to a verdict avoiding government shutdown? >> ken paxton, he just survived his impeachment trial and the threat of being removed from office over allegations of corruption. one of the states impeachment managers joins me to explain what happened at today's senate vote. i'm simone sanders townsend, and i have something to say. ♪ ♪ ♪ we begin with seismic developments this week on capitol hill and in high-profile legal investigations. the latest? a filing from special counsel john smith in the election interference case against former president donald trump. smith has asked the judge to grant an order narrowly limiting trump from making public statements about the identities and testimonies of witnesses. as well as any disparaging or intimidating statements about any party in the case. including attorneys or court personnel. just hours after that filing was unsealed, trump ranted against jack smith on his social media platform. and during his campaign events, calling the special counsel, quote unquote, deranged. this is the exact behavior the filing was talking about. but, folks that is not the only legal news this week. hunter biden was indicted by a grand jury after an investigation by the u.s. attorney david weiss in delaware who has the special counsel status. now, two counts in the indictment accused hunter biden of lying about his drug usage on a firearms license form. the third count relates to biden's possession of a firearm while using drugs. here is what biden's attorney abbe lowell had to say in response. >> this office has never brought a charge like this against anybody. when they are bringing the, charged as either because someone has had the gun in the commission of a crime. they have bought multiple guns, they are struggling caught pressures in it for someone. elsewhere their felony possession. that, none of that is true about hunter biden. >> this indictment comes as republican house members have been desperately trying to link president joe biden to hunter biden's business dealings. oversight committee james comer had this to say. >> that is one of about a dozen crimes that hunter biden has committed. and ironically that is the one crime that he committed that she could not tie joe biden to. >> to be clear, the house oversight committee's investigation into whether president biden profited from his son's business dealings while serving as vice president, it has produced zero evidence. at this point, i think you could say that all the committee has done is prove joe biden did nothing. nada, xuzhe. so the fact is they are basing this inquiry on allegations and assumptions. yet republican house speaker kevin mccarthy unilaterally authorized an impeachment inquiry, despite promising on september 1st that he wouldn't pursue an inquiry without a floor vote. this is the speaker's latest cave to the demands of a small but very vocal minority in the house. the so-called freedom caucus. but not all republicans are on board, not even all the freedom caucus members. congressman from colorado and freedom caucus members can buck, he blasted the inquiry in a recent op-ed for the washington post. writing, republicans in the house who are itching for an impeachment are relying on an imagined history. it is hard to imagine that this is where house republicans priorities are, as our nation speeds towards a government shutdown. only seven working days left for the house to pass a resolution to fund the government beyond the september 30th deadline. or, you know, passive budget. if a resolution is not passed by september 30th, hundreds of thousands of federal workers will be -- that means they will be temporarily laid off without pay during the time that they are laid off. during thea vast array of publis that folks rely, on they will come to free screeching halt. let's not get into that major news of federal court in washington d.c.. the special counsel filed a request to nearly restrict donald trump's public attacks, right? remember, he said that these are false and disparaging speech, and that could prejudice retained a jury pool. quote, resulting threats or harassment to individuals that he singled out. trump's legal team has until september 25th to respond to the filing. and the special counsel office will then have five days to reply. and then after, that judge chutkan will decide. within hours of the filing being unsealed, donald trump responded directly. >> did you see today that deranged jack smith, he is the prosecutor, he is a deranged person. he wants to take away my rights under the first amendment, wants to take away my right of speaking freely and openly. never forget, our enemies want to stop us because we are the only ones that can stop them. they want to take away my freedom because i will never let them take away your freedom. >> okay. the freedom conversation, again, it is not. truly like to point out that this is the kind of comment that the protective order requests sites. jackson's motion included several of donald trump's truth social post as example. like the one that reads, if you go after me, i am coming after you. which he published just after his indictment in this very case. and the special counsel's office added that he has made good on his threat. but defendant has spread disparaging and inflammatory public posts on truth social on a near-daily basis regarding the citizens of the district of columbia. the court, prosecutors, and prospective witnesses. for more, i want to welcome former federal prosecutor shan wu. okay, shannon, thank you for being here. i feel like you are the perfect person to break this down. can we just talk about this protective order? not productive order, pardon me, folks are calling it a gag order but i have a very much intent to talk about the judge is going to talk about whether a limit will be placed on what team trump is able to say. why do you think at this juncture, jack smith and his team felt it was necessary to make this request? >> well, they are laying the foundation and it's very obvious the kind of tendencies trump wasn't from submitting his defense. and they want to make it clear to trump, and the data foundation for that, that he can't attempt to disparage or verbally attack witnesses, because it is dangerous for people, we have seen that already in the country. but there is a challenge here, and the challenges mostly for the judge. special counsel can make these, points after the restrictions, even possibly bring other charges for what this harassment or intimidation. but it's the judge that's gonna have to balance how do i balance the first amendment right as somebody running for president, and anyone's right to declare innocence versus this harassment. i actually, think simone, it's a pretty easy rule. he can say that isn't as much as he, wants but what you can't do is call people names, you know, call the prosecutor deranged. call the district of columbia a dirty place. those kind of things can cause harassment and violence towards people. and tainted jury pool. >> you know, donald trump obviously sat down for an interview with my colleague, kristen walker, the new moderator of meet the press. that will air tomorrow. and in that conversation, also previously, he said this a lot of places as of now. he said he will testify. now, we don't know where donald trump is saying he is going to testify. he is claiming that it will be under oath. do you think we will actually ever see donald trump take the stand in any of these cases? whether we are talking washington d.c. or georgia or manhattan, anywhere? >> it would be a mistake for him to testify. most criminal defendants don't do themselves any favors when they testify. here is the random factor with him. his lawyers have to really listen to him. they seem to be very much guarded by him and don't seem to be able to talk any sense into him or keep him restrained. so if he pushes them hard enough, they may let him do it. now, whether he actually wants to do it versus he is just bolstering this lane. because while it is fine for him to want to talk on the stand, it is probably not fine for him to get cross-examined, he won't like that very much. >> i highly doubt it. before i let you go on this, i do want to ask you about hunter biden, okay? three charges that the u.s. attorney in delaware who has special counsel status is bringing two of these charges about a four firearm, a form, he -- apoxsee check on this form for a firearm and he checked the box that noted that he was not under the influence of any drugs or wasn't using narcotics. and then in the third count is for having a being in possession of a firearm while using narcotics. m whwhat happens next in this c? i've heard some people suggest that a plea agreement could be back on the table. but the u.s. attorney has charged hunter biden, so wouldn't that suggest a plea agreement is out of the question? >> while at this point it is certainly off the table. i, mean they tried to put him in the diversion program, the whole thing broke down and went down and crashed and burned. so they have charges. but lots of cases do still play out even after an indictment. sometimes they play out in the middle of the trial. so going, forward i don't think they should. i think this is like star trek's five-year mission. they have had this long to explore new charges the could come up with. they should have been resolved a while back. and they should resolve it now. >> they should resolve it now. i want to bring in melissa to the conversation, melissa, former fulton county prosecutor, melissa, so glad you can be with us. before we talk about what is happening in georgia, i want to get your thoughts on some of the -- my colleague, kristen walker, meet the press, moderator tomorrow, she's got this interview with donald trump. i want to play, one donald trump was asked about the security camera footage that he is accused of being requested to be deleted. i want to play this for you. >> i want to ask you about the case related to mar-a-lago. a new charge suggests you asked a staffer to delete security camera footage so it wouldn't get into the hands of investigators. >> that's false. >> it's false? when you testified to that under oath? >> i will testify. if >> you will testify that under, okay. >> it's a fake charge by this deranged lunatic prosecutor who lost in the supreme court 19 nothing any tried to destroy a lot of lives. he is a lunatic. so it's a picture. but more importantly, the tapes weren't deleted, in other words, there is nothing them to them. and they were my tapes. i could have fought them, i didn't even have to give the tapes, i don't think. i would have won in court. when they asked for the tapes, i said, sure there might. tapes i could have fought. them i didn't have to give. them just so you understand the, we didn't delete anything, nothing was deleted. >> so that is false. the people who testified -- >> number, one the flame is false, much more importantly, when the tapes come and everyone says, this they were deleted. given 100%. >> you can see more of this interview tomorrow on meet the press. i will note, kristen also extended an invitation to president biden to be interviewed. okay, melissa, i have to imagine that fani willis is going to be watching meet the press tomorrow. and everyone in her office with their pen and pad, to see what donald trump has to say. because that is how he is talking about the florida, case i can only imagine that he is going to say something about georgia. your thoughts? >> there is no way he is going to be able to avoid talking about the case. i want to mention all of them. i am sure to his attorneys to spare, you really don't -- criminal documents talking about the facts of any of them under any circumstances. everything he said is public knowledge. it can be used against him if he says anything incriminating, anything different from how he could possibly testify in the future. he is locking himself into a version of this event or story or theory of a defense. and you just don't want that prior to going to trial in any case. i think you are right, i think i anticipate that if he is -- and then some. >> so in the latest in fulton county, cheeseborough and -- have officially severed their cases from the other 16 codefendants and president trump, former president trump. so what happens now to donald trump and the 16 codefendants. because on october 23rd, chesebro and pow, they are going to court. what about everyone else? >> everybody else has to determine where they want to be. so we have a few that are still calling petitions to remove their case to federal court. each of those cases has have to be heard. and i mentioned judge jones will have a separate hearing for each individual. there may be appeals determining depending on how he rules on those cases. as we have seen in the metals case. he has given a deadline, i believe around september 29th for those individuals who have not yet weighed their right to a speedy trial. to do so, anyone who does ask for a speedy trial will immediately join -- october 23rd. i can't imagine anybody would want to do that on such a short time period, and the amount of information that is -- exchanged in discovery. so i imagine they will be on a separate track yet to be determined. >> all right, melissa redmon, shan wu, thank you both very, very much. up next, folks, house republicans, they are apparently too busy bickering about impeaching president biden with no evidence of wrongdoing, by the way, to work out a way to find the government before time runs out. that's most important, i've got congresswoman melanie stansbury who sits on the oversight committee to join me. and she is going to talk about what is that, stake whether democrats can use the republican infighting to their advantage. and are we gonna fund the government? (vo) subaru is the national park foundation's largest corporate donor, helping expand access for all. as republicans appear more preoccupied with their effort to impeach president biden, again based on evidence that they still don't have. then funding the government before the september 30th deadline. the freedom caucus has vowed to oppose any continuing resolution to avoid a shutdown. unless their laundry list of demands are cater to. these demands that will be dead on arrival in the senate. against amongst democrats and frankly republicans. they are even threatening to jeopardize mccarthy's speakership by invoking a motion to vacate the chair. here is what republican congressman matt gaetz said on the house floor earlier this week. >> mister speaker, you are out of compliance with the agreement that allowed you to assume this role. the path forward for the house of representatives is to either bring you into a immediate total compliance, or remove you. >> immediate, total compliance. well, nbc news reports that in a closed door conference, meeting speaker mccarthy challenged his detractors to, quote, file the effing. motion and he did not say effing. once again, the speaker has mentioned just a complete inability to get his house in order. and the freedom caucus is yet again using their leverage to put pelley petty politics over the needs of everyday americans. and the stability of our government, might i add. the question is, will house republicans come to their senses. or will they drive the economy over a cliff? joining me now to discuss is democratic congresswoman and house oversight committee member melanie stansbury. welcome, welcome, welcome to you. i want to talk about this motion to vacate the chair. if it is brought, will democrats join it? >> well i think it is obvious that we don't support speaker mccarthy's speakership. he couldn't even get the votes in 15 rounds of votes to become the speaker in the first place. and we stand strongly behind hakeem just to be the next speaker of the house. but i think the inability of the gop to pass a, budget to even bring a rule to pass the budget to the floor shows their complete lack of seriousness about governing the political stunts they're willing to pull, and to thank the american economy in the process. and that they lack any appreciation and support for basic democratic institutions. and, you know, i think it is noteworthy that kevin mccarthy went out today or this week and said he was willing to launch an impeachment with zero evidence in order to hold a speakership. >> for me it seems like he did it to, you know, placate the freedom caucus. matt gaetz still went to the floor and that fiery clip was after mccarthy announced the impeachment inquiry. so there is a lot of infighting amongst republicans, particularly in the republican conference in the house. i remember a time when all anybody in washington would talk about was democrats in disarray. but in the house, it seems, the democrats are in a court. is there a discussion amongst democrats in the house to use this republican infighting to their advantage? or, are you all really just focused on the government funding? >> i think democrats are unilaterally focused on governing. we are trying to get a budget across the finish line. we are trying to get a firm bill finished. we have federal aviation legislation we are trying to get done. and we understand the consequences of a government shutdown. in fact, the last time that a government shutdown happened, it cost the american people 11 billion dollars. we are talking about millions of americans that want to be getting a paycheck, putting a roof over their head, putting food on their table. so that is what democrats are really focused on. but at the end of the day, we know that a shutdown is not what the american people want. i just came back from six weeks in my district traveling to my rural and tribal areas that i represent. and the american people, new mexicans, are tired of this. they don't want to see this fighting, they want to see a government that represents them. that is gonna fight for them. and that really wants to get something done. so it is really going to be to the political detriment, i think, of republicans to continue down this path. >> you, know you talk about what folks in your district are talking about. i have to imagine that impeachment is not at the top of their list, yet james comer and frankly speaker mccarthy as we just discussed are charging forward. you sit on the house oversight committee, we don't have time to play the sound, but the ranking member on the committee, jamie raskin, he is very forceful about the strategy that you all have been employing. talk to me a little bit about the strategy. i know you have all been having meetings and are you aware of any communication between donald trump and house oversight republicans? [♪♪] >> embattled texas attorney general ken paxton has been acquitted of all charges in his historic impeachment trial in the texas senate. the far-right republican faced 16 articles of impeachment, raging from disregard of official duty to constitutional robbery. state senator angela paxton, the attorney general's wife, was not allowed to vote. paxton issued a triumphant statement, saying, in part, the truth could not be buried by mudslinging politicians or their powerful benefactors. interesting that it is he who is in trouble for his benefactors. but paxton is still in some serious legal jeopardy. he's facing a felony fraud case in texas and an fbi investigation initiated by four former staffers of his. joining me now is texas state representative and johnson. she was the vice chair for the house impeachment managers and says today is the darkest of days for texas. state representative johnson, thanks very much for being here. you were tasked with summarizing the alleged misconduct, what is your reaction to this verdict? >> i am deeply disappointed and devastated. this is not who texas is in the texas senate. the republicans in that chamber put a corrupt individual back in as the top cop, as the head of the texas attorney generals office, despite the fact that numerous loyal conservative republicans within his own office hour the ones that outright about the fulfillment criminal conduct that he was using the office and hijack the office to benefit a man they call -- giving him the case to the office, even though he was under federal investigation. the attorney general completely went against the interest of all texans animal enforcement, and republicans just put him back in the office. >> state representative johnson, you know this all started, it really boils down to the attorney general asking or requesting that three point $3 million of state funds be paid to settle a lawsuit from the four individuals you just named, these whistleblowers who came forward. after all of the evidence was presented, 59 republicans in the house, nearly 70%, voted to impeach paxton. that was in may. so are you surprised about how senate republicans came down on this issue? i've got a great panel to talk about. it maria teresa kumar, an msnbc critic peter and president and ceo of -- and sarah chamberlain is here. she's a republican strategist and president and ceo of republican mainstream partnership. we've got a lot of presidents and ceos in here today, okay. sarah, what does romney's -- the question i ask, what does his departure mean for the party and the senate? >> and for the country, i would argue. it's a shame. he is an older gentlemen. he's kind of right, it is time to pass the torch. it will be a great loss for the senate. and really for the country. he's a fine human being. whether you agree with his politics or, not hit a wonderful human. >> marie teresa, the commencement army from the atlantic saying that, a large portion of his party doesn't believe in the constitution, it is remarkable that this is the same met romney that was the 2012 republican nominee. just what has happened in the years since then? it's crazy. >> i think that the challenge. to your point, what you're saying, mitt romney is very much a republican. he believes in the constitution. he believes in this idea public service, and moving forward. and the people in charge right now, the republican party, the trump party. don't want to have any of it. they don't want to have actual laws that they have to abide by. they don't want to play by the rules. but that does provide an opportunity to see what he wants. more individuals, young, commitment to the party. what would that would? like we were talking off air, if it mcmillon ran as an independent in utah, and he ran as an independent. it will be interesting to see if he throws his head in the ring. and this could be a way for him to -- for mitt romney to make way for -- >> there was a recent poll, dan jones and associates paul, it was actually conducted last month. and it found that 54% of utah voters approve of trump's performance. so sarah, carrying on from what maria teresa kumar said, do you think there is an appetite for a romney-esque or evan mcmullin kind of person, because there were also some far-right candidates and iota i can imagine or thinking about this it. now >> absolutely an appetite for a middle of the road type republican. the republican party, we have 90 of them. they do exist. and i do think mitt romney will do his best to turn over her seat to someone who's more like him, who's just a politically younger generation. i think it's time to stop having 78 and eight year old people, and push it back to maybe 50 and 60-year-old, supporting the? >> because the republican party members -- working very hard to try to cut a deal with the freedom caucus and trying to at least get a cr. trying to do something. they believed and putting america first and i shouldn't certainly doesn't do that and doesn't benefit republicans to shut it down. so they are in heated discussions now trying to find a good compromise. >> maria teresa, i played the sound of matt gaetz earlier today, and those comments can directly after speaker mccarthy gave the freedom caucus what they wanted. an impeachment inquiry into president biden. i was floored. you didn't ask to speak to the speaker that way. >> especially when he's on the spain team as. you are trying to really figure out what is matt gaetz strategy. >> or the freedom caucus a strategy. >> or him, he's putting himself and his position. what is his strategy? what is his aspirations? right, now if you have the speaker of the house on your side, your road to basically rising into the political party is a very, very limited. >> you have to assume he cursed about that. >> there. >> but i was happy to see the speaker responds to him and conference and we all know what he said. >> he said -- >> and if you see, matt gaetz has not responded. >> i think speaker mccarthy is calling the bluff. as we talk about this looming potential shutdown, we put a number of federal workers out of work and not without pay. thousands more, you know, some wealthy furloughed workers supported by paint, once the government reopened. but thousands of workers would. not contra or, cresswell cove. that's happening. a strike is happening. we're gonna talk to a member on the picket line later today. just -- this seems like a summer of strikes, maria teresa. it seems like the labor movement is definitely having a moment. >> and i think it has to do with everything with what biden's able to pass in legislate, what he's basically been able to do. bulging are infinite once again, workers are saying we are happy to go in and build that infrastructure but we have to recognize that inflation is a really big deal. how do we make sure we are negotiating, not for you after this gorgeous, but for a future purchase? and effect the president came out and support for this happening in the united states, for everyday americans, that is going to be his campaign. and he's actually has -- you're seeing wages rise. you are seeing gas prices fall. and you're seeing food prices go down. so he needs to make sure he is constantly on the worker side, an order for him to go to the next level. and that is his reelection. and i think that's were, for the republicans, it becomes difficult because these are those people who voted against his whole agenda. >> his whole agenda, and who traditionally, as of late, are not necessarily pigment opinions. and so it was working to meet her a number of -- donald trump, but a number of other republicans speak out in support of the uaw workers. what is going on there? >> actually, it's been a myth, again, with the main street 19 members. many of them are very close with unions. union support main street have a good deal. and we support the american worker. not all republicans are against unions. >> and we did receive the erosion of democratic support from unions and the midwest, when donald trump became the ticket. and i think that is where the replicas really have a hard time saying -- government shutdown, to? all >> right now, the most important's wages and ending the two t errors. it is hard to pick one thing that's important. because over the years, everything has snowballed so much that we are missing a lot of what you once had, and we haven't made any adjustments as the world goes around. >> so, tiffanie, when we have told about this compensations terrorist term earlier, you just said the top two things are wages and the tears. can you just explain what that term means, when we talk about competition tiers and what eliminating them would do? >> so, right now we have more cars that have come in and it will take them a number of years to gain full pay. whereas, when i came in, it took me eight years to gain full pay. my father, it took him 90 days to gain full pay. everyone is indifference, different journeys with the company right now. instead of clipping everybody on the same page. ending tiers and ending progression would put everybody on the same page. it builds a divide within the workers, it built into five between the workers and the company. it's all around, it's not right. >> i wrote it down when you said it. it took you eight years and it took her father 90 days. there is a chasm of discrepancy there. can't you talk to us about how has it been being, you're at one of the plants that's on strike. take us to the picket line. how are folks feeling and what is the response been from the plant? >> the adrenaline is high. we lift the plant peacefully, quietly. everyone is hopeful, everyone is excited. there is a nervousness to its. of course, due to the situation. but everyone knows that for some, this is a fight, it does a fight for our of life. this has been a long time coming. so for us to finally get here, it is a monumental thing. >> you know, ever since thursday, i was up first night at 11:59 pm, eastern time, like, is that happening? it's not happening? and when i saw that the uaw members recover a strike, i just thought about all of the lawmakers and folks who are now traveling to be with folks on the picket line at one of the three plans. you heard president biden. he spoke out in support of uaw members. what do you feel? to a verdict avoiding government shutdown? >> ken paxton, he just survived his impeachment trial and the threat of being removed from office over allegations of corruption. one of the states impeachment managers joins me to explain what happened at today's senate vote. i'm simone sanders townsend, and i have something to say. ♪ ♪ ♪ we begin with seismic developments this week on capitol hill and in high-profile legal investigations. the latest? a filing from special counsel john smith in the election interference case against former president donald trump. smith has asked the judge to grant an order narrowly limiting trump from making public statements about the identities and testimonies of witnesses. as well as any disparaging or intimidating statements about any party in the case. including attorneys or court personnel. just hours after that filing was unsealed, trump ranted against jack smith on his social media platform. and during his campaign events, calling the special counsel, quote unquote, deranged. this is the exact behavior the filing was talking about. but, folks that is not the only legal news this week. hunter biden was indicted by a grand jury after an investigation by the u.s. attorney david weiss in delaware who has the special counsel status. now, two counts in the indictment accused hunter biden of lying about his drug usage on a firearms license form. the third count relates to biden's possession of a firearm while using drugs. here is what biden's attorney abbe lowell had to say in response. >> this office has never brought a charge like this against anybody. when they are bringing the, charged as either because someone has had the gun in the commission of a crime. they have bought multiple guns, they are struggling caught pressures in it for someone. elsewhere their felony possession. that, none of that is true about hunter biden. >> this indictment comes as republican house members have been desperately trying to link president joe biden to hunter biden's business dealings. oversight committee james comer had this to say. >> that is one of about a dozen crimes that hunter biden has committed. and ironically that is the one crime that he committed that she could not tie joe biden to. >> to be clear, the house oversight committee's investigation into whether president biden profited from his son's business dealings while serving as vice president, it has produced zero evidence. at this point, i think you could say that all the committee has done is prove joe biden did nothing. nada, xuzhe. so the fact is they are basing this inquiry on allegations and assumptions. yet republican house speaker kevin mccarthy unilaterally authorized an impeachment inquiry, despite promising on september 1st that he wouldn't pursue an inquiry without a floor vote. this is the speaker's latest cave to the demands of a small but very vocal minority in the house. the so-called freedom caucus. but not all republicans are on board, not even all the freedom caucus members. congressman from colorado and freedom caucus members can buck, he blasted the inquiry in a recent op-ed for the washington post. writing, republicans in the house who are itching for an impeachment are relying on an imagined history. it is hard to imagine that this is where house republicans priorities are, as our nation speeds towards a government shutdown. only seven working days left for the house to pass a resolution to fund the government beyond the september 30th deadline. or, you know, passive budget. if a resolution is not passed by september 30th, hundreds of thousands of federal workers will be -- that means they will be temporarily laid off without pay during the time that they are laid off. during thea vast array of publis that folks rely, on they will come to free screeching halt. let's not get into that major news of federal court in washington d.c.. the special counsel filed a request to nearly restrict donald trump's public attacks, right? remember, he said that these are false and disparaging speech, and that could prejudice retained a jury pool. quote, resulting threats or harassment to individuals that he singled out. trump's legal team has until september 25th to respond to the filing. and the special counsel office will then have five days to reply. and then after, that judge chutkan will decide. within hours of the filing being unsealed, donald trump responded directly. >> did you see today that deranged jack smith, he is the prosecutor, he is a deranged person. he wants to take away my rights under the first amendment, wants to take away my right of speaking freely and openly. never forget, our enemies want to stop us because we are the only ones that can stop them. they want to take away my freedom because i will never let them take away your freedom. >> okay. the freedom conversation, again, it is not. truly like to point out that this is the kind of comment that the protective order requests sites. jackson's motion included several of donald trump's truth social post as example. like the one that reads, if you go after me, i am coming after you. which he published just after his indictment in this very case. and the special counsel's office added that he has made good on his threat. but defendant has spread disparaging and inflammatory public posts on truth social on a near-daily basis regarding the citizens of the district of columbia. the court, prosecutors, and prospective witnesses. for more, i want to welcome former federal prosecutor shan wu. okay, shannon, thank you for being here. i feel like you are the perfect person to break this down. can we just talk about this protective order? not productive order, pardon me, folks are calling it a gag order but i have a very much intent to talk about the judge is going to talk about whether a limit will be placed on what team trump is able to say. why do you think at this juncture, jack smith and his team felt it was necessary to make this request? >> well, they are laying the foundation and it's very obvious the kind of tendencies trump wasn't from submitting his defense. and they want to make it clear to trump, and the data foundation for that, that he can't attempt to disparage or verbally attack witnesses, because it is dangerous for people, we have seen that already in the country. but there is a challenge here, and the challenges mostly for the judge. special counsel can make these, points after the restrictions, even possibly bring other charges for what this harassment or intimidation. but it's the judge that's gonna have to balance how do i balance the first amendment right as somebody running for president, and anyone's right to declare innocence versus this harassment. i actually, think simone, it's a pretty easy rule. he can say that isn't as much as he, wants but what you can't do is call people names, you know, call the prosecutor deranged. call the district of columbia a dirty place. those kind of things can cause harassment and violence towards people. and tainted jury pool. >> you know, donald trump obviously sat down for an interview with my colleague, kristen walker, the new moderator of meet the press. that will air tomorrow. and in that conversation, also previously, he said this a lot of places as of now. he said he will testify. now, we don't know where donald trump is saying he is going to testify. he is claiming that it will be under oath. do you think we will actually ever see donald trump take the stand in any of these cases? whether we are talking washington d.c. or georgia or manhattan, anywhere? >> it would be a mistake for him to testify. most criminal defendants don't do themselves any favors when they testify. here is the random factor with him. his lawyers have to really listen to him. they seem to be very much guarded by him and don't seem to be able to talk any sense into him or keep him restrained. so if he pushes them hard enough, they may let him do it. now, whether he actually wants to do it versus he is just bolstering this lane. because while it is fine for him to want to talk on the stand, it is probably not fine for him to get cross-examined, he won't like that very much. >> i highly doubt it. before i let you go on this, i do want to ask you about hunter biden, okay? three charges that the u.s. attorney in delaware who has special counsel status is bringing two of these charges about a four firearm, a form, he -- apoxsee check on this form for a firearm and he checked the box that noted that he was not under the influence of any drugs or wasn't using narcotics. and then in the third count is for having a being in possession of a firearm while using narcotics. m whwhat happens next in this c? i've heard some people suggest that a plea agreement could be back on the table. but the u.s. attorney has charged hunter biden, so wouldn't that suggest a plea agreement is out of the question? >> while at this point it is certainly off the table. i, mean they tried to put him in the diversion program, the whole thing broke down and went down and crashed and burned. so they have charges. but lots of cases do still play out even after an indictment. sometimes they play out in the middle of the trial. so going, forward i don't think they should. i think this is like star trek's five-year mission. they have had this long to explore new charges the could come up with. they should have been resolved a while back. and they should resolve it now. >> they should resolve it now. i want to bring in melissa to the conversation, melissa, former fulton county prosecutor, melissa, so glad you can be with us. before we talk about what is happening in georgia, i want to get your thoughts on some of the -- my colleague, kristen walker, meet the press, moderator tomorrow, she's got this interview with donald trump. i want to play, one donald trump was asked about the security camera footage that he is accused of being requested to be deleted. i want to play this for you. >> i want to ask you about the case related to mar-a-lago. a new charge suggests you asked a staffer to delete security camera footage so it wouldn't get into the hands of investigators. >> that's false. >> it's false? when you testified to that under oath? >> i will testify. if >> you will testify that under, okay. >> it's a fake charge by this deranged lunatic prosecutor who lost in the supreme court 19 nothing any tried to destroy a lot of lives. he is a lunatic. so it's a picture. but more importantly, the tapes weren't deleted, in other words, there is nothing them to them. and they were my tapes. i could have fought them, i didn't even have to give the tapes, i don't think. i would have won in court. when they asked for the tapes, i said, sure there might. tapes i could have fought. them i didn't have to give. them just so you understand the, we didn't delete anything, nothing was deleted. >> so that is false. the people who testified -- >> number, one the flame is false, much more importantly, when the tapes come and everyone says, this they were deleted. given 100%. >> you can see more of this interview tomorrow on meet the press. i will note, kristen also extended an invitation to president biden to be interviewed. okay, melissa, i have to imagine that fani willis is going to be watching meet the press tomorrow. and everyone in her office with their pen and pad, to see what donald trump has to say. because that is how he is talking about the florida, case i can only imagine that he is going to say something about georgia. your thoughts? >> there is no way he is going to be able to avoid talking about the case. i want to mention all of them. i am sure to his attorneys to spare, you really don't -- criminal documents talking about the facts of any of them under any circumstances. everything he said is public knowledge. it can be used against him if he says anything incriminating, anything different from how he could possibly testify in the future. he is locking himself into a version of this event or story or theory of a defense. and you just don't want that prior to going to trial in any case. i think you are right, i think i anticipate that if he is -- and then some. >> so in the latest in fulton county, cheeseborough and -- have officially severed their cases from the other 16 codefendants and president trump, former president trump. so what happens now to donald trump and the 16 codefendants. because on october 23rd, chesebro and pow, they are going to court. what about everyone else? >> everybody else has to determine where they want to be. so we have a few that are still calling petitions to remove their case to federal court. each of those cases has have to be heard. and i mentioned judge jones will have a separate hearing for each individual. there may be appeals determining depending on how he rules on those cases. as we have seen in the metals case. he has given a deadline, i believe around september 29th for those individuals who have not yet weighed their right to a speedy trial. to do so, anyone who does ask for a speedy trial will immediately join -- october 23rd. i can't imagine anybody would want to do that on such a short time period, and the amount of information that is -- exchanged in discovery. so i imagine they will be on a separate track yet to be determined. >> all right, melissa redmon, shan wu, thank you both very, very much. up next, folks, house republicans, they are apparently too busy bickering about impeaching president biden with no evidence of wrongdoing, by the way, to work out a way to find the government before time runs out. that's most important, i've got congresswoman melanie stansbury who sits on the oversight committee to join me. and she is going to talk about what is that, stake whether democrats can use the republican infighting to their advantage. and are we gonna fund the government? (vo) subaru is the national park foundation's largest corporate donor, helping expand access for all. as republicans appear more preoccupied with their effort to impeach president biden, again based on evidence that they still don't have. then funding the government before the september 30th deadline. the freedom caucus has vowed to oppose any continuing resolution to avoid a shutdown. unless their laundry list of demands are cater to. these demands that will be dead on arrival in the senate. against amongst democrats and frankly republicans. they are even threatening to jeopardize mccarthy's speakership by invoking a motion to vacate the chair. here is what republican congressman matt gaetz said on the house floor earlier this week. >> mister speaker, you are out of compliance with the agreement that allowed you to assume this role. the path forward for the house of representatives is to either bring you into a immediate total compliance, or remove you. >> immediate, total compliance. well, nbc news reports that in a closed door conference, meeting speaker mccarthy challenged his detractors to, quote, file the effing. motion and he did not say effing. once again, the speaker has mentioned just a complete inability to get his house in order. and the freedom caucus is yet again using their leverage to put pelley petty politics over the needs of everyday americans. and the stability of our government, might i add. the question is, will house republicans come to their senses. or will they drive the economy over a cliff? joining me now to discuss is democratic congresswoman and house oversight committee member melanie stansbury. welcome, welcome, welcome to you. i want to talk about this motion to vacate the chair. if it is brought, will democrats join it? >> well i think it is obvious that we don't support speaker mccarthy's speakership. he couldn't even get the votes in 15 rounds of votes to become the speaker in the first place. and we stand strongly behind hakeem just to be the next speaker of the house. but i think the inability of the gop to pass a, budget to even bring a rule to pass the budget to the floor shows their complete lack of seriousness about governing the political stunts they're willing to pull, and to thank the american economy in the process. and that they lack any appreciation and support for basic democratic institutions. and, you know, i think it is noteworthy that kevin mccarthy went out today or this week and said he was willing to launch an impeachment with zero evidence in order to hold a speakership. >> for me it seems like he did it to, you know, placate the freedom caucus. matt gaetz still went to the floor and that fiery clip was after mccarthy announced the impeachment inquiry. so there is a lot of infighting amongst republicans, particularly in the republican conference in the house. i remember a time when all anybody in washington would talk about was democrats in disarray. but in the house, it seems, the democrats are in a court. is there a discussion amongst democrats in the house to use this republican infighting to their advantage? or, are you all really just focused on the government funding? >> i think democrats are unilaterally focused on governing. we are trying to get a budget across the finish line. we are trying to get a firm bill finished. we have federal aviation legislation we are trying to get done. and we understand the consequences of a government shutdown. in fact, the last time that a government shutdown happened, it cost the american people 11 billion dollars. we are talking about millions of americans that want to be getting a paycheck, putting a roof over their head, putting food on their table. so that is what democrats are really focused on. but at the end of the day, we know that a shutdown is not what the american people want. i just came back from six weeks in my district traveling to my rural and tribal areas that i represent. and the american people, new mexicans, are tired of this. they don't want to see this fighting, they want to see a government that represents them. that is gonna fight for them. and that really wants to get something done. so it is really going to be to the political detriment, i think, of republicans to continue down this path. >> you, know you talk about what folks in your district are talking about. i have to imagine that impeachment is not at the top of their list, yet james comer and frankly speaker mccarthy as we just discussed are charging forward. you sit on the house oversight committee, we don't have time to play the sound, but the ranking member on the committee, jamie raskin, he is very forceful about the strategy that you all have been employing. talk to me a little bit about the strategy. i know you have all been having meetings and are you aware of any communication between donald trump and house oversight republicans? [♪♪] >> embattled texas attorney general ken paxton has been acquitted of all charges in his historic impeachment trial in the texas senate. the far-right republican faced 16 articles of impeachment, raging from disregard of official duty to constitutional robbery. state senator angela paxton, the attorney general's wife, was not allowed to vote. paxton issued a triumphant statement, saying, in part, the truth could not be buried by mudslinging politicians or their powerful benefactors. interesting that it is he who is in trouble for his benefactors. but paxton is still in some serious legal jeopardy. he's facing a felony fraud case in texas and an fbi investigation initiated by four former staffers of his. joining me now is texas state representative and johnson. she was the vice chair for the house impeachment managers and says today is the darkest of days for texas. state representative johnson, thanks very much for being here. you were tasked with summarizing the alleged misconduct, what is your reaction to this verdict? >> i am deeply disappointed and devastated. this is not who texas is in the texas senate. the republicans in that chamber put a corrupt individual back in as the top cop, as the head of the texas attorney generals office, despite the fact that numerous loyal conservative republicans within his own office hour the ones that outright about the fulfillment criminal conduct that he was using the office and hijack the office to benefit a man they call -- giving him the case to the office, even though he was under federal investigation. the attorney general completely went against the interest of all texans animal enforcement, and republicans just put him back in the office. >> state representative johnson, you know this all started, it really boils down to the attorney general asking or requesting that three point $3 million of state funds be paid to settle a lawsuit from the four individuals you just named, these whistleblowers who came forward. after all of the evidence was presented, 59 republicans in the house, nearly 70%, voted to impeach paxton. that was in may. so are you surprised about how senate republicans came down on this issue? i've got a great panel to talk about. it maria teresa kumar, an msnbc critic peter and president and ceo of -- and sarah chamberlain is here. she's a republican strategist and president and ceo of republican mainstream partnership. we've got a lot of presidents and ceos in here today, okay. sarah, what does romney's -- the question i ask, what does his departure mean for the party and the senate? >> and for the country, i would argue. it's a shame. he is an older gentlemen. he's kind of right, it is time to pass the torch. it will be a great loss for the senate. and really for the country. he's a fine human being. whether you agree with his politics or, not hit a wonderful human. >> marie teresa, the commencement army from the atlantic saying that, a large portion of his party doesn't believe in the constitution, it is remarkable that this is the same met romney that was the 2012 republican nominee. just what has happened in the years since then? it's crazy. >> i think that the challenge. to your point, what you're saying, mitt romney is very much a republican. he believes in the constitution. he believes in this idea public service, and moving forward. and the people in charge right now, the republican party, the trump party. don't want to have any of it. they don't want to have actual laws that they have to abide by. they don't want to play by the rules. but that does provide an opportunity to see what he wants. more individuals, young, commitment to the party. what would that would? like we were talking off air, if it mcmillon ran as an independent in utah, and he ran as an independent. it will be interesting to see if he throws his head in the ring. and this could be a way for him to -- for mitt romney to make way for -- >> there was a recent poll, dan jones and associates paul, it was actually conducted last month. and it found that 54% of utah voters approve of trump's performance. so sarah, carrying on from what maria teresa kumar said, do you think there is an appetite for a romney-esque or evan mcmullin kind of person, because there were also some far-right candidates and iota i can imagine or thinking about this it. now >> absolutely an appetite for a middle of the road type republican. the republican party, we have 90 of them. they do exist. and i do think mitt romney will do his best to turn over her seat to someone who's more like him, who's just a politically younger generation. i think it's time to stop having 78 and eight year old people, and push it back to maybe 50 and 60-year-old, supporting the? venus >> us 33-year-olds still gotta wait in line. i want to turn to the government shutdown. limit government shutdown. we were chatting off camera and you don't think the government actually cannot shut down. why? >> because the republican party members -- working very hard to try to cut a deal with the freedom caucus and trying to at least get a cr. trying to do something. they believed and putting america first and i shouldn't certainly doesn't do that and doesn't benefit republicans to shut it down. so they are in heated discussions now trying to find a good compromise. >> maria teresa, i played the sound of matt gaetz earlier today, and those comments can directly after speaker mccarthy gave the freedom caucus what they wanted. an impeachment inquiry into president biden. i was floored. you didn't ask to speak to the speaker that way. >> especially when he's on the spain team as. you are trying to really figure out what is matt gaetz strategy. >> or the freedom caucus a strategy. >> or him, he's putting himself and his position. what is his strategy? what is his aspirations? right, now if you have the speaker of the house on your side, your road to basically rising into the political party is a very, very limited. >> you have to assume he cursed about that. >> there. >> but i was happy to see the speaker responds to him and conference and we all know what he said. >> he said -- >> and if you see, matt gaetz has not responded. >> i think speaker mccarthy is calling the bluff. as we talk about this looming potential shutdown, we put a number of federal workers out of work and not without pay. thousands more, you know, some wealthy furloughed workers supported by paint, once the government reopened. but thousands of workers would. not contra or, cresswell cove. that's happening. a strike is happening. we're gonna talk to a member on the picket line later today. just -- this seems like a summer of strikes, maria teresa. it seems like the labor movement is definitely having a moment. >> and i think it has to do with everything with what biden's able to pass in legislate, what he's basically been able to do. bulging are infinite once again, workers are saying we are happy to go in and build that infrastructure but we have to recognize that inflation is a really big deal. how do we make sure we are negotiating, not for you after this gorgeous, but for a future purchase? and effect the president came out and support for this happening in the united states, for everyday americans, that is going to be his campaign. and he's actually has -- you're seeing wages rise. you are seeing gas prices fall. and you're seeing food prices go down. so he needs to make sure he is constantly on the worker side, an order for him to go to the next level. and that is his reelection. and i think that's were, for the republicans, it becomes difficult because these are those people who voted against his whole agenda. >> his whole agenda, and who traditionally, as of late, are not necessarily pigment opinions. and so it was working to meet her a number of -- donald trump, but a number of other republicans speak out in support of the uaw workers. what is going on there? >> actually, it's been a myth, again, with the main street 19 members. many of them are very close with unions. union support main street have a good deal. and we support the american worker. not all republicans are against unions. >> and we did receive the erosion of democratic support from unions and the midwest, when donald trump became the ticket. and i think that is where the replicas really have a hard time saying -- government shutdown, to? all >> right now, the most important's wages and ending the two t errors. it is hard to pick one thing that's important. because over the years, everything has snowballed so much that we are missing a lot of what you once had, and we haven't made any adjustments as the world goes around. >> so, tiffanie, when we have told about this compensations terrorist term earlier, you just said the top two things are wages and the tears. can you just explain what that term means, when we talk about competition tiers and what eliminating them would do? >> so, right now we have more cars that have come in and it will take them a number of years to gain full pay. whereas, when i came in, it took me eight years to gain full pay. my father, it took him 90 days to gain full pay. everyone is indifference, different journeys with the company right now. instead of clipping everybody on the same page. ending tiers and ending progression would put everybody on the same page. it builds a divide within the workers, it built into five between the workers and the company. it's all around, it's not right. >> i wrote it down when you said it. it took you eight years and it took her father 90 days. there is a chasm of discrepancy there. can't you talk to us about how has it been being, you're at one of the plants that's on strike. take us to the picket line. how are folks feeling and what is the response been from the plant? >> the adrenaline is high. we lift the plant peacefully, quietly. everyone is hopeful, everyone is excited. there is a nervousness to its. of course, due to the situation. but everyone knows that for some, this is a fight, it does a fight for our of life. this has been a long time coming. so for us to finally get here, it is a monumental thing. >> you know, ever since thursday, i was up first night at 11:59 pm, eastern time, like, is that happening? it's not happening? and when i saw that the uaw members recover a strike, i just thought about all of the lawmakers and folks who are now traveling to be with folks on the picket line at one of the three plans. you heard president biden. he spoke out in support of uaw members. what do you feel?
