Were monitoring all of this. This is of course what has been going on in the wake of the killing of george floyd. But as you look at these scenes that may be familiar, let us be very clear about the facts. Tonight one thing is very different. At this hour most of the officers last night involved in that killing were uncharged and at large. Now, tonight here you have it. These same officers, three of them now in custody as murder defendants. Their new mug shots just released tonight. Prosecutors charging these three officers with felony murder. For aiding in the, to put it in the legal terminology, the unintentional murder of mr. Floyd. They also call it felony murder. This altogether are all four officers who were involved in that fateful arrest and killing. Prosecutors also enhancing charges against the main officer who led, pinning floyds neck until he died. He now faces seconddegree murder charges. Each of these individuals that you see on your screen now face up to technically 40 years in prison if convicted. Minnesota attorney general Keith Ellison made the tense announcement today and also spoke with rachel tonight. I am absolutely confident that these charges are supported by the facts. It is very important that folks understand that these cases are not easy. But its also important for people to understand that this case, these four defendants should be convicted. They did the conduct that violated these criminal statutes. And i would not have charged them otherwise. And they should be convicted. Mr. Ellison explaining his rationale. We now go on the ground. Nbc newss jo ling kent live in seattle. What are you seeing . Hey there, ari. Yes, we are three stories above what is a very large protest here in seattle. You can see behind me the protesters are stretching just about a block back and they are chanting black lives matter. They are asking the police to take off their riot gear as well. And you can see that police line full of umbrellas, and then facing off with an increased presence right now of National Guard in full riot gear along with seattle police. Now, earlier when we brought you these pictures it was a couple of lines of Law Enforcement. Now you can see that it is six, seven rows deep. We also i believe have an Armored Vehicle on site as well that has pulled forward. Now, these umbrellas of course, as you know, have been put up to protect against possible pepper spray or tear gas. But the police have already warned on the p. A. System for protesters not to throw projectiles across the police line because they want to keep this peaceful. Now, ari, its an interesting evening here because as you look and see this crowd this is also the first night in a couple of nights that there is no curfew. There was supposed to be a 9 00 p. M. Local curfew that went until 5 00 a. M. , and just about an hour before the curfew, a little bit more than that, they canceled that curfew. The police chief, carmen best, saying to the mayor according to the Mayors Office that they will be able to keep the peace here in seattle and allow for these peaceful protests to go on. But last night things went haywire and there was tear gas and flash bangs. So well see what happens here in seattle. But certainly a very large presence, ari. And jo ling, based on what you are seeing there, you have that view, we can hear some of what youre hearing, is there a way based on your past reporting to contrast what youre seeing tonight now that all four officers have been charged as compared to earlier nights or are you feeling that its similar and protesters of course are demanding more than just action in minnesota . Yeah. You know, you definitely feel a larger sense of organization over the past couple of days, and youre seeing that in a much more coordinated way here. The number of protesters has actually decreased a little bit since the height of earlier this evening. But i did ask the mayor of seattle, jenny durkin, what they are doing as a step one to actually come to an agreement with protesters here and they say she says shes trying to change the culture by meeting with protesters. Now, the protesters had this meeting just a few hours ago. Some of them saying to the Seattle Times it was successful while others clearly do not feel the same way. So this is where you find this faceoff right now. People are calling for the protection of black lives. They are of course coming out in support of george floyd and calling for justice. But its a passionate group of people, and theres a few factions within them. But certainly the enthusiasm and the spirit behind this protest has only increased over the past five, six days. Jo ling, thank you and stay safe out there in seattle, where night has not fully fallen. We turn now to the east coast. Nbcs Garrett Haake joins us from just outside the white house. Garrett . Hi, ari. Were an hour into a d. C. Curfew in washington. As you can see the protesters who have been around the area by the white house arent going anywhere. While we were standing by to come to you, another large group what is been marching around the city just arrived to cheers from the couple hundred people who are still left here at 16th and i. The attitude of the protests today have been i think noticeably more joyful and optimistic. It had very much a Block Party Vibe around 8 00 tonight when this protest reached its peak. Thats in contrast to the increasingly milita lly militar response weve seen on the streets. There have been no clashes no, scuffles of any kind at least where ive been today. But the barricade exactly right. Exactly right. The barricade today between these protesters and Law Enforcement is National Guardsmen black lives matter and officers from the federal bureau of prisons whove been out here. But again, the entire city right now. It seems again, we are still under a curfew. Its not being enforced. Metropolitan police department, d. C. Police are basically letting people protest freely in their city so long as they do so peacefully. And ari, that is exactly what we have seen. All day and now late into the night here in d. C. Understood, garrett. And its interesting seeing both you and jo ling in places where planned curfews not necessarily taking effect the way they were other nights. Were seeing cities deal with this and figure it out as they go. Stay safe. I want to bring in experts orrin this news day. Mark claxton, retired lapd detective is director for the black alliance. He has experience as an officer and on the civil rights side of this he can waigs. Joining us is nyu law professor melissa murray. Good evening to both of you. Mark, ill start with one of the questions we have been charting all day, an unusual day to be sure. Can you ever think of a time where Police Officers have been indicted for felony murder in the first place . Yes, there have been indictments for felony murder. Dont ask me to recall it right off the top of my head. But the indictments the charges themselves although significant are just one piece of a larger puzzle and one step toward ultimate justice that i think the protests but i want and i want to get you on all of it, but before we jump ahead, given that three officers were hit with felony murder today, when we checked we found this to be relatively rare. This is very rare. This is a charge that typically is used against drug dealers, gangs, people who are involved in the commission of what you might call a more traditional street crime. And its a way to throw the book at them. So i want to get all your thoughts. But im curious what you think about the significance of that. I dont think most people a week or two ago would have expected minnesota to go this route against all four officers. Its hugely significant and hugely impactful. It was a tremendously impactful announcement by the attorney general. And it will have really it will reverberate through the Law Enforcement community. Weve always said that until there is really a holistic, a complete prosecution, an arrest, serious charging, not undercharging, and ultimately conviction of the Police Officers we wont have Significant Impact so theres no doubt that the charges are significant and theyre resonating throughout the Law Enforcement community and will have an impact. These charges will have impact and perhaps set a precedent that will be applied in the future. Professor murray . Well, to be really clear, this is seconddegree murder. And in minnesota seconddegree murder can either be murder with the intent to kill but without premeditation or it can be a killing that occurs in the conduct of another felony, which is what has been charged here. So the underlying felony is assault. And i think its important here to note that they changed and escalated the charge, i think likely because they were trying to bring in these three other officers on accomplice charges and in order to have the accomplice charges you need to have an underlying charge that requires some kind of specific intent, whether its the underlying intent to commit the felony or the underlying intent to kill. So its both i think a response to the political environment but also a tactical question about how to rope these other three officers in here as well. And i think its vitally important that the other three officers were also charged here because as the other guest has said it serves as an enormous deterrent to other Law Enforcement officers across the country that you cant simply stand by as these things are going on and turn a blind eye while your colleagues are doing this kind of conduct. Thats right. I mean, professor, what youre speaking about of course is deterrence. Something that Law Enforcement often emphasize against civilians and citizens. You have to have tough and deterring systems. And yet we have documented how little that actually then applies to the police themselves. To the point you raise, professor, lets take a listen to Keith Ellison at that press conference today. I filed an amended complaint that charges that charges former Minneapolis Police officer Derek Chauvin with murder in the Second Degree for the death of george floyd. Hennepin county attorney Michael Freeman and i filed a complaint that charges Police Officer kyung, lane and tao and aiding and abetting in the Second Degree. George floyd mattered. He was loved. His family was important. His life had value. And we will seek justice for him and for you and we will find it. Professor murray . I think its important here that attorney general ellison made clear that this is not some ordinary street crime, this is an actual person to whom something violent occurred. His life was lost. His family lost a loved one. And there has to be some kind of accountability in the circumstance. To be clear it is not the first time that an officer involved in a civilian shooting like this or a civilian killing like this has been charged with seconddegree murder. This also happened in the 2009 killing of oscar grant in oakland, california. But again, it is significant that the underlying charge is actually one of felony mufrd which is really about not the intent to kill but the intent to commit some kind of underlying felony. And thats a much lower bar and much easier for the state to prove at trial. And i think thats likely part of whats going on here as well. Right. And i think getting exactly your breakdown there of why that matters, why it relates to the ethics of it but also how it will work in the courtroom is very useful. The professor was just speaking about oakland and we were just looking at some shots of oakland tonight. Were also looking at seattle and washington, d. C. And marq, i have to finish out the book of business, which is you said you wanted to also going beyond these individual charges and discuss the wider reform. I hand the mike back to you for that purpose as we look at different cities. Los angeles a place that has had a police force, and were looking at oakland as well. But both those places in california have had, like nypd and like other places, Police Forces widely accused of routine alleged brutality and racism and so marq, what do you mean when you say this is a time to look at more structural reform . I think attorney general ellison touched on it in his announcement today when he spoke about one is to remain sober in our analysis of this, dont go too far with our expectations or anticipation of what will occur. But most importantly, for the interested parties to demand and continue the march toward justice. Overall comprehensive reform, to continue that. Dont let this singular prosecution get in the way of that. Overall reform requires you deal with every aspect of Law Enforcement from the pervasive racebased enforcement. You deal with hiring, retention practices. You deal with agency accreditation. You deal with increased accountability. So this prosecution, this prosecutorial decision will go a long way in spurring the Movement Toward criminal justice reform, specifically police reform. Understood. Weve been monitoring the scene all over the country including here in oakland, california. Were about to be joined i by california congresswoman Maxine Waters. She has been working on these issues facing the nation for a very long time. In 1992 she was in her very first term in congress. We want to remind viewers of this. Parts of her own l. A. District saw the violence, unrest after many were shocked and outraged by the acquittal of officers in a beating caught on tape of rodney king. The New York Times reported waters presented herself at the door of president bush after learning she was not invited to a meeting about those very issues. She got into that meeting. And here she was in 1992 discussing another issue, meeting with then attorney general william barr. He was in the same post then as now and he was overseeing the federal civil rights investigation into the beating. We want the Justice Department to prosecute. We want them to move with all due haste. Perhaps that will help stem the tide of violence. In addition to that, we really do need to look at further how we can have laws in this country that will supersede some of these jurisdictions that in fact are racist and backwards and some other kinds of things, who fail to prosecute officers who violate human beings. The federal investigation did change the dynamics. There were charges against all four officers and convictions for two of them. As mentioned, joining us now on this big night is democratic congresswoman Maxine Waters, chair of the Financial Services committee. Congresswoman, as you look back then and look at yourself and the work you did then, whats on your mind in what has and hasnt happened since then . Well, it has been many years since rodney king, and before that i was confronting the then chief of Los Angeles Police chief daryl gates. And not a lot has happened. Normally when an officer kills even an unarmed person, usually a black man or a black woman, it is deemed justifiable homicide. But i want to tell you, i have a very special feeling about what is going on now. I believe that these young people in the streets are truly creating change. And i think were on our way to the development of laws and practices that weve not been able to achieve with all of the struggles that weve been in about Law Enforcement and the abuse and the targeting and the killing of blacks in particular. And so there are many while theyre concerned about the protests i dont think people need to be concerned about the protests. People should be thankful because these young people are doing what legislation has not been able to accomplish. The ministers begging and praying have not been able to achieve. And it goes on and on and on. So because these young people said enough is enough and they have hit the streets and they are staying on the streets, i think they have just opened up a new era in dealing with police abuse with the killing of blacks in particular. Im feeling very, very good tonight. Its striking, congresswoman, to hear you put it that way given your track record. We wanted to play one other thing we dug up because when you look at history or social change theres movement and some of the movement in all honesty has been towards you, towards things you have said and others that back in the day was considered radical or extreme. Calling out racism for what it is. Lets take a look at a moment again, its late night, congresswoman. Were staying up late. So im going flashbacks with you. With katie couric in 92. Take a look. Why do you think they were acquitted in a correlate of law . It is what america does not want to confront. It is racism, pure and simple. The anger that you see from young black males in los angeles is an anger justified by the treatment they receive simply because they are who they are, theyre the color that they are. Why was it important to you then to name it, racism, bluntly and do we need to continue to do that now . Well, you know, i have the ability to call it like i see it. Thats unusual, particularly with elected officials. And i also know that the right wing, the White Supremacists and the kkk had shut down using the word and claimed that those of us who would dare use the word were basically racist ourselves. And so for a number of years, particularly elected officials were squeamish about using the word racism. Ive never backed down from it. And i think now that the world really knows and understands what it is. And so im pleased that we can openly talk about racism and get into a discussion about what it is and what it takes to get rid of it. And so yes, i used it back then. Ive continued to use it. Ive talked about the president. The president is a racist. As a matter of fact, ive known that the president is a dangerous human being, a wouldbe dictator who would move in the direction that hes doing. Many people were shocked when he came out and walked out to that church with the bible in his hand, with the military backing him up, and having all of those protesters basically gassed and in addition to that threaten. Im not shocked and im not surprised because i warned america that this was a dangerous man, a wouldbe dictator. This was a man who has no conscience. This is a man that should never have been in the highest seat of the land. And so im hoping that the more he defines himself and the more hes rolling out, threatening all of these young people, its not just blacks that hes threatening now, hes threatening these young white children, young people whose parents perhaps are frightened that theyre out on the street, probably dont want them there. And they must realize that if this president dares to pull the military out on them that their children are in danger, black, white, green, whatever color. And so while we are making movement here, i think were on the verge i think weve got to be worried about this president and hope he does not serve this country another four years. Youve got about 500, 600 people that are down here. It looks like theyre starting to get down and kneel, take a knee in front of these officers over here that are protecting city hall. This is the iconic city hall. Obviously the people out here honoring the life of george floyd a little while ago they were holding up lights in his honor. All of that happening right around 9 00. Technically 9 00 is the curfew here in los angeles. Were a little past that now. But we understand that curfew wont go into effect, wont be enforced until about 10 00. This is a much different scene than what weve seen over the past few days, that curfew. What we were told from police is its not meant to prevent protests, its meant to prevent things from looting that may be or may not have anything to do with the actual protests. They say that in the past few days what theyve seen is organized criminals that have been following some of these protests and caravans and theyve been really trying to crack down on some of those caravans, impound those cars and make arrests. And they say that every single day theyve made progress in stemming that, so that curfew keeps moving back. Again, tonight its 9 00. Yesterday it was 6 00. So there is some progress. He called them more profound than anything in his lifetime. Let me start by just acknowledging that we have seen in the last several weeks, last few months the kinds of epic changes and events in our country that are as profound as anything that ive seen in my lifetime. Thats one former president basically giving a shout out to protesters, a contrast to trump, whos tried to undermine these in very significant ways. Even threatened to use the military. Obama also invoked Martin Luther king regarding the work of activists. Ive been known to quote dr. King, ive said frequently, the arc of the moral universe is long but it bends toward justice. We bend it. All of you have bent it over the last four, five, six, ten years. And we are seeing the fruits of those labors in the degree of awa awareness that is out there. As obama returns to the National Stage with such controversy, were joined by john eligo, a National Correspondent for the New York Times, and yamiche alcindor, correspondent for pbs newshour. Yamiche, what did you think of obamas return . I think supporters of president obama, supporters of former Vice President joe biden, would say that president obama did what President Trump has failed to do, which is that he not only sympathized with protesters and said that america has a long history of protest including the American Revolution but he also went on to talk about concrete things that could be done to change things including banning choke holds or reviewing Excessive Force policies. Thn he also did something that again, people that support president obama think was remarkable, which is that he said protesters, we hear you, we hear the urgency in your voice, you should be able to have your dreams realized. So he was also in some ways putting himself in the shoes of protesters and saying look, i understand what youre going through and i also understand that youre living through a time where people dont value you because of the color of your skin. I think President Trump again and again, while he said that he wants to be an ally of peaceful protesters, he of course had gassed he gassed protesters to move out of the way to walk to a church. But he also hasnt put forth any concrete policing changes. Time and time again ive asked white house officials what their plans are, and President Trump so far has just has no plans at this point. And john, barack obama may stand out for more than one reason, but there are several former prntsz now who all stand fairly united against the current president , which itself is unusual. Reading from the Washington Post it notes, four living expresident s have drawn a contrast with trump. His predecessors making their case at least implicitly for a president to do this, quote, in a more traditional way express sympathy, try to unify the country. John, where do you think obama fits into what the living president s are doing . I think its really if you look at obama, hes lived through a lot of this unrest and these types of situations because when he was president , even back when ferguson was happening. I think the thing that really stood out about president obama is he spoke in very personal terms, connecting his own life and his own experiences to those of the protesters. And i think thats what were seeing him kind of rekindle right now. President trump, he talks a lot about law and order and things like that. And usually when he makes the appeal to issues of race he talks about things like the economy and the work that hes done on things like hbcus and things like that. But he doesnt really talk about racial justice, which is really at the heart of what a lot of those protesters that i talk to, they say its not just that, Police Accountability is a huge thing but they talk about systemic racism, and we really have not seen much of that from President Trump. Or should i say any of that at all from President Trump. Talk or acknowledgment of systemic racism. John, you talk about systemic racism and the roots of this. This is something weve all been dealing with for hundreds of years. Some people consciously, other people perhaps ignorant to it. But its been there. Bob marley said 400 years and its the same philosophy. And obama hit that very point today. Take a listen. One of the things that has been raised is the fact that we dont have the capacity to eradicate 400 years of racism in one fell swoop. So if we think that this is a seismic shift, i hope people dont feel like, well, nothings going to happen once we figure this out. John, whats the president getting at there in your view . I think hes getting at the sense that these things are a long arc, they dont just happen overnight. And i think the interesting thing that im seeing, you know, when i talk to people is that while it can seem in some ways hopeless from the outside looking in because these things, these things seem to be happening over and over again, they seem to be cycling, i actually sense on the ground that there seems to be a paradigm shift among protesters where theres a real sense that maybe this time we can get the change that were asking for. And just a young woman i spoke to just now in minneapolis, she talked about seeing white allies come and talk in very personal terms about how they understand the struggles that black people are extermination at the hands of the police in ways that they never have before through this George Floyd Killing and through the Police Response to the protests. She really feels like there is some sort of underlying shift going on. So i think that long arc, while it can seem frustrating, it will be interesting to see Going Forward whether this actually does lead to a lot of that system change that activists have been fighting for for years now. Yamiche . I think what stands out to me is the fact that president obama also said that there was a small tiny, he said, a people that were violent protesters and he basically was saying that not only do i empathize with you but in some ways im inspired by the fact that there are protesters out there taking to the streets. President trump has said over and over again that protesters are domestic terrorists, that they are antifa. What im seeing on the streets are people who are demanding change from their government but who love america and who want a democracy. Im thinking of jaden, he was an 18yearold young man that i talked to. He was 8 years old when Trayvon Martin was killed this florida by george zimmerman. He said, i realized then as an 8yearold that i could be killed because of the color of my skin. And now hes protesting for the first time in his life and hes saying that because now i feel like i can come to the streets, i can have a voice. And im horrified of course by seeing george floyd be have his neck kneeled on for 8 minutes and 46 seconds. Im also thinking of my mother, a mother who brought her four children to the protests who said im here because i want the future of their lives to be safe and i want my kids to not be killed by police because of what they look like. So i think the protesters are largely peaceful people and President Trump is continuing to kind of make them a foil and continuing to try to make them to be this kind of myth of this roving anarchists when in reality the large majority of them are americans who really just want their country to be better. Indeed, we have seen activists pressing leaders equally in red states and blue this week. Harsh critiques of how Police Forces are run in cities that are largely democratic like l. A. , minneapolis, new york, seattle. Very blue. Were looking at that right now. But i want to be clear this is also a fierce insistent rejection of donald trump, how he governs, how he divides, how he campaigned on race baiting. And in that effort were also seeing signs of trumpism on the run. Leaders across the spectrum condemning attacks on the press that trump has been fomenting for years now. Clernlgly across the spectrum slamming the trump photo op at the church. Veterans condemning trumps effort to invoke military force against free speech. Trumps own secretary of defense, james mattis, making news tonight saying his old boss is undercutting our constitution and trying to divide us. Meanwhile, former Confederate States now removing a battle statue of robert e. Lee from the capitol. So take this in. In the tense summer of 2020 right now were seeing a Southern State issue the rejection of a race fight that trump infamously picked back in 2017 over those same monuments touting the losing side in the civil war. As so many forces reject these features of trumpism, you can also still ask, okay, but will any of this matter at the ballot box . Well, in one republican race the answer is yes. Iowa republicans ousting one of the trumpiest members of congress after 18 years. Steve king just lost his primary. The conservative firebrand was in freefall after he said last year, white nationalist, white supremacist, how did that language become offensive . Why did i sit in classes teaching me about the merits of our civilization . Well, just last night Republican Voters gave mr. King an answer. White supremacist is not only offensive, its unacceptable. Joining me now is mark thompson, host of the make it plain podcast. Thanks for being here, sir. Thank you for having me, ari. Very important discussion. Yes, sir. Mark, throughout the week, throughout the day, throughout this hour we have been looking deeply at these historical issues and civil rights, racism and policing. I turn to you for larger connecticco context. It does seem in n. Some ways trumpism is on the run. It does. Thank you for having me. There have been some victories. As you noted. Steve king, hes been called out by mattis and others. Theres been unanimity. Theres even been protests around the world. One other thing very important that has happened i think we have to acknowledge is the fraternal order of police for the first time to my knowledge actually released a statement condemn i condemning the death of george floyd. And the fraternal order of police tends to be very conservative, very close to republicans. And even it said something. So i think were seeing some victories in that regard. Although theres still a lot more to do. As you alluded to. Police departments are governed locally. And if we are not organizing on the local level to demand local officials, democrat or republican, arent reforming police departments, were not getting that far. The demonstrations are beautiful. They are a sight to behold. But we also must do that real organizing on the ground. Ive been hearing young people are really upset with the system. Some of them are saying once again as they often do whats the point in voting . But we have to remind them that those down ballot races can determine the makeup of a police department, voting for a mayor, voting for City Councils and county commissioners. Those are the people that hire Police Chiefs and oversee the police department. And so this has got to be a street heat as well as us going into the ballot box to make a difference. We are discussing how society deals with a challenge to its use of force or violence in policing, and then you have the military. So it has been quite disturbing that part of the government response to that has involved more allegations of improper force and violence. And the military should be far, far from that. Which brings us back again, as mentioned, to secretary mattis, reading a little more from what he said, he doesnt need to weigh in but he chose to. He said, militarizing our response sets up a conflict, a false conflict between the military and civilian society. It erodes the moral ground thaen shurz a trusted bond between men and women in uniform and the society theyre sworn to protect. Your thoughts, mark. This is an absolute abuse of the military. And lets be clear. You know this as well and better than anyone, because you covered trumps being enamored with Richard Nixon and his favorite nixon acolyte, roger stone. Its as if theyre trying to create the theatrics of 1968. Nixon won with law and order like this. And it would appear that thats exactly what theyre trying to do now. We pray that it wont work. We cannot rest, though, because weve seen maybe not this size, but weve seen demonstrations before, weve seen people get upset in the moment. And then somehow things go back to normal once theres another distraction. Ari, im a black man raising a black son who will be 18 this weekend and graduate virtually from high school. And its really something to try to figure out a way to keep his life safe and young men like him alive while celebrating him at the same time. Its quite a task. Its paradoxical in a sense. Our graduations when you and i graduated wasnt like this. When i was 18, when i was his age, i was a freshman at georgetown and i was a part of a movement that ended georgetowns investment in south africa. It was a divestment movement. We got the university to divest from the apartheid state. Donald trump has an apartheid state right now while my son is 18. And so i never dreamed i would have to fight this same battle again when my own child would be the age i was when i fought it. And so weve got to keep fighting. I want to just say too weve been in some discussions, people around the world, its not just that trumpism is losing here but around the world people are sick of this. And so we may have to appeal to our allies around the world, just the people, to say that as long as trump is in office and as long as this continues we may have to go back, bring the band back together and discuss divestment from america until this situation changes. Marches, protests, speeches, public grieving by his own family, stories shared in person and online by many, many others recounting their own experiences with police, with the criminal justice system. It has and continues to be a lot. Now, just as there was protest music and a soundtrack for past movements from joan baez to marvin gaye, todays artists are also weighing in. A new song from john forte, the singer and fujees producer, offers a tribute to floyd and these protests rallying around the black lives matter credo let us breathe.
