Thats because of us. Undocumented immigrants and crime excuse me, massive numbers of crossings. It shows undocumented criminals or undocumented immigrants committing crime than native born americans. Do you really believe that stat . Take a look at our federal prisons. Im asking you to clarify where you get your numbers, because most of the dea Crime Reporting statistics that we see show that drugs are coming across at the ports of entry, that illegal immigration is down, and the violence is down. I get my numbers from a lot of sources like Homeland Security primarily, and the numbers that i have from Homeland Security are a disaster. And you know what else is a disaster . No, theyre going to i come home and i read a certain paper where the story was there that they were actually forming to go into really to really do big destruction. And i put out a statement that, you better not do it. And in all fairness to russia and iran and syria, they didnt attack, or theyre doing it surgically at least. Saved a lot of people. That was President Trump unscripted just a little while ago in a wide ranging address in the rose garden announcing hes declaring a National Emergency to pay for his border wall using money from american taxpayers. Lets just be clear about this. Whether the money comes from a bill in congress or an executive action by the president , like a National Emergency, its still all your money. The president is issuing the controversial executive order while using the bully pulpit to boast about trade talks with china, the united kingdom, his relationship with north korean dictator kim jongun, his nomination for the nobel peace prize, how estopphe stopped the slaughter in syria. A lot of stuff. Joining me now is Kelly Odonnell who was there at the white house asking a question of the president , opinion Writer Jonathan capehart. Kelly, im going to come to you second because we heard from you in the mash up we just ran. I want to ask jonathan, you were like me, watching this and listening to this. What do you make of it . Wow, ali, is all i have to say. It was a president like weve seen before, somewhat rambling, going down his greatest hits. It had more of a feel of yet another campaign rally, an announcement of a National Emergency. We are used to well, we used to be used to president s coming into the roads garden declaring such things with a soberness and an importance with a keen focus on that particular issue. But in this announcement, yeah, he talked about the National Emergency, but he also talked about trade and tariffs and all sorts of fentanyl, and all sorts of other things that sort of distracted from what was supposed to be a very important announcement. And the other thing, ali, that i found interesting, is that he the president throws out superlatives all the time. Its the biggest, its the greatest, its whatever. Ive come to view them as a bit of an invisibility cloak for what the truth is. So when he says, i barely know ann coulter. Take the opposite. He knows ann coulter. He knows all these people. I was very surprised by the fact that he i had not seen this reported before, that the Prime Minister of japan, shinzo abe nominated him for a nobel peace prize. Thats news. Certainly news to me. Right. And then the other thing, you played that clip where the president said, i didnt need to do this. I want to do this faster. George conway this is important. George conway tweeted out, this quote should be the first sentence of the first half of every complaint filed this afternoon. I didnt know to do this. George conway is important because he is the husband of kellyanne conway, one of the senior advisors to the president. So, kelly, lets pick up on that. The president said he didnt need to declare a National Emergency to get the funding for the wall. He just needed to do it faster. Worth noting. I tried to get at that in one of my questions to the president where i asked him about how he acknowledged he had been new to politics and he thought this could have been done earlier in his administration. Whatever attorney general or stakeholder it will be, as you know, he had that singsongy answer about going to the court. The president didnt seem to recognize this was a presentation that would, in fact, be cited. I was also struck as jonathan was, this was not a teleprompter event. It seemed like a bullet point moment for the president where he had a lot of things he wanted to talk about and there were many other things that seemed more important to him than the reason we had convened in the rose garden to begin with. The president sometimes is quite transparent in that whats on his mind comes out of his mouth, and he wanted to talk about other matters. He also talked about a plan to have Speaker Pelosi and leader schumer together with him to talk with president xi of china for the trade march deadline discussion about tariffs and so forth. He also talked about in the next 24 hours, there will be announcement that a caliphate held by isis land area that they have controlled would be no more. There were so many head points this this that get away from even the reason we were there together, a National Emergency. Right. And he seemed to refer to it as a tool, knowing that its going to court almost, ali, he knows where this is headed. Go to the 9th circuit. Wont go well, go to the Supreme Court before he even fully announced it. So, jonathan, part of the thing that i think is important for people listening to remember, whether youre part of Donald Trumps base or whether youre ann coulter, Rush Limbaugh or sean hannity whom he named specifically, or whether you dont like donald trump, its still the same pot of money, right . People need to understand its all the same pot of money. The president has talked about taking money from disaster relief, puerto rico, california, theyll sue over that. The money has got to come from somewhere. He had asked for 5. 7 billion for a wall we knew was going to cost, for what the president wants, well over 20 or 25 billion. Now hes talking about this, getting him about 8 billion which still wont build him his wall. Its still taxpayer money. Right, it is. And from the reading that ive been able to do, the money that had been threatened to be taken from disaster relief, that is not happening. However, there appear to be money that they have identified that they can take from Construction Projects from the department of defense and other places. Its the equivalent of the white house diving under the couch cushions trying to find money so the president can come up with the 8 billion he says he needs to build this wall, although as weve been reporting all week, especially since that rally in el paso, that the wall is already being built. Despite evidence to the contrary. Ali, to go back to the court thing and kellys comment about the president s singsongy answer about how he thinks this is going to go and he is anticipating the court case comes out of the 9th circuit, which is known as the most liberal circuit in the federal judiciary, what happens i think Michael Steele made this point. We have to keep this in mind. What happens if the court case doesnt come out of the 9th circuit, but the 4th circuit based in richmond, virginia . This is the kind of case where you have a president declaring a National Emergency, which under other circumstances say if it were president obama, republicans would declare this an overreach of executive power. They said that when president obama used executive actions on things for immigration and other things, saying he was using that power too much because he was subverting the power, the constitutional powers of congress. Now we have a president who is using a National Emergency to the democrats mind, subverting congressional authority. And there are republicans and there might be conservative federal circuit courts that might agree that what the president is doing is an overreach of executive power. How will the president respond when its not the 9th circuit that slaps him back. That changes the narrative just a little bit if that were to happen. Kelly, thank you for your great reporting today. Im going to break down exactly what constitutes a National Emergency, what is it, what is it not, and how much power does the president wield when he invokes it. President trump announced a National Emergency to build his wall on the border. Lets take a look at what it means for the president to declare a National Emergency and what congress can do about do about this . Accord together law, congress wrote need to pass a joint resolution, getting the agreement of both chambers of congress, to terminate a National Emergency. Now, like any other bill passed by congress, it would go to the president s desk. If the president were to veto the termination of a National Emergency, congress would then need to override that veto to force a termination and that would typically require a twothirds majority. With Mitch Mcconnell announcing that he would support the president s Emergency Declaration a declaration an override of it seems unlikely. What is the president planning to do with this one . Hes authorizing 8 billion for border wall contraction, notably thats more money than he was asking for before, 5. 7 billion. Whether its 5. 7 or 8, it doesnt come close to building the amount of wall he wants to build. But it comes from several sources and were going to dig into the issue of money coming up. The declaration can be challenged in court like we were discussing likely making being its way to the Supreme Court fairly quickly because none of this money is appropriated for a border wall. Lets talk about this a little more. Joining me now is michael waldman, president of the Brennan Center for great to. Were looking around the country for people who have studied these National Emergencies and the power that it gives the president. We certainly talked in the last several years about executive authority, you know, president executive actions that they take, that to a lot of people who grew up understanding how bills and laws are made, seem unusual. This is a different version of that. Its something the president , him or herself, can do. Thats right. President s, all president s use executive orders. This is a more dramatic exertion of executive authority with much greater, i think, constitutional problems. But as you showed, congress in many years has given this president and all president s correct. As it turns out, pretty vast authority to declare an emergency. But even sew, it mo, this goes. The courts may find this goes too far. The National Emergencies act doesnt define what an emergency is. Emergencies declared before, things like hurricanes or things that feel like they might be an emergency. Yeah. Ann coulter doing an unpleasant tweet about a budget deal does not actually count as an emergency. And so the question is will the court say, this is too much of a pretext. You cant just as the president start moving money around because you dont like the way a budget negotiation the Brennan Center has an article out today saying the president s declaration is an abuse of power. One of the things that Jonathan Capehart was pointing out was in the president s declaration or his, whatever it was in the at the white house today, he said, i didnt know to do this. I just did it so that we can do it faster. One of the interesting novel questions the courts have having to deal with these days is what do you do with the stuff the president says or writes or tweets . Yeah. My view is hes standing in the rose garden announcing this act of a National Emergency. Its important to take that kind of thing seriously. This is not just some guy spouting off. Right. Even if there is an emergency or that power is allowed, then the question is there are 123 specific laws that must be followed. They need to do this under some legal authority.
