we will unpack that strategy. let's get started, we have a lot of business. >> we are looking at a consequential week ahead for donald trump and for democracy in america. on tuesday, a federal grand jury in washington d.c. will meet for a potential third criminal indictment against trump. of course, efforts to overturn the results of the 2020 election this comes just days after the special counsel's office tacked on three additional charges. we are looking for espionage obstruction who died but in the documents case. special counsel as two new charges, and for charges against a brand-new defendant at mar-a-lago property manager, carlos oliveira. he will make his first court appearance in florida tomorrow. although, we have just learned that he does not have local, legal counsel. the former president responded to this in front of thousands of supporters in pennsylvania last night nearly two hours, predictively painting himself and writing his critics and railing against any semblance of an order applied to him. >> they waited two and a half, almost three years so they could bring him in the middle by presidential election. it's election interference. i considered a great badge of honor i do. it's a great badge of honor i'm being indicted for you. >> >> additional charges, a looming third indictment. and the possibility of even more charges. don't forget what's happening in georgia, folks. this could feel like or should feel like the demise of trump's political career. a long awaited and to his outside influence and national morale. so, why does it feel like our morale as even more battered and brittle. the only -- to watch trump pledges allegiance are the ones that bear his name. he sent the nation to the brink of a constitutional crisis, rather than accept defeat. he is more than willing to do it again. he told us so himself. >> you get convicted and sentenced, does that stop your campaign for president if you are sentenced? >> not at all. there is nothing in the constitution that says that it could. not at all. even the radical left -- and it would stop me either. >> his lies have directly threatened our democracy before with millions of supporters attaching their very identities to his whims. in the former president refuses -- he wants to or to preserve, protect and defend that democracy. it may be more in danger than we think. joining me now to discuss, this and more is nbc news senior national political reporter, john allen. and new york times congressional reporter -- >> john, let's start with. you talk to us about the former presidents speech. his claim that we just heard of the beginning of a whole mix of grievances that he had some of the chs against him. >> and of course they're similar nature to what we have heard before. he portrays himself like a victim, silva convict him on behalf of it. he says he is being indicted for you, meaning his supporters i think what's really interesting about what he said last night and what he has been saying about the last couple of, days and what we've seen from his campaign team in the last 24 hours. it's a really harder edge towards republicans who do not get behind him immediately. there has been a back and forth between the desantis campaign in the trump campaign today. in which the trump campaign basically said, the desantis folks are helping the liz cheney's and adam schiff's of the world. and that only morons or idiots would effectively side with them. so, we are hearing a harder edge right now. >> let's stay on this issue of, you know, what is happening in trump world. how are they taking this superseding indictment and possibility of a january 6th indictment that could come this week, how might that be impacting the campaign itself? >> these are sort of two separate things in a way, charles. from the perspective of donald trump, he doesn't go to prison. and anybody who thinks otherwise is not paying a lot of attention. of attention. >> there is risk for him and at least a couple of these cases of that happening. certainly, the federal indictment that we have already seen in the southern district of florida, miami. but the superseding indictment, that is a potential outcome. you have also seen the expecting of an indictment in the january 6th case. that is a huge liability for him. so, on the practical level there is concern. as far as the politics go, it is really helping him in the primary. he has been able to rally republicans around him. he is trying to do that even harder now as the heat turns out. he is chilling that heat back on, if you get with me now or your turncoat. >> what campaign is trump expected to do this week will the legal drama is unfolding? >> we are expecting to see him basically at the end of the week. we may potentially get more indictments before the end of the week. but we are expecting to see him in south carolina next weekend. also, in georgia on friday. >> so, luke unlike the classified documents case some embers of -- were aiding his effort for biden's victory in 2000 -- advancing lies about a stolen election, or conferring with trump to -- based on your reporting, if there is a third criminal indictment against trump this week in the january six investigation -- can we expect from the congressional republicans? >> well, if histories and a judge to congressional republicans will rally around trump. there is a culture on the hill that basically donald trump can do no wrong, no matter what the accusations against him. we have seen what happens to republican, after republican. they are quickly run out of office or sidelined in the party. so, i would fully expect them to rally around donald trump, no matter what this indictment says. and in fact, they will probably shift the conversation to a myriad of accusations against the biden administration and not even try to entertain the facts around the indictment. >> let's look at this low, in the midst of all these developments with donald trump, some republicans are hyper focus on an impeachment of president biden. what are the latest on that effort? how are they justifying this? >> right, yeah. speaker kevin mccarthy gave someone his strongest comments supporting an indictment -- sorry, an impeachment inquiry. but he gave them no timetable for that. so, we are expecting that to be -- if it does get launched sometime in the fall, there's still a lot of debate on the hill among republicans. i talked to a number of centrist republicans and they don't like this idea. they think that there needs to be stronger evidence before any impeachment inquiry where to begin. they think the republican party will be better off focusing on things like inflation or the high cost of groceries. things that they think resonate more their voters. especially, those republicans who won and districts that were won by president biden. in order for there to be an impeachment inquiry, there would be a vote in the house to do it. so, kevin mccarthy would need to unite the republicans around that. but i think he is doing, at least according to the freedom caucus. he's giggling that up there for them to get up there and get excited about. it to distract them from the egoing on about spending. >> but look, trump himself is piling on the pressure right now. he's going to endorse the impeachment effort last night. he's going to call for republicans who are supposed to pay a price. take a listen to this. >> the biggest complaint that i get is that the republicans find out this information and they do nothing about it. the republicans just don't fight, there are people, they don't buy the weight of supposed to fight. a republican who doesn't act on democrat fraud should be immediately primaried and get out. get out. >> now luke, how heavily do you think republicans will weigh those words? >> yeah, i mean he just threw down the gauntlet, they're right? . we >> kevin mccarthy was impeachment inquiry on the floor, he is putting a very tough vote up for his own conference. it will be a tough vote for many of the republicans in congress. because congress is so gerrymandered, most of them it will be a very easy vote. yes, we will investigate biden and try to impeach him. but for those two dozen members or so, one in districts where president biden is likely to be voted for him. that is a much tougher vote. and so, if they take a vote and they become ostracized by trump in the party. they get run out by someone more extreme in the primary. well, now they are potentially giving away those seats to the general election. that is a very risky strategy. that's what trump always does, he forces them. you're either with me or against me. that is one of the reasons that the republicans believe they have lost the senate in the presidency under his leadership. >> i want to stand this trump strategy. this whole thing is classic trump. targeting his component, affecting from his own legal issues. it tends to work, right? >> absolutely, charles. it works in the republican primary. but what we haven't seen yet, and what we remain as an open question for this election is whether he is harming himself in a general election. you, know what these investigations and indictments will mean for independent voters come november of next year. whether they will weigh that against him or for him. they are looking to -- but what we saw on 2020, a lot of ways trump defeated himself. you look forward a little bit and say, the picture is not as clear as it is when you talk about the republican primary. you've done such a very good job of demanding and getting loyalty. >> nbc, jonathan allen. luke broadwater. thank you so much for joining me. coming, up the mountain of legal trouble for donald trump seemed to be growing by the minute. and next week, things could be getting even worse. we are breaking down exactly what the former president could be facing with a potential third criminal indictment. but first, here's richard lui with today's other top news stories. richard? not in my house. >> convinced that at some point upgrade to new cascade platinum plus. dare to dish differently. to next week, at whatever point, and i'm actually feeling better since the letter has gone out. that's right. that's something that's going to happen. i don't know what. i'm convinced it will be directly related to the work of the january six committee. >> congressman benny thompson told simone yesterday that he expects another potential criminal indictment for former president trump soon. this time, in connection with the special counsel's investigation into 2020 election interference. we may learn more on tuesday when a federal grand jury meets again in washington, d.c.. what we do now at this point, for a target letter donald trump received. its sights laws on conspiracy, witness tampering and deprivation of rights. tomorrow the newest defendant in the trump classified documents case, collars to alabama, expected enough florida courtroom. nbc news has just learned that he has not secured local council yet. the mar-a-lago property manager faces obstruction charges as part of a special counselor superseding indictment released on thursday. another loss in court for the former president today as his defamation lawsuit against cnn for using the big lie to refer to his efforts to overturn the 2020 presidential election was dismissed. oh judge did not agree that the phrase, quote, was tantamount to comparing him to adolf hitler. for more on trump's legal troubles, i'm joined by two of our msnbc legal analyst, former federal prosecutor carole lamb and former brooklyn new york prosecutor charles coleman, who is also host of the charles coleman paul cast. what should we expect one carlos to oliveira, the resort manager, -- to delete security video appears in court for the first time tomorrow. that is if he actually can secure local council. >> yes, charles. good afternoon, so what can we expect is, when as much as well not a went through, his, codefendant you appear in court for what's known as your first appearance. you are arraigned on the charges that are filed against you in the indictments if he has not procured local council, yet that's to somebody who has admitted to the southern district of florida bar and so can make appearances for him in front of that court, it will probably be delayed or postponed as it was in wealth not as case until a time thatoeo can go into court and bail will be set and conditions of release and then he will be arraigned on the charges. advising the next court appearance. as the mere fact that he has not obtained local council yet is not terribly surprising. he may not have known exactly when he was going to get indicted. the most likely does have council, just not one who's admitted in the southern district of florida. admittedhern>> charles, the wast reported that walt nauta and a trump employee shared a lawyer for many months. that was paid for by donald trump's pack, according to people from the matter. -- after trump and nauta were indicted intrusion, however, -- decided he had more he want to tell the authorities about his conversations with de oliveira. after that, a second lawyer not paid by the packet was brought in to provide legal advice to taveras. who then spoke on the two investigators. what do you make of the details? >> -- >> carol, i think we lost charles. can you respond to that? what do you make of it? >> sure, well, it's very interesting. what this means is that a jack smith actually has a witness in the form of mr. taveras, a party to these very important conversations with mr. de oliveira, with respect to donald trump, or the boss, he's described in the indictment, the boss saying that he wanted these video surveillance tapes destroyed. so, what happens is, when one potential defendant decides to cooperate with the government, there's a conflict of interest, obviously, between a current defendant and one who's going to cooperate with the government. so, what nauta has this attorney. now mr. taveras, the cooperating mar-a-lago employee, apparently has his own attorney, at least one who is ethical enough to say, well, i'm going to do what's in the best interest of mr. taveras. that appears to be cooperating with the government. he does need his own counsel who is not also representing one of the current defendants. >> charles, could a third defendant delay this may 2024 documents trial? >> that's a great question. -- this is a guy that's been impeached twice. three different cases. another aspect of the indictment was just added. there he is at the top of the polls still by 25 to 35 points and some polls. his comments a few years ago about being able to shoot so many on fifth avenue, his supporters still being with, them so far that as, you know, that hasn't been disproven. however, to the extent that voters in the republican party start caring about electability, about the ability to beat joe biden more and more, and i think there's an opportunity for others to rise. i don't know that's going to be rhonda, santas maybe it's one of the other candidates. the problem is, he's convinced so many people in that party that he did win the 2020 election. so, either way he kind of has fertile ground to keep his position. to hold that front runner position. i don't see that changing anytime soon. >> jennifer, we are a month out from the first republican debate. it's still unclear whether trump will be on that stage. especially because he refuses to commit to supporting whoever the eventual nominee is, if it is not him. if the current front-runner isn't part of the first debates, how does that undermine the credibility of the republican national committee? >>. i don't think that's what you're going to. say i thought you're going to ask me how does it undermine trump. my answer would've been, it undermines the rnc. it undermines it's a great deal. it shows that they don't have the, they don't have the organization under control. they don't have candidates who are concerned about cooperating with them, working with them arm in arm. and you know, for trump i would be very surprised if he's not on that stage. if you recall, he wasn't talking, he was being very hesitant about endorsing the nominee that wasn't him back in 2016 as well. so, trump just has this hold. we talk about the hold that he has over the voters in the republican party, he has a real hold over the leadership, overt ronnie macdonnell, over the national committee people across the country. the state chairs. they all look at trump as their only chance to win. so, no matter what they say in a written agreements, if these are the, rules anything else they are gonna going to do anything that might undermine his ability to be successful. >> secretary, only a handful of republican hopefuls have been willing to speak out against trump including former congressman will hurd who recently said that trump was only running for president to avoid prison time. he elaborated on those comments this morning in an interview with chuck todd on nbc's meet the press. take a listen to that. >> donald trump is a liar. drawn a trump is a national security threat. donald trump willingly knew that he had this country's secrets. he was trying to tamper with evidence to hide that he had that information. all of those things are true. that doesn't matter who the head of doj or fbi's. >> secretary, at what point if any will be re-see other candidates speaking out against trump at that level? >>. it's mind-boggling, charles. basically, the people that are during this, like congressman hurd, i know him, he represents part of my own hometown here, san antonio, and also, asa hutchins, and i think they were the two at the lincoln dinner the other night that went aggressively attacking trump. they are the people that don't have a snowball's chance of winning. the problem is, even if some of the others like desantis started to attack in the same way i don't know that they've established the name idea in the credibility that you would need to effectively pull off that attack. the conventional wisdom in politics is don't attack your opponent, especially if it's somebody that's doing better than you in the polls. unless you've built up your own name, i.d., goodwill with the voters. name, i.d., goodwill with the voters. i'm not sureow anyone has done. the, so probably their best, that although it won't happen because they're all competing against each other, their best bet politically would be for all of them to gang up togethe,g donald trump on electability, if we get into the fall of 2024 you're going to have someone that's indicted. he's going to lose the general election go after him on the electability. again, i don't know if that's going to happen, i see that right now is their only hope. >> so, i want both of you to stick around. up, next house republicans are making unfounded threats of impeachment towards towards president biden. it's so absurd that biden is making a joke. we'll get into that. that's next, in a few minutes. stay with us. small towns across the us, where our focus is to always support the people who live and work there. because you call these communities home, and we do too. pnc bank. permission to dig in? >> if i were a betting, man i bet on, that. charles i think first of all as others have pointed, out you can have all of those republicans who probably just came in in the last cycle who are in swing districts, close districts, yes, those still do exist. they exist in a few places. they are going to be against going forward. i'm sure they're telling kevin mccarthy do not do. this it's going to put our reelection in jeopardy. it's going to put republican control of the house in jeopardy. you're already dealing with a presidential cycle where in a lot of these districts the democratic vote is stronger than in mid term years. i think it's also going to hurt the presidential candidate for republicans. it's going to be bad. there is no way that people who are listening to the facts who could go either way that are going to be crucial in some of these very close states, i'm thinking a place in the midwest, i'm thinking of pennsylvania, arizona, georgia, they don't see a reason to impeach joe biden, they are going to see this as ridiculous and retribution. that's going to hurt republicans. as the secretary was hinting at, on the one, hand you have the freedom caucus republicans pressuring kevin mccarthy to pursue impeachment. then, on the other, hand you have swing district republicans who oppose impeachment who will let this thing die on the floor. when does that leave speaker mccarthy? >> this is the best example so far of how dangerous it is to have speaker mccarthy. and when we remembered the path that led him to the speakership, he is accountable to this small damaged minority of republicans in the house now. if they go forward with this to the secretary's point, it's going to hurt almost all republican candidates. it's going to hurt their presidential candidate. it will hurt the majority of their congressional and senate candidates. what mccarthy is going to bring it forward, he is essentially sold his soul to get the speakership to this small group of republicans who care not at all about the party or the country. they care only about their own personal ambitions. >> i would say they're only very damaging personal ambitions. >> moving to the supreme court, amid calls for more oversight of the nation's highest court justice samuel alito rejected the idea that the constitution gives congress any authority for the court, we should note that republican -- on justice alito at a luxury trip he took to alaska with republican donor who had business interests before the court. secretary, what is your reaction to justices comment? >> a very convenient response from justice alito. just after we've uncovered all of these really highly questionable actions by clarence thomas and by alito himself. of course, he try to preempt that by going to the wall street journal. however, it's clear that congress does have a role. here they already have dealt with expanding the court in the past. requiring ethics disclosures that the supreme court says they voluntarily go along with. so, this is not something that is foreign. this kind of accountability. it also exists for lower courts. it's disappointing that justice alito would take this position in the face of so much evidence that the system is broken. that folks are engaging and unethical conduct. if, anything they should be holding themselves to a higher standard than everybody else. because of their unique role in ensuring justice and our country. >> jennifer, justice alito is reacting to efforts to impose a code of ethics on a supreme court. as the secretary just pointed, out this is just like the ones for every other federal court that they already had. why is this not more of a bipartisan issue? >> it shockingly political, isn't it? the manner in which justice alito's phrasing this and responding to this, this is the most openly political court we've seen in my lifetime, certainly. in my adulthood. every week that passes, it feels like the conservatives on the court are becoming more openly political. lower more pro-republican as opposed to pro democrat. it's really shocking to hear them behave in this manner, to speak in this way. i would say that for justice alito and any others on the court who are coming forward with the same idea, that they don't deserve to be to have oversight or that somehow they should be able to do what they want and when they want were guard less of ethics, it makes them look and sound more guilty. it sounds more and more like they are concerned about what the people might learn about them in the future. i think it's a poor position to be in. it should make everybody in that country a little bit suspicious and very much more concerned than we have been before. >> it feels like it's damaging the court for them to feel like they're above. secretary castro, jennifer, horn thank you so much, coming, up a new charges against donald trump seems to be drawing even more parallel to former president right richard nixon from previous years. we are talking to historians who have written a book on the missing audio in the tapes. the comparisons to what trump allegedly tried to do with the mar-a-lago security. my store and my design business? >> donald trump is an outlaw persona figure. he despises the institutions of the federal government. if he had his choice, he would abolish the fbi, the irs on and on. he is an autocrat. authoritarian, a dictatorial bent, it is an egomaniac. so, these indictments, he's going to have to wear them as some kind of badge of honor. it's his only escape from potentially, his only escape from prison as winning the white house. you're watching all these other candidates in iowa. ron desantis, is running for the presidency. chris christie. only donald trump has that extra motivation. he could end up spending years in jail if he doesn't win the presidency. i would say this is about the we are this spectacle in our nation's history. we put a mafioso gangster el cajon dillinger pretty boy floyd iconic outlaw vote figure at a top of the grand old party of abraham lincoln. >> let's stay on that a little bit. it's not just that trump is vying to be the republican nominee in 2024's presidential election after being criminally indicted, he is also signaled that he would expand the powers of the president if he is reelected for a second term. is that where you?
