To the white house to talk infrastructure again. But it could be off the rails before it even starts, as President Trump threatens to block any infrastructure deal unless Congress Approves his new nafta. And right now on the hill, treasury secretary Steve Mnuchin testifying. This after a confidential irs memo obtained by the Washington Post says the agency must turn over tax returns to Congress Unless executive privilege is invoked. And also happening right now, democrats are meeting behind closed doors to discuss, you guessed it, whether or not the party should move forward with impeachment proceedings. We have to start this morning with the meeting going on now on capitol hill. Nbcs Kelly Odonnell is live on the hill. Kelly, take me inside the mind of nancy pelosi. House speaker is huddling with congressional democrats. We know impeachment is the hot topic. What do you think is going on inside . Its a careful balancing act, steph, because the House Speaker is trying to be responsive and listen to her members who have been talking about impeachment really since they took the oath of office but we have seen a shift in recent days, especially after don mcgahn, former white house counsel, was not appearing on capitol hill despite a subpoena and the white house has thrown up roadblock after roadblock. So it has bubbled up to a perceptively different level among members. But the House Speaker is also trying to balance governance. You referenced the meeting at the white house today on infrastructure. Nancy pelosi has long been saying this time in office for democrats must also be about accomplishing an agenda, doing the peoples work, and that could easily be overrun by racing too quickly on impeachment. Shes not antiimpeachment. Shes about taking a methodical approach. Shes told us this time and time again, Win Committee by committee, pursuing in effect grinding out the hard work of these investigations, going to work, winning there and then ultimately building a case in a slower pace to get to an impeachment proceeding but not to rush with the possibility of mistakes or missed opportunities. So how do tols to balance that shes trying to do at the same time listening to her members. Steph . Shes not the only one busy on the hill. Take me to treasury secretary Steve Mnuchin. We know hes testifying at a House Committee hearing. Hes going to get questions about the president s taxes. I mentioned earlier we saw a bombshell report out of the Washington Post about the irs and tax returns, and Steve Mnuchin said theres no legislative reason to give the president s tax returns. Is he going to change his tune . Unlikely but what is different now is the last time he appeared on capitol hill he said the lawyers for irs agreed with his position. He also said while every president and Vice President do go through a mandatory audit process, that is not in and of itself enough of a reason for congress to get this information, tax returns of the president , even though the law they are citing says shall and not may. Meaning thats more certain requirement for the irs, and he has the supervisor of the irs, treasury secretary, would have to comply. Hes saying no, the difference now is the Washington Post found this internal memo from the irs. We dont know that it reached the level of the Treasury Department or the secretary. But it talks about that expected request from democrats written months ago and it was the irss view that they would have to turn over the president s tax returns. How he handles that would be key today. Hes rebutched ffed it time and again, hasnt discussed it with the High Pressure but will be able to do that now. Lets go to the white house and Peter Alexander is standing by. Peter, what are your sources telling us about the irs memo . The president s secretary walked outside a few minutes ago. I pressed her on this request of the irs legal memo and its determination according to the draft the president white house would have to assert executive privilege or they would have to turn over that his tax returns. Well, Sarah Sanders pushed back and effectively brushed it off saying Treasury Department made its position clear on this. I asked her if he would excerpt executive privilege and he ignored my question there. The bottom line, steph, this is another example how the white house is trying to stiff arm, stonewall in effect these efforts by democrats to get new information on the Mueller Report, obstruction of justice or the financial records, as evidenced by the latest fight here. We know the president is set to meet with congressional leaders nancy pelosi, Chuck Schumer. The topic is infrastructure. Their last meeting in theory went very well. They said they agreed to an infrastructure deal but we have not heard much since then. Were supposed to hear more about it today. The phoningous focus of this meeting this morning with Chuck Schumer and nancy pelosi and certainly other aides in the room was infrastructure. Late yesterday the president wrote a letter to the Democratic Leaders saying basically no infrastructure talk until you guys help get a deal on usmca, that is the trade deal thats been negotiated between the u. S. , mexico and canada, to replace nafta. The president and his aides have been feverishly pushing behind the scenes to try to get this nailed down. Democrats have some concerns they indicated about a series of provisions within that deal there. The president making it clear he wouldnt talk about it until a deal was passed. The democrats firing back in effect in a statement they put out where they ignored that from the president , just talked about the infrastructure deal itself. Peter, we should make it clear, its not like hes asking them to fund the wall. Usmca is not necessarily a huge leap for them. Its basically nafta 2. 0. Its not a huge point of contention, not like other issues. Thats exactly right. Obviously theres been a lot of frustration between democrats with anything the president s been doing. Theres real frustration about the tariffs. Theyve been laying into the president saying hes squandering a good economy that was provided to this administration by the obama administration. Last week the president ended those tariffs on canada, specifically as they related to aluminum and steel. The same on mexico. They think he cleared the president , his administration and aides think, they cleared the path for this to get done but democrats remain resistant to it and so its something the president will try to push behind the scenes. Youre talking about stonewalling requests. Lets talk about stonewalling subpoenas. The House Judiciary Committee released subpoenas for former white house aides hope hicks and annie donaldson. We know don mcdpagahn failed to show up yesterday. What have we heard about this . We have not heard from donaldson. Hope hicks lawyer provided nbc news a no comment here. Her testimony, were she to testify, would be significant. She was perhaps one of the closest confidantes to the president of all of those inside the west wing. Her office just outside the oval office. The president would routinely call her to come in. But the president lashed out again today, perhaps frustrated by this latest effort by democrats here saying the investigation was started illegally, accusing democrats in what he calls a witchhunt of trying to debt a doover here. He said absent this investigation, said his Approval Ratings would be at 65 . Specifically he said too bad. And once again echoed a claim he said throughout the course of this that it is, quote, president ial harassment. The president s words and others say theyre doing their job. Peter alexander, thank you so much. Lets please bring in msnbc legal analyst glenn kirschner. The reason i say please, glenn, this is a question i have heard over and over, and ive got it too. We know that attorney general bill barr ignored a congressional subpoena. Don mcgahn said no thank you. At some point what happens to those who ignore subpoenas . Are there any legal consequences . There should be, steph. And there are three separate vehicles for congress to try to enforce its subpoenas. For whatever reason, congress has chosen not to exercise any of the three. Weve been asking this so long, it reminded me of the famous el noor roosevelt quote, nobody can make you feel inferior without your consent. For whatever reason, congress is consenting to being treated like a lesser coequal branch of government. What can they do . Quickly, criminal contempt, enforcement and civil contempt. Criminal contempt is out because it requires William Barrs department of justice to support congress in its request to enforce subpoenas. William barr, basically a flak for the president , snort going is not going to do that. Civil means they file a suit and ask the judge to order the witness, con tempuous witness to testify. And if he doesnt, the judge can hold the witness in contempt. That takes some time. Real quick, steph, judge mehta just decided a congressional subpoena issue in lightspeed. Six days. I think that signals the judiciarys willingness to move these things quickly. The third is inherent contempt. We all heard thats where the sergeant in arms of the house of representatives, paul irving, a 25year secret service veteran, he knows his way around a pair of handcuffs, can go out and arrest somebody for failing to appear on a congressional subpoena. I think thats what they need to do. They need to flex their coequal branch of government muscle and begin to move out. Glenn kirschners word of advice to congress, time to get your muscle going. This morning Mother Nature unrelenting as tornadoes, strong winds and floods reeked havoc across the south and midwest. In arkansas a dramatic rescue, emergency crews saving a woman after strong winds trapped her under downed trees. Missouri hit late tuesday with a tornado near springfield, bringing ferocious winds and rain. A man was rescued from floodwaters in broken arrow, oklahoma, after clinging to a fence post for nearly five hours. A dramatic rescue going on. Reporter hours later this woman near Oklahoma City holding on for her life after heavy rain caused rapid flooding. These cattle struggling to get to dry land. And homes dangling off the edge of a cliff. The power behind the flooash floods evident at the union pravg rail line where the water washed away he gravel under the earth at the tracks. In tulsa, a tornado knocked down dozens of trees and power lines, entire neighborhoods ripped apart. I thank god were okay. Thats all that matters is we have our lives. Thank god for that. You can replace your home and your cars, not your family. Reporter in kansas cars pulled over as large hail pounded vehicles traveling southbound. Stretches of i40 shut down after heavy rains. Here in oklahoma, kansas city, missouri folks need to there will be more rain, hail, flash floods and tornado threats exist in missouri, western illinois to arkansas and louisiana and still in texas. The bottom line is that people need to be aware, if you look at the statistics we have since saturday since the threat began 133 reported tornadoes, more than 30 in the last 24 hours. People are getting exhausted. Theyre getting fatigued by this and the one thing that folks want everybody to recognize is to remain vigilant. Do not drop your guard. If you see something, take cover. I want to go now to our National Security justice reporter Julia Ainsley for some new details were learning about a Migrant Detention Center on the southern border that has stopped taking anyone in and under quarantine. Julia, youre breaking news on this beat every single day. Whats happening now . First i just want to put in context what a big Detention Center this is. This is mcallen, texas, heart of the rio grande valley, high traffic area crossing over to texas from the rio grande in mexico. This is a place where people are not supposed to be over 72 hours. Now these people are quarantined inside probably with limited personnel. That from a health and operations perspective, that has a huge impact. But lets go back to how this started. There was a 16yearold boy who died recently in the past week with because he first exhibited flulike symptoms and then he was placed back into custody after exhibiting those symptoms and he was found deceased the next morning. That is the place they are now quarantining but it raises a lot of questions, stephanie, about these processes and whether or not customs and Border Protection have the right protocol to deal with someone who is sick. When they see someone with these symptoms and place them back into custody, they obviously were not able to provide him the care in order to save his life at that last minute. Tell us about the new name moving to homeland security. The president appointing, going to fill a top job, and this is a job that oversees all of these immigration policies. Whos getting it . So the name might sound familiar to you, stephanie, its ken cuccinelli, the attorney general in virginia during a time of the obamacare lawsuits. He made a name for himself there. He had an unsuccessful run for the governorship and since has not been a trump supporter although an immigration hard liner. He famously stomped on his credentials at the nominating hearing and essentially called trump an idiot. Hes bringing someone who is not a loyalist but immigration hard liner and has had instances that all immigrants should learn to speak english and against daca. This is someone say Stephen Miller agrees with but as we know the president values loyalty and theres so much infighting over immigration and the white house, it remains to be seen how effective he could be in this job.
