Over the over the top. I dont believe that, you know, them looking into carter page means they were spying on the campaign. If the performance that we had in helsinki took place before those applications were filed, i think that whole interchange with putin would have been a central exhibit in the fisa applications. If you asked the fbi today, how much of the dossier on trump has been verified, almost none of it. But you say mostly, not entirely. Therefore, was the surveillance justified . No, not at all, in my view. If the dossier is the reason you issued the warrant, it is a bunch of garbage. The dossier has proven to be a bunch of garbage. We begin with carter page, the onetime Trump Campaign adviser, denying he was a russian agent, following the release of previously classified documents related to a 2016 fbi wiretap. You did advise the kremlin back in 2013 or 2012, somewhere in there. Jake, thats its really spin. I mean, i i sat in on some meetings, but, you know, to call me an adviser, i think, is way over the top. Informal, having some conversations with people. I mean, this is really nothing. And just an attempt to distract from the real crimes that are shown in this misleading document. All right. So the document that page is referring to is this. The 412page fisa application. And to related materials released by the justice department. Late yesterday, the heavily redacted materials were made public after several news organizations filed a freedom of information act lawsuit to essentially obtain those documents. You may remember earlier this year, page was at the center of a controversy among house intelligence officials over how the fbi obtained those very secret warrants. Republicans, well, they were alleging the fisa warrant was politically motivated. Democrats, on the other hand, well, they say their release of those documents debunks that very republican argument. Now through the unredacted parts of this document, we learn the fbi actually told the intelligence court that page had established relationships with russian government officials and intelligence officers. The russian government coordinated its on all this im joined by peter baker and chief White House Correspondent for the new york times, vivian sal amo and evan mcmullin, former cia operative in 2016, independent president ial candidate. Peter, let me get your perspective on these documents. What do they exactly tell us about why the fbi sought this secret fisa warrant against carter page . Well, the first problem with these documents, of course, is that you look through the 412 pages, and an awful lot of it is blacked out, redacted, in order to protect sources and methods and other exemptions are allowed in order to take that information out. So we dont learn some things that we could learn from it, if we had a full copy of the document. Broadly speaking, i think what we learned from it is a lot of what we had already heard, if you put the democratic and republican memos together that they released earlier in the year, describing this, which is to say that the fbi did rely on the steele dossier, at least one element of its request to the court for a fisa warrant. It did disclose to the court that the steele was looking for incriminating information about donald trump. But didnt identify steele, didnt identify who paid him, which, of course, initially was republican opponents, later was the democratic opponents of trump. And it makes clear that there are other reasons that it was looking at carter page, that he, in fact, had been a subject of interest by the russians since 2013. Things that were not part of the steele dossier. So i think what we see, once again, it is sort of a muddled picture in order to try to prove a point without actually resolving this in a clearcut way that either side probably wanted. Yeah, and so to that point, vivian, i want to focus a little bit on the house intel chairman, devin nunes. Because he released his memo, i believe back in february, that alleges that carter page and the fisa warrant that we were just referencing there, was essentially based on the Christopher Steele dossier, and therefore him and all of his allies and those that supported the president were saying this was politically motivated. Politically charged. In fact, i want to play you the sound bite where he is explaining why he pushed for the release of the memo. Take a listen. What happened is, the fbi presented the dossier as if it was true. And then they used a news article to corroborate this dossier, but didnt say that steele who wrote the dossier, also briefed the reporters. Do you think there would have been a warrant without the dossier . Absolutely there would not have been. We know that from the fbi themselves. A lot of people will have an issue, especially with the last part, there would be no fisa warrant, without the steele dossier. We also know that george papadopoulos, the basis for the mueller investigation. Is there any truth to nunes claims . Well, again, its like what peter was just saying. Every side is going to essentially view this in their own way. But at the heart of the nunes memo, and now what were sort of revisiting here, is the judges that signed off on the fisa warrant. These four times judges found probable cause to actually issue this warrant. And devin nunes in his memo a couple of months ago had actually cited that the fbi had misled those judges to reach that determination for various reasons, including because of any reliance on the dossier. But now, again, what were learning from this latest redacted memo is that its essentially not the only basis that the fbi had to base their intelligence on, and that there were various other sources. And so this is obviously pushing back on the republican claim that the dossier was the sole source of that. But, of course, you still have republicans coming out, including the President Donald Trump saying insisting that the fbi had misled investigators on this. And so, you know, it was slanted and politicized in some way. Yeah, so let me pick up on that point quickly, alexi, that vivian just brought up, the president tweeting out about this, probably unexpected. But he tweeted out, essentially saying that the fbi and the doj misled the courts. Hes claiming that the documents released yesterday are actually vindicating him, though he doesnt in any of his tweets spell out how exactly that does vindicate him. What kind of argument do you think hes making here . Try to read between the president s lines for us and explain what might be his vindication in these documents. Thats such a fun thing to do. To read between the president s lines in a tweet. Thank you so much. Well, remember when devin nunes released his memo originally . When was that, back in february . And the president had a very similar tweet in which he said he felt totally vindicated by the release of that memo. I think the big picture here, if were reading between the lines of that tweet, is that whether its nunes or the president himself, theres an Ongoing Campaign by republicans and those around him to discredit bob muellers investigation and the ultimate report and findings. And so by saying that he feels vindicated by this fbi release or the nunes release, which are two separate things, he is pushing for that same goal of discrediting the ultimate report that will come from bob mueller showing there was no meddling, he says, the president , and no collusion by Anyone Around him or by his campaign. But i will say one more thing to vivians point earlier, which is that all four of those judges, by the way, who approved this warrant against carter page, were republicans. Yeah, were going to dig into that in just a little bit. But evan, the sad thing about this is that republicans are probably going to cherrypick this, and as were hearing, also democrats, as well. But when you look at marco rubio saying that there seem to have been enough grounds for the carter page more than the steele dossier and Lindsey Graham saying all of this was based on the steele dossier, how do you parse these two positions coming out of the Republican Party . What are republicans going to say about this . Loo look, i think some republicans, like marco rubio, are being grounded in facts. Their commentary being led by the facts. You have others including the president , of course, who really dont care what the facts are. The president views this as the release of this application, the public releases of this application as a messaging opportunity for him to say whatever he wants about it and his base and perhaps more people to varying degrees will sort of believe. Okay, well, maybe there was some wrongdoing here. And thats what he does. I mean, it doesnt very few people are going to read this 400pluspage application. But, look, the reality is this. Carter page is somebody who is developed by russian intelligence in 2013 or as early as 2013. Hes a guy who he himself called himself he called himself an informal kremlin adviser. And then also we learned from this application that the fbi, how they looked at Christopher Steele and his work. There is a description of their assessment of his work. And they say, look, this guy has been a source to us in the past. Hes provided credible information in the past. And this is and by the way, some of that information, a lot of it, was related to russia. So this is a guy who is already reporting to them on related issues, and here is more information from him on, again, similar issues. And they trusted it. And i feel like one of the points that keeps getting missed in all of this is that this had to be renewed several times, and every time another judge would have to take a look on what new intelligence had been gathered by the previous method. So it feels like the further we got away from the initial application, the further we got away from this steele dossier, and more information emerged that, hey, keep this surveillance going. We dont know what the take was. We dont know what the collection was. But if they continued to see the need to collect it, they must have seen something. But the bottom line is, i just have to say here, look, from a counterintelligence perspective, carter page is he should have been under surveillance. This is a guy who was already known to be dealing with russian intelligence officers, who had been charged for their activities in the United States. This is a guy hes an obvious candidate for surveillance. All right. Theres a lot more to talk about. Stick around. Thank you guys very much for joining us this sunday afternoon. Loyalty and betrayal. President trump sounds off after learning his former fixer secretly recorded their conversation about possible payments to a former playboy model. The drum over those tapes, next. Thats confident. But its not kayak confident. Kayak searches hundreds of travel and Airline Sites to find the best flight for me. So im more than confident. Hows your family . Kayak. Search one and done. So, howell. Going . We had a vacation early in our marriage that kinda put us in a hole. Go someplace exotic . Yeah, bermuda. A hospital in bermuda. A hospital in bermuda. What . What happened . I got a little overconfident on a moped. Even with insurance, we had to dip into our 401 k so it set us back a little bit. Sometimes you dont have a choice. But it doesnt mean you cant get back on track. Great. Yeah, great. Id like to go back to bermuda. I hear its nice. Yeah, id like to see it. No judgment. Just guidance. Td ameritrade. [ coughs ] [ screams ] [ laughs ] whoa, whoa, whoa. Your one item would be the name your price tool . It helps people save on car insurance. Why wouldnt it save me . Why . What would you bring . A boat. Huh. Are you worried that Michael Cohen might flip . Look, i did nothing wrong. Ive always liked michael. So how things have changed since those remarks last month. We now know that president s former lawyer and confidante, Michael Cohen, made a secret audio recording of then candidate donald trump about a potential payment to former playboy playmate, karen mcdougal. Mcdougle claims she she had an affair with trump a decade ago. But the white house denies any affair took place. The president reacted yesterday, calling it inconceivable that a lawyer would tape a client and suggest it was perhaps legal. Cohens attorney, lanny davis, responded by saying the trump teams legal strategy is, quote, false and flawed. So the question is, who leaked the tapes existence. Joining me is danny cevallos, and harry litman, former Deputy Assistant attorney general for the clinton administration. Gentlemen, great to have both of you with us on this. Danny, if i may begin with you. I want you to take a listen to these stunning claims today from Stormy Daniels attorney, Michael Avenatti. Watch. This is not the only tape, i can tell you that for a fact. Theres multiple tapes. You dont know there are more tapes of President Trump, though. No, i do know there are more tapes of President Trump. Theres multiple tapes of President Trump, number one. The president knew that his attorney, Michael Cohen, had a predisposition towards taping conversations with people. And cohen had shared tapes with the president along the way during the ten years of legal representation. Do you know whats on the tapes . I know the substance of some of the tapes, yes. All right. So cohens attorney responded to avenattis claims in a tweet, reading in part, Michael Cohen did not and has never shared any information about any tapes or anything else with mr. Avenatti. So i want to point out that he did not dispute avenattis assertion, though, that trump knew that he could actually be taped by cohen. So this, of course, comes as trumps current lawyer, Rudy Guiliani, is confirming to nbc news that the president formally waived Attorney Client privilege over that tape we were referencing earlier. Danny, you say this could be a, quote, alltrial strategy by trumps legal team. Could the president be making his case for the public, not necessarily for the courts . Walk us through your thinking here. Okay. If trumps team already views these tapes as going over old ground, maybe theyre using an old trial strategy, which is, get out the damaging information about yourself, put it out there on direct. Put it out there in your own case in chief so that later on, you dont get lambasted with it on crossexamination or by the defense when they put up their case. But whatever the decision is, we can reasonably assume that Rudy Guiliani and trumps defense team balanced out the risk and reward here. And they concluded that whatever risk of releasing this information, the fact which evidences that trump had extra Marital Affairs and may or may not have paid people off. They must view that as not as damaging as withholding that information. And to some degree, the strategy is still concealed from all of us. I think were going to find out if we ever do that there are reasons behind this, based on something that just isnt quite there yet. There still seems to be something missing in this analysis of why in the world they would waive attorneyclient privilege on a tape like this. Harry, we heard Michael Avenatti there say he definitely knows there are more tapes. Hes obviously speaking with a lot of confidence. You certainly know a lot better than i do. Is it common for lawyers this far in advance to various Legal Proceedings unfolding to kind of be aware of these types of i guess if you use the word evidence, that may exist among the various people theyre either going after or defend organize what have you . Is that common . Its uncommon to tape, period. And, of course, we have no way of knowing what avenattis basis for saying that is. Look, this was a facetoface meeting. Trump comes in and they Start Talking about mcdougal. And cohen has the wherewithal and brazenness to push whatever button that is to record things for a couple minutes. To me, it stands to reason that if hes doing that on a live facetoface conversation, where he could be caught redhanded, that its likely that hes done it regularly on phone discussions. That would make sense to me. But i agree with danny that theres something about the waiver here, how it got to the trump team is a little mysterious. But it doesnt matter, really. If they are thinking in their cost benefit calculation it helps them, i think theyve badly miscalculated. The headline here is clearly, he had the affair, and he was casually engaging in a hush money payment. And it may involve many other actors. Remember, if this stays privileged, nobody hears about this. Not the public, not the prosecutors, not the jury. So the fact that its now come out i think has to be counted as a Bad Development for team trump. Okay. So thats a really good point. Let me pick up on that, danny. So if, in fact, as harry is saying, this is a bad miscalculation, bad misstep by team trump, since the president has waived this originally privileged tape, is this going to impact the special masters privilege review that is Going Forward . Could you now hear the special master, who is reviewing all of this, say, well, look, you waived that privilege. So by that same logic, all of these other tapes we were going to consider to be privilege are not. It is easy to waive privilege. It is a difficult thing to maintain privilege. Privilege is not the default position. Instead, parties need to create privilege, and there are any number of things that will destroy it. For example, the communication has to be to obtain Legal Services or request for Legal Services. And it has to be safeguarded against disclosure to third parties who are not part of the attorneyclient transaction. So in a case like this, it is possible the special master, if she were still continuing her review of these documents, could conclude that the privilege has been waived as to this communication if its closely enough related to other communications. Sure, i think thats a possibility. And so to that point, harry, do you think that the im curious to get your thoughts. And i dont want to ask you to speculate. But how do you think the existence of these tapes was leaked to the public . I mean, based on the assessment of who benefits the most here. Yeah. Ive really been puzzling over this all weekend. I think there are two hypotheses. One is, a blunder by guiliani, who apparently said at the getgo, he didnt know whether it was privileged or not. He might have heard about it, talked about it, inadvertently based and it would be ranked malpractice. The other possibility, its a little bit convoluted, but they were actually you can otherwise privileged communication becomes not privileged if its a crime fraud. If its furthering a crime. If the United States here was making that argument, its possible that team trump strategically said, we dont want them to go there, because that might be a conclusion that trump has been acting in a guilty way. Lets waive the privilege so the question doesnt come up. But again, i want to underscore, its the substance that will matter. Weve just heard guilianis assessment of the transcript, and what he calls the headline that trump discussed using a check is not the headline. The headline is trump they lied, and they were ready to do the hush payment. He made the point that was in cash, because they wanted to have record of the payment. Interesting. A virtuous guy. Danny and harry, im going to ask both of you to stick around for our next segment. Were going to be talking about Paul Manafort, the president s former Campaign Chairman, heading to court this week. Welcome back, everyone. In just three days, trumps former Campaign Chairman, Paul Manafort, will head to trial in a virginia federal courthouse. Manafort is facing 18 counts of alleged financial crimes in the commonwealth. Including five counts of filing false income tax returns, four counts of failing to report Foreign Bank Accounts and nine counts of bank fraud charges. Prosecutors say manafort did not properly disclose his wealth and connections to the government. Manafort has denied any wrongdoing and hes also facing a separate trial in washington, d. C. , set for mid september. Joining our panel now is visiting professor at the university of miami and Foreign Policy analyst. Danny cevallos and harry lipman. We begin with muellers team. They put together about 500 pieces of evidence, among the pieces of evidence include email exchanges with former ukrainian president , victor yanukovych, statements from land rover of alexandria, photos from the putting green at the hamptons house and a photo of the houses pergola and overseas bank records. All of this to show the opulent wealth and fortune that Paul Manafort had amassed. Harry, how do you think prosecutors are preparing to make their case . Whats the argument by having all of that evidence . Methodically. It was difficult to put together, but a very straight forward case now to present. He basically makes tens of millions of dollars, working for the russian puppet president , and he doesnt state it on his taxes, and then he lies when he tries to get more loans. So it wont only show his oppop lifestyle, the houses and jewelry ask cars, but it will show assets he either hides or else gives motives for him to have tried to falsify applications to banks. Well finally find out what he must possibly be thinking. And, you know, its kind of exciting. To date weve just had these are only allegations, et cetera. Now were going to have the real evidence, and mueller to date, not a single thing hes alleged has been proven false. This is the first person who said prove it, and mueller is going to stand up now and either prove it or not. But i think hes going to. And it will generally, i think, put the lie to the notion that this is some kind of witch hunt. Im not going to lie. Im kind of interested to see what kind of pergola he built in the hamptons. I know those things can be kind of pricey. Theres going to be a lot of interest in a lot of this stuff for the jury. Let me ask you really quickly, because both the virginia and d. C. Trials that prosecutors in both those cases are zeroing in, as harry was mentioning, on the work that manafort did for the former ukrainian president. And that president s Political Party. Theyre accusing manafort of hiding that money that he earned in ukraine to avoid paying taxes back here in the u. S. And then lying about that, lying about his debt. Give us a sense about what this tells us about what manaforts dealings were in ukraine. Manafort is a foreign agent, and if you are working on the behest of a foreign government, you have to register as a foreign agent. Remember, manaforts relationship with Eastern European dictator yanukovych starts ten years ago. When yanukovych didnt even speak ukrainian, he spoke more russian, and he looked like a thug. So manafort advised him on how to look. But above all, he led a very severe campaign of discrediting his opponent. The official slogan of the Trump Campaign, lock her up, actually was born in ukraine in 2012. Where manafort was leading the effort to get the opponent of this dictator arrested. They managed actually to arrest julia yanukovych. And put her in jail for three years. Another thing happened at that time. He was getting millions of dollars to also pile and lead an effort to discredit the then Hillary Clinton, secretary of state. He managed to get many to depict Hillary Clinton, the then secretary of state, as corrupt, as inept, and move the position of the Ukrainian Government very close to putin. One of the things that putin was very concerned about is the magnitsky act. Yeah. Which the government put in place to punish those who are violator of human rights, to ban them from having visas. He was very adamant, and he blamed Hillary Clinton for that. Paul manafort, fast forward, became the Campaign Chair of donald trump. They share two things in common. One, they have no regard for morality, legality, and they ignore any rule of law on having to deal with these kinds of dictators and having money from very uncomfortable and very awkward sources. The other thing, they both agree that theyre willing to trade with russia. The one thing that russia wanted, which is to basically repeal the magnitsky act. And this is what manafort was offering them. So, yeah. To that point, evan. We know that the prosecutors have been able to trace his funds overseas in countries from cyprus to the united kingdom, what have you. But why does that matter in the russia probe . Viewers may be watching this and say, okay, tax fraud, hes not registered as a foreign agent. Break down why that matters in this big picture investigation. I think it really does matter, this case. And as we see it play out now publicly. Because i truly feel that we as a country, all of us the media, in political leadership, voters, were all climbing this learning curve. How is it that the russians interfere in foreign countries, especially in liberal democracies and western democracies . How do they do that . And right now, this week, were going to start to see a case of a russian operative, which was Paul Manafort, or a pro russian operative, who with russia supported a russianbacked candidate and a russianbacked party in ukraine through a variety of corrupt means. And then ten years later, here he is in the United States, doing something that ill say was very similar. Theres quite a lot of parallels here. And i think eventually, as a country, were going to get to the point where we understand that donald trump was a russian. We will call him this. A russianbacked candidate here in the United States. And Paul Manafort performed this was his specialty. And he performed that specialty and supported donald trump on behalf of in part the russians. The russians certainly played the long game when you look at how long they were trying with these relationships. And danny, in washington, manafort is accused of failing to register as a foreign agent. Based on the evidence we know so far, how hard will it be for prosecutors to make that case . And is that in and of itself a significant case . Theyre both significant cases. I would say in terms of exposure, under the guidelines and maximum sentences, the virginia case is probably more serious. But then again, so is the one in d. C. And heres how they make it out. Its pretty straight forward. They prove that was he conducting activities, did he fail to register . Its just like the one that harry talked about in virginia. Its a pretty straight forward process. And federal prosecutors dont like to lose. If theyre going to bring a case like this and get an indictment, youre going to see, just like you saw with the exhibit list, classic prosecution, federal government overkill. Theyre going to inundate a jury, either in d. C. Or virginia, with evidence of these crimes. And youre going to see evidence of the benefits in virginia of the putting greens and the pergolas and everything else. And thats the kind of thing thats going to make a jury go, you know what, i dont really like this guy. And hes having a really good time. And defying the taxpayers and the laws of the United States. Yeah. And some would argue working against the interests of the United States. Thank you guys very much for joining us. It is going to be a busy week. I have president putin. He just said its not russia. I will say this. I dont see any reason why it would be. The sentence should have been, i dont see any reason why it wouldnt be russia. President putin was extremely strong and powerful in his denial. I accept our Intelligence Communitys conclusion that russias meddling in the 2016 election took place. You say you agree with u. S. Intelligence that russia meddled in the election in 2016. And ive said that before, jeff. I have said that numerous times before. And i would say that that is true, yeah. Could be other people also. A lot of people out there. Coats says the threat is ongoing. Do you agree with that. Well, i would accept. Hes an expert. Is russia still targeting the u. S. , mr. President . Lets go. Its been a week of he said i guess he said. Despite a series of walkbacks from the white house. Half of americans disapprove of President Trumps handling of his meeting with russian president Vladimir Putin. Thats according to a New Washington post abc news poll. However, broken down along party lines, support remains high among republicans with 66 of those polled who identify with the party approving of the president. Now thats compared to an 8 approval from democrats that were polled. I should point out that we have a brandnew nbc news wall street journal poll that is coming out at the top of the hour. You dont want to miss that. Well, the president firing back this morning, tweeting out, i had a great meeting with putin, and the fake news used every bit of their energy to try and disparage it. So bad for our country. Now with an invitation extended for a second summit, here in the u. S. , there is new pressure for lawmakers to hold President Trump accountable if mr. Putin does indeed come to washington. Joining me now, former democratic congresswoman, Donna Edwards of maryland. And former republican congressman david jolly of florida. Great to have you with us. Let me begin with new findings from the poll, if i may. It shows that 47 believe americas leadership in the world has gotten weaker under President Trump. Congressman david jolly, what does this say about the damage thats been done by last weeks meeting, if at all anything . Its not just last week. Go back to the very beginning of his presidency, when he botched International Phone calls with leaders. Donald trumps most authentic moments is when he is unscripted, when we get to see who he really is. And that is what we saw in helsinki. Donald trump is being honest when we see him in helsinki, standing next to Vladimir Putin, saying, i believe Vladimir Putin. He is being dishonest when his staff has then said, we have to correct this. And we are going to give you this proof of life video opportunity in a Cabinet Meeting to suggest you were wrong when you were actually being honest. The problem that i think World Leaders see, but also voters here in the United States, is this. When you lose credibility, you lose the benefit of the doubt. We dont trust a large portion of the country does not trust donald trump. Some do. But we have seen a president on the world stage who among his peers as World Leaders and among the voters here in the United States do not find him credible. Ask therefore, he doesnt get the benefit of the doubt when he tries to clean up the chaos he creates like he did throughout western europe last week. Yeah, and certainly has a lot of allies scratching their head and members of the Republican Party trying to figure out how to shore up support for additional american allies. To that point, representative edwards, weve heard members of both sides of the aisle criticize the president S Performance. But there have been some criticism that republican members of congress are not going far enough from within the president s own party. There have been several polls that show the gop collectively is still backing trump, and especially his meeting with Vladimir Putin. In the new york times, there was an oped titled republicans dont just tweet about it. Do something about it. Charles sykes writes, republican members of Congress Need to act like a Political Party with principles, rather than outsourcing their consciences to a handful of critics. Taking action now is not merely a matter of recovering political courage and integrity, it would be Congress Articles and system of checks and balances. What kind of checks and balances are we talking about here . Well, i think for one, even last week in the face of all of the fallout from the beginning of the week to the end, republicans couldnt even pass in the house of representatives legislation that would put more resources into making sure that we protect our electoral system. Even though there is an acknowledgment throughout the Intelligence Community that russia interfered with and meddled in our elections. So i think what youre seeing here is this kind of disconnect. Because on the one hand republicans are looking at the president s polling numbers in among republicans, but on the other hand, theyre faced with a president clearly who isnt even supporting his own National Intelligence infrastructure and has, you know has attacked what david jolly and thanks, david, you pointing out, it wasnt just helsinki. It was coming on the heels of attacking our allies at the nato meetings just prior to helsinki. And so i think that you did see a little bit of chink in the armor when it came to this poll. People are generally willing to give a president latitude when it comes to Foreign Policy. But youre seeing a little bit of a chink, especially among moderate republicans. And we have to remember that its those moderate republicans and independents who are showing a little bit more disdane for the president. And they are going to be the ones who actually are going to be on the forefront when it comes to some of these swing districts. And so i think republicans really are going to have to start looking at that. And viewing the president more critically in support of the United States. And let me just say, you know, lastly, i think that every single voter at every town hall Meeting Needs to start asking their members of congress, do you stand on the side of the Intelligence Community, or on the side of donald trump supporting russia . Yeah, and it seems a lot of the most critical voices coming out of the gop are those that dont have much skin in the game left, senator jeff flake and bob corker of tennessee both leaving at the end of their terms respectively. The government has four days to reunite parents and children under the zero tolerance policy. As of friday, 450 children over the age of 5 had been reunited with their parents. That leaves more than 2,000 to go by the court imposed deadline this thursday. All 57 eligible kids were reunited as of july 13th. On monday, a federal court made a temporary ruling allowing the reunited families to stay in the u. S. For one week to decide if they wish to seek asylum. The judge makes final ruling at a later date. Some families waived their right to reunification for their children. We have the author of crux and an immigration attorney who represents almost two dozen migrant families. Jose, let me begin with you. There was a judge that order the reunification originally saying that in a hearing i believe on friday that the process appears to be working. You represent two dozen families, among them children here in new york. You have a very different tale of how this process is working. I saw how the process was initially not working. I have seen, however, the majority of my clients, the mostly our females, they have been released. I dont know if theyve been reunited. I know they left the detention facility. However, there are still about four mothers that are still languishing in Detention Center and two of the children are here in new york and theyre waiting for their mother to come pick them up and i just dont understand why some of them are being left behind. Okay. So these kids, you know where they are. You know where the mother s yisd the government hasnt provided you a reason why this reunification has not happened . Absolutely not. The dhs officers at the detention facility are just overwhelms with my phone calls. Im assuming so many other phone calls asking them whats going on . Every day the policy changes. So they said, you know what . We dont have any information. Im going to forward you on to a supervisor. That supervisor doesnt have any information either. So its almost like, again, another stalemate. I dont know whats going on. You have had any proceedings involve these particular children . Have you attended any hearings or anything to discuss the reunification of this family . These children have not had any hearings. I know that for sure. Some of the parents have been in the detention facility with them in arizona and theyve had some hearings. But really its just moving is trickling. Jean, let me get your perspective. Is there any consequence for the government if it does not meet the reunification deadlines ordered by the court . So far the only thing the judge has said is that if they dont immediate the deadlines, they need to provide reasons and explain why they didnt meet these deadlines. They need to explain why certain families werent reunited. But as far as the further consequences, nothing has been discussed. Can you help us understand something . During a friday hearing a sorry. I want to ask you this question about some parents who are leaving their kids behind. Am i understanding that correctly . Thats right. So parents have been given the option to either deport to be deported by themselves or to be deported with their children. And the aclu has some concerns about this form that parents have been asked to sign. And thats what thats why they asked for this stay on deportations because they want the parents to have time to consider this decision instead of having to make it very quickly like this very significant decision as to whether to leave their children in the United States and to be deported by themselves or to be deported together. Because of the settlement in 1997, many immigrant children are more likely to win their asylum cases than their parents. Thats why the parents are deciding to left children behind. They dont like the idea of if theyre going throes their asylum claim and be returned to these dangerous home countries in central america, for example, they dont want their child to have to face that if they do have the option to stay in the United States and be grant add sigh lum. So from your reporting, have you gotten a sense of how many people may have exercised that option . I dont. We know that at least 12 parents have been deported without their children. We dont know, however, if that was done voluntarily or if they chose that. But we dont have a good sense yet how many parents chose to be deported without their children. It is worth noting, you mentioned that all of the children under age 5 had been reunited with their parents. Just under half actually were deemed ineligible for reunification. That is currently happening with the children older than 5. More than 1,000 of the children have been deemed either ineligible for reunification or for some reason have not had that properly assessed yet. So its unclear how many of these children will actually be reulted by the deadline. Jose, very quickly. Do you expect this deadline to be met on thursday . Absolutely not. These two, for example, these two kids that are at this center, their mothers have been finger printed, dna tested. But theyre languishing. Theyre not telling when or if theyre going to be moved. One of the mothers has a individual hearing on thursday in which i plan and i hope will be postponed. The individual hearing will be whether or not we move forward with asylum or not. If they move forward with that, she could be ordered removed on thursday. All right. Heartbreaking. Jean and jose, thank you both very much for joining us. Were going to stay on top of this story. Today we have to acknowledge what our president wont our democracy is under attack again.
