major milestone for the center. we issued over 3500 kidsom 31 different schoolsthat now attended at no cost to the city. these 3 stem classes were designed specifically to meet california core standards.this is the 1st time some of these kids a touch the water in the san francisco bay and they are excited about it. we mentioned the meeting support from bob back in emd and w these have been crucial in designing our new space and we are excited for that. what we do is provide environment nature and sailing. is time is clear on weekends which is great. and get right to use and usage. here is a breakdown of that division of the sailor, paddlers and kayakers on clifford cove in 2015.it's starting on the left you see the green area and this is for safety training and paddling and swimming on the right this would be for with multiple classing for the same time. this also gives current access to launching facilities and makes this unique. the last point is the 500 foot safety zone and that safety zone really only provides 5 minutes except the current in the wind provides less than 5 minutes so that is it. that is that my 3 minutes plus. thank you for your time. i'm always available sarcastic congratulations that is due you have officially evicted the san francisco there's no longer a san francisco dragon boat coverage they have now move. numerous supervisors have never supported quite frankly they've never supported this marina. supervisor avalos,compos, kim, all have not supported this marina and i think that supervisor compos has probably written you a letter about this. the reason that dating and water ways refused to endorse. i'm sure that loan report is not in your packets. it went on and on and on. the staff agreed upon a conditional approval but even them the dpw refused this approval. your hearing different things from your staff and from the public and from the developers and that has to be yours to bear but i have a quick and short hand out and i hope you get to it. the basic problem is it back in 2005 there was a process to approve a marina. the proposed marina is 60% bigger. the developers claim that is the same because it has the same amount slips at a different arena in this proposed approval.this is the heart of the matter. the heart of the matter between the developers and public opinion about this arena and i hope you approve this marina. board. in the last 2 months since our april long island meeting we have had 2 additions of the treasure island flee on the last weekend as well as the tenants and subtenants of building 80 had a closing celebration as they vacated it. most of those tenants of lee's new spaces there the pasadena visa will be held through august, the rescue orphan mammal program provided tips and best practices for secure crawlspaces and points of intrusion and other access to buildingsto prevent access to raccoons andother animals that might have access to the property in the spring season. on may 26 the san francisco department of emergency management calo es and dem will be here today to provide an update on their tsunami prepared his work over the past year. volunteers also conducted a count on - island this past weekend on butterflies. species include the pipeline swallowtail, the western swallowtail, in the pipeline swallowtail is the only place in san francisco where that has been identified. we will also be hosting a project poll high school intern.and this is a recent graduate and they will be returning to the university of michigan this fall as a freshman.this is a program ran by the public utilities commission that caters to students interested in careers in engineering and the sciences. we did unfortunately have 3 power outages this last month one was caused by a booth that struck some lines at california and avenue h. the fspc are installing bird divers which are essentially reflectors which grow in the dark around the fields where geese tend to congregate to make the powerlines more visible. the other 2 power outages were the result of vandals that broke into vacant building 450 on the island. the former judge advocate general building and removed some electrical equipment that resulted in the power outage. we did meet in april with the new captain of the southern station and had a good dialogue with him darrell fong, and we will follow up with him regarding the recent vandalism problem as well as sideshows that continue to occur on the island. the fire antenna is now online and providing greatly improved service on the island for residents who happen to subscribe to verizon. unfortunately because of the phone technologies involved it is not having a similar impact on some the other services. the dog park improvements are under way. the new dog fence was installed in the new entrance bars are going in and will beinspected and be in by the end of june. we also installed new replacement signs at the treasure island playground denoting the park rules and regulations and improvements for the grocery store continue with the grocery store expecting to open in its new location in july. the treasure island nap cup celebrated in may at the treasure island vista and on the construction front and go bay is completing its vacant work on the building on oak where do island this week and that construction is expected to be completed next week. that should be going up at the end of this month around the barracks in july and be completed around august. the processing of permit packages through ppw, puc, through site and infrastructure packets. next week the ftc will provide an update on the resolutions and provide in invitation of intent. the lucas museum team is evaluating potential sites on the island and we are internallythrough the city evaluating potential implications of that development for both infrastructure as well as any impacts that would require any further environmental evaluation in any plan amendments that would will be going but when did the renovations to the center happen? >>and where are we at now? >>we really began around january 2015 and the developer for the marina began to move forward with additional planning and communications begin with the sailing center in march 2016 i'm sorry 2015 was the 1st time that the sailing center put forth the idea or articulated the need for a 1600 square foot sailing area and it was july of last year that they came up with the idea came up with the idea of the 500 ft.2 buffer. so we have been back and forth with the sailing center with t i.e. trying to understand the needs of the sailing center and how we could potentially adapt to their facilities. >>thank you and i asked that question because i asked that specifically and i think it's very important for us and for the public and the stakeholders to understand that times instructed our to come together with our stakeholder in negotiations and everyone can come together but the timeline is very important because it some point when you come back to tell us where we are we again need to make sure that everyone is on this page and how we get to where we are. and thank you for that update and whenever you speak on that matter it is very important because people are beginning to look at this issue very close to now. but let it be said very clearly that yes, we take our jobs here very seriously and we still asked for the parties to go back to the drawing board and make something happen.and i don't think that there has been any other issue that has taken a timeline that is so historic sculpture in generosity of tida. i hope this is found as a win-win situation where the port does the art conservatory preservation on this and makes it suitable to be displayed in a public place these 2 sculptures. both in that temporary place at the port property and in future placement at treasure island and i hope it also provides a connection between the san francisco waterfront and treasure island with people having these sculptures in both places and it's likely that we would do some interpretive plaque explaining where it comes from and the relationship has to treasure island. if you have any question either of us would be happy to address those. >>dan, for the public could you please describe a little bit about the sculptures themselves. >>the sculptures are part of the worlds fair exhibition and they were done by an african-american artistand you're going to test my knowledge here. sgt. johnson is the artist and he was a san francisco sculpture and they are about 12 feet tall and 9 feet long and 3 feet wide. they are a cement-based piece of art. meaning like a stucco material with the cementitious cover of a male and female figure and they make prominent entry features. they will be located at the ports new cruise terminal at james herman cruise terminal at gate 27 at a prominent location so we have a basic infrastructure there and we need some improvement on the site to make this an appropriate destination for visitors as they can be greeted by these as they walk through the cruise terminal plaza. >>thank you very much any other questions? >>thank you for your presence here. the african american historical society is extremely excited with the opportunity to isplay these here. we are excited and we are willing to work with the port to make this happen andeven went further to look at all of the exhibits that we have in maybe we could collaborate with that and we could loan them to the port so that you could display them. let's make this work. please. >>item number 7, resolution approving the budget of the treasure island development authority for fiscal years 2016-2018 and authorizing the treasure island director to enter into work orders for services with other city departments, professional service contracts and agreements with service providers. >> thank you members of the board.we are happy to be here to present this to you. we have some increases in costs as we continue to move through it the documents submitted by pic and then about a half $1 million of repairs to the wastewater plant. on the revenue side we are projecting commercial revenues to proceed projections by about 15%and the rest will go to rehabbing the units for vacant occupancy. this fiscal year we will exceed the current year revenues. this wasn't dissipated when we prepared last year's budget in this budget will be balanced by prior year fund balances to supplement current revenues. there will not be an opportunity to make a contribution to our revenues this year. for 2016 and 2017 some of the community programs that are going to be continuing next year are the ymca operations the treasure island clinic, the tie-dyed programs the tool works in custodial services program and rubicon's landscape management of the landscape on the island as well as the areas for the residential areas and neighborhoods. and there are also revenues being preserved in next year's budget. there will be a rebound in revenue next year despite the loss of several buildings. we are still projected toincrease slightly here with the residential leasing levels expected to return with levels consistent in past years. we will also be increasing the budget for the tie-dyed job broker program and that is a program that is funded by ticd we will pass those revenues on to tye dye.the system engineering for her services and development firm a and setting up funds for the arts commission for an art commission fun. elements that will be decreased in next year's budget will be tida revenue for a spell and the revenue details and the work orders in the last 2 items are not a reduction in service but adjusting the items to reflect past trends. this does not include in the budget 2 1/4 million dollars and we will make a final payment to the fcta. next year we do expect to exceed revenues but we expect to balance these revenues with our fund balance revenues without requiring tida to cover our total expenses. >>i be happy to answer any questions that you may have. >>thank you. any questions? >>thank you mr. beck. one question i have has to do with the inter-agency or our sister brother agencies. don't we have the ability to negotiate with them to make sure hat with the puc and things of that nature that we can recover some of those costs from them? >>our costs are committed to the staff hours that have been committed for the reviewed. it is for actual hours worked. it is not a lump sum. the structure that we have here on our program is similar in its concept to that employed on other projects like peers 70 development, mission bay candlestick point. the one difference being here are that because tida has the leasing revenues we are paying for those services directly and if we end up reaching that point where so many of our facilities have been lost to development that our revenues are no longer covering her expensive then they are required to fill our budget shortfall and other programs reimburse the city agencies directly for those services. >>thank you. i understand that. again my opinion or my comment is that they could absorb some of the cost because those agencies have a lot of money in their budgets but anyway the resolution is to approve the budget. >>mr. dunlop. >>thank you very much. i just wanted to note that the continuing programs in the community programs that we in the staff support for such a small section of san francisco we really do a lot of supportive work and i think it is great and obviously we will continue as the development goes forward in fact there will be opportunities to support the communities and i totally support the budget. thank you. >>before we take the item 8 please >>item 8 isa resolution authorizing the treasure island development authority to execute a grant application, grant agreement, and related documents necessary to file as a joint applicant with treasure island community development under the state of california's affordable housing and sustainable communities program, and to accept and expend funds as set forth in the grant application, subject to approval of the city's board of supervisors, and authorizing the treasure island director to enter into an indemnification agreement with treasure island community development.we did woy >> and with tie-dye to submit the final application.that i ahsc program s administered by the strategic growth council it is a target tax supported rent program and this is a part of transportation housing and infrastructure projects with specific objectives to help support the development of projects thatachieve greenhouse gas reductions in benefit disadvantaged communities. just a word since we been talking quite a bit in recent months about affordable housing and financing for affordable housing and the need for additional funds this application does not include funds for initial affordable housing units. that is because it is really a timing related issue. the 1st affordable housing projects will not begin construction in till 2018 and we want to be able to complete that work within the timeframe set in this year's grant application for the deadlines to expend funds in this years grants. but we do intend to expend for affordable housing funds in future cycles and we have an additional transportation scope that we will be able to include in future applications to bolster affordable housing as well. >>in terms of the scope of the application, the bulk of the improvements that are in the application are in transportation -related infrastructure. the 3 ac transit buses that are required to initiate initial transit service is anticipated to begin in 2019 through bus stops at the mobile homes and this will provide 4.8 miles of bike facilities 4.8 miles of bike facilities and 1.2 miles of additional bike facilities and a new bike share station that would be located adjacent to the ferry shelter. also there is construction of the ferry plaza itself with the seating and landscaping and all of the features that that will include as well as streetscape amenities throughout the initial sub phase areas including lighting, benches, bike racks, wayfinding and other street improvements. and then finally for many of us most excitedly we have been working with tie-dye to develop a concept for the and pull program. this is around tihdi regimen but also around tida regimen and the school. is to work with tihdi and timma for the initial operations of a shuttle program. the applications are due by the end of 20th of june and wewill be accepting any proceeds. >>thank you. let me just say that this program is one of the few state programs available for affordable housing and transportation unfortunately over the years that state has less and less affordable housing programs. i have worked with this program and with the state as this has been developed i'm glad that we are at least putting an application trying to get our share of the funds. we just wish that there was more funding available for the great need that we have in the city as well as all over california. i would like to note that david hsu who is our assemblyman in san francisco is the chair of the housing committee that this department is under so i think you have some good friends in sacramento and i hope that we will be successful with this application. the application just as mr. beck said is just for transportation but really what we are interested in is getting our share of funding in order to be able to subsidize the affordable housing because only through that inclusion of state and possibly federal tax credits are we going to be able to make our housing affordable enough for the people that we want to serve. so certainly i urge your support for this resolution. any comments? >>yes, given the expertise that we have here in the application i think would be very great if you could let us look at the draft so we can see how you put it together the package. one of the things that has already been established that the treasure island issued development of one of 6 projects worldwide in the us that has already been established as a global sustainable community development so there is no other project like that in california or anywhere. so we have that moving forward.tida has spent a considerable amount of time looking at the transportation infrastructure and we are still highly interested in no other project in the bay area can match the emphasis that we are putting into the transportation infrastructure and also the tihdi and the homeless initiative and the initiative on homeless development and housing. with our correspondence, the way we put this application together will be the key. we want to make sure that even given all the items that we have going forward that we had put an emphasis on the application. so, we would like to offer our expertise in helping to make that application a stellar one. okay mr. back? >> thanks kate. >>i think this is a wonderful program and i do hope that we get this 10 1/2 million dollars it would really help us to improve the infrastructure what are those funds already counted in our initial budget assumptions. if for example we do not get this approved, what would happen to the 3 bus stops in the 3 transit buses, what would happen to those? >>most of the scope that is part of this project are developer obligations under the dda. they would then be eligible for reimbursement for the ifd and cfd that are already formed and to the extent thatwe are able to draw more resources to the overall financing program thatprimarily consists of the ift and cfd to the extent that we are able to fully reimburse the tida eligible cost and the other thing at the ifd funds is our public financing program and also at the sea level program. and in the eventthat we get this reimbursement than this would mean that our budgets for these programs would flow to other programs. >>so to the extent that this is growing this could have an impact on several things. >>to the treasure island outreach. >> a tsunami is when 2 waves come together. us do not me is not one wave it is usually more than one wave in this nami is not the largest. it can last for hours and its damaging currents can last for several days. there is also a number of subsequent hazards that can result from a tsunami. there are numerous things that we have to plan for. in san francisco there are distant source, regional source and the resources the nominees. that depends on where we are from where the earthquake occurred.i near source would be like the tsunami that happened off the coast of alaska. we have had 54 tsunamis observed in san francisco since 1850 and in 18 yours it is a very very short of time in geological perspective so even though they are a low probability event they do have a high consequence so that is why we plan for them. we do make sure that we are prepared to handle the consequences. >>we utilize tsunami maps that were utilized by by the state by the ccsf. the maps are a combination of regional source tsunamis. and as you can see the map is entirely in inundation zone. so it's a worst-case scenario. how do we get information to the public? there is an emergency alert system that comes through the radio and television. there is an outdoor siren system and we do test them. there is alertsf which if something happens in the city if you sign up they will text or email you. there is a normal test that we do of our system in a textbased system of the social media that we use like twitter and it was supposed to be just an internal test but it went out to everybody that was described in the system. so within 3 minutes we came to that and we use that as an opportunity to educate people about tsunamis and promote alertsf as a tool. and also we will make mobile announcements if we have time to tell people to evacuate. all of these systems are great for dealing with a regional or a distance source tsunami. in a near source an army where we would have 15 minutes to inundation that would be generated by an earthquakeit would be very significant we know that there would be damage to infrastructure and impacts to personnel that have torun these systems. so, we have plans in place so that we have things in line before this would damage our infrastructure or impact of personnel. and also we would ask that we have evacuation plans to move everyone away from the water. we have a 2016 tsunami annex plan and that focuses on eoc and doc and we have really beefed up the outreach and education plan. there is a separate section in the plan related to treasure island there are some nuances to evacuating the island. we made a recommendation in the plan that ti be afforded priority as far as research allocation because there's so few ways off the allen. we worked with many sources in developing a priority to make a high resource priority plan and we've also worked with the fire and the police in several government agencies to put this plan into place. this is for evacuation only. another thing that we did was we began doing outreach on treasure island to different community organizations. we held meetings in march and april with job core and treasure island community development as well as community developers to talk about outreach strategies to the public and messaging and preparedness information and then just a couple weeks ago in may we did an open house for the public and we had experts they are to discuss emergency preparedness and this summer we will be beginning citywide to replace and augment the evacuation signage that you may see around the city. in treasure island we hope to start signage installations in early july and we have worked with developers so as there is changes in july they can be incorporated in the overall signage plan and they can be incorporated as well. that is all i have for the signage plan i'd be happy to answer any questions that you may have. >>thank you very much. underwater what could happen in these are for the future and god forbid anything would happen today but what if it does happen today or tomorrow? how would we react since we haven't done this? >>i think it will depend on where the synonymy is generated from. if we have 4 more hours we would start evacuating the island as much is possible although it really if everybody gets in a car and tries to get off island it once it would be very difficult so some of our outreach messaging has been around carpooling and people starting to get to know their neighbors as much as possible so that they can drive off the island. we would also encourage people in the messaging that we have done we have a near source tsunami right now you can walk to high ground off of treasure island and with the development even the extension of the bike path when that happens it will be another way for people to walk off the island. so, we are really looking forward to the ferrys and the bike path and the other world methods of transportation. >>if this were to happen tomorrow does wbi have literature to tell them what to do? >>yes. that's why we have the literature that we have to tell them what to do. we have done a synonymy walk on the island of something we've done on other parts of san francisco but we look forward to doing more outreach with other residents for exactly that purpose. because people can only be so dependent on city services. we have to be ready to take actions for ourselves. >>thank you. >>thank you very much amy. when you come here i know that you're having all these and you can't get into the bay how do you evacuate then because in the 1980s treasure island was flooded and it was a nasty experience and i don't know if people in san francisco all remember that. so, what you see is the sea and you don't know where palm avenue is located. it is a very scary experience that we would like to have you come back and make a full presentation and we will make provisions for you to do that and we would like to know in the worst-case scenario where is the plan that you have and if there's not time to evacuate how do people get in if treasure island is san francisco adopted these vision zero policy, where we have committed to work toward the goal of the zero traffic deaths by 2024. we have a long ways to go. every year about 30 people lose their lives and over 200 are seriously injured by traveling on our streets. these deaths and injuries are unacceptable and preventable. vision zero is about city officials, city employees, and community members working together and committing to create safer streets. what is been brought forth for your consideration today is to extend telematics into the majority of our cities leads of more than 3000 vehicles. in the last five years, we have spent nearly $77 million in litigation and settlement directly related to our cities fleet of vehicles. as elected officials, we are charged with an expected to be accountable for a public dollars. this is why last year i directed the budget legislative analyst to produce a report and old a hearing on this report and i was cosponsored by many of you. the benefits shown on this report in terms of safety improvements, savings and environmental benefits are clear. undeniably beneficial and proven. telematics has been used as a correct trained to improve driving habits, decrease inappropriate or unauthorized use, and has shown to have environmental benefits in reducing emissions in many locations in the united states. telematics sometimes are first added a black boxes. it is a technology that has gps along with capacities to collect information and data such as speed, hard braking or acceleration, mechanical diagnosis, could this technology is currently in early 9% of our city's fleet of vehicles. it has already proven to have increase safety by reducing the number of collisions. for example, mta conducted a pilot similar to not technology in one year reduce collisions by 50%. i want to thank the advocates who have the support of this legislation, including lot sf but by coalition the and vision zero coalition. i would also like to thank my staff, erika mae born, we saw this legislation through. now, what i'd like to mention here is that we are not including law enforcement officers at this point because there was some details to be worked out and i didn't want to start this process anymore for the rest of the fleets, but rest assured, i will be working with the-our city administrator google come up with airport in the next few months so we can move forward to include the law enforcement officers in this particular item. to follow legislation should it's critical we work towards our vision zero goals by changing our culture to smart and proven policies and to our language and how we speak about our goals. so, this is the reason i am making a motion for two minor amendment. you have a copy of that and that will be better aligned. these basically are minor language amendments, better align with our vision zero goals. so, on page 1 line 24, to reduce all traffic fatalities, and on page 2, line 13, the word accident, which may not be avoidable, is changed to collisions. so when i talk about accidents could talk about collisions, which we can work to address and reduce. so, colleagues, i hope you will all have heard, as well as the head of our department of real estate, john update, for working on this matter for the last several months. the legislation before you is really an update to chapter 23 of the administrative code that will standardize how the city acquires and conveys real property as well as how we deal with leases. this is modeled in many ways after state and federal law, and will ensure that the city gets at least 100% of the appraiser market value when it sells or leases land. it also provides for third-party appraisal review of appraisers of certain threshold about you could i also think our enterprise departments further engagement on this legislation. as we all know the enterprise components which include the mta, the airport, and public utilities commission have some discretion to conduct a real property transactions on their own outside of the purview of our department of real estate. this legislation provides standard procedures for leases that enterprise the parties enter into without interfering with the core functions of these enterprise departments under the city charter. to that end, i have some brief amendment based on our conversations with court staff which you can find on page 8 of the subject legislation did i previously distributed copies to all of you specifically at page 8, line 7-10, we would like to amend to add the following language quote, unless the executive director of the port determines the real property under cold that the rental rate for the proposal lease meets or exceeds port commissions annually adopted parameter rental rate for such real property, at line 14, on the same page, remove the language, executive director of the port determines applying the market rent requirement would conflict with the port commissions annually adopted parameter rental rate for the proposed leases. that was dealt with in the previous amendment. finally, on line 12 of the same page, add a the language, the board of supervisors on high-resolution lesser a proper public purpose or three, and skip two line 16, commission or agency determines with director of property concurrence that an independent appropriately qualified real estate economic expert is better suited than appraiser to perform the rental analysis. if there's any questions, the representatives of the ports one hand with regard to those amendment. if not i like there is going to be a challenge to hold any property or future property owner accountable to providing a significant level of community benefits without attaching that somehow to a price negotiation and i want to understand how this legislation could impact a project of that nature. >> supervisor peskin: so, first of all, we have counsel here but i do not believe that our chapter 23 provisions apply to ocii, the successor agency and the indeed invoke an appraisal statute under state law as you previously referenced. but relative to an appraisal process, the value of the property is what a knowledgeable buyer would pay a knowledgeable seller based on comparable sales of similar property. if those community benefits were to be deducted from that value you'd have to-derby and appraisal problem and somebody would have to assess the value of those community benefits which presumably would be a deduction from the praise for market value. >> president breed: okay. so if that happens, in the case of the successor agency which definitely has its own process, that happens for example in the case of the city is closing of any assets in the same capacity we are talking about making sure there's clear-there is a clear match to the appraised value though that the city ultimately doesn't lose any money? >> supervisor peskin: corrected ultimately it's a function of how the city through its department of real estate instructs an appraiser. for instance, in the case of what actually started this whole ball rolling 30 van nuys, if the city is demanding that the property include 20% of service to not only the-people but many other types, bows eight chairperson,, thank you for keeping the history of legacy and ongoing struggles of the people alive here in the san francisco bay area region the behalf of the people of the city and county of san francisco, we honor the--tribe diverse peoples of this land this commendation from the board of supervisors. i want to also say that the tribal administrator ms. norma sanchez is also here with us in the chambers thank you to her for joining us today could i respect him is also acknowledge and thank two of chairperson -liaisons in san francisco who represented her really incredibly in san francisco. the late dr. estella jackson who we honored in a previous board meeting, but she can we continue to celebrate and treasure her work on about this piece of legislation, which has been long come on time coming. i want to thank my cosponsor supervisor peskin. i want to thank a very broad coalition that includes a very diverse group of people who normally are not on the same side of this type of an issue. but, how we got here is after a long fight, including a pretty, i think, difficult fight at the ballot, but we decided to do and think about how to address the problems that clearly remain on this issue is to present as we have presented a pretty modest and a pretty simple proposal that essentially, try to preserve san francisco's housing. this legislation in a very simple way, mandates and that what web platforms that engage in short-term rentals reports, not hinder, the enforcement of our short-term rental object again, as a repeatedly have said, it's not about changing the current law. it is simply about enforcing that law. that is what supervisor peskin and i have put forward. also want to thank supervisor mar supervisor avalos for the cosponsorship. this proposal mandates that hosting platforms like airbnb their firehose has registered with the city before advertising their short-term rental on its website. if a hosting platform fails to do so , the platform itself will be penalized for up to $1000 a day . while the current law has set rules for hosts stipulating that all closeness register with the city, more than 75% of airbnb 7000, plus in san francisco have in fact not registered. in fact come up we have only received 1800 applications to open since the launch of the program and that's essentially 26% of the 7000 airbnb hosts we know. short-term rentals that have been issued are 1300 24 or 18.9% of the 7000 host with airbnb to last year's budget analysis report found that airbnb alone has taken up to 2000 entire units of housing, 2000, completely off the market. this is why we need to bring the hosting platforms into compliance. the one thing from our perspective that has been missing in the existing airbnb short-term rental law is corporate accountability. the weakness of the law is that corporate accountability is essentially nonexistent. it's not surprising, given that corporations that ultimately controls a large part of the market is the one that actually broke the law as we know it. i have met with many home shares, and let me say, once again, as we have repeatedly said supervisor peskin and i throughout this process we support capital host, mom and pop hosts, will not be impacted in any way because of this law. we are simply focusing the law and enforcement on the corporations. i want to address a couple of misconceptions about the legislation. some have claimed that the legislation would force platforms to police short-term rentals. that could not be further from the truth. if your rental car agency and you have to make sure the person that you rent that vehicle to actually has a license before you run them a car. that's exactly what we are asking the short-term rental platforms to do here. second, on a huge support of internet freedom and we were carefully not only with the city attorney, but also with online advocacy groups to make sure that this legislation passes legal muster. again, i want to thank the broad range of people who have formed this coalition. again, microsoft or supervisor peskin and his chief of staff sunny
