yesterday that we all followed it. this former president, now presidential candidate convicted of a felony. but that brings to us a different and unprecedented reality now. because he is the presumptive nominee of his party. we have not heard about dropping him from the ticket which in a different era and party you might hear about. trump holding his first campaign rally since becoming a convicted felon. he went to arizona, one of the battleground state. that is a dnc ad trying to get everyone focused on the reality saying he is unhinged and unfit. they might change the bylaws now but that defeats the purpose of having the requirements and the rules for a party. a non-partisan journalist means trump is banned from carrying a gun. that is just a reality. so, on the one hand he will not be able to have the guns he used to have access to. that is not something convicted felons are allowed to have. if he wins the electoral college he could be in charge of the nukes again. donald trump is not trying to move on from the issues. two convicted felons. one convicted last week and the other donald trump pardoned back in the day. republicans might argue they always saw it as a miscarriage of justice, but it is a choice to hold your first rally with another person who has been convicted. trump embracing the disgraced sheriff. he is controversial legally and because he is someone that actively campaigned and really denigrated people based on race and other classifications. he has been on "the beat" once. we pressed him on these very issues. this is hey, the guy accused of racism. if he wanted to strike the tone or do something for d-day he could have done that. all of this comes at an important time. we are going to see the two people facing off. two weeks ago nobody knew whether that would even happen this year. it is a year with a lot of uncertainty but the biden campaign decided they will face down trump in the earliest ever debate just weeks away. the biden camp felt it was a pivotal part of standing up to an incumbent president and showing he was ready for the job. the trump folks think it will play well for them. they also sigh it as a contrast to joe biden and his style. there are maga allies in congress who are doubling down on the message and the governance of what could be a less rule of law society. a more autocratic one. let's be clear that it goes beyond messaging. speaker mike johnson is all but vowing to turn it into a banana republic and go after the very jury system that he used to defend. top republicans say they will target prosecutors and do things that are all but admitting illegality if you say you are go going to go out and get someone and they take their cues from the convicted felon candidate. >> revenge does take it is easy. it is joe biden. you see all of the criminality. that was donald trump talking to dr. phil with his version of catch me outside. donald trump needs everyone to think it is an endless cycle of partisan witch hunts and that the doj is only targeting republicans. that will be a hard message to sell to people that follow the news or information or independents or people not in his maga bubble. people are aware the doj has a trial against hunter biden and robert menendez. they are not from a position of strength where regular people who are worried about inflation and life are thinking about the political witch hunt allegation and conspiracy theory from a convicted felon who is losing his gun rights and needs to meet with a probation officer. there are also white nationalists groups responding to all of these the proud boys are saying stand back and stand by. it is far from over. one group is calling for war. on the one hand there is so much online rhetoric. but on the other groups these are the groups that waged a sedition and the groups donald trump vowed to pardon if he gets back into office. if you have a republican uncle who say it is over and done, remember, this is right now. these are the militias that did it and some of them now are dethroned unless they are pardoned by trump. there are a lot of ways people experience it. people don't follow things. i want to play where him and obama were on the same page to underscore how extreme it is to have not only trump, a felon trying not to go to jail and other republicans bluntly attacking the you have to connect these sorts of events to real world consequences. there are real world consequences. without the rule of law what are we as a society. what happens when donald trump becomes dictator. think of the kind of society donald trump wants to create, a society with a double standard. if you are poor or non-white you are subject to certain laws and rich and white you are not. if you are a woman you are subjected to a certain type of belief and intrusion into your privacy. if you are a white male you are not subjected to that. there are real world consequences. we are seeing >> there is no convicted felon like trump. he is one of a kind. all that i can speak to is how it goes for the average joe. they are asked to come in and sit in a small city office and meet with a city probation officer and discuss everything from the crime they are convicted of, any criminal history they might have. their family situation. their obligations. where they are living and how they are supporting themselves and their income. any mental or physical issues that might compromise their ability to support themselves or live independently and to assess their willingness to abide by the conditions that the judge might set for a probation or a conditional discharge sentence. >> to put it simply can that report impact the sentence and potentially lead to a more serious sentence. >> it certainly can. in new york city 95% of the convictions are the result of plea negotiations. the purpose of the probation report is aggravating or mitigating circumstances. >> if you have someone violation of the gag order, attacking the judge's family and other things and sits down with the probation officer and that person continues to seem defiant, how might that affect a judge. >> i'm not a judge. i can't say. >> you have over seen two of the very key entities in the same jurisdiction where this convict is going forward. yes. is this individual amenable to supervision and receptive to accepting the restrictions placed upon them in the event they are placed on probation. will they comply with the rules or are they likely to violate the rules. that is something that would be appropriately noted and reported to the judge, and then it is for the judge to weigh. certainly in this case this judge knows the defend very well. >> right. last question, based on what we know now do you think that donald trump's approach has made it more likely that he could get jail or less likely or really no difference? >> self knowledge is not, you know, flowing these days. i think people just block it out. they take positions that suit the moment. like the other thing that really got to me this week is clarence thomas apparently forgot to disclose millions of dollars in gifts. like, if i had a gift for $100, i would remember it for a really long time. and i'm writing an obit of clarence thomas. we do it ahead of time, don't get excited, for "time" magazine. so i interviewed a lot of people who kept telling me about his converted school bus that he went around the country with ginni and they would go and sometimes park at walmart. well, he was given a quarter million dollar luxury motor coach by a health care executive. how do you forget that?
