Veronica, our principal Environmental Health inspector of the Site Assessment and Mitigation Program is here and i understand you have a presentation. I do. Theres a slide. It takes a few moments to sync up. It will be on your right. My name is veronica. Im a principal and Environmental Health inspector from the Environmental Health department, department of Public Health and im here from sight mitigation and speaking on Remedial Program which is the vrap and i like to wait a moment for the slides to come up. Through the chair, we see the slide on teams but im not sure why its not showing up television. Oh, there it goes. Thank you so much. So before i begin the overview of the volunteer remedian action plan. I would like to mention this is different from our Health Code Section article 22a which is also known as the mahar ordinance and its different from the super fund heights at Hunters Point shipyard as well as the Treasure Island but with that said, if you have any questions regarding the mahar program, im happy to meet with you separately and answer questions about the program. So the goal of the vrap program is protect Human Health Human environment and return property back to productive use when theres a release of Hazardous Waste within at a property within city and county of San Francisco and the remedial action is required. As the as the title of the program states, its a voluntary basis so its initiated by responsible party usually thats a Property Owner where the waste, release of waste occurred. When they request a local agency to oversee the cleanup. They do have an option to enter this agreement with the state agency so a part of the Program Process is notify the state agency and state has to choose not to oversee the cleanup. But this program, if the state chooses not to oversee the clean up but it then allows the local agency to enter into a written agreement with the responsible party to setup cleanup goals, supervisor remedial investigation and remedial action and once the cleanup goal is reached, we can issue a letter that certifies that the cleanup goals have been met. Just as an example, common the common cases of the vrap is, for example, we have, you know, when theres a gas station and theres a lot of times when theres a property transaction, responsible party tends to seek this, to enter this agreement and that happens when the seller wants a clear and indiscernible known as the no further action letter to show the bank or the buyer that theyve done their Due Diligence and sometimes the bank would really require an nsa letter to provide a loan to the lender. And many times Property Owner wants to voluntary enroll in the information regarding Environmental Health risk, environmental risk is entered to protect the occupant or protect against litigation. A lot of the times these cases tending to less complex and if we do have the local agency communicates frequently with the state agency to get support and a lot of the times the more complex cases tending to referred to the state and the law also allows us to ask for their support if we lack adequate staffing and resources and technical knowledge. To this date, based on our database, we have cases as early as 2001 in our database and i think the total to this state is about 241 cases which equates to around 12 cases per year, so we dont get a lot of these cases but we have been dealing with these cases since 1996. Next slide, please. So, as i mentioned that this isnt a new program. It has been with the city since 1996 and authorized by the heat and safety code through health and safety code through senate bill 1248. There was Assembly Bill 304 that passed and became effective as of january 1, 2022, which changed the definition that requires the local officers to be granted an authority by the cities or counties governing body. Next slide, please. So we would like to be in alignment with this new state law and are coming to you for approval of this resolution. As mentioned, the proposed resolution authorizes the county Health Officer or the Health Officers designee and the department of health of Health Branch or designee to reach into mediation or action through a with the California Health and safety code. My question to you only about, like, enforcement authority. So, from your presentation, i understand that relationship with the state, but what if somebody, you know, enters into an agreement with you and then you know, they run out of money or the situation changes and they dont follow through on the cleanup that your supervisor is there a mechanism to revert it back to state if we dont have the, you no, capacity to do enforcement in that way . Yeah, thank you for that question. Thats a great question. So the health and safety code does not authority the local enforcement agencies to have an enforcement mechanism but state does, so we have there is a mechanism for us to refer that to the state and then the state would utilize their enforcement authority. Is there a drawback in terms of timing of using our own local powers to to supervise this . In a scenario where someone runs out of funds which happens, is there a drawback or does it take longer for state to oversee rather than i cant speak thank you for that question. I cant speak for the timeline of the state or speak for state but a lot of the times, time is one of the factors when the responsible party chooses to come to local agency. Okay. Thank you. Two is a hearing to consider results of waste audits and the implementation of the large refuse Generator Program established by ordinance no. 30018; and requesting the department of environment and city administrator to report. I havent been here in a long time. I tried to let you guys do your work in peace. [laughter] but it was more about trying to stay as far away from certain people, but anyway. Not you, supervisor preston and supervisor melgar. Im going to hop in. A few years ago, we had a goal. A goal in this city to achieve zero waste and our first year in office, we were coming up on that tenyear deadline. We called for a hearing to discuss the citys ability to achieve that goal and how we were going to get to zero waste and achieve some of our environmental goals that were set out at that time. We were very for gnat that San Francisco was fortunate that have was moving more aggressively than other municipalities in achieving . Good success but we called for a hearing to see how much farther we needed to go and how much room there were for improvement in that hearing, we discovered there were a few areas and we done two pieces of legislation to address those two remaining gaps. The first one is the bases for hearing today which are the larger refuge generators and those are the larger entity thats create volume in terms of waste and how they were doing and how they were participating in the same way, everyday san franciscans are. So, what we discovered were the hospitals, the hotels, the universities, the really large apartment buildings both affordable and private market were not actually really participating and in many cases paying the fee to offset what they needed to do in terms of their sorting. So, it was from that time we created legislation. We basically created an ordinance around how large refuse generates were defined and what role they needed to play in terms of participating in our environmental goals. One of the ways in which we measured them was to have every single one of them audited and this is something that happens on a regular basis. Theres auditor thats go out and look at the waste treatment and determine how well they are participating in the program. And so as part of the legislation, all of the different large refuse generator were audited. And those that did not succeed in terms of meeting the threshold that the city had set would then need to, as it was determined, have zero waste sorters or zero waste employees onsite to help participate and that would be for a period of time. Weve called this hearing today to determine how those audits have gone, which large refuse generators or large producers of waste are doing a job, how much more room we need to improve, ones that did not pass, those that did not pass, what they are doing in the meantime. We would like to see how many green jobs have been created. We think this is a green job generator because its helping us meet our environmental goals and folks are participating on the front lines, actually sorting and what wed learned from the department of environment in the industry is actually at the source of where the refuse is generated, where the trash is generated or where the waste is generated, thats the best place to sort and determine what streams. Just for the public edit any when you put it into compost, it creates methane gas and detrimental to the environment so we want to avoid putting things that could be composted into the waste or recycling stream and we want to ensure what we are putting in recycling stream is recyclable and not getting into the landfill so we can reuse it. I want to thank director ju and his team and the department of environmental. They are going to have information for us today. We also have claudia from the realestate department and hillary near from the department of environment on director jus team and talking about the progress of the ordinance and i can, through the chair, hand it over to director ju and then we can open up for some questions and comments. Were before you to report on our first three years of implementation of this ordinance, how things have gone over the first three years and what is next. Im joined by my colleague, our zero waste coordinator hillary who will do the second part of the presentation. I can put where the waste fits into our Climate Action plan. At this commit as this committee knows, we have a bold goal to reach of zero emission by 2024.
