The resolution has been approved, moving on next agenda item is number 2 which is general Public Comment this is for items not listed on the agenda. There is one zoom comment, one moment. Speaker good evening, commissioner, going to unmute joel, so ill bring joel in here. To joel if you can hear me please unmute yourself and then you have three minutes. Hello. Yes, we can hear you. Okay, great. So ive been communicate withing Entertainment Commission since november 2021 regarding the union blue bar, they were granted a g. M. Permit during covid period where the public was not allowed to have any opinion on their activities. This is a bar who in the same time, they were granted a permit in november of 2020. In that same month they were sued by one of my neighbors for building a unpermitted back yard and making so much noise or disturbing the neighbors. The lawsuit was successful, the question i wonder whether the commission knew that or took that into consideration when they granted this permit into the blue light. Since then, ive been reporting violations as a 60foot distance where they have to not exceed am byyant noise. Its not possible to not receive ampient noise. Ive submitted about 15 complaints, i think two or three have been given notice of violation. But in general my complaints are ignored. And most recently when they were in violation, i was told they were barely in violation, im not sure i understand of that. But because they were in violation, the permit was modified so they can have ambient above level. This is done, because they could not be able to continue their programming and also, satisfy the terms of their jam permit. It seems to me that they should stop operating rather than you should extend the distance of their allowed to make noise to bother the neighbors. I would like this to be changed back to she can only play unamplified music, thats my request. Thank you very much, and we do not respond to Public Comment, its not part of the rules here but maybe Deputy Director can just refresh our memory where were at with blue light. Sure, hi, president bleiman, the comment was accurate, there was an evaluation of jam blue permit. We know that the jam permits are fluid in the sense that we have been amending them, based on changes that are necessary. Recently, there was a determination that the program which the blue light is only allowed to have entertainment on fridays and saturdays with no drums, they self conditioned themselves with no drums. And the other days of the week, theyre allowed to have recorded amplified sound. We did extend the distance at which the entertainment portion is allowed to be heard of which is 100 feet from the property plain so we cannot exceed ampient which is consistent with the other permits that have same programming with live entertainment. Is there any more general Public Comment . No. There does not appear to be more. Well close general Public Comment and well move on to the next agenda item which is approval of the minutes for october 18, 2022 commission meeting. To i have a motion, do we have a motion to approve . Would i like to make a motion to approve the minutes from last meeting. Is there a second. Ill second. Is there any Public Comment on the minutes . There are no Public Comment. Okay, we can vote. President bleiman . Aye. Vice president. Aye. Commissioner tomas. Aye. Commissioner perez. Aye. And commissioner torres. I abstain. Next is a report. Good evening, i do have a large update apologies in advance. Just taking this out of order, i just wanted to welcome our newest commissioner torres to seat 2. Its the board appointed industry seat, so welcome aboard. Were very happy to have you. Justium pg right in, soy wanted to update everybody on our annual survey. The survey did close at the end of october and we received 133 responses. We think this is a good sample size relative to service years. Our last year, we had about 120 responses. Kufrntly organize eyesing and analyzing this data and hell send you key findings in early december and plans to present to all of you at our december 20th hearing. If you want to check out the survey questions again, that is in your folder in the google drive. A shared update for you all tonight and this may be pertain to anybody watching who is a permit holder. Just announced that the deadline to receive the applications has been extend today january 15th from the original november 1 due date. Weve been promoting this new due bait in our e blast and social channels and urging everyone to act now and not wait until the due date to submit their applications. Just to help jog your memory, the permit is a permanent version of the permit that businesses can obtain to replace the pandemic shared spaces permit. The pandemic permits are said to ex tire at the end of the march 2023 and businesses must have a permit in order to operate after the Pandemic Program expires. The jam program which correlates to shared spaces are said to expire on march 31. This means that our jam permit holders have more time to apply for this legislative permit which they need in order to start their process for our brick and mortar. So were working with dpw for approval that are coming through with these spaces so we can align with our processes and continue out reach with our permit holders about their next steps for the transition. We plan to give you more update on this on the 20th of december, along with a proposal for any special hearings that might be needed. We may be able to nannage these with regularly scheduled hearings. But well keep you posted here as we get informed projections around the volume of regular agenda applications. Next update is around next year free program. This was a legislative program that began a year ago and it technically was said to end on october 31. But it was extended just recently to june 30, 2023, so just refresher on this one, this is a program that waved initial application and license fees for new businesses that were starting that were in the last year. So we were able to waive Entertainment Permit application and annual license fees for this program. Amended ordinance also expands eligibility for businesses to increase the gross receipts for a business to qualify for the tax and fee waiver from 2 million to 5 million dollars. Le and it removes the requirement that the business be located on the ground floor. So the board passed this on second reading and its now for the mayor for signing so we anticipate it going into affect shortly. Just for some data in the first year, we were able to waive 14 total permits, including 8 places of entertainment and one billiard partner for a total of 21,471 waved in application fees which we love to hear. Our next update is on the hiring process for vacant 1840 sound inspect or. This is a parttime information, we have identified our candidate and theyre now going through backgrounding. Were really hopeful that we can introduce them to you officially at our Holiday Party which im going to update you about now. So just wanted to give you a little bit of an update about our upcoming hearings here. A reminder that our hearing on thursday december 6 is canceled were having a Holiday Party in place of that. It is going to be similar to last year, pretty cashl. It starts at 5 p. M. On tuesday december 6 and goes to until 7 30 p. M. So were advertising it as a cocktail party. Its a cash bar and there is a password to get in which is in line with the programming of this bar. So we decided on turn tables as the password. Our hearing on thursday january 23, is also canceled due to holiday and well pickup on january 17th. So tonight, december 20th and january 17th are our main hearings coming up. Commission secretary leon will send a schedule of 2023 hearings shortly and will continue to send polls to check on your planned attendance. I also wanted call for attention about emails for required training for commissioners. Please make sure that youre opening your email to see if you received one from leon, there were a few commissioners on the list that were mission mandatory city trainings. Most of them are due bit end of the year. To make sure to complete those as soon as you can, some of them were marked as soon as possible because theyre overdue. And if you dont receive an email, this means that you have done all of your mandatory trainings and you get a gold star. All right, if you have any questions on that, you can contact may directly. Finally, for you this evening, i wanted to let you know that i issued a directors order for sky lark recently, so we received complaints from a near by business about sky lar proposing safety concerns. So an sspd officer and did a complete place of Entertainment Permit and security plan check. Of the 12 security conditions listed, we observed they were in violation of 7 of them at the time. So we issued a citation immediately and held a meeting with the owner of the venue along with admission station to discuss their security plan and Current Operations. In affect, i went ahead and issued a directors order that required skylar to submit a revised security plan to reflect their Current Operations and to ensure spont operations moving forward. Today is the day that that goes into affect. So well be conducting a followup compliance check to the business to ensure that theyre adhering to the security plan conditions. If you have any questions around this update, let me know. And thank you for participating. Very well. This is probably a question for may. The only notice i get from trainings is from Entertainment Commission saying that theyre late. There is no earlier communication that i think ive ever gotten asking about them. This is fissioner this is the first time. I also have not completed them and im sad to hear that one is four hours long. Got it, thank you. Okay, anymore questions . Lfrt is there any Public Comment on this agenda item . There are no Public Comment for this item. All right, we will close this item and move along. The next item is number 5 which is a report from Deputy Director. Thanks, good evening, commissioners. I too have a long update for you, so please settle in. The memo is included in the report, your google folder if you want to follow along are the enforcement updates in the tracker. So the first, thing i want to mention is that we have received 7311 complaints. And i have a few rather large updates for you. Please feel free to ask any questions when were done. The first is about adobe books. They are small coop bookstore and hold a coop. We have learned that their events are staffed by veering volunteers who may not know about the neighbor conditions or policy. Since the pandemic, many have brought out a lot more patrons than expected. It has lead to some complaints and large number of patrons congregating in front of the store. This year we received 6, 31 complaints and visited the business 3 times. We issued them a notice of violation for having their door open while having a band inside. And crowding on the sidewalk. Saw at that time front door was open and by the time he parked, and headed over, the performance was done so he was actually unable to confirm. However, did observe a large crowd out doors. Inspect or spoke with the volunteers who were unfamiliar with their permit education. So we educated and showed them a Good Neighbor policy explaining that theyre responsible for keeping the crowd clear. They were issued a citation for these violations. On november 11th, we received another complaint. He observed a large crowd and a person with a blue tooth speaker playing music outside. And explains the reason for the visit. Asked speaker of the outside was not sponsored by the bookstore but it was clear that it was one of their patrons. The next day, they said that the crowd was so big that it stopped two mini buses and people were climbing all over them. While we did not witness this happening, inspect or did take a video of the crowd. It also shows people having actually walked in the street to by pass the large crowd. And finally i received a email from the permit and that eager to be Good Neighbor and create a safe non bar destination for people to gather. So director wyland and i plan to meet with the leader and discuss strategies as this appears to be the biggest issues. Their events are well attended and their capacity cannot hold all of their patrons. So result, people are handing out in the sidewalk. Please let me know if you have any suggestion buzz this and ill keep you apprised. We have received 38, 311 complaints and visited the business 21 times. We received a smraint saying that their window was open during entertainment. Rm conditions. Ontheir parked vehicles at 12 00 am, the band was still performing inside of the business . So they went inside and they told the owner that their permit requires them to End Entertainment for them. We issued a sieltation for the occurrence as they had just received a notice of violation for the same violation. This is their 4th citation since november 2021 for having entertainment after 11 00 p. M. As a reminder, the business came back to hearing to discuss their on going violations. Namely for operating after 11 00 am. Staff is recommending that you ask them to come back and potential recontinuing as you all see fit. Inspectors have, there is no more education that we can provide and the citations dont seem to make a long term impact on compliance. This business holds llp from our office. Respond today a 311 on november 5, about loud music and he he arrived there was a dj performing inside. Manager indicated that they had a onetime event for that night. Upon our review of our application database, they have not had a onetime permit since march of this year. So they issued a ticket for violation. Next update i want to provide you with is about the mix, as a reminder of the mix has had outdoor amplified sound for the last 30 years. However they were recently approved to make their Outdoor Activity official with our office. On october 5th, you approved to have amplified sound, sunday through wednesday, until 10 00 am and thursday through saturday until 12 00 p. M. Set up a sound limit for their back patio. They have near by residential neighbors. During the sound test, inspectors identified the value limit which they locked into place with their outdoor sound limit at all times. This is a digital of demark ating and vision the permit holding not to turn the knob past the line which we have done before to help management and staff be consistent. Since the business was granted their peo amendment permit on october 5, we received 16 sound complaints on 10 different days and 15 have been anonymous. Its important to note that some complaints specifically gulate, it can squaou. So to solve for this, our inspectors have been check the volume control channel that we mentioned. Next update is about bar parttime, this business also has an llp permit which they use for live entertainment. They also obtain onetime permit that are schedule today go later than 11 00 p. M. Recently have been contacted about their sound and noted the abatement theyve done to the building including suspending their speakers. We did issue them an nov, since then, we have visited the business four more times and have observed full compliance each time. The neighbor is disrupted by the volume of their music and he can hear it when they open the back door. I spoke with one of the owners about the complaint he explained that theyre directly in touch with the neighbor and the practices that they put into place, including sticker garbage bags to muscle the sound of bottles and cans. I also learned that get outside to the back of the building, you have to go through three different doors. And staff was diligent that each door is closed before the next is opened so there is no sound bleed. Yesterday i received an email and im currently in conversation with them about the role of ec and what parttime is doing to be a Good Neighbor. One solution that we plan to try is to test the sound limit from the rear rather than the front since the direction of the sensitive director. The final update for you tonight is about providence located at 51 polk street. This business was formerly known as play land. I want to make you a what ir that another one of our holder thats been making serious allegations about the club stating they are posing a xlaet. Complaint. And supervisor peskins office. They have worked closely with city attorneys and to date we have not substance yated any of them. In january, there was a shooting, the shooter was a customer that was inside providence. They got into alter racing and removed by security. That person went to his car and get a gun and fired shot. The complaint was scared and blamed providence. And it was determined that providence was not at fault for what happened. Following that complaint, we have responded to numerous records. On halloween weekend there was another incident on polk street where they said it was providences fault. However we learned that the incident was not tied to providence. I want to note that the owner team has been very communitive with me. And both sites visit show them to be operating in full compliance with security plan and off limit. We will continue to be responsive to the situation of the appropriate. Ed i make a motion to have stall come in next available. Is it necessary for a motion. I think, yeah, i think. Yeah, not a motion then. Can you remind us too, in a place na repeatedly just does not follow the rules that they say theyre going to follow, how does it escalate . Other than calling them back here which were going to do . Its challenging to take any kind of like suspension action unless we find them to be out of compliance with their sound limit three times in a 90day period. Its usually reconditioning with the commission or coming in for a hearing to do some oversight. Make sense. More questions, anyone . Yeah, is there any Public Comment on the Deputy Directors report. There are no Public Comments. Okay, well close Public Comment. And we can move on. The next agenda item is number 6 which is hearing and possible action regarding application permits under the jurisdiction of Entertainment Commission. Thanks president bleiman, so we have four applications. I would like to note that three of the permit application right side for cannabis and were excited to see more businesses like this applying for. Due to the Zoning District of m it teesing, the entertainment would have to end by 10 00 p. M. Rather than 10 00. I teached out to both emailers, both neighbors and neither responded to me so i was not able to interact with them. So im recommending that they stay in the Consent Agenda this evening. For the one permit which is coast, there were no added conditions from sf tv. So its to vote to approve the Consent Agenda with the staff recommendations below. Questions . All right, do we have a motion to approve the Consent Agenda . So moved. Is there a second. Second. Is there any Public Comment on the Consent Agenda . There are no Public Comment. All right, we can have a vote. President bleiman . Aye. Vice president. Aye. Commissioner perez. Aye. Commissioner thomas. Aye. Commissioner torres. Aye. Can you please remind me where was my dispensary . It was you. I just want to put that on the record. All right, the next is the regular agenda. So the one permit is for cavania roof top. Its inside the luma hotel, one of the owners roofed up a ca kaya, a latin theme cocktail bar that will be opened 7 times a week along with three outdoor terraces on the roof top of the hotel. Theyre applying for the peo to host indoor and sunday until tuesday to 2 00 am. Theyre seeking the ability to occasional entertainment. During the hours of application between 10 00 am and 10 00 p. M. Daily. And as the land use agency, they have approved these requested days and hours of entertainment sound. So youll see them the staff recommendation below. When renovations are complete they will set a internal limit with article 29 sound limit. Based on preliminary research of surrounding residential buildings, staff will be setting the outdoor sound limit at a distance closer. Due to near by sensitive receptors. Our inspectors will make this. In your file youll see a de tailed efforts as they conducted for this application. They hand delivers their out reach let tore 14 businesses so they can speak about their programming plans. There is no opposition for this permit, since writing this memo, i have received a letter of support which is in your file and one standard calendar noticing condition which is included in the staff recommendation. Okay, so here to speak with you is owner john park represented by mark. New commissioners welcomes. Im this is john park, unfortunately anthony park, the park the, anthony john park, anthony park. No parking out there, trust me. He tested positive can for covid today so hes laid up and trying to stay away from people. We do have a present abesing. Thank you for having me here again for an opportunity to to apply for a place for entertainment. Cavana is built in a new hotel in mission bay, luma hotel. Were located in the 17 the floor of this hotel, occupied by entire level, intended to be a celebration of land and culture of all things. Were going to be a shared menu that features a lot of street foods from brazil argentina and peru and mexico as well. Cavana like many culture will be incompasses latin culture and we want to provide that as a part of our experience for our guest. Well have live music as well as djs. We did extensive out reach and theyre very welcoming to the point that theyre new yorking on a daily basis asking when they can come in. So were excited to be in the neighborhood. And bring up, mostly, i think in that neighborhood is not enough Small Businesses but more of the stadium businesses that exist and i think were going to bring a great a little bit of evening and night life culture that will sit well with the neighborhood. Did i not do. Our additional cocktails. Its, its right now, the Creative Process by some of the most talented and ill introduce them shortly after this slide. The cocktail consist mostly of cane and agave. A little bit of our Cocktail Program here. Our food again is highlighting the street foods of central america. And we have arepas which is venezuelaian as well as columbian. A little bit of our menu here. This men has grown since we have developed this menu. Going to be part of our program and sorry that was here. Music entertainment as mentioned. And lastly, myself as well as on the right, anthony parks my partner he has been involved in a lot of high level restaurants as well as, other Cocktail Programs. Which is located in mission star restaurants. On the side is emil i dont, one rising stars in 2019, he was a bombay bartender. And. My executive chef will the head khefr here along with other talented young chefs in the industry. Also executive from cayo roof top bar born in peru and brings a lot of knowledge to south american cuisine. See more and food and cocktail driven program. Thats it. Thank you. Anyone want to open up some questions . I love the presentation. That was a good one. No, i have to say, it makes me really excited just to see this kind of opening happening across the roof top of San Francisco actually. So i feel very excited to see this activate. i appreciate the community out reach in your packet. Im wondering if you can expand from what you have heard from your neighbors, as far as community out reach. Sure. So far, everything positive. We have not this far, we have not received any feedback. There is a long time anticipation of this time being built. The Community Mission bay was mostly empty especially with the stadiums close. To see the vibrant neighborhood come back, its like really excited in the people in the neighborhood. What is lacking right now are more elevated, cocktail and cocktail and bar programming that really exist other than the chase stadium. So theyre excited that were going to be located in this hotel. In addition, they want to make sure that the neighborhood as well as San Francisco bay area that would not hotel just for tourism. Sure, we welcome that tourism but we also want to embrace the local community especially the neighborhood. We have something called Glow Community which is open communities where they enjoy a couple of coffee in the lobby areas, all San Francisco food and bench providing that product to the hotel. And they, they allow the guest, the neighborhood to come in and enjoy, and have whether theyre on a laptop doing a little work or enjoying copy and having a little get together, really embrace the community. We take the same approach in really welcoming the community and making sure that the immediate neighborhood is really welcomed to our space. Thank you, last question. In the event that there is a possible complaint from the neighborhood, what would be our procedure to address that time . Absolutely. We have been down and to stay xhaoum la tiff went around purposingly knocking on doors, myself Contact Numbers and email addresses. The hotel discussed protocols and how we can deal with neighborhood complaints if there is one. But we are definitely, doing the out reach as well as welcoming any communication that they want to provide. Thank you. My pleasure. So, i apparently have a reputation among my commissioners about asking about roof top bars. But, youre only proposing to do amplified entertainment in the indoor area of outside bar except for special Corporate Events and so on. That is correct. All right so what amplification do you have. On speaker, that youll find in bars or restaurant, not nightclub bar. One of the things that we become aware of is that sound travels differently. It has a potential to generate complaints from folks that you would not think necessarily could hear something. Hopefully folks in alameda will not hear this. Well go through testing that the sound is at low levels and not neighbors. 2500 square feet. 3000 square feet. Beautiful glass, 280 views around. You can have a hurricane going and that party can just go. The glass is very thick. And if youre facing south towards the chase center, there is no resident for about 14 floors down which is about 100something feet. And the other side, the biggest terrace is facing nothing but, you know, two miles away on protero mill. Thank you, and one other things, bars are stepping up and getting their staff trained on how to use narcan and stocking narcan which is the medication that reverses opioid and how would you respond to drug overdose. Well be open ho training in all forms. Wonderful, thank you very much. I think im different than commissioner tomas, if somebody is going to hear the sound i hope theyre in alameda because thats is outside of your jurisdiction. Im wondering about the programming that youre planning inside, what do you think . Latin dance, its not top 40, its going to be a little more, that is deeply rooted in south america. In fact, our were going to be salsa, its not geared for parties more like cocktail environment have more music. Thank you, that makes sense. Anyone . Please. Number 1, just reiterate what my fellow commissioners have said. This is a beautiful setting. I regret that i have not gotten inside yet. I also really appreciate your dedication to uplifting latino, latinx, latina culture into that end, i see in back of the house and in your program, cocktail curation and culinary occuration, is there latinx in your staff. And duck tail off what president bleiman said, i would hope that there will be a youth of the local latinx workforce also our the many many many many talented musicians that live here in the city or play here in the city. Absolutely, we as you know, i own kaya roof top as well and celebration of japanese and peruvian. We recently made a lot of contacts local pe ruerian and latin dance that celebrates latin music and their soul. Because of latin music, its up beat and fun and engaging. We want to definitely want to embrace that music versus anything that youll find in nightclub or that is pop or radio. As far as representation, we are except for myself, my chef and my partner is proofing as well. He emelio is venezuela and and they really embrace it. And really embrace the latin culture and food and beverage. I thank you for that. A couple of questions, i had a very extensive security plan which i appreciate. I did notice a few things, one thing that you highlighted the safety of both men and women are equally important. Is there a certain lgbtq competency that youre hoping to employ. I think we have a lot of employees that fall in that category. In fact, everybody is really a Diverse Group of employees. When were fully open, i think were about 75 employees will be working at the establishment. Its important in San Francisco not just in our work place to really recognize the community that sounds us. Rounds us. And everyone that is in the Gay Community as well as Trans Community and everyone else beyond that as well. I have one more question about workers in regards to there is a, there was a plan for if there was a bomb scare which i hope would never happen. And one of the suggestions was that the employees may first try to see if they can find the bomb. And that struck me as maybe i would not want to do it if i was on shift as a bartender or anything like that. That is something that you might look into. If i can, this is on page 9 of any security plan. We do say that a lot of these are fake. It says ask questions, this is what the cops are going to ask you. It does not say look for the bomb. Where is the bomb located, what is in the bomb, how you set it off. This is what the cops want to know to get information. This security plan is just to get the staff sort of thinking about these things. I do i want to say commissioner in the resent days, as we just started our staff training on monday. We were luckily we were able to connect and he shared with me extensive evacuation plans and that, that we implement to our employee handbook as part of the training as well. We, weve just today we discussed how if there was an emergency how we would exit the building and where the meeting points are. These types of demonstration because were in a high profile building and its needed because of the safety of the very small chance that things like this will happen that were taking that and were doing our Due Diligence to train our employees properly. Thank you very much. Absolutely. All right, thank you. Any further questions . All right have a seat and lets entertain motions. This is a limit ~ this is place of argument. My bad. I would like to make a motion to approve with staff recommendations. Second. Spd recommendation about calendaring. Thats included in the staff rec. All right, we have a motion. Is there any Public Comment on this agenda item . There are no Public Comments. All right, seeing none well close Public Comment and we can vote. President bleiman. Aye. Vice president. Aye. Commissioner perez. Aye. Commissioner thomas. Aye. Commissioner torres. Aye. Congratulations, king the roof tops continues into the parks. Moving, on to i believe we have one more agenda item. Comments. Commissioner comments. Welcome commissioner torres, welcome were very happy to have you on board and looking forward to working with you. Any other comments . Lori, you always have something. Do i . Isnt it like heart date. There is got to be ining. Db something. Oh al, go ahead. Well i want to say, that today is American Indian heritage month. In fact there is a celebration right now at the rotunda sponsored by the mayor so happy native american month to everybody. And also happening at the libraries at the official launch of the quarter. Its the 5th coin in the women quarter program. And first asian face on the u. S. Currency. So representation matters. So, check that when you get the coin. Thank you. Thank you. All right, so congratulations on our successful election day. San francisco does elections so well, its something that we should be so proud of. I think were ranked first in the nation on how smoothly our elections go. We just had four. And this one had a lot of twist and turns. Its still surprising us at the end here. That was exciting. All right there any Public Comment . May i make. Oh please. I just wanted to formerly say thank you for welcoming me on board. It was a warm welcome and just be patient with me as i learn the many twists and turns of the commission and codes and everything. And i just hope that can bring what i can from my experience to the better work of this commission and our beautiful and vibrant night life that we have here in San Francisco. Thank you. All right, any Public Comment . There are no Public Comments. All right, well close Public Comment and we can adjourn the meeting at, 6 35 p. M. Thank you, everyone. I have been living in San Francisco since 1957. I live in this area for 42 years. My name is shirley jackson, and i am a retirement teacher for San Francisco unified school district, and i work with Early Childhood education and after school programs. I have light upstairs and down stairs. Its been remodelled and i like it. Some of my floors upstairs was there from the time i built the place, so they were very horrible and dark. But weve got lighting. The room seems lighter. They painted the place, they cemented my back yard, so i wont be worried about landscaping too much. We have central heating, and i like the new countertops they put in. Up to date oh, and we have venetian blinds. We never had venetian blinds before, and its just cozy for me. It meant a lot to me because i didnt drive, and i wanted to be in the area where i can do my shopping, go to work, take the kids to school. I like the way they introduced the movein. I went to quite a bit of the meetings. They showed us blueprints of the materials that they were going to use in here, and they gave us the opportunity to choose where we would like to stay while they was renovating. It means a lot.
