Legacy. This was a good day for america america. Obama care is here to stay. Today in a landmark 63 decision, the Supreme Court voted to uphold nationwide subsidies to help poor and middle class americans Purchase Health insurance under the Affordable Care act. The justice appointed by president george w. Bush chief Justice John Roberts wrote the majority opinion for the court. Leaving no doubts for his judicial the power to make the law rests with those chosen by the people. Congress passed the Affordable Care act to improve Health Insurance markets, not to destroy them. In plain terms, the decision means everyone who got Health Insurance through healthcare. Gov will get to keep their plans. Since most states operate through the federal exchange. Removing the subsidies would have kicked 6. 4 Million People off their health care plans. The decision seals the fate on a law in which president obama has staked much on his presidency. The president was thrilled following the announcement. We finally declared that in america, health care is not a privilege for a few, but a right for all. After more than 50 votes in congress to repeal or weaken this law. After a president ial election based in part on preserving or repealing this law, after multiple challenges to this law before the Supreme Court, the Affordable Care act is here to stay. This is not about the Affordable Care act as legislation or obama care as a political football. This is health care in america. This afternoon, i spoke to the official in charge of implementing the law during its launch, former secretary of health and Human Services kathleen sebelius. Secretary sebelius thanks for joining me today. I know its a big day for a lot of people in the administration and who are former Administration Officials for all the defense youve done on this law. Do you feel vindicated today . Well i think this law has always been about people who wanted and needed desperately Affordable Health coverage. Theres 6. 4 Million People who know the coverage that they have can continue on with subsidies and millions more who can take advantage of it. Ive been a lucky one, ive always had affordable Available Health care so i kneel great for the people who talk to me every day in the Grocery Store and on airplanes and stop me on sidewalks and tell me that this has changed their life forever. They no longer have to worry about affording health care if they get sick taking care of their kids and this is a very good day for those americans. Were you worried . Always. Its unpredictable. I thought the case was incredibly strong. I was confused why the court took it in the first place. Having said that there was no guarantee that the court would find against the plaintiffs i said the great news is that the Strong Majority of the court, including Justice Roberts and kennedy said this is what the law was intended to do to actually improve the insurance market. Help people get Health Insurance, not jeopardize the coverage that they had, so i was really pleased that the decision was so strong and with the 63 majority, hopefully it lays to rest a lot of the issues around is the law constitutional or not, it clearly is. What did you think of Justice Scalia calling this scotus care . Well unfortunately, i think Justice Scalia sees the world through a different lens has not been a fan of this law, in case anyone missed the first decision. And clearly that continues on. And seems to be frustrated by the fact that the majority is growing, not shrinking. Do you think this decision changes the Politics Around the law . When you look at the polling about americans opinions of the aca. 8 say the law is working well thats an nbc wall street journal from today. 40 believes it needs only minor modifications to be improved. Do you think this represents a change in Public Opinion . Well, i think that people are now saying this is the law. I Hope Congress stops relitigating the past i feel like were living in groundhog day. And starts looking toward the future. The president has said from the beginning if there are better ideas about how to ensure millions of americans, how to keep costs low, how to improve the care that people get every day, bring them forward, happy to work on them in 5 1 2 years, the republicans have never had a viable alternative. I think that it indicates the vast majority of the americans felt if the court were to rule with the plaintiffs congress should immediately act to restore the subsidies, they believe in the framework of Affordable Health care. Do you expect that this is actually going to be an issue in 2016 . I certainly hope theyre done. Thats what everyone is saying after 50 votes to repeal this now the Supreme Court has spoken, its time to move on. And this was a great decision today as secretary sebelius said. A broad decision a decisive one, and this is a great day for american women. A lot of folks dont realize how much women gain in the Affordable Care act. Free access to all Preventative Care including mammograms Breast Cancer screening, birth control. Women dont have to pay more for insurance. And they cant be denied coverage. This is a huge revolutionary change for women and a wonderful day. You talk about the winners, its a big win for the administration, its a big win for low income and middle class americans, and specifically overwhelming women the ones that are shunted aside in this process. You have an interesting thees us, and i tend to agree with it which is that with this decision, obama care or Health Insurance, health care in america, has been made a right, and it is no longer a privilege. Explain and expound on that if you can. This is a fundamental change in americas social policy dynamics. And you saw it before this decision actually came down. Primarily what republicans in congress were doing, were coming up with ways many a lot of them were contradictory. But were coming up with ways where they could say, yeah were going to somehow keep these subsidies going, even though the Supreme Court got rid of them. They would promise in two years to completely replace obama care. What that was demonstrating, this is a xi familiaric weve seen before. You see it with medicare social security. Its very hard once a benefit is in place to remove it the politicians are very afraid of creating that kind of disruption. Now that there is a fundamental relationship between the government and low income americans who want access tole th care its going to be hard for any politician to unwind that. Imagine a jeb bush or marco rubio or scott walker coming in as president in january of 2017 and saying as our first act, theyre going to take Health Insurance away from 20 Million People. You would basically be detonating a bomb on top of your own presidency. Its not going to happen. After this this is here to stay. Do you think we are going to have feasible replacement ideas . No. Illustrated and articulated by this republican field of candy dates . I think if there were ideas like this we would have had them already. This is waiting for health reform. We began with repeal and replace, we have just waited and waited and waited and waited for what the replacement would be paul ryan said that before this Supreme Court decision came out, it was very important republicans had their replacement plan, it was clear, it was detailed, it was scored by the congressional budget office, he presented no details and no office scores. Its not an accident. Obama care took a bunch of their ideas, they cant have them any more. And they dont want to make the kind of tough tradeoffs, the often unpopular tradeoffs that are necessary to create a plan which the democrats did. You have the court weighing in a president who has spent years selling this law to the american people. And yet a poll in march, 83 of Americans Still hold the same opinion on obama care that they did in 2010. Why has the American Public remained unpersuaded of the benefits of this law. Even as they seem to like the benefits of this law . Right, i think what ezra said is right, now, and this is what were seeing of planned parenthood, women are coming in who have never been insured before. Women send in their receipts from the pharmacy saying i cant believe it i dont have to pay for these benefits. All the benefits theyre receiving are directly as a result of the Affordable Care act. Do you say this is obama care in action . This is actually messaging and information . Some residents dont realize theyre participating in obama care, and not say, connect. And i think that is the work to be done now. For women, they know the difference of going and not paying anything for their pharmaceuticals, for their coverage for birth control, for their mammogram. As long as we make that link for people, its absolutely, this is the biggest benefit for women that weve ever had in the health care in a century and i agree with ezra as well. They couldnt get this done for 100 years, this is here to stay and now we just have to make it make sure its enforced make sure everyone knows whats available to them. I want to talk about john roberts. Because a lot of folks, i mean the conservative base is accusing him of harassy. Hes being kicked out of some conservative circles. You guys have a really good analysis, which is that thank you. In fact we have to lure you back on somehow. In fact john roberts is actually followed very much in line with the tenets of what conservatives want from their justices, which is narrow rulings, not activist judiciary, but someone that believes very strongly in a smaller role for the courts and deference to the legislative branch. At least what conservatives say they want. Im old enough to remember when george w. Bush who said he wanted justices who would not be trying to reinvent laws or change social policy. Thats what he did here. He decided not to rewrite this law, he decided not to pretend this law wasnt something it wasnt. He decided not to believe a genuinely ridiculous argument. I was really reading the brief, the opinion on this was somehow it was cathartic. The world became slightly crazy, that there was this pretense that obama care was somehow unclear on this question of whether people got tax credits in nonstate based exchanged states. Which had been 100 clear through the debate. We were sort of forced to take this sort of ridiculous idea seriously, and in this decision they did not fwlinch at all, they did not give any quarter to this argument they did not do what they did in the individual mandate decision where they split on medicaid in these weird justification for the mandate, they just said this law is perfectly clear in what it does in how it works, and its not for us to reinterpret it and its not for us to pretend that there is another viable interpretation i honestly found that refreshing, it was a refreshingly nonpolitical judgment. You also saw that in the split by the court. Basically, congress didnt write a law to selfdestruct. And there you have it. Obama care is both a law, but also a symbol a symbol of the fact that the wrong people are running the country and were on the wrong side of the equation. I think its a really fascinating open question, if youre sitting next to the republic nominee, how you navigate this, i think, look approval of the law just ticked up. Its going to be above water, its hard to see how it comes down. In the primary, theres no cost to do the shtick theyve been doing since the law passed which is rail against it and say youre going to repeal it. The courts decision represents a fundamental shift in the social contract. Health insurance is now a right. It is except i think thats right, were optimistic, were looking toward a point when people actually have the coverage they deserve, theres many states where republican governors have not expanded medicaid, and thats huge were talking about january tors and School Bus Drivers who are independent contractors who are working class folks who cannot afford to send their kids and themselves to the doctor. And that is the kind of question that should be called in a president ial campaign cycle. Do we want to be the kind of country where people are working hard and cant afford to see a doctor . I think its still going to be a question, that parts of the law that are still very much not fully implemented. Im glad to see it i think its important for us to have that conversation and start Winning People over beyond the symbolism to what kind of country we want to be. I think also it will be interesting to see when they finally move away from the repeal language and on to trying to fix the law, it may be in the general election where they do that. But the chances for repeal get worse everyone worse with each year because most people are enrolling. This becomes a chronic political issue for them in the way the abortion issue is entitlements its something they can keep coming back to and not invoke the same furor youve seen over the last several years, something they can continue to stoke people with.
