afternoon to you as well and thank you for being here. let me offer my congratulations to supervisor and peskin on his election to represent district 3 and i look forward to working with you supervisor, on housing and affordable affordability issues. any other needs for the neighborhood and the city need as well. congratulations. also, i want to take a moment to address the topic that has been on the minds of many san franciscans. as you know, last week there was an officer involved shooting that resulted in the death of mario was, a san francisco resident. i would like to say that i take any officer involved shooting extremely seriously and sodas are chief of police. we all are community and the family a full and transparent investigation without delay and there are at least three separate open investigations going on right now. i met with community leaders and members of the board after the shooting. i would like to reassure the people of san francisco that lethal force is always a last resort. the men and women of our police department dedicate their lives to protecting people and building trust with the community,, and they too, deserve more alternatives to de-escalate conflict. so, under my direction cheap-is taking specific immediate action to ensure officers have more options to resolve situations with a minimum use of force. i've also directed the police commission to do a thorough review of existing policies to make it clear that the department's policy in using lethal force is a last resort. i commit that we will take all necessary action, steps, to vet these kinds of incidents to ensure public safety, protect the lives of our young people and maintain officer safety. i also look forward to working with all of you to tackle the challenges of homelessness. without a doubt our city it changed many lives for the better. the best evidence of our work are the 20,000 formerly homeless people, now living indoors independently and with social and emotional support that they need in our city or back in their hometowns. we have pioneered models of care but the navigation center, which in just nine months has successfully moved more than 250 people off the street and into healthier settings. but while we house and served homelessness unfortunate thousands of homeless unfortunately, they are replaced by new house listed people fall into homelessness for number of reasons and they need our help. last week i announced a goal to help at least 8000 people out of homelessness forever over the next four years. we will do this by stabilizing people's lives through our nationally recognize housing and service programs. and by building a system to prevent homelessness or any persons homelessness before becomes chronic. i will create a new department to keep homeless residents permanently -allow and help homeless residents permanently exit the streets and move into housing and services. while over the last 20 years we've increased spending on homelessness, we've done that because the crisis worsened. but because we did not have a central department for homelessness we later program upon program across dozens of independent departments. no one agency's mission was to solve homelessness. so, i want to fix that. what greater coordination, we will expect better outcomes, better results, more efficiencies and a deeper accountability. i look forward to working with all of you to make sure we remain the city of st. francis and help our most vulnerable. thank you. peter thank you mr. mayor. alex, before we moved to our consent agenda, i would like to take a quick point of privilege. today, we are joined by a new and an old colleague supervisor aaron peskin representing district 3. supervisor peskin, lawmakers say congratulations and welcome. you ran a phenomenal campaign and i think we can all agree that those people know i supported supervisor christiansen, but i was no one thing. no matter how the election turned out no matter who won, districts rate would have a smart capable supervisor dedicated to serving the district and dedicated to serving the city. so, i know you will prove me right on that. he supported me when i first ran for supervisor in 2012 when a lot of other people would not and that is always meant a lot. we had our disagreements since then, but whatever has come between then and now, i'm proud to call you my colleague. i'm eager to partner with you on our priorities, with the best legislation, and i look forward to working with you. so welcome aboard supervisor peskin and the rest of my colleagues can make comments about welcoming you during roll call for introduction. speaking >> thank you mdm. pres. and thank you for the opportunity to say a few words. i never actually expected to be back in this room, at least not as an elected supervisor. the fact that i am, i think, is evidence of the depth and seriousness of our affordability crisis, particularly our housing crisis. the rents are too high. home prices are off the charts. too many people are being either good and we all know that too many people are homeless. i sincerely appreciate the efforts of everyone in this building that are being made to address this crisis, but i think the message of this election is clear. city government hasn't been doing enough to ease this crisis and there's much more that we can and should do. we have a mandate to take bold action on affordable housing, and i look forward to working with each and every one of you to fulfill it. i strongly support the idea of increasing the requirement for affordable housing including middle-class housing, low and very low income housing. of course, we have to go to the ballot to change this, but as we've seen with supervisor kim's work there's no need to wait until june or november. there's plenty we can do right now as we recently saw mdm. pres., when you are legislation. we can and we should insist on mandating higher rates of affordability, and let's not get supported by false and divisive political trade-offs that some special interests would put in front of us to distract us from our real mission. i strongly support petitioning our elected state leaders to push, not just for reform, but as i said at the beginning of this campaign, to amend the cost of hawkins act so that rent control can be expanded to apartments, built after 1979. as we build more, the new buildings we build should afford the same legal protections against eviction and exorbitant rent hikes that current buildings have, or else, we will have what we have now, a two tiered system with some renters having more rights than others. i think that is unacceptable. i realize that we don't have the power to amend the cost of hawkins act here, but like so many progressive changes that have emanated from san francisco we can begin to the conversation here and i'll be offering a resolution urging the state legislature to amend cost a hawkins. we need to dramatically increase affordable housing requirements for projects built on public land. these are currently negotiated between developers and housing advocates in private talks. they should be a matter of public discussion and regulation. i'm very proud of the work that supervisor kim has pioneered in these chambers and put before the voters of san francisco. to that end, colleagues, i'm going to respectfully suggest that we all consider voting to reject the sale of the city's property at 30 dan s today at our board meeting. we can and should getting a much higher percentage of affordable housing at this site as well is a higher dollar amount. we must also address the needs of nonprofits, artists and small business by creating affordable office space and new developments, similar to our existing inclusionary requirements for affordable housing. we need to significantly increase our efforts to address homelessness and mr. mayor, i guess the mayor is not here-but i am pleased to see the renewed commitment from your administration, and look forward to working with you and that my colleagues here on the board to lessen this crisis. i want to thank the people of district 3 further support and for repudiating the hyper money fueled politics of negativity and personality, rather than the politics of issues, the politics of affordability, and livability. i want to thank the many many volunteers and campaign supporters for incredible work. thank you to so many of you for coming today. >>[applause] >> thank you for your sustainability fee is a spinning application of the transit impact development fee. with exceptions by the transportation sustainability fever means operative making clarifying amendment to the finder you. colleagues, first of all i want to say welcome to supervisor peskin. and just remarking on the words that you said about taking bold action on housing, but affordability. i also think we have to thank bold action on transit and transportation. the transit system fee has not been am i believe, will be worked on as well as it really should have. we have had discussions that lasted lengthy amount of time. both in committee and on the board of supervisors. as i have said before i thought we had left a lot of money on the table about what we could actually charge for the fee that would go for transportation projects in san francisco. so, i know that this version that's before us today had a few amendment made that were sent back to committee that made it stronger relative to hospitals and grandfathering projects that were submitted before before july 1, 2015 for the noncommercial site. that's what i want to make sure we can support today and build on today. but i would also do, i would like to do separate from the boat of before us is to duplicate this file so we can continue to have discussions about how we can actually maximize our dollars for transportation that the fee would allow and what i'd like to do is to propose the we actually on noncommercial properties, that are over $99,999 square feet that we can increase that by two dollars. originally i requested that increase it by four dollars. this is a compromise amendment to actually make sure that we can maximize what is available for transportation projects. when we look at the planning department and did a study about the impacts about these noncommercial high-rise properties would be on transportation, what we see is that were well below what are these are i can to mitigate the impacts that are going to happen on a transportation system. so, we are well below what the old real cost of building is in san francisco. the planning department, the planning commission also looked at the fiscal fees this ability of these projects as well as to raise the fee. the two dollar increase still keeps us well below the planning commission has recognized as a 10% threshold that would make projects no longer feasible. a two dollar increase would actually put us at these 7% well below the 10% threshold. so, this is not something i spent that we can vote on today, but i want to duplicate the file and include these amendments as well as a grandfathering in of nonresidential projects that were submitted both before july 1, 2015 or july 21, 2015, but have not had the final approval yet. they would charge the difference of 50% between the key idf-so whatever that differences, they would not be paid the full amount of difference but 50% of that difference for projects that were in the pipeline before july 21, 2015 but not yet been approved. that itself would achieve about $8 million more in one time funds for transportation projects and, given our tremendous needs in transportation in san francisco, it makes a lot of sense that we actually do what we can to get these projects initially feasible but also to do right by the people who are relying on transportation to mitigate the impacts that these projects will have by raising duffy and grandfathering in certain projects. so, what i would like to do is to maketo duplicate the file. without the one that is on today to vote on and we'll duplicated file, i would like to amend and have a motion. advocacy we can as a city and a committee as a whole in january to discuss the new amendment that i would like to make today. >> avalos, do you have a copy of those amendment that you can circulate to the full board and give us time to review them? >> i do. what we can do if you like we can do further this item delay on the agenda to and point out this is the second reading of a duplicate file of the test as to send back to committee so we could memorialize a few-immortalize a new fee structure for hospitals and medical services. this actually comes after weeks of conversation. and please report the full board at the full board meeting, that we had reached an agreement with the nonprofit hospitals to contribute to our transportation system and in the initial proposal, if you recall, all hospitals were 100% exempt from pain both on new hospitals as well as medical services facilities. but, as a result of our negotiations, the duplicated ordinance we have on the second reading divorce has been amended i won't go over those amendments get him sure you're familiar with them, but i want to assure you of new hospital and medical services have an impact on our transportation. i think we all are in agreement with that. i want to also take a moment, again, to thank our city staff. at risk and,-the tori weiss, john ram as well as david-and the members of the hospital counsel. to put it frankly, i think we have struck the right balance in ensuring hospitals and medical service the saudis articulating to our transportation system while also reckon i think they provide an important public and event. i understand-that's it. thank you permits. colleagues i do help to have your continued support on this item? >> supervisor campos >> i do want to thank supervisor cohen that she did on the hospital piece and i think that work takes a great deal of sense. i think it is struck the right balance. i think that what supervisor avalos is proposing makes a great deal of sense. the last time that we talked about this item i will note that given our own study am a that we have left hundreds of millions of dollars on the table. so, we have a situation here that development is clearly impacting public transit, public transportation come up and the city is choosing not to charge developers the-the fact of the impact they are having. so to me tapping as a committee is aware we collectively as a board come back to this to have an open, honest conversation about what the real impact of development on transportation is, makes a great deal of sense. given that we did leave a lot of money on the table and we have a new member of the board, i think giving him the opportunity to come back and look at that issue makes a great deal of sense. so i will be supporting that effort? speaking supervisor speed task and >> i just want to second supervisor avalos on the to greater file. >> are pretty clear. just to reiterate, it's an increase in nonresidential fee for footage over 99,000 hundred 99 ft.2. toby at two dollar increase. still well below what it initially feasible as measured by the planning commission and is well below overall impact that cost these projects will have an our transportation system. the other amendment is for nonresidential projects that submit an application before july 21, 2015 but have not yet received final approval. they shall pay 50% of the difference between the current fee they are paying, and the psf. so, that would affect the handful projects but overall, it would bring in about $8 million according to the planning department. i was told to my legislative aide. that would be one-time money. the two dollar fee of course would be ongoing revenue coming for. so, colleagues, i would like your consideration for this file. we can amend-we can actually have duplicated file. we can amend these amendments and we can forward it to the full board we can have a goat guillen whether we can accept these. whether we as a committee as all we can do that as a committee as all we can do that in january 13, the leaf, is our first board meeting in january.? january 12 speech of january 12. at that point if people disagree with the amendment they can vote them down. if they agree they can vote them up. to me it gives us another chance were maximizing the amount of dollars that we can put together for the transportation system that is overtaxed by congestion and lots of facilities, especially in major parts of san francisco that are very transit oriented. >> so can you clarify why the committee as a whole month and not specifically to land use? >> i would prefer that we actually engaged at the full-bodied. >> okay. so, in order opposite economic and workforce developed enforcement provisions.? supervisor cohen >> thank you. good afternoon everyone. colleagues, this legislation you have that were dealing with here is the result of months of calmer station with representatives from the labor segment of our community, office of labor standards as well as the mayors office of housing. really, this ordinance would prevent up local wage for the sale and lease of city-owned property for the purpose of developing mixed use housing projects. currently, the city requires all contractors performing public works projects improvements to pay up or billing wage comply with state apprenticeship programs and if the contract is over $600,000 comply with our local higher policy. however, these policies are not always required when the city is selling or leasing its property for the moment by third-party. so, earlier this year, the board submitter surplus property measure to voters reiterating our belief that the city surplus properties should be used whenever possible to construct affordable housing. but it is also essential that we ensure that these projects are being constructed to the same employment requirements and standards that we have of our own public works contractors. so, i really want to take a moment and thank the members of the building and construction trades council work with my office on this issue. as well as donnie leavitt. she'd been incredible. i don't see her out here-there she is. this woman certainly deserves an award from the office of labor standards and enforcement. also may, i don't know. you too, my friend deserve an award. you both have provided incredible feedback that has been helpful instrumental in helping us shape this policy. so colleagues and i ask for your support on this measure and again want to acknowledge my staff that worked on helping this craft this. speaking speaking speaking supervisor wiener? i want to thank supervisor cohen and farrell but her leadership on this legislation. prevailing wage in addition to local higher air pressure program are really key in terms of making sure were lifting people up into the middle class, pain people wages and benefits on which they can actually live in this expensive city. making sure that we are also focusing first and foremost, on her own residence and our own young people to give them opportunities to go into the trades, to make a good wage, and to make lives for themselves and for their families in this city. so, again thank you to my colleagues for their leadership on embraced by major parts of our city government. i really want to thank mayor lee for his work on it over the years and making sure that the major focus of his administration. it is been doing wonders for san francisco neighborhoods to ensure that not just getting workers from neighborhoods on projects now land on city property. but we are also recycling local dollars into local economies. that is this. weave an opportunity to uplift and pay homage and respect to an incredible city employee. ms. alina wolfe, who is the second director of the san francisco rent board she is retiring this month, ladies and gentlemen. killeen has spent more than half her life that the reported she joined the department in 1982. katie, i don't know how you will work your probably like two years old. that just goes to show you that you been with us for a very long time and we value you. when you come up to the podium? folks, you heard in many of the remarks earlier from supervisor peskin to supervisor avalos, were always talked about the cost of living in the city. i want you to know the rent ordinance has been amended a mere 92 times since the day that killeen wolf walked into the door. 92 times. she began her rent board career as a worker making only $16,000 a year and now she's finishing her career as the executive director, overseeing as a worker making only $16,000 a year and now she's finishing her career as the executive director, overseeing a $6.9 million budget. she worked herself up through the length ranks holding almost every position in the agency and also serving for 25 years as a secretary to the rent board commission which, i understand, is the absolute favorite part of her job. she is revered by the commission., door by staff and respected throughout the landlord and tenant communities, which is faithfully served the past three decades. please join me in congratulating wolf on her retirement. >>[applause] >> thank you so much supervisor. i actually had something very nice to say about each and every one of you but i did deference to pres. breed's request to speak less than five and is in you all i know long-winded acne but the good news is going to listen to me for too much longer. i just want his aides and absolutely my honor and privilege. i had a job where i got paid a professional staff to do what i consider social justice work with the best of the last two weeks. his name is esau archives, and many of you read about him in the news. every now and then we encounter everyday people whose heroic action truly capture us. life affords us these moments when we can be heroes. some of us take those opportunities and really decide to take it on. esau is one of those people. this is one of those moments. on the afternoon of monday on the afternoon of monday, november 23 esau was riding his delivery bike down market street and noticed a group of people screaming around a bus shelter between fifth and sixth. a woman was crouching on the when he dropped his bike and ran to her he found that the reality was even more heartbreaking. the woman was having a baby at the bus shelter. he literally took a close up of his back and quickly wrapped the newborn baby that was on the ground to keep the baby warm and how the baby to his chest into the police officers and fire department responded arrived. he saw as a local hero. he stumbled upon an emergency and without hesitation took action. it would've been just as easy for them to step back and watch as many others did, but he made a split-second decision to act and probably saved this newborn babies like. i'm really excited to honor he saw today and i'm really glad they were able to make it here with your beautiful wife and your daughter .. well he has a daughter as well. what a wonderful father to have. also, we know there are many people in the communities also want to reckon eyes you as well. so, we do have one of our homegrown businesses, san francisco-christian and andy were good enough to donate a sweatshirt to you and we've also heard through the grapevine the 49ers have welcomed you to a game and also with a chance to blow the horn to signal the start of the meet pope francis, and to do so for the purpose of advocating for immigration reform and for immigrants to be treated with respect and dignity. in a day when donald trump is heard talking hatefully about immigrants, that these women have the courage to speak up for the rights of immigrants is something we should be very proud of. they are tireless work helps give a voice to millions of immigrants throughout this country where struggling to secure the human rights that all of us deserve. with a certificate of honor we simply want to say thank you. are your efforts. thank you for for. this is katie tang speaking at today's a bittersweet day because were saying farewell to and henson. executive director the apartment of aging adult services at the human services agency and trent-director of hsa. director hinton has served in this role since 2005. a career helping seniors spans more than 40 years. our work has included positions of the director of home care, care management and fiduciary services for the institute on aging. director of aging services for san francisco's catholic charities, and director of the south san francisco senior services. she also has experience as a lecturer and teacher in the field of gerontology. as executive director of-she's responsible for the departments for divisions in some support services, protective services, office of long-term care, and office of aging and veteran services. director hinton has been working tirelessly to make sure the apartment of aging and adult services is a central place for information and counseling and a referral among many other things. some highlights of her. director hinton successfully oversaw the merger of-the human service agency. she helped develop a robust community based service of care system for sentences go seniors and adults with disabilities. she's an amazing leader in her field both statewide and nationwide. old import officer positions in both california association for area agency on aging and the national association for area agencies on aging. katie tang speaking again i personally witnessed how under director hints of leadership san francisco's been a pioneer in the way we serve seniors and adults with disabilities. for example, our office recently worked with her through a new program designed to better serve seniors or mobile and need access to helping the ill. this program utilizes existing restaurants as partners and seniors can go out in the community and enjoyed healthy meals with family and friends at either free or highly reduced rates. i can't think of a better advocate for a senior community and director hinton. her last official day with the department sadly, december 16 and director hinton, congratulations on your retirement. we wish you all the best in your years had. thank you so much for your contribution to our city. that's from katie tang. i just want to add, director hinton has been amazing in efforts to end hunger and food insecure security for seniors to address the needs of people with disability in addition to seniors so that those are intertwined in what we do for services for people. i also want to say she'd been a champion of aging in place programs and villages that are spreading throughout this country but especially building upon next village and supervisor peskin's district to golden gate village, which is just started in mind, and sf village in many others. willie, allowing seniors to support one another with mutual support and an organic ways develop networks, neighborhood by neighborhood as well. so, i want to thank her for visionary leadership and amazing work for many years with our community-based organizations and our department of aging and adult service. on behalf persons. so here's our proclamation whereas, beth burns served as program director for sunday streets where she helps grow the events of a fledgling experiment in to a beloved san francisco institution that celebrates recreation, community activity, and fund in neighborhoods across the city and whereas, as a board member of young workers united bath helped immigrant san francisco workers in the service industry organized to improve working conditions including passing san francisco's first in the nation paid sick days ordinance which is actually a model for many cities around the nation, whereas, beth burns has contributed to the vibrancy of the bernal heights community to her service as secretary and vice president of the bernal heights ever the board and leadership in making fiesta on the hill the huge success, and whereas, as a member of the steering committee of the san francisco league of voters pissed off voters, beth burns produce voter guides that educated and gave excited young loar in san francisco and whereas references also a gifted graphic designer who is generously donated her services to many worthy causes, including design the sidewalk plaque that will second appeal only if the board of hole boldly eir. if the board rejects the eir then we will take no additional action on the warriors project today. then, we have more pieces of legislation related to the project to which need to be voted on after the appeals if we affirm the eir and the subdivision map. so, clerk, at this time can you please call items 57 and 60 and i will then recognize other colleagues.? board of supervisors met the sitting and governing board of the successor agency to the former the development agency for public hearing of persons interested in the certification of the final subsequent environmental impact report for the proposed golden state warriors event center and mixed-use to bauman project in mission bay south box 29-32. the constitutes vatican says of a multipurpose mixed-use event center including office retail open space, and parking on approximately 11 acre site in the mission bay south redevelopment area plan. i'm 58 is a motion of the board of supervisors acting in his capacity as a governing body to the successor agency to affirm the commission on community investment and infrastructure certification of the final subsequent environmental impact report. i'm 59, bush and reversed the commission certification of the eir. i'm 60 motion directing the preparation of findings reversing the commission certification of the fs eir.? colleagues, for this eir appeal were functioning as a governing body of the successor agency to the former redevelopment agency. so, this is a-this hearing will be wholly separate from the tentative subdivision map appeal hearing in which we will be functioning as the board of supervisors. so, we have before us an appeal of the final subsequent environmental impact report certification for the warriors project. our consideration of the appeal involves our analysis of the adequacy, accuracy, and sufficiency and completeness of the environment impact report. without objection, we will proceed as project has been through a very lengthy process, the reengaged process. one that has evolved quite dramatically. including with a very dramatic decision last summer to change their point of location. while its new location in mission bay and particularly in the district that ira present, needs widespread support i look forward to listening to our staff, the city and appellants around concerns around traffic congestion, environmental impact, and the process that took place to bring this arena project before us. i have been really-i want to express some acknowledgment and thanks to our city step did i know this has been white a complex project. it's not an easy thing or everyday action to bring in arena and entertainment stadium to a city. it certainly is very complex and whether huge impact both on the neighborhood and the city. i think that this process through the appeal will really allow us to delve into some these important issues in terms of how we can make this work within the fabric of our neighborhood. so, without further ado i like to turn the floor over to our appellants. >> thank you supervisor kim. with that, i'll be appellants to come forward. you will have 10 min. >> thank you, supervised. good afternoon my name is tom lippi represent the mission bay alliance. this environmental impact report is very competent even date loosed with paper. spend a few minutes that we have here is an appellant to try to supply a couple of the issues. this eir with respect to transit impact hhas serious deep flaws. i've some graphics i think might assist in bringing those two lights. if i could ask the clerk, i'd like to pass these graphics out. they were sent by e-mail but you might not have had a chance to download them. if you want to look at them, i have copies for all supervisors.? deputy clerk will pick those up and hand them out. >> alas sfgtv to switch to the overhead please. what i'm showing you is-is not coming through very clearly on your overhead projector, but with this graphic shows is that the eir is carefully drawn the study area for the project assessment of traffic impacts to avoid a host of other study areas that are contained in the eir and negative declarations. brother projects south of market and downtown areas of san francisco. so, what you have here is kind of a funny looking polygon that is clearly designed to avoid into sucking with other projects study areas and south of market and these other projects are manifold. there are lots of other projects that in recently approved or in the pipeline now. you're the 5m project to 22 second project 706 mission st. price. 801 brandon project. and the list goes on. so, there's a lot going on here in san francisco both in terms of construction and operational impacts because all these projects increased traffic or change traffic patterns. now, the next graphic this is map number one in your pocket, the next graphic is map number two. again, the overhead is not very clear, but what you can see there is the northern portion of that strange looking polygon, the blue one, this project study area. it is targeting intersections which is why about long arm of it pointing north up toward harrison street. but what all those red dots are, the intersections surrounding the polygon, which is the bay area, which are either at level of service e or level of service f which is severely impacted already. so the study area is clearly designed to avoid encompassing those. why? because small changes make a big difference when you already have a significant impact. this part of san francisco is severely impacted with traffic and has been for years. is that my office on bryant and second street so i know it intimately. especially since the giants moved in. now you're going to add to that both in terms of number of days where you have those kinds of conditions and the number of-increase in severity of those conditions when you have an overlap between games between different teams. the next traffic which is method number three, brings us to aid assessed together and you can see these other projects are smack dab in the middle of all these sf and e intersections. the severity of the impact is another the problem with this eir. i have another graphic which i can see now on the screen is not very useful. let me just tell you what it says. the eir provide some summary tables for impacts. it tells you that many intersections are going to ls which is level of service f which is severe. it doesn't tell you how bad it gets after it gets to f because above f or worse than f you about figure greater than 80 seconds of delay per vehicle. when you go to the premises you go find out those numbers are much higher but the body of eir does not show that. so people reading the eir are being misled into thinking that all the impacts are just around the same which is 80 but what this shows when you have an evening game, basketball game at the 16th and mississippi intersection, give actually 107 seconds. we have two games to 1/82. almost 3 times as much for twice as much as 80. so, this problem of a little change makes a big difference to the eir has skirted around the problem by selectively presenting information and selectively studying the impacts. now, one of the other comments that we had made is that the eir underestimates the number of people arriving at the gains in the peak hour of the pm period between 5-6. if so not because it assumes only 5% of the people were coming to again or even will be traveling in that time or not. but it admits for a 7:30 pm game 11% of those people are going to get there between six-6:30 pm. it excludes them from the five-6 pm period time period. it's completely illogical to think those people dramatically turned up at the turnstile without having had to travel during that peak period. so we've created a traffic simulation to illustrate a point in consequence, where you have those 11% of the people added to the 5%, you have 16% and mr. dan smith traffic consultant that i've consulted is going to narrate the video. mr. smith, if you could come do that at this point.? i'm going to >> i'm going to turn on the video so if the sfgtv people speak of it on. >> >> it's on. >> what we have here, dan smith smith engineering management union city california for the record. despite here is a simulation of traffic using mostly the topic scenarios from the eir. the intersection of 16th, seventh and mississippi's on the left of the simulation. 16th and third is on the right. 16th and owens, 16th and fourth in between. the project is at the upper right in each clip. the hospitals across third street. the caltrain tracks in the amber at the left. blue dots are cars. we would white backs are large trucks. buses are magenta teal and green depending on whether they are regular services or special event services. in the upper clip is the baseline scenario for the eir. that baseline scenario includes the assumption of the 22 fillmore priority lanes. most of you are aware my things down there in the peak period now work fairly well. when you take away two of the lanes on 16th st. to create the bus priority lanes, the traffic situation deteriorates, and you will notice on the screen, we've created as if you could look straight through the eye 283 freeway and see the traffic running underneath beneath six street. as i said, when the 22 fillmore project is implemented,, things get more difficult. the middle clip includes the project with the warriors game, but no giant skin. you can see how the big bills northbound on third. picu actually extends several blocks off the screen. sometimes westbound 16th is totally backed up to third, all the way from the railroad tracks and also there are long queues, each on 16th approaching seventh. so, that's a more severe situation than the assumed existing baseline condition in the eir but the eir does not distinguish. finally, the clip at the bottom reflects the scenario that tom mentioned it instead of just the 5% of people who pass through the arena turnstiles in the pm peak hour,-instead of just the different transportation modes. so, the traffic in this area is very busy. it would still build a large-scale parking lot in this area it will worsen the traffic dramatically. in the event of a large-scale catastrophic emergency,, how can we handle that? i hope when you do the city planning, please put the human life in the first place. please stop constructing such a large sport center and black caucus of state legislators with a big issue is economic violence. which is reduced black wealth by 53% in the past seven years. this is a local example of the economic violence. 45% of black workers in san francisco lie on public transit to get to work. this project severely compromises [inaudible] to earn a living. but generally, with preferential treatment for private shuttles. there affect me personally but are very concerned about a couple things. one being what other speakers have spoke to get another one is nurses actually getting to work and the ability for the relief to come. who's got the paint for their overtime, whose cannot be the state of california when the relief is not able to reach the hospital when the other nurses are stuck in traffic? then, the other issue that bothers me so much is that the traffic is going to be very congested country i used to work admission date and i really truly cannot imagine a mother and sick child stuck in the car watching your child deteriorate when you're trying to access the emergency room because there's so much congestion. that is the part that i think no illness you can't put a price tag on that to take now anyway. we met personally. so, i'm actually here to speak about the traffic congestion issue. i am just wondering, where the studies came from, who did the studies that actually make it appear as if there's some way to mitigate the traffic situation? i'm not sure what time frame they live in or what level of reality there on them about the people who think they can do anything about it when they have done nothing but make it worse is for the last four or five years i don't think the public trust them to mitigate any. therefore we encourage you to support this appeal. thank you.? thank city. but transit vehicles themselves are often mired in traffic. the reason is, we have too many cars in san francisco. one project that is very highly rated by the regional federal agencies promises to alleviate part of the problem. that is the downtown extension of how tran from fourth and king street to the new transit terminal. that project has been extensively vetted. it's been engineered. it's been environmentally clear. it's on the federal start list. however, recently, there has been a move or idea that is surfaced to relocate the couch when track to third street partially perhaps to support the warriors project. this is a very bad idea. they will move this project way down the federal list and perhaps even eliminate the possibility of moving the project forward. i urge you not to rely on any transit contributions from moving the caltrain track two thirds should get it's a nonstarter. it's not going to happen. rather, i urge you to help get this project funded so that once the transit center is completed and bus traffic starts in 2017, we can move seamlessly into phase 2, which is construction of the downtown extension of caltrans. thank you. >> thank you. next speaker, anything that we can in this city do that three bart lines don't already do wonderfully well. $80 million improvements supposedly will not add or fix or beat three bart lines. while $80 million is prepared the new light rail cars for muni are losing eight seats. i find this is-it does not sit well. it's in the wrong place. it's not downtown under market street or around markets to get it's not caesar chavez. the tidbit on television at the end of the baseball season on one of the little tidbits of news we got, a gentleman said he interviewed a woman who is taking her four-year-old son to the appointment at mission bay. they took a half hour to get through baseball traffic. add the giants development, just a block down, we've got 1500 units of housing them a 11,000 jobs in office buildings. so, there's can be a whole bunch of new people going back and forth, again, not with the bart system where three trains are coming in serving the whole bay area. if this was on bart, i would be more inclined to go for it. the vulnerability of the day is also another issue. i want to see the burn. last week we did 75 howard. how are we going to protect us from the water rise? lots of and gridlock and pollution to an area that's already suffering from it make it harder for people to get around on the bus, on foot, on bikes in their cars. whatever it might be. even more than that, i'm just appalled you consider putting this by hospital. this is for doctors and nurses to heal their patients. for them to not be will to get there for their families families not be able to get their children and have to worry there's no way-anyway i think that's terrible. >> thank you. next speaker, please. >> i am [inaudible]. i have lymphoma and i assume you're familiar with lymphoma. it's important that my family and people that work with me can get to the hospital. i love the warriors. i really do. i'm excited that they're 22-0. it's amazing. but i think you might need to take more time to look into this. [inaudible]. thank you very much. >> thank you. next speaker, please. >> thank you. good afternoon. my name is susan. i'm a longtime resident of san francisco. for the moment decision to? but i thought it was important to share my view. i'm a big fan of the warriors and were having a great time right now. obviously. but, i don't feel that this stadium or event center, as you're calling it, is really a right fit for san francisco. we had talked about too much noise, too much traffic, and it's way too close to the children's hospital. the stadium is supposed to be 1000 feet from the emergency room, which looks like it could be great major problems right there. i really feel that it's just the wrong place for the event center, and thank you for allowing me to speak. >> thank you. next speaker, please. pet >> mining the subject basin, professor of anesthesia at ucsf. achieve it anesthesia at the san francisco general. my thoughts are that well stressed by many people, but working at the county i know meet axis is absolutely essential. i cannot see how that will happen here. thank you. >> thank you. next speaker, please. >> my name is gloria judd. i live in basically i lived in san francisco since 1960. i worked most my adult life at ucsf on parnassus in the neonatal intensive care and i retired in 2007. i'm here to give a voice to the critically ill infants who are in the end en route to ucsf which is a hospital. many of these babies are extremely low birth weight, as small as one and 2 pounds and very premature, 24-25 we frequently. dependent on ventilators. some are unstable in the ambulance and require and ventilated with these time is everything and they need to get the hospital for emergency care that they so desperately need. since there's minimal parking provided for the warriors arena, it is suggested that fans use public transportation and i feel this is discriminating towards senior citizens and disabled persons. the initial proposed site at pier 30 was dropped because of the concerns about local and tourist traffic and block abuse for residents who live on the waterfront. but now, it is considered okay to build a sports arena directly across the street from a hospital that treats the sickest of the sick patients and takes the risk of impacting negatively the quality of life of a child. i just don't get it. homeland security has made it very clear that sports arenas by the number one target. >> 27 seconds >> homeland security has made it very clear that sports arenas are the number one target for terrorist events in our country. if there was a major event at the proposed arena it would be impossible to activate the sick infants out of the hospital and out of the area in a timely manner. i do not believe that there is any other sports arena in our country that is located directly across from the hospital.? thank you. next speaker, please. >> >> next speaker, please. >> a lot of great people are here today. mission bay lights thank you for showing up. we would hope aaron peskin would be. [inaudible] are fighting a price. the resident of the troll hill. that state the facts. mission bay is a very tranquil place at this moment. as i heard on the tbd other night, about the new arena rvs come as genuine. i have the g1 set arena there like we don't want that arena there. think about it. joe talmage will not want you arena. all that traffic coming through there, it's tranquil. we got the fresh air. me, a person who likes to run, about these people want to get out, the elderly or run on the track around third street. all that pollution. the environmental. so, i appeal to to grow decisively like we fought for the kaiser project breakdown the quote. it was just a little thought they relocated. the arena should not be built right there at that spot. all the congestion is going in that one strip in that area. mr. avalos he likes to ride a bike. that's what we need more bicycle riding it we don't need that congestion. we don't need the arena. think about that. think about it. there's a lot of people who would probably show up today but i would like to speak on their behalf. we do not need that arena in that area there. the mission bay alliance we should be applauding them today. think about it. they're part of ucsf. there's a fashion that does not want. >> thank you. speed next speaker, please. >> good afternoon pres. breed and members of the board of supervisor on susan graham holly. i'm a member of the mission bay alliance legal thing and i'm here to talk a few minutes or 2 min. exactly, about the ceqa problems with this project. we received a lot of information from us and for many many people about very technical but very real environmental problems with the proposed arena. because there are significant impacts, because of the proximity to the uc medical center, because of the fact that the land use in this area is carefully planned and did not include an arena, it's very very important that the city consider alternatives. ceqa has both procedural and substantive rules. the procedure has not been gone through pushing and eir, getting comments, etc. it's a substance that's the real reason behind ceqa. the point is to look at environmental impacts of the project impact will be significant to see if there's a way to mitigate that. the alternative is in the eir is therefore the very most important part of one of the most parts and here is not a minor error. it's a major error. eir did not locate any potentially feasible off-site alternatives. not one. it is required by law. there were some sites rejected but they were not studied so that does not take care of the problem. the only site in the eir was the pier 30, 32 site that's been rejected it is infeasible or the warriors would've proceeded there. so pretend it's potentially feasible and satisfy ceqa's requirements to look at alternatives to see, is there way to commerce this arena, with less impact, without doing that you're doing a disservice to the warriors team itself and to the people of san francisco. you should amend the eir and look at off-site alternatives. at least one. >> next speaker, please. >> good afternoon. my name is martin lee and i am [inaudible] i submitted about four years ago with a letter from pres. obama. i am here today because i was also a part of a demonstration 17 years ago when william hanks and was shocked at point blank range in the back of the head on by the san francisco police department here we are, again, another young african-american senselessly killed. i mean, the mission bay project is admirable. i'm sure it's greatly needed, we had all these people demonstrating for the injustice that african-american people face every day. we probably would not be here today. i'm sure that stadium is going to be built, but how many of our people are going to be here to watch it? we don't know because it seems like we're under attack and deputy gains, [inaudible] she served the city of san francisco for three years, with a smile. you would never know she lost her own child, and nothing. what is it going to take for people to wake up? education is at the foundation,, the very core, the everything we believe in, but if everyone is not getting the same level high level of education how are we going to grow and develop as a society? i'm going to be here as much as i can because it's of vital now. we are under attack. and nobody is fighting for us. not even our own people. they don't even fight for themselves because they're not educated enough to know. we can't place blame about this and that. that's not going to do a bit of good.? should we move to the next speaker >> okay. next speaker, please. will come back when we get it fixed >> my name is jennifer wade did i live in the mission and six years ago my son was born at uc with a congenital heart defect and can use to receive treatment at ucsf today. it's about okay this arena project would create massive traffic jams in the area around us today on a regular basis. this would be a public health disaster for city children. ucsf is the only nationally ranked children's hospital in the city of san francisco only children's hospital that treats rare condition such as my sons. my son's condition carries a 75% lifetime risk of return. if you would have a stroke prior to it-estimate stuck in traffic with the need to be diverted to a different hospital could mean the difference between a full recovery and permanent disability or even death

afternoon to you as well and thank you for being here. let me offer my congratulations to supervisor and peskin on his election to represent district 3 and i look forward to working with you supervisor, on housing and affordable affordability issues. any other needs for the neighborhood and the city need as well. congratulations. also, i want to take a moment to address the topic that has been on the minds of many san franciscans. as you know, last week there was an officer involved shooting that resulted in the death of mario was, a san francisco resident. i would like to say that i take any officer involved shooting extremely seriously and sodas are chief of police. we all are community and the family a full and transparent investigation without delay and there are at least three separate open investigations going on right now. i met with community leaders and members of the board after the shooting. i would like to reassure the people of san francisco that lethal force is always a last resort. the men and women of our police department dedicate their lives to protecting people and building trust with the community,, and they too, deserve more alternatives to de-escalate conflict. so, under my direction cheap-is taking specific immediate action to ensure officers have more options to resolve situations with a minimum use of force. i've also directed the police commission to do a thorough review of existing policies to make it clear that the department's policy in using lethal force is a last resort. i commit that we will take all necessary action, steps, to vet these kinds of incidents to ensure public safety, protect the lives of our young people and maintain officer safety. i also look forward to working with all of you to tackle the challenges of homelessness. without a doubt our city it changed many lives for the better. the best evidence of our work are the 20,000 formerly homeless people, now living indoors independently and with social and emotional support that they need in our city or back in their hometowns. we have pioneered models of care but the navigation center, which in just nine months has successfully moved more than 250 people off the street and into healthier settings. but while we house and served homelessness unfortunate thousands of homeless unfortunately, they are replaced by new house listed people fall into homelessness for number of reasons and they need our help. last week i announced a goal to help at least 8000 people out of homelessness forever over the next four years. we will do this by stabilizing people's lives through our nationally recognize housing and service programs. and by building a system to prevent homelessness or any persons homelessness before becomes chronic. i will create a new department to keep homeless residents permanently -allow and help homeless residents permanently exit the streets and move into housing and services. while over the last 20 years we've increased spending on homelessness, we've done that because the crisis worsened. but because we did not have a central department for homelessness we later program upon program across dozens of independent departments. no one agency's mission was to solve homelessness. so, i want to fix that. what greater coordination, we will expect better outcomes, better results, more efficiencies and a deeper accountability. i look forward to working with all of you to make sure we remain the city of st. francis and help our most vulnerable. thank you. peter thank you mr. mayor. alex, before we moved to our consent agenda, i would like to take a quick point of privilege. today, we are joined by a new and an old colleague supervisor aaron peskin representing district 3. supervisor peskin, lawmakers say congratulations and welcome. you ran a phenomenal campaign and i think we can all agree that those people know i supported supervisor christiansen, but i was no one thing. no matter how the election turned out no matter who won, districts rate would have a smart capable supervisor dedicated to serving the district and dedicated to serving the city. so, i know you will prove me right on that. he supported me when i first ran for supervisor in 2012 when a lot of other people would not and that is always meant a lot. we had our disagreements since then, but whatever has come between then and now, i'm proud to call you my colleague. i'm eager to partner with you on our priorities, with the best legislation, and i look forward to working with you. so welcome aboard supervisor peskin and the rest of my colleagues can make comments about welcoming you during roll call for introduction. speaking >> thank you mdm. pres. and thank you for the opportunity to say a few words. i never actually expected to be back in this room, at least not as an elected supervisor. the fact that i am, i think, is evidence of the depth and seriousness of our affordability crisis, particularly our housing crisis. the rents are too high. home prices are off the charts. too many people are being either good and we all know that too many people are homeless. i sincerely appreciate the efforts of everyone in this building that are being made to address this crisis, but i think the message of this election is clear. city government hasn't been doing enough to ease this crisis and there's much more that we can and should do. we have a mandate to take bold action on affordable housing, and i look forward to working with each and every one of you to fulfill it. i strongly support the idea of increasing the requirement for affordable housing including middle-class housing, low and very low income housing. of course, we have to go to the ballot to change this, but as we've seen with supervisor kim's work there's no need to wait until june or november. there's plenty we can do right now as we recently saw mdm. pres., when you are legislation. we can and we should insist on mandating higher rates of affordability, and let's not get supported by false and divisive political trade-offs that some special interests would put in front of us to distract us from our real mission. i strongly support petitioning our elected state leaders to push, not just for reform, but as i said at the beginning of this campaign, to amend the cost of hawkins act so that rent control can be expanded to apartments, built after 1979. as we build more, the new buildings we build should afford the same legal protections against eviction and exorbitant rent hikes that current buildings have, or else, we will have what we have now, a two tiered system with some renters having more rights than others. i think that is unacceptable. i realize that we don't have the power to amend the cost of hawkins act here, but like so many progressive changes that have emanated from san francisco we can begin to the conversation here and i'll be offering a resolution urging the state legislature to amend cost a hawkins. we need to dramatically increase affordable housing requirements for projects built on public land. these are currently negotiated between developers and housing advocates in private talks. they should be a matter of public discussion and regulation. i'm very proud of the work that supervisor kim has pioneered in these chambers and put before the voters of san francisco. to that end, colleagues, i'm going to respectfully suggest that we all consider voting to reject the sale of the city's property at 30 dan s today at our board meeting. we can and should getting a much higher percentage of affordable housing at this site as well is a higher dollar amount. we must also address the needs of nonprofits, artists and small business by creating affordable office space and new developments, similar to our existing inclusionary requirements for affordable housing. we need to significantly increase our efforts to address homelessness and mr. mayor, i guess the mayor is not here-but i am pleased to see the renewed commitment from your administration, and look forward to working with you and that my colleagues here on the board to lessen this crisis. i want to thank the people of district 3 further support and for repudiating the hyper money fueled politics of negativity and personality, rather than the politics of issues, the politics of affordability, and livability. i want to thank the many many volunteers and campaign supporters for incredible work. thank you to so many of you for coming today. >>[applause] >> thank you for your sustainability fee is a spinning application of the transit impact development fee. with exceptions by the transportation sustainability fever means operative making clarifying amendment to the finder you. colleagues, first of all i want to say welcome to supervisor peskin. and just remarking on the words that you said about taking bold action on housing, but affordability. i also think we have to thank bold action on transit and transportation. the transit system fee has not been am i believe, will be worked on as well as it really should have. we have had discussions that lasted lengthy amount of time. both in committee and on the board of supervisors. as i have said before i thought we had left a lot of money on the table about what we could actually charge for the fee that would go for transportation projects in san francisco. so, i know that this version that's before us today had a few amendment made that were sent back to committee that made it stronger relative to hospitals and grandfathering projects that were submitted before before july 1, 2015 for the noncommercial site. that's what i want to make sure we can support today and build on today. but i would also do, i would like to do separate from the boat of before us is to duplicate this file so we can continue to have discussions about how we can actually maximize our dollars for transportation that the fee would allow and what i'd like to do is to propose the we actually on noncommercial properties, that are over $99,999 square feet that we can increase that by two dollars. originally i requested that increase it by four dollars. this is a compromise amendment to actually make sure that we can maximize what is available for transportation projects. when we look at the planning department and did a study about the impacts about these noncommercial high-rise properties would be on transportation, what we see is that were well below what are these are i can to mitigate the impacts that are going to happen on a transportation system. so, we are well below what the old real cost of building is in san francisco. the planning department, the planning commission also looked at the fiscal fees this ability of these projects as well as to raise the fee. the two dollar increase still keeps us well below the planning commission has recognized as a 10% threshold that would make projects no longer feasible. a two dollar increase would actually put us at these 7% well below the 10% threshold. so, this is not something i spent that we can vote on today, but i want to duplicate the file and include these amendments as well as a grandfathering in of nonresidential projects that were submitted both before july 1, 2015 or july 21, 2015, but have not had the final approval yet. they would charge the difference of 50% between the key idf-so whatever that differences, they would not be paid the full amount of difference but 50% of that difference for projects that were in the pipeline before july 21, 2015 but not yet been approved. that itself would achieve about $8 million more in one time funds for transportation projects and, given our tremendous needs in transportation in san francisco, it makes a lot of sense that we actually do what we can to get these projects initially feasible but also to do right by the people who are relying on transportation to mitigate the impacts that these projects will have by raising duffy and grandfathering in certain projects. so, what i would like to do is to maketo duplicate the file. without the one that is on today to vote on and we'll duplicated file, i would like to amend and have a motion. advocacy we can as a city and a committee as a whole in january to discuss the new amendment that i would like to make today. >> avalos, do you have a copy of those amendment that you can circulate to the full board and give us time to review them? >> i do. what we can do if you like we can do further this item delay on the agenda to and point out this is the second reading of a duplicate file of the test as to send back to committee so we could memorialize a few-immortalize a new fee structure for hospitals and medical services. this actually comes after weeks of conversation. and please report the full board at the full board meeting, that we had reached an agreement with the nonprofit hospitals to contribute to our transportation system and in the initial proposal, if you recall, all hospitals were 100% exempt from pain both on new hospitals as well as medical services facilities. but, as a result of our negotiations, the duplicated ordinance we have on the second reading divorce has been amended i won't go over those amendments get him sure you're familiar with them, but i want to assure you of new hospital and medical services have an impact on our transportation. i think we all are in agreement with that. i want to also take a moment, again, to thank our city staff. at risk and,-the tori weiss, john ram as well as david-and the members of the hospital counsel. to put it frankly, i think we have struck the right balance in ensuring hospitals and medical service the saudis articulating millions of dollars on the table. so, we have a situation here that development is clearly impacting public transit, public transportation come up and the city is choosing not to charge developers the-the fact of the impact they are having. so to me tapping as a committee is aware we collectively as a board come back to this to have an open, honest conversation about what the real impact of development on transportation is, makes a great deal of sense. given that we did leave a lot of money on the table and we have a new member of the board, i think giving him the opportunity to come back and look at that issue makes a great deal of sense. so i will be supporting that effort? speaking supervisor speed task and >> i just want to second supervisor avalos on the to greater file. >> measured by the planning commission and is well below overall impact that cost these projects will have an our transportation system. the other amendment is for nonresidential projects that submit an application before july 21, 2015 but have not yet received final approval. they shall pay 50% of the difference between the current fee they are paying, and the psf. so, that would affect the handful projects but overall, it would bring in about $8 million according to the planning department. i was told to my legislative aide. that would be one-time money. the two dollar fee of course would be ongoing revenue coming for. so, colleagues, i would like your consideration for this file. we can amend-we can actually have duplicated file. we can amend these amendments and we can forward it to the full board we can have a goat guillen whether we can accept these. whether we as a committee as all we can do that as a committee as all we can do that in january 13, the leaf, is our first board meeting in january.? january 12 speech of january 12. at that point if people disagree with the amendment they can vote them down. if they agree they can vote them up. to me it gives us another chance were maximizing the amount of dollars that we can put together for the transportation system that is overtaxed by congestion and lots of facilities, especially in major parts of san francisco that are result of months of calmer station with representatives from the labor segment of our community, office of labor standards as well as the mayors office of housing. really, this ordinance would prevent up local wage for the sale and lease of city-owned property for the purpose of developing mixed use housing projects. currently, the city requires all contractors performing public works projects improvements to pay up or billing wage comply with state apprenticeship programs and if the contract is over $600,000 comply with our local higher policy. however, these policies are not always required when the city is selling or leasing its property for the moment by third-party. so, earlier this year, the board submitter surplus property measure to voters reiterating our belief that the city surplus properties should be used whenever possible to construct affordable housing. but it is also essential that we ensure that these projects are being constructed to the same employment requirements and standards that we have of our own public works contractors. so, i really want to take a moment and thank the members of the building and construction trades council work with my office on this issue. as well as donnie leavitt. she'd been incredible. i don't see her out here-there she is. this woman certainly deserves an award from the office of labor standards and enforcement. also may, i don't know. you too, my friend deserve an award. you both have provided incredible feedback that has been helpful instrumental in helping us shape this policy. so colleagues avalos, were always talked about the cost of living in the city. i want you to know the rent ordinance has been amended a mere 92 times since the day that killeen wolf walked into the door. 92 times. she began her rent board career as a worker making only $16,000 a year and now she's finishing her career as the executive director, overseeing as a worker making only $16,000 a year and now she's finishing her career as the executive director, overseeing a $6.9 million budget. she worked herself up through the length ranks holding almost every position in the agency and also serving for 25 years as a secretary to the rent board commission which, i understand, is the absolute favorite part of her job. she is revered by the commission., door by staff and respected throughout the landlord and tenant communities, which is faithfully served the past three decades. please join me in congratulating wolf on her retirement. >>[applause] >> thank you so much supervisor. i actually had of the last two weeks. his name is esau archives, and many of you read about him in the news. every now and then we encounter everyday people whose heroic action truly capture us. life affords us these moments when we can be heroes. some of us take those opportunities and really decide to take it on. esau is one of those people. this is one of those moments. on the afternoon of monday on the afternoon of monday, november 23 esau was riding his delivery bike down market street and noticed a group of people screaming around a bus shelter between fifth and sixth. a woman was crouching on the ground, people were screaming and there was blood everywhere. esau immediately got off his bicycle does he thought she had been stabbed it although there was a god he knows no one was doing anything. when he dropped his bike and ran to her he found that the reality was even more heartbreaking. the woman was having a baby at the bus shelter. he literally took a close up of his back and quickly wrapped the newborn baby that was on the ground to keep the baby warm and how the baby to his chest into the police officers and fire department responded arrived. he saw as a local hero. he stumbled upon an emergency and without hesitation took action. it would've been just as easy for them to step back and watch as many others did, but he made a split-second decision to act and probably saved this newborn babies like. i'm really excited to honor he saw today and i'm really glad they were able to make it here with your beautiful wife and your daughter .. well he has a daughter as well. what a wonderful father to have. also, we know there are many people in the communities also want to reckon eyes you as well. so, we do have one of our homegrown businesses, san francisco-christian and andy were good enough to donate a sweatshirt to you and we've also heard through the grapevine the 49ers have welcomed you to a game and also with a chance to blow the horn to signal the start of the football game. which is incredibly excited i see the warriors are here as well. there nodding their head. i think there's a ticket waiting. >>[applause] >> our national champion team that is now 22-0. meet pope francis, and to do so for the purpose of advocating for immigration reform and for immigrants to be treated with respect and dignity. in a day when donald trump is heard talking hatefully about immigrants, that these women have the courage to speak up for the rights of immigrants is something we should be very proud of. they are tireless work helps give a voice to millions of immigrants throughout this country where struggling to secure the human rights that all of us deserve. with a certificate of honor we simply want to say thank you. are your efforts. thank you for today. we have an amazing >> speak a little softer mar. just kidding >> we have an amazing dedicated senior advocate leader, or leader on behalf of seniors. i like to ask if andrew hinton can come for. this is katie tang speaking at today's a bittersweet day because were saying farewell to and henson. executive director the apartment of aging adult services at the human services agency and trent-director of hsa. director hinton has served in this role since 2005. a career helping seniors spans more than 40 years. our work has included positions of the director of home care, care management and fiduciary services for the institute on aging. director of aging services for san francisco's catholic charities, and director of the south san francisco senior services. she also has experience as a lecturer and teacher in the field of gerontology. as executive director of-she's responsible for the departments for divisions in some support services, protective services, office of long-term care, and office of aging and veteran services. director hinton has been working tirelessly to make sure the apartment of aging and adult services is a central place for information and counseling and a referral among many other things. some highlights of her. director hinton successfully oversaw the merger of-the human service agency. she helped develop a robust community based service of care system for sentences go seniors and adults with disabilities. she's an amazing leader in her field both statewide and nationwide. old import officer positions in both california association for area agency on aging and the national association for area agencies on aging. katie tang speaking again i personally witnessed how under director hints of leadership san francisco's been a pioneer in the way we serve seniors and adults with disabilities. for example, our office recently worked with her through a new program designed to better serve seniors or mobile and need access to helping the ill. this program utilizes existing restaurants as partners and seniors can go out in the community and enjoyed healthy meals with family and friends at either free or highly reduced rates. i can't think of a better advocate for a senior community and director hinton. her last official day with the department sadly, december 16 and director hinton, congratulations on your retirement. we wish you all the best in your years had. thank you so much for your contribution to our city. that's from katie tang. i just want to add, director hinton has been amazing in efforts to end hunger and food insecure security for seniors to address the needs of people with disability in addition to seniors so that those are intertwined in what we do for services for people. i also want to say she'd been a champion of aging in place programs and villages that are spreading throughout this country but especially building upon next village and supervisor peskin's district to golden gate village, which is just started in mind, and sf village in many others. willie, allowing seniors to support one another with mutual support and an organic ways develop networks, neighborhood by neighborhood as well. so, i want to thank her for visionary leadership and amazing work for many years with our community-based organizations and our department of aging and adult service. on behalf very humbly but getting a lot of work done and beth has been one of those persons. she's just been a real inspiration wherever she is working. we have a proclamation today that all the numbers of the board of supervisors signed, but did not vote books on but i think the signatures themselves are enough to make today beth burns day and in fact, there was already a lot of people saying congratulation you today for being that burns day and i want to make sure that we can have you in the board chamber to celebrate you here today. it's also been bittersweet for me knowing that you will be leaving us to move on to oregon o we loose a lot of really great families in the city and there many people who are are going to miss you and just seeing you everywhere. so, i'm one of those persons. so here's our proclamation whereas, beth burns served as program director for sunday streets where she helps grow the events of a fledgling experiment in to a beloved san francisco institution that celebrates recreation, community activity, and fund in neighborhoods across the city and whereas, as a board member of young workers united bath helped immigrant san francisco workers in the service industry organized to improve working conditions including passing san francisco's first in the nation paid sick days ordinance which is actually a model for many cities around the nation, whereas, beth burns has contributed to the vibrancy of the bernal heights community to her service as secretary and vice president of the bernal heights ever the board and leadership in making fiesta on the hill the huge success, and whereas, as a member of the steering committee of the san francisco league of voters pissed off voters, beth burns produce voter guides that educated and gave excited young loar in san francisco and whereas references also a gifted graphic designer who is generously donated her services to many worthy causes, including design the sidewalk plaque that will commemorate the childhood home of jerry garcia that will be in san francisco now, therefore be it resolved with the city signature volume members of the board of supervisors we declare today beth while its new location in mission bay and particularly in the district that ira present, needs widespread support i look forward to listening to our staff, the city and appellants around concerns around traffic congestion, environmental impact, and the process that took place to bring this arena project before us. i have been really-i want to express some acknowledgment and thanks to our city step did i know this has been white a complex project. it's not an easy thing or everyday action to bring in arena and entertainment stadium to a city. it certainly is very complex and whether huge impact both on the neighborhood and the city. i think that this process through the appeal will really allow us to delve into some these important issues in terms of how we can make this work within the fabric of our neighborhood. so, without further ado i like to turn the floor over to our appellants. >> thank you supervisor kim. with that, i'll be appellants to come forward. you will have 10 min. >> thank you, supervised. good afternoon my name is tom lippi represent the mission bay alliance. this environmental impact report is very competent even date loosed with paper. spend a few minutes that we have here is an appellant to try to supply a couple of the issues. this eir with respect to transit impact hhas serious deep flaws. i've some graphics i think might assist in bringing those two lights. if i could ask the clerk, i'd like to pass these graphics out. they were sent by e-mail but you might not have had a chance to download them. if you want to look at them, i have copies for all supervisors.? deputy clerk will pick those up and hand them out. >> alas sfgtv to switch to the overhead please. what i'm showing you is-is not coming through very clearly on your overhead projector, but with this graphic shows is that the eir is carefully drawn the study area for the project assessment of traffic impacts to avoid a host of other study areas that are contained in the eir and negative declarations. brother projects south of market and downtown areas of san francisco. so, what you have here is kind of a funny looking polygon that is clearly designed to avoid into sucking with other projects study areas and south of market and these other projects are manifold. there are lots of other projects that in recently approved or in the pipeline now. you're the 5m project to 22 second project 706 mission st. price. 801 brandon project. and the list goes on. so, there's a lot going on here in san francisco both in terms of construction and operational impacts because all these projects increased traffic or change traffic patterns. now, the next graphic this is map number one in your pocket, the next graphic is map number two. again, the overhead is not very clear, but what you can see there is the northern portion of that strange looking polygon, the blue one, this project study area. it is targeting intersections which is why about long arm of it pointing north up toward harrison street. but what all those red dots are, the intersections surrounding the polygon, which is the bay area, which are either at level of service e or level of service f which is severely impacted already. so the study area is clearly designed to avoid encompassing those. why? because small changes make a big difference when you already have a significant impact. this part of san francisco is severely impacted with traffic and has been for years. is that my office on bryant and second street so i know it intimately. especially since the giants moved in. now you're going to add to that both in terms of number of days where you have those kinds of conditions and the number of-increase in severity of those conditions when you have an overlap between games between different teams. the next traffic which is method number three, brings us to aid assessed together and you can see these other projects are smack dab in the middle of all these sf and e intersections. the severity of the impact is another the problem with this eir. i have another graphic which i can see now on the screen is not very useful. let me just tell you what it says. the eir provide some summary tables for impacts. it tells you that many intersections are going to ls which is level of service f which is severe. it doesn't tell you how bad it gets after it gets to f because above f or worse than f you about figure greater than 80 seconds of delay per vehicle. when you go to the premises you go find out those numbers are much higher but the body of eir does not show that. so people reading the eir are being misled into thinking that all the impacts are just around the same which is 80 but what this shows when you have an evening game, basketball game at the 16th and mississippi intersection, give actually 107 seconds. we have two games to 1/82. almost 3 times as much for twice as much as 80. so, this problem of a little change makes a big difference to the eir has skirted around the problem by selectively presenting information and selectively studying the impacts. now, one of the other comments that we had made is that the eir underestimates the number of people arriving at the gains in the peak hour of the pm period between 5-6. if so not because it assumes only 5% of the people were coming to again or even will be traveling in that time or not. but it admits for a 7:30 pm game 11% of those people are going to get there between six-6:30 pm. it excludes them from the five-6 pm period time period. it's completely illogical to think those people dramatically turned up at the turnstile without having had to travel during that peak period. so we've created a traffic simulation to illustrate a point in consequence, where you have those 11% of the people added to the 5%, you have 16% and mr. dan smith traffic consultant that i've consulted is going to narrate the video. mr. smith, if you could come do that at this point.? i'm going here is a simulation of traffic using mostly the topic scenarios from the eir. the intersection of 16th, seventh and mississippi's on the left of the simulation. 16th and third is on the right. 16th and owens, 16th and fourth in between. the project is at the upper right in each clip. the hospitals across third street. the caltrain tracks in the amber at the left. blue dots are cars. we would white backs are large trucks. buses are magenta teal and green depending on whether they are regular services or special event services. in the upper clip is the baseline scenario for the eir. that baseline scenario includes the assumption of the 22 fillmore priority lanes. most of you are aware my things down there in the peak period now work fairly well. when you take away two of the lanes on 16th st. to create the bus priority lanes, the traffic situation deteriorates, and you will notice on the screen, we've created as if you could look straight through the eye 283 freeway and see the traffic running underneath beneath six street. as i said, when the 22 fillmore project is implemented,, things get more difficult. the middle clip includes the project with the warriors game, but no giant skin. you can see how the big bills northbound on third. picu actually extends several blocks off the screen. sometimes westbound 16th is totally backed up to third, all the way from the railroad tracks and also there are long queues, each on 16th approaching seventh. so, that's a more severe situation than the assumed existing baseline condition in the eir but the eir does not distinguish. finally, the clip at the bottom reflects the scenario that tom mentioned it instead of just the 5% of people who pass through the arena turnstiles in the pm peak hour,-instead of just the black caucus of state legislators with a big issue is economic violence. which is reduced black wealth by 53% in the past seven years. this is a local example of the economic violence. 45% of black workers in san francisco lie on public transit to get to work. this project severely compromises [inaudible] to earn a living. but generally, with preferential treatment for private shuttles. there affect me personally but are very concerned about a couple things. one being what other speakers have spoke to get another one is nurses actually getting to work and the ability for the relief to come. who's got the paint for their overtime, whose cannot be the state of california when the relief is not able to reach the hospital when the other nurses are stuck in traffic? then, the other issue that bothers me so much is that the traffic is going to be very congested country i used to work admission date and i really truly cannot imagine a mother and sick child stuck in the car watching your child deteriorate when you're trying to access the emergency room because there's so much congestion. that is the part that i think no illness you can't put a price tag on that to take now anyway. we met personally. so, i'm actually here to speak about the traffic congestion issue. i am just wondering, where the studies came from, who did the studies that actually make it appear as if there's some way to mitigate the traffic situation? i'm not sure what time frame they live in or what level of reality there on them about the people who think they can do anything about it when they have done nothing but make it worse is for the last four or five years i don't think the public trust them to mitigate any. therefore we encourage you to support this appeal. thank you.? thank city. but transit vehicles themselves are often mired in traffic. the reason is, we have too many cars in san francisco. one project that is very highly rated by the regional federal agencies promises to alleviate part of the problem. that is the downtown extension of how tran from fourth and king street to the new transit terminal. that project has been extensively vetted. it's been engineered. it's been environmentally clear. it's on the federal start list. however, recently, there has been a move or idea that is surfaced to relocate the couch when track to third street partially perhaps to support the warriors project. this is a very bad idea. they will move this project way down the federal list and perhaps even eliminate the possibility of moving the project forward. i urge you not to rely on any transit contributions from moving the caltrain track two thirds should get it's a nonstarter. it's not going to happen. rather, i urge you to help get this project funded so that once the transit center is completed and bus traffic starts in 2017, we can move seamlessly into phase 2, which is construction of the downtown extension of caltrans. thank you. >> thank you. next speaker, anything that we can in this city do that three bart lines don't already do wonderfully well. $80 million improvements supposedly will not add or fix or beat three bart lines. while $80 million is prepared the new light rail cars for muni are losing eight seats. i find this is-it does not sit well. it's in the wrong place. it's not downtown under market street or around markets to get it's not caesar chavez. the tidbit on television at the end of the baseball season on one of the little tidbits of news we got, a gentleman said he interviewed a woman who is taking her four-year-old son to the appointment at mission bay. they took a half hour to get through baseball traffic. add the giants development, just a block down, we've got 1500 units of housing them a 11,000 jobs in office buildings. so, there's can be a whole bunch of new people going back and forth, again, not with the bart system where three trains are coming in serving the whole bay area. if this was on bart, i would be more inclined to go for it. the vulnerability of the day is also another issue. i want to see the burn. last week we did 75 howard. how are we going to protect us from the water rise? lots of and gridlock and pollution to an area that's already suffering from it make it harder for people to get around on the bus, on foot, on bikes in their cars. whatever it might be. even more than that, i'm just appalled you consider putting this by hospital. this is for doctors and nurses to heal their patients. for them to not be will to get there for their families families not be able to get [inaudible]. thank you very much. >> thank you. next speaker, please. >> thank you. good afternoon. my name is susan. i'm a longtime resident of san francisco. for the moment decision to? but i thought it was important to share my view. i'm a big fan of the warriors and were having a great time right now. obviously. but, i don't feel that this stadium or event center, as you're calling it, is really a right fit for san francisco. we had talked about too much noise, too much traffic, and it's way too close to the children's hospital. the stadium is supposed to be 1000 feet from the emergency room, which looks like it could be great major problems right there. i really feel that it's just the wrong place for the event center, and thank you for allowing me to speak. >> thank you. next speaker, please. pet >> mining the subject basin, professor of anesthesia at ucsf. achieve it anesthesia at the san francisco general. my thoughts are that well stressed by many people, but working at the county i know meet axis is absolutely essential. i cannot see how that will happen here. thank you. >> thank you. next speaker, please. >> my name is gloria judd. i live in basically i lived in san francisco since 1960. i worked most my adult life at ucsf on parnassus in the neonatal intensive care and i retired in 2007. i'm here to give a voice to the critically ill infants who are in the end en route to ucsf which is a hospital. many of these babies are extremely low birth weight, as small as one and 2 pounds and very premature, 24-25 we frequently. dependent on ventilators. some are unstable in the ambulance and require and ventilated with these time is everything and they need to get the hospital for emergency care that they so desperately need. since there's minimal parking provided for the warriors arena, it is suggested that fans use public transportation and i feel this is discriminating towards senior citizens and disabled persons. the initial proposed site at pier 30 was dropped because of the concerns about local and tourist traffic and block abuse for residents who live on the waterfront. but now, it is considered okay to build a sports arena directly across the street from a hospital that treats the sickest of the sick patients and takes the risk of impacting negatively the quality of life of a child. i just don't get it. homeland security has made it very clear that sports arenas by the number one target. >> 27 seconds >> homeland security has made it very clear that sports arenas are the number one target for terrorist events in our country. if there was a major event at the proposed arena it would be impossible to activate the sick infants out of the hospital and out of the area in a timely manner. i do not believe that there is any other sports arena in our country that is located directly across from the hospital.? thank you. next speaker, please. >> >> next speaker, please. >> a lot of great people are here today. mission bay lights thank you for showing up. we would hope aaron peskin would be. [inaudible] are fighting a price. the resident of the troll hill. that state the facts. mission bay is a very tranquil place at this moment. as i heard on the tbd other night, about the new arena rvs come as genuine. i have the g1 set arena there like we don't want that arena there. think about it. joe talmage will not want you arena. all that traffic coming through there, it's tranquil. we got the fresh air. me, a person who likes to run, about these people want to get out, the elderly or run on the track around third street. all that pollution. the environmental. so, i appeal to to grow decisively like we fought for the kaiser project breakdown the quote. it was just a little thought they relocated. the arena should not be built right there at that spot. all the congestion is going in that one strip in that area. mr. avalos he likes to ride a bike. that's what we need more bicycle riding it we don't need that congestion. we don't need the arena. think about that. think about it. there's a lot of people who would probably show up today but i would like to speak on their behalf. we do not need that arena in that area there. the mission bay alliance we should be applauding them today. think about it. they're part of ucsf. there's a fashion that does not want. >> thank you. speed next speaker, please. >> good afternoon pres. breed and members of the board of supervisor on susan graham holly. i'm a member of the mission bay alliance legal thing and i'm here to talk a few minutes or 2 min. exactly, about the ceqa problems with this project. we received a lot of information from us and for many many people about very technical but very real environmental problems with the proposed arena. because there are significant impacts, because of the proximity to the uc medical center, because of the fact that the land use in this area is carefully planned and did not include an arena, it's very very important that the city consider alternatives. ceqa has both procedural and substantive rules. the procedure has not been gone through pushing and eir, getting comments, etc. it's a substance that's the real reason behind ceqa. the point is to look at environmental impacts of the project impact will be significant to see if there's a way to mitigate that. the alternative is in the eir is therefore the very most important part of one of the most parts and here is not a minor error. it's a major error. eir did not locate any potentially feasible off-site alternatives. not one. it is required by law. there were some sites rejected but they were not studied so that does not take care of the problem. the only site in the eir was the pier 30, 32 site that's been rejected it is infeasible or the warriors would've proceeded there. so pretend it's potentially feasible and satisfy ceqa's requirements to look at alternatives to see, is there way to commerce this arena, with less impact, without doing that you're doing a disservice to the warriors team itself and to the people of san francisco. you should amend the eir and look at off-site alternatives. at least one. >> next speaker, please. >> good afternoon. my name is martin lee and i am [inaudible] i submitted about four years ago with a letter from pres. obama. i am here today because i was also a part of a demonstration 17 years ago when william hanks and was shocked at point blank range in the back of the head on by the san francisco police department here we are, again, another young african-american senselessly killed. i mean, the mission bay project is admirable. i'm sure it's greatly needed, we had all these people demonstrating for the injustice that african-american people face every day. we probably would not be here today. i'm sure that stadium is going to be built, but how many of our people are going to be here to watch it? we don't know because it seems like we're under attack and deputy gains, [inaudible] she served the city of san francisco for three years, with a smile. you would never know she lost her own child, and nothing. what is it going to take for people to wake up? education is at the foundation,, the very core, the everything we believe in, but if everyone is not getting the same level high level of education how are we going to grow and develop as a society? i'm going to be here as much as i can because it's of vital now. we are under attack. and nobody is fighting for us. not even our own people. they don't even fight for themselves because they're not educated enough to know. we can't place blame about this and that. that's not going to do a bit of good.? should we move to the next speaker >> okay. next speaker, please. will come back when we get it fixed >> my name is jennifer wade did i live in the mission and six years ago my son was born at uc with a congenital heart defect and can use to receive treatment at ucsf today. it's about okay this arena project would create massive traffic jams in the area around us today on a regular basis. this would be a public health disaster for city children. ucsf is the only nationally ranked children's hospital in the city of san francisco only children's hospital that treats rare condition such as my sons. my son's condition carries a 75% lifetime risk of return. if you would have a stroke prior to it-estimate stuck in traffic with the need to be diverted to a different hospital could mean the difference between a full recovery and permanent disability or even death
