"morning joe" starts right now. sunday started with prayers and messages of unity, peace, and justice. it took a very different turn after dark. and i believe the continued resolve of the good people of this community, ultimately triumph over the few people bent on violence and destruction. >> good morning. it is monday, august 18th. welcome to "morning joe." with us on set, "morning joe"
contributor mark halpern. former communications director for president george w. bush nicole wallace and msnbc.com germane standing by in ferguson, missouri. he has been on the front lines and community for days now doing great reporting there. he'll have the very latest after another violent night. plus the executive editor of "the texas tribune" with his reporting on the indictment of texas governor rick perry why he is comparing it to a sewer leak during the opening of a new restaurant. we will explain that in a moment. >> wow. i don't know if i would have done that. >> actually it's one way of saying things. if you believe this indictment is weak, it's a way to bring someone down, i guess. >> an indictment is not weak. it is an absolute farce. >> okay. >> it is an embarrassment for the prosecution. you have people on the left and the right saying that this is
just preposterous. >> i think it's fascinating what is happening and we are going to look at all angles of that coming up because if you take a look at both sides closely, it's not what it appears. >> you know, last night, i mean, last night, things got so bad in ferguson that now they are bringing in the national guard. so we are going to get to that in a second. let's talk about your weekend. >> what? okay. >> how was mommy and how is daddy and how was baby girl when she was dropped off at college? did you collapse into tears? >> i do feel like i'm missing something, like a limb or something right now. i feel like i left my heart there, but it went well. it was a lot harder than i thought it would be. i hate to be one of those people that it was really a lot harder than i thought it would be. we put together a little piece and we have the president of some universities coming in actually to talk about this. it's fine with the kids.
>> yeah, they are fine. nicole is probably -- >> i have a 2-year-old and i think i say once a week, i can't believe he is going to go to college in 16 years and my husband is like, we hope! >> we overpacked. i think there was some nervous packing going on on the part of all of us. that's amelia. we will have more on that coming up. it's actually rite of passage for kids and parents for sure. violence returned to the streets of ferguson, missouri, overnight. nearly a week after an unarmed black teenager was shot to death by an officer. hours ago, democratic governor jay nixon ordered the national guard to the city to, quote, help restore peace and order. for the second night in a row, a curfew is in place and police and demonstrators were involved in heated clashes. hours before the curfew went into effect police fired tear gas at hundreds of protesters.
state highway patrol captain ron johnson said the contest spiraled out of control and the police had no other choice. >> mostly there were actions of violence that clearly appeared not to have been spontaneous or premeditated criminal acts designed to damage property, hurt people, and provoke a response. >> you know, willie, so the worst night of violence yet. a son of a city brought back in and try to do all of these things. they had a day of moving religious services there and everybody talking about the need for calm. reverend sharpton said we are not looters, we are liberators, yet it keeps getting worse and worse. so bad that officials have gone
from apologizing to now bringing in the national guard. >> the tear gas is back. the national guard. reverend sharpton was sitting around the table with us with a night after peace. he said, wait a minute, we are not through this yet. we have a long way to go and he proved to be right over the weekend. tramaine syou've been on the ground there for quite some time. what have you seen last night compared to a week or so ago? >> another hot night in ferguson punctuated by violence and tear gas. clear we are breaking into two concentrated groups. one group is a group of protesters who are earnest and coming out to fight for the name of michael brown and justice and police brutality and a long history here. another group that is emboldened by the escalated confrontation between the police and themselves. now the police say there seems to be folks planning attacks on police and reports of molotov
cocktails and firing at police. also reports of protesters who are trapped between police who are firing tear gas and other people who are firing at police. again, another night in the situation seems to be kind of evolving in a very troubling way. >> tramaine, we read reports and i'm sure you heard it yourself an awful lot there. there were people who came from out of town. "the new york times" said one couple came from out of town to pay their respects to the family, to go to these church services who actually came out and said they felt like their lives were in danger, and were clearly, like most of the good people of ferguson, just outraged at this violence, that i guess they stormed the -- the looters tried to storm a shopping center. they took over a mcdonald's. it sounds like absolute chaos. >> reporter: here are the
problem. early on, the protesters will say at the heart of the problem were the police, right? the more police you have, there is more of an opportunity for confrontati confrontation. the police after the wednesday and thursday and militarization was at its height they tried to step back a little bit and give people some space. in the beginning it seemed like it worse but the later in the evening with the police stepping back, there is a sense of chaos and a sense of lawlessness. at the same time, people who are still here trying to protest the name of michael brown but trapped by that chaos that is starting to ensue. >> mika, at that point, the governor has no choice. >> i know. >> and -- >> the tension is so ratcheted up. when you have, like i say, shopping centers where the police are setting up their headquarters being attacked and you have that mcdonald's being completely taken over, they have to step in. >> so many different controversies that add to it.
the release of the videotape. now new, overnight, a preliminary autopsy conducted on behalf of michael brown's family shows the 18-year-old was shot at least six times, including twice in his head. some bullets entered and exited brown several times. the autopsy found no gun paueds on brown's pod which could indicate he was not -- he was not shot from close range. police have said brown was shot after a struggle. >> unfortunately, this autopsy, mark halpern, like every other autopsy, like every other part of this story is inconclusive. they don't have the clothes so maybe there is gun powder on the clothes. he was shot on the top of the head which they believe was the fatal shot. but they don't know whether that was when his head was down and he was charging the cops or when he was giving up. it's still just another big question mark here. >> even the gentleman who conducted the autopsy said, as you said, that this is inconclusive and there will be two other autopsies.
the president comes back today. i think -- i try to be optimistic here about where we are. the president is heavily engaged. the attorney general, obviously, is. people need to protest and exercise their first amendment rights but order needs to be restored. i'm optimistic based on the weekend's activities i think today is a better day and a real effort to restore order. >> why do you say that? last night was the worst night of violence that there has been. >> because i think authority is moving more towards people who understand the right balance between civil liberties and order. >> i thought that's why they brought in, what, ron johnson? >> yeah. >> i thought that's why they brought in ron johnson. i mean, the state officials have been on the apology tour the past three or four days talking about how terrible it is. eric holder stepped in. everybody stepped in. last night was the worst night of looting yet and lawlessness yet. by the way, if you're at home and sitting there thinking the cops are terrible people and they are horrible and what has
happened is horrible, well, i certainly would agree with you that there is such an unbalance but we have taken the ferguson cops out of the equation which is overwhelmingly white and underrepresented. nicole, i haven't seen any polls. i would guess the overwhelming majority of governor jay nixon's constituents are saying, bring order to that place. we don't want that in our state. we don't want the lawlessness in our state. we don't want mcdonald's taking over. we don't want small business owners shops being looted. i am just injecting a little political reality in this i would expect state officials if this doesn't stop, to get a lot tougher, a lot faster. because, politically, the danger here at the end is allowing lawlessness to break out in the streets for weeks and weeks. >> the most compelling figure to me is captain johnson. what an elegant -- >> great guy. >> -- and passionate man what he
said yesterday. you know, it moved me and i had hoped would move the community members. but i guess the question to trumaine, how much impact are his words having? he talked yesterday so eloquently about his own son. he said that's my baby. that's my baby with baggy pants and his hat on sideways. i am you. yet he is so far incapable of quelling all of the violence. what prospects do people on the ground see for his words having an impact? >> reporter: captain johnson has been a game changer. every time he steps into a crowd, he's embraced with handshakes and hugs. the people here certainly do love him but the vast majority of the public who loves him but a group of men who are disinfected and had this long and hopeless history day in and day out with the law. i think when you see johnson's face he looks earnest and this is his community and those
people are his people. the people unemployed and dropped and pushed out of schools and have no sense of hope his words fall flat because tomorrow, the next day when we leave they are still going to be in this concentrated poverty. their lives are going to be dire and their outlook is dim and dismal and that is who we are talking about here. we are not talking about the good church folks, so-called good church folks or the leadership that seems to be so far away from the front lines. we are talking about young men and he women who day in and day out living with the burden and weight of poverty and all of the things we talk about day in and day out. so it's hard for them to hear the positive words and see that face and believe is what we are dealing with here. >> trumaine lee, thank you very much. to another story that has extremely broad implications in the world of politics across the country. texas governor rick perry says an indictment issued for him for abusing his power is in itself an abuse of power. he said in part we don't settle political difference with indictments in this country. it is outrageous that some would
use he is making good to threat for veto a state agency that vegetables public corruption. the agency is run by democrat rosemary lindbergh who refused to resign after being pleaded guilty to drunk driving. she served 45 days in jail at the time. during the the time a jailhouse video of her emerged and here is how the reporter chris willis covered the story when the tape was released. >> reporter: the video confirms what the police report states. that the night of her arrest district attorney rosemary lindbergh was combative and resisting and refusing to imply with law enforcement. >> turn around and face the wall! >> reporter: after repeatedly yelling at jailers and kicking on her cell door, jailers rushed her cell and strapped her into an emergency restraint chair and placed a spit mask over her
head. she laughs and says call greg referring to greg hamilton the travis county sheriff. >> did you call? did you? did you let him know you had me in custody? >> you've been arrested for dwi. >> that is his problem. >> reporter: deputies say the district attorney also attempted to scratch and grab an officer's hand and when her blood was drawn she remained strapped in the restraint chair and her spit mask was removed but later put back on. her attorney says the mask was not because she spit on anyone but, rather, to conceal her identity. >> you know what? mika puts a spit mask on me sometimes when the show begins. >> yes. >> i just -- you have people on the left and people on the right talking about how outrageous this is. willie, this woman -- i mean, she blew 3.5, 2.5, point 6,
something like that. she was gat icombative. everybody makes mistakes. she made a big one. threatening i'm going to put you in jail and acted about as badly you can act under these circumstances and everybody makes a mistake and go to rehab. but i think any governor that i've ever met -- and i've met a lot of governors -- who would say, you know what? she is probably not the best person to run the public integrity unit after acting that way. >> is that an elective job? because you could argue that the folks decided that. just saying. there's two sides. >> so, any way. >> but two sides and on all of them stands the republicans plus david axelrod and legal scholars
and on the other partisan public interest. >> david axelrod said this is a very sketchy -- >> looks very sketchy. >> and allen said no legal grounds for indicting him for carrying out the constitutionally clearly stated objectives of this office. >> let's put in this proper context. republicans have caught a lot of flak this summer for suing the president, not personally. but having the constitutional question about the powers of the white house. what the white house can and can't do. then you have impeachment. that sort of is the next level where you try to remove somebody from office but not put them in jail. i said that's stupid. people talk about that being the politicalization of office. in this case, the austin district attorney is trying to put rick perry in jail for doing
something that i think a lot of other governors would have done at the same time. >> i want to play out both sides of this. joiq joining us from austin, texas, ross ramsey. ross, good to have you on the show. i guess lay out for us, the way you see it and the way you see is personally covering stories and your instincts and intellect at play here, are there two sides to this or does this look slanted? >> it looks a little slanted. you start these things whenever you prosecute someone in politics. their first response, you know, it's textbook and also often correct is, you know, this is all politics, we shouldn't be doing this. rosemary lindbergh is impossible to defend here. the problem here is that the governor is accused of coercing her and using a power that was his, the power of the budget and the veto pen to say if you don't quit i'm going to veto this. she is an elect official and not
in a state agency, a travis county prosecutor. she's an elected official. she pled guilty. she did jail time. she survived a civil lawsuit to remove her. and she also said she wouldn't run again. that is how she has dealt with this. then perry comes in and says, you know, if you don't quit i'm going to take this fund away from your office. it wasn't her prosecutor, it was a special prosecutor. the prosecution says he can't use that veto in that way. he can't use that to make another elected official do something that the proper course for that would have been to pursue some impeachment or other mechanism. it's not that perry did a veto. it's that he did a threat. that's where this thing hinges. >> they are talking about -- yeah, this has to, because if you look at the statute it can't be the veto because that is a government election by a government embody. in this case, they are indicting him because the prosecutor is so desperate to do this, they are
indicting him for political speech which, of course, is the most protected speech under the united states constitution, and he's done it all publicly, right? nobody is suggesting that he's whispering behind closed doors and saying give me cash. i thought when i first heard this, the news first broke saturday afternoon, i said he must have taken cash under the table. there had to be more to this story. no! they were public veto threats that they indicted him for which using this logic, ronald reagan could have been indicted when he threw that huge budget down saying if you send it to me, i will veto this budget and somebody lose their job because they said we are going to veto -- i mean, is there anything else out there that he has done other than make public statements? >> he did a couple of things. it's not just that he made a public statement. that he said i'm going to defund this agency or i'm going to take away the state's funding for
this agency if she doesn't quit. now, one of the reasons that the partisans got involved on the other side and made the original complaint was is hers is the office that investigates state goverts. she is the watchdog over public corruption cases and things like that. perry is in the case of a fox taking away the food supply of the watchdog at the henhouse. and so there is a conflict of interest in it and a lot of people said at the time that he spoke up, you know, you ought to back out of this and you can veto that funding and you can demand her resignation but you can't tie those two things together. >> i totally agree. the question did he have the authority to do this and if he did, he did. mark halpern, i guess one other facet of this you could argue that she was investigating things that were of very close interest to him. >> she potentially was. this is the stupidest thing i've heard in my entire career. i hope a judge throws it out. it's not only funny and
ridiculous but an infringement on civil liberty. he has a right because he is governor of texas. it's easy to joke about this but this is a serious thing. it is ridiculous that he was indicted for this. ridiculous. >> it's ridiculous also, ross, really quickly, i mean, also ridiculous that you have this going on in texas repeatedly where you've got democrats based in austin, texas, going after republicans that run statewide offices or in the case of tom delay, this scene has happened time and time again where democrats go after republicans with, you know, sketchy, you know, sketchy reasons. >> i think that's right. i need to point out here that the prosecutor on this is a republican. there is a special proper in this. it's not rosemary lindbergh. a republican appointed by a republican judge. tom delay is one and kay bailey
hutchison is another and they don't have a very good batting record on it. >> they charged kay bailey hutch southern. never indicted. >> they did indict her, actually. >> oh, they did? >> yeah. she went to trial and -- on the first day of the trial. >> wow. >> that's unbelievable. maybe it is like a sewer leak in a restaurant that just opened. we will see. ross, thank you very much. one other story we want to get to before we go to break. kurdish forces are celebrating a key victory overnight over islamic militants in iraq. they took over the area two weeks pregnant the country's largest dam and provides electricity to northern iraq. president obama notified congress about the new air strikes and said regaining control of the area would protect iraqi civilians and
americans serving overseas. joining us now is msnbc chief pentagon correspondent jim miklaszewski with the latest. jim? >> reporter: mika, what is interesting this is the kurds are celebrating but they didn't do it by themselves. they were actually fighting in conjunction with iraqi security forces and, of course, all that massive air power, all those bombs and rockets that u.s. fighter bombers and those armed drones were raining down on the enemy forces. it's interesting, you know, because there was some concern about mission creek that the president had to notify congress again because this is, in fact, an element of mission because originally u.s. military forces there were to see how they could support the protection of u.s. personnel in the country and for humanitarian reasons. in this case the reason for launching those air strikes was
to support those kurdish and iraqi forces attempting to go back and seize the dam. i believe this is the opening volley of an actual ground war against isis, not by the u.s., but an aggressive effort by kurdish and iraqi forces with that massive kind of air power support for those forces for some time to come, mika. >> all right, jim. thank you so much. we really appreciate it. that's great news. >> we will see. still ahead -- >> say, thank you, president obama. republicans, can you say that today? this is your test today. >> that's pretty good. >> this is your test today. thank you, president obama, for getting involved and helping stop early stages, one of the most dangerous forces in america, okay? you can thank, okay? thank you, president obama. >> where are they on this? >> well, we will see. we will see. >> okay. very well done. >> can you say that? thank you, president.
stand in front of the mirror like in romper room. i see. i see a republican grateful. >> democrats too because some democrats should thank him too. >> and people on the far left need to thank the president too. a strong show of force. i, for one, is glad the president didn't show his hand. the first thing he did, first thing the president did was got to stop the genocide. i predicted he was cracking the door open because it's the most lethal and most dangerous force across the middle east. the next thing is we got to protect u.s. troops. then they gave arms to the kurds and the bombing and taken back this dam. this is extraordinarily important and we need to keep doing it. >> did you see lindsey in your romper room mirror? >> no, i did not see lindsey or johnny mccain. >> they are into this stuff. oh, wait. only when they want to. >> they should learn from bill clinton when somebody on the other side of the aisle does something good, you go, "good

let's take a look at the morning papers. it's not. i don't know if it is. seriously, i've been reading conflicting, but still, the concept of kale. if not bacon. talk about that coming up. start with the daily mail. a malaysian bank employee and her husband were arrested in what police call an inside job to steal from the bank accounts of passengers of missing flight mh-370. are you kidding me? officials say in july the
suspects allegedly transferred a total of nearly $35,000 from the accounts of three passengers into the account of a fourth passenger. money was then withdrawn until account was empty and flight mh-370 vanished five months ago. >> that is disgusting. >> from our parade of papers. a female caught a record setting gator over the weekend. the gator weighed in at 1,011 pounds and 15 feet long and took 15 people to reel it in! the catch may qualify as world record for the largest gator killed illegal by a hunter. "the new york times," the als ice bucket challenge continues to make a splash across social media raising money and awareness to fight the disease. since the challenge went viral back in june, more than 1 million people have posted videos on facebook and it has been mentioned on twitter over 2 million times. even celebrities are taking a
challenge with stars like justin timberlake and jimmy fallon and governor chris christie and oprah donating and recording videos. there is gale. she is awesome. joe and i took the challenge last week. joe, you got it so bad. that's how you do it, everybody, right there. just right there on "morning joe." joe took a challenge and passed it on to our good friend carole king. >> als, i'm challenging "morning joe" who nominated me, so here we go. tim, ice. creek water. 1-2-3! >> oh, my goodness. carole did it right! you know that creek water in idaho was probably colder than the ice! >> she is amazing! >> how great is she? >> i love her.

♪ >> i want to start off by talking to mike brown's family. my heart goes out to you and i say that i'm sorry. i wear this uniform and i stand up here and i say i'm sorry. >> welcome back to "morning joe." nicole wallace and mark halpern still bus. and joining us on ari melber, the host of "the cycle" on msnbc. >> ron johnson was coming to pay his respects to michael brown's family and then, of course, last night, things got worse. it was the worst night of violence and looting that they had. the national guard has now been called out. they had a shopping center that was attacked. a mcdonald's that was taken
over. it's just complete lawlessness in the street. and "the new york times" quoted a family that said we came in to pay our respects to the mother, to the family, and then this. one of the gentleman quoted saying, this is no way to remember michael brown. you do that by voting for change. >> whether a curfew helps or hurts in terms of escalating tensions but they did have a curfew in effect as well. regardless, violence returned to the streets of ferguson, missouri, overnight, more than a week after an unarmed black teenager was shot to death by an officer. just hours ago, democratic governor jay nixon ordered the national guard to the city to, quote, help restore peace and order. for the second night in a row, a curfew is in place and police and demonstrators were involved in heated clashes. hours before the curfew went into effect, police fired tear gas at hundreds of protesters. state highway patrol captain ron
johnson says the protests spiraled out of control and the police had no other choice. >> molotov cocktails were thrown. there were shootings, looting, vandalism, and other acts of violence that clearly appear not to have been spontaneous or premeditated criminal acts designed to damage property, hurt people, and provoke a response. >> also new. overnight, a preliminary autopsy conducted on behalf of michael brown's family shows the 18-year-old was shot at least six times, including twice in his head. some bullets entered an exited brown several times. the autopsy found no gun paueow on browned's body which could indicate that he was not shot from close range. the autopsy says brown died because of struggle. >> we were critical of the
police moving in. now the governor has done what most people would do, he brought in a son of the city. that hasn't worked. now they are bringing in the national guard. the lawlessness last night worse than it's ever been. eric holder getting involved. the president, i'm sure, will speak out even more on this in the coming days and weeks. what is next? >> you need a lot of resources on the ground. part of why i'm optimistic that things are going to get better i think you're going to see the white house send whatever resources are required not just the national guard. >> what other resources? >> community leaders. civic leaders. i think you're going to see a lot more people on the ground, a lot more tensiattention from th national government as well as coordination with the local government. the state was overwhelmed by the situation. you can't shut the city down. people have to be able to exercise their first amendment rights to organize and gather
but i think there will be sufficient resources -- >> you say sufficient resources. the ferguson police department last week rightly was criticized for overreacting, ari, but if the violence gets even worse, if it keeps getting worse, you're going to see a scene that looks more like a military zone. >> look. this kind of conduct and you heard the captain there who i think has more credible than some of the other authorities, also speaking out against this criminal conduct. but as you know, joe, as you've discussed, an interplay here with what some of the authorities have been doing. you had basically widespread jury tampering via video release late last week. it is outrageous to take what would probably be inadmissible video of other conduct by this dead teenager and putting it out for the entire town to see. >> wait. what are you talking about? >> i'll talking about the video they put out of michael brown saying here is a separate
incident allegedly and they put out this video. >> robbing -- >> everyone criticized and a lot of legal people can tell you that's not right and not proper. it's out for the whole community. if there ever is a trial now you already have the police interceding early to put out this video. i found it outrageous. >> you thought it was outrageous they put out a video that was allegedly minutes before the confrontation? >> allegedly a separate incident that the police themselves said the police commissioner in his speaking out on friday said the officer who shot this individual didn't know about this. so we are just putting it out. >> not like it wasn't called in saying there was a robbery at a convenience store? >> if that changes we haven't heard from this officer there is a legal process has to play out. what were the police doing way out front of that process? that was suspicious and why the governor who has backed the police in other ways who credited them for keeping the peace last week, even he came out and said, this isn't how you
do it. now, i'm not saying, obviously, that that validates any of the lawlessness but there is a cycle here of mistrust between the authorities and what happened. >> haven't the authorities, by bringing in ron johnson, haven't the authorities, by having, you know, him apologizing, everybody stepping forward and apologizing. a what point do you not have a blank check to go out and smash up stores, take over mcdonald's? >> no. >> i just don't think there is any justification whatsoever. >> right but no justification for releasing that video regardless of what their motivation was. >> i'd like to know what their motivation was. everybody thinks releasing the video of him in the convenience store, separate incident where the cops involved with the case and that involves his death had apparently no idea about it at the time, at the moment. what was their reasoning for releasing the video? >> they claimed, i found this highly suspicious, but to the point of the reporting implied by your question, they said this was in response to freedom of information request that they
felt they had to release it. as pointed out, they didn't respond to many other freedom information requests and if you want to get technical, missouri has a state public safety regarding public release of information and no rush to put it out and goes to a larger point. if you were litigating the case the first thing i would do is ask for a venue change. >> you point out that this could have escalated the tension or added to the tension. let's bring in the mayor of baltimore, maryland, stephanie blake. baltimore has its share of challenges with crime. how important is the relationship with the community and what do you make of what has happened in ferguson in terms of the release of the tape, the curfew, and the events overnight? >> so it's good to be here. and we have had our share of problems, and i've faced similar issues of police legitimacy in baltimore.
under my administration, we were able to get the homicide down to the lowest they have been in generations and i thought i would be hoisted up on shoulders and everything would be excited about it. but, at the same time, the homicide were low, distrust of the community -- of the community of the police was very high. people did not trust the police. there was very high brutality, d discourteous complaints and i've been out in the community and i've gone to every single council district and had a community formed just for young people. this is about getting the communities to have voice. and you can't do it after the fact. you have to do it in recognition and respect of the perspective and the feelings of the community and then you have to do something different. >> mayor, what do you do? you talk about the feelings of the community. last week, we were saying something around this set completely different and i suspect we will say around the set this week if the violence continues. if you go and you talk and you
explain there is a problem with the police department and you're going to work on that problem and you do all of the things that the missouri officials did belatedly, and the violence still continues, the looting still continues, the pressure is on you to stop the stores from being vandalized, to stop the mcdonald's from being taken over. what would you do in this position now, knowing that you had the worst night of violence last night and you've got to protect your citizens and small business owners for the night that comes? >> the challenge is if they don't take a time-out and start to listen and not just react, i think the violence that you're seeing and the looting is just the beginning. they cannot have -- >> weren't they listening yesterday? >> it doesn't look like they were listening yesterday. it looks like they have continued with the militarized response, a panic response, because they don't have any relationship with the community.
it was clear by what you saw on the street. it's clear by the response that you see from the few black elected official that you have. they need people to be able to speak up for them and it can't be just people in uniform. >> but the man in charge of the policing is actually a son of ferguson. he's an african-american who gave an impassioned plea yesterday in a church service, apologized and said, "i am you. my son is you. i understand what you've going through. >> do you see him out there with any other african-american law enforcement agencies -- i mean, law enforcement officials? he is out there by himself. if they think they are placing this problem on his shoulders they are make ago mistake. they need others to be able to step up. you can't prop people up. you have to be in relationship and they have to sit and listen to this community. >> what do you do tonight? so they listened all day yesterday. they had the worst night of violence. you said that it still looked
militarized. would you take all of the vehicles off the road for tonight, lift the curfew, and just let happen whatever happens? >> i don't know all of the intricacies of the relationship with the community. if you keep doing the same thing over and over and respect the response different i think there is something wrong there. they have chosen a response and they have chosen a road to go down that is not getting them the results that they want with the community. so doing the same thing again tonight, how would you expect to have a different result? >> mayor, to add to your point about sort of the panic and the response, here is some video last night emerged and appears to show an officer threatening a local radio reporter. take a look. >> get down! [ bleep ]
. >> so, mika? >> that definitely one way to deal with a person standing in the street. but i think mayor stephanie -- >> hold on a second. >> the context -- >> we have no idea what is going on there! we show 30 seconds of clips and, by the way, we don't know what is happening in the street! >> joe, what i'm talking about is how, at this point, law enforcement must feel. they must be very, very exposed and vulnerable and really, really concerned about getting the job done and staying alive. >> there was gunfire last night at police officers. >> i know. >> there were molotov cocktails last night thrown at police officers. we show a three-second clip up and then there is a pregnant pause that hangs over the set? we aren't in their positions and we don't know what they are going through! right now, we don't know what that officer was going through when he yelled that. >> nor do you know about the
people of ferguson have been going through for years. >> actually, i do. >> we should put ourselves in the place of the police officers and put ourselves in the position of the people in the community. they are frustrated. >> repeatedly what is going on there, they are in a community that is underrepresented. there are, what, 55 police officers. 52 of those police officers are white. it's a disgusting situation and we have condemned it on this show for good reason and they can't expect to have community support. the question is what do we do to stop the bleeding now? what do we do to stop the violence now? that is what i'm asking you. okay. we can't do what we have done in the past. they are trying to change. what do we do to get peace on the streets tonight? >> i think the police officials have to show the community that they are willing to step up and to say that this is wrong. they took a giant step backward when -- no. i'm talking about the chief of police, not captain johnson. i'm talking about the same one
that released the tape of michael brown allegedly of michael brown in the video store. you can't do that and expect support from the community. they had to expect that there was going to be a response and it was going to be negative. they chose that path. now they have to fix it. >> fascinating. mayor stephanie rawlings-blake, thank you for being on the show this morning. >> thank you. moving on to -- >> no, no, i mean, listen. let's talk about this. >> okay. >> when you -- >> i don't think you -- >> i do understand all too well. when you loot and you cause damage to property and you fire bullets at police officers and you throw molotov cocktails at police officers, then, at that point, you are opening the door and basically begging authorities to do what they did last night and what we were condemning them for doing a week wag. >> i think we are saying the same thing. what i was trying to say i don't
think you understand why i showed that clip. i don't necessarily claim that that officer or -- i don't know exactly where that law enforcement person came from. but whoever it was, i'm not saying that he was abusing the radio reporter. i'm saying you could hear the panic in his voice because things are so bad there, one other concept may be, what else would you do at this point if you see anybody out past the curfew? you panic and say get down. >> the reporter may have been in harm's way. >> right. >> and this goes to how this is very much in the eye of the beholder. i think if you watch the reporters, this network especially, a report from war zones, they listen to the military voices on both sides because their lives are often in danger. that to me sounded like a voice telling that reporter to get down because he could have been in danger so it's very precarious to sit here and try to -- >> he was saying he would shoot him. >> maybe with a rubber bullet to get him down.
we just don't know what is going on. i'm uncomfortable with reporters making themselves part of the store. there is enough suffering on the ground from the people that live there, that i'm -- >> by the way, a lot of that is going on. >> reporters being a part of this? >> making themselves part of the story. >> it's not as compelling to me -- we were talking at 6:00 about the people that live here day and nand day out. i asked why ron johnson isn't capable of being the element that changes things on the ground and he said because there's so many disinfected people in this community that even his words, someone to us looks like he would have the ultimate credibility, his words are falling on deaf ears. that is more compelling than a reporter who may have gotten in the line of fire. >> he has operational authority over the streets. he doesn't have operational authority over the investigation and no one says he should. so this is -- >> you think people are kicking in windows and looting and stealing things because they are trying to figure out who is going to have operational control over the legal process?
that's b.s. >> no, absolutely not. so i think what you have here actually is a problem in the cycle of conflict between two groupings of people where the majority may want something acceptable, a majority of, say, good cops who didn't shoot anybody and a majority, i would argue if you look at the footage a majority of people who are peacefully protesting. >> overwhelming majority. >> right fo. >> these loots who may not be from ferguson are giving right wing nuts all of the ammunition they need to attack politicians on both sides who are trying to preach restraint, to do what, you know, rand paul said last week, and what -- i bring him up just because republicans are finally starting to talk out on this. eric ericsson had a very good post last week saying, hey, conservatives, do you really have to wait for a white teenager to be shot to be horrified by what is going on in
ferguson? >> here is a hard thing that people need to start saying. the governor needs to say it. the local officials need to say it and eric holder needs to say it. the investigation is going to take a while. the police officer has constitutional rights. >> sure. >> they are dodging those questions and they are setting up a series of miniexplosions as this thing goes forward if they don't start telling the community what the real deal is. you cannot rush this investigation. you cannot dodge the fact it's going to take a while and people are not going to get all of the information they want. >> by the way, i understand eric holder is doing what eric holder needs to do to let them know the federal government is involved and they are concerned. eric holder also has a responsibility to say just that. everybody has, you know, their rights. we are going to do an investigation. we are going to figure out what is going on and what happened with michael brown. we are going to figure out whether -- whether he was shot in cold blood on the street without any provocation, or whether, as other reports have it, he was charging the police

♪ texas governor rick perry says an indictment issued for him for abusing his power is, itself, an abuse of power. >> i would agree with this. >> he says in a statement, in part, we don't settle political differences with indictments in this country. it is outrageous that some would use that. he is making good on a threat to veto millions of dollars for a state agency that investigates public corruption. the agency that is run by democratic -- democrat rosemary lindbergh who refused to resign after convicted of drunk driving, she pled guilty and
served 45 days in jail at the time. during the trial a jailhouse video of her emerged and here is how kxan reporter covered the story when the tape rwas released. >> reporter: the video confirms what the police report states. that the night of her arrest district attorney rosemary lindbergh was combative and resisting and refusing to imply with law enforcement. >> turn around and face the wall! >> reporter: after repeatedly yelling at jailers and kicking on her cell door, jailers rushed her cell and strapped her into an emergency restraint chair and placed a spit mask over her head. lindbergh laughs and continuous to tell they will to, quote, call greg, referring to travis county sheriff greg hamilton. >> did you call? no. did you? did you let him know you had me in custody? >> you've been arrested for dwi. >> that is his problem. >> reporter: deputies say the district attorney also attempted to scratch and grab an officer's hand, and when her blood was
drawn, she remained strapped in the restraint chair and her spit mask was removed but later put back on. her attorney says the mask was not because she spit on anyone but, rather, to conceal her identity. >> the governor has denied wrongdoing. for months insisting he is the target of partisan games. >> and i did what every governor has done for decades, which is make a decision on whether or not it was in the proper use of state money to go to that agency and i vetoed it. i stood up for the rule of law in the state of texas and if i had to do it again, i would make exactly the same decision. >> it's a sad video when you watch after the dui arrest. perry looked quite fine. he has those glasses on and everything. but this video was such a sad video, mika. the thing is you can feel sorry for her. everybody makes mistakes. we all make mistakes. the question is whether it's
legitimate for a governor after looking at that tape and looking at how she seemed to be striking out and threatening people, whether that's a person you want to run your state's public integrity unit. >> i guess some would say that is for the voters to decide. joining us from austin, texas, senior editor of texas monthly, erika greeter, she is the author of book, big, hot, cheap and right what america can learn from the strange genius of texas." erika, first of all, is there anyone that thinks that this indictment is a strong case against the governor? >> a strong case, no. thanks for having me. i think everyone thinks it seems pretty weird. personally, i'm in a lot of suspense. i think it's pretty mysterious and i'm excited to see what the evidence is. i guess they think they have something. based on the indictment itself it seems like a pretty flimsy case again the governor. >> amazing. everybody says that. >> a lot of people, ari, have been calling this a flimsy case against the governor,
including -- you got david axelrod and jonathan shape at new york magazine has said the same thing. of course, he also said i'm the axis of evil so you have to discount some of this stuff. but i think he is right on this too. but erica people on the left and the right. at least on the national stage, that think this is a ridiculous case against the governor. are there legal experts in texas that are suggesting that maybe we just don't understand something about texas law? i think it's possible we don't. i'm not a lawyer. look at the indictment it's possible something else happened. the veto itself seems it's clearly within the governor's authority to do. he vetoed state funding and he is allowed to do that. he doesn't need a reason but his reason as you guys said seems pretty plausible but he could do it for any reason. he doesn't even need to explain. it's possible that after the veto, there was some discussion
between his camp and her camp about a possible appointment to replace her. maybe there is more coming out on that front. even so, i'm not sure what the legal status of that would be. much less the ethical status. >> erica, thank you so much. we greatly appreciate it. your big, "big, hot, cheap, and right," heck of a book. >> thank you, erica. >> ari, let's put context in here. you got two tiesides. you probably have a lot of people looking that aren't from texas saying, wait a second. why would democrats rally behind this woman who is so clearly drunk and, you know, part of it is that perry would be able to replace her successor, right? a lot of the investigations that were going on, some against organizations who were aligned with rick perry, maybe those investigations would fall by the wayside. they didn't want rick perry to
appoint a republican and rally behind she is not the best candidate for support. >> the indictment looks fairly illegitimate. if there is another legitimate shoe to drop the thorough you put forward. actually some direct evidence of disrupting to shut down those ongoing investigations. >> like andrew cuomo did in the state of new york? >> allegedly and that is a important conversation. >> that is the difference between a good lawyer and a bad lawyer. if you're keeping score at home. speaking for the common man it sure looked like cuomo was trying to shut down that investigation. by the way, he could. it's his. ipso facto. >> the problem with this indictment it doesn't have that kind of charge in it. it doesn't have an obstruction or tampering charge. it has two charges one relating to the veto itself dated to the
date of the veto and that is essentially a criminal charge for a veto which as i wrote on msnbc.com seems absurd. >> by the way, that will not stand. it goes against a texas statute itself. >> that is right. >> the prosecutor in a difficult position. the veto, there are exceptions for acts in this so they have to actually charge him for the threat of the veto which is like i said earlier that impings upon political speech. first year in constitutional law you know that is protected political speech. no way this holds up. >> right. the threat goes to what they are calling a coercion of a public official charge. let's be clear. that usually means something like, hey, mika, here's some cash. please do what i want. that is illegal. as we have seen in the virginia case, hey, thanks for the gift, i might do you a favor when i'm in government. this is not even alleged in the indictment. >> that is the problem. how many times, mika, have we
seen what rick perry did? he is being indicted what we have seen presidents do time and time again. i will veto that bill. they all do it. ronald reagan, bill clinton, all of them. >> in virginia, governor mcdonell takes the stand this week and we will be following that. the perry indictment might be much more smoke than fire he isn't the only governor facing scrutiny. believe it or not there is more. msnbc news kasie hunt has more on the country's most visible governors for fighting scandals that could put a serious dent in their political ambitions. >> it's a relief to be out of the texas heat. awfully nice to get up this morning in the beautiful iowa weather and good looking corn crop. >> reporter: rick perry is trying to focus on the future but he is stuck looking over his shoulder. >> i stood up for the rule of law in the state of texas and if i had to do it again, i would make exactly the same decision.
>> reporter: perry isn't the only ambitious governor who is feeling the heat. expensive gifts. lane closures and suspicious e-mails. the list goes on. threatening to sink the highest hopes to the lowest of lows. in wisconsin scott walker is in a close race for re-election against democrat marry burke. his name surfaced in an alleged criminal scheme for election law a and prosecutors stopped without any charge. in new jersey chris christie's legal fees soars to $7.6 million all billed to the taxpayer. two staffers were dismissed over the bridge scandal and investigation is still going but, so far there is no smoking gun. >> they want to put you in cuffs and send you away. he had to have known. he knew. now, when i turn over every e-mail, every text message, everyone gets to look at it and
it's become clear in six months he didn't know. >> reporter: virginia's bob mcdonell was a contender to be mitt romney's running mate and now he and his wife are airing their dirty laundry in court laying barry a broken marriage. they say he didn't do them any favors in return. >> nothing going on in any way impairs my ability to be oon effective governor. no one in my administration has been given any special consideration. >> reporter: andrew cuomo of new york mentioned as a future democratic presidential pick is facing allegations he meddled with an independent commission charged with cleaning up albany. one of the commission's co-chairs stood up for cuomo saying the governor didn't interfere. >> what do the chairman's actions show? no! resoundingly, no! the rejection is ipso facto, a statement of independence because he said no.
>> thank god kasie got the ipso facto in. >> let's bring in a reporter for pro publica. we have to say his name right. theodoric? >> yes, that's right. >> and blake sheft a former top aide to snyderman before entering journalism. >> theo, i picked this up on an app this weekend. a fascinating story that you broke. tell us about it. they are wiping out new york state e-mails in, what, three months? what is going on? >> so the administration has adopted this policy and really two parts to it. one, e-mails are being deleted starting last year after 90 days automatically. >> why? >> unless state employees, you know, sort of specifically save them. >> right. >> two, the guidelines for what has to be specifically saved are
not nearly as expansive as the other states i talked with. >> what is the justification? three months? my inbox is filled with things i haven't opened in three months. >> that's a different story. >> we obtained a memo from our freedom of information request that sort of outlined why they were doing it and they said it was to improve e-mail management in parts. but, strangely, the policy was also adopted at the same time they moved to sort of a new e-mail system that featured cloud storage in which each e-mail user has 50 gigabytes of storage. >> so you can just store stuff forever? >> that is enough to store millions of e-mails. >> this isn't like a federal government is claiming, well, we got tape from, like, 1978 and store all of this on 8-track tapes. they have got cloud technology. so 50 gigabytes? that holds a hell of a lot of e-mails. >> that's a lot.
>> any nusks frjustification fr governor's office for wiping these e-mails out in three months? >> only improving e-mail management. the independent experts i talked to and people who design these sorts of policies for other government agencies have said this is not a good idea. this is not enough time to save your e-mails. >> i'm curious. other states have policies that go longer than three months. connecticut, two years and washington state four years and florida, it's three years. so those routine e-mails were kept for a longer period of time. when was this decision made? >> some state agencies seem to have been doing this going back to maybe before the cuomo administration. but there was a memo sort of standardizing it for all state agencies that came out last year. i think it was last june or july. >> interesting. >> blake, andrew cuomo promise to be transparent like everybody else when he gets into office and it seems to be actually him doing just the exact opposite. >> yeah. this falls right into the pattern with what you guys were
talking about with the moreland commission. he comes out saying i'm going to have an independent commission and can look at anybody and go after the bad actors and politicians in albany aren't going to linike it. now theo brought to life i've going to be the one to reform albany and turns out they have this new e-mail deletion policy. it's a little bit of a pattern here that we have seen. >> is it connected directly to him, this decision? >> he is known for micromanaging every little aspect of his operation and that could be a good thing and bad thing but in this case it's hard to major major policies are not happening without his permission. >> mark halpern? >> what is your sense of where the moreland investigation is going in terms of the end of the ferguson prosecutor? >> yeah. so for people who are watching this on the national level, they are basically two faces to this investigation. first what you might call the underlying allegation as we discussed sort of meddling into the commission when they had subpoenas that got too close to
the governor's associates the allegations his top aides said pull it back. . the ipso facto comments, after the investigation was announced by the federal prosecutor, there were statements that came out by commissioners that said, oh, there wasn't any interference. the federal prosecutor has said he is interested in looking into how the statements came out and did the commissioner influence those? the sense i'm getting from people knowledgeable about the investigation that may be the easier and more cleaner jurisdiction for the federal prosecutor in terms of a witness tampering charge. >> thank you both so much. >> thank you, guys. >> keep us up to date. still ahead -- >> now we have ari here, this is why. >> justin bieber and kevin spacey and bill gates, somehow they all made it in today's h l hollyweird. really?

time on the speaking circuit. according to documents obtained by the las vegas review journal, the former secretary of state will only stay in luxury presidential suites. >> that's the mika writer. >> taking part in appearances. stop it. she also requires a private jet for transportation. >> i'm sure it's like a cheap private jet. >> like a glider. >> no, a $39 gulf stream jet or larger. it calls up to five rooms for her travel aides and advanced staff who fly business class to the events ahead of her. her stenographer must be paid for too a thousand bucks. clinton's standard speaking contract says she will stay for no longer 90 minutes and will pose for no more than 50 photos. >> mika, you like these writers, don't you? the documents were related to a speech last year at the university of of las vegas where
hillary clinton got 225,000 to speak and some students complained noting their own struggle with financial aid and debt. annie, you were writing in "the new york" magazine that hillary clinton d first of all, that was a discount, the $225,000 is a discount. she usually gets $300,000. >> yeah, this is on the cheap. >> this is on the cheap but you say she doesn't have a mitt romney problem. why is that? >> insist one of many stories has come out about the clinton's earnings and money. especially a lot of scrutiny paid to bill clinton as well. he has been raking in even more than she has. a lot of that has come from financial firms. you know, there's some questions about that legitimately. but, of course, she gets paid a ton to speak and i think that the issue has been more her response where she said, oh, we are just normal people, there is that kind of infamous thing they were dead broke coming out of
white house. ultimately at this point she is not running against anybody and she is collecting heat for this and had sort of awkward answers but at some point she is running against a republican and i think probably easier for her than said republican to say she clears about the middle class and low income americans on the basis of her policies. >> in part, as you explained in the piece, mitt romney was talking about policies that would actually help people and make the type of money that hillary clinton makes and she probably is supporting policies that would be detrimental to people that don't want to pay higher taxes and make that much money. >> i've been surprised by the likes that this story has had. it's just been this regular drum beat of pieces that have come out about her stories. you know, i don't know that it's affecting any ratings or anything like that but it's interesting that it's the narrative has sort of taken on a life of its own. she is kind of a one person center and she is out of touch. >> to annie's point, joe, isn't this, to an extent, i mean, you look at how fickle the media is
and how pages turn in unbelievable ways. i think this could be brilliant. first of all, personally i think she could take the disadvantage and make it into an advantage. this page turns. she announces her run for president. what does it really matter what she gets paid for a speech? if they just embraced their richness it would be fine. >> look, she lucky, you're lucky -- >> i'm not as lucky as she is. >> no, i'm not -- >> that's ridiculous.
we're at the who concert and they wanted the m&ms removed or something. what's ridiculous is she has done very well. she just has to say i have been lucky, i've been blessed, and i think everyone in america should have that shot. >> if she is -- if you're running her campaign or advising in her campaign, i guess nobody can tell you that, but people around her would say you're worth $100 million. you don't have to go make $300,000 on speeches. if you do give the money away and make a big point about it. >> we sat around the table last week and said her two vulnerabilities are that she could face a republican but also someone in the democratic party,
and they think her ties to wall street make her vulnerable among voters. i think it's inconceivable not just to normal people, but even to people who do well to get paid $300,000 for 90 minutes work. there's a small sliver of the nation that can even consider that. >> she lets her staff fly business class, that shows she is a woman of the people. >> the amount of time we spend talking about it is perhaps about us and not about her. a campaign is never about all of us, but i don't think these things -- >> you're right it's more about the president, but she came to colorado this summer, she didn't charge. it was perfectly fine, she did not charge, occasionally she gaved paid speeches, there's

also we have the very latest after another violence night, plus the executive editor of the "texas tribune," ross ramsey. he is coming the situation with the governor like a sewer leak for the opening of a new restaurant. >> it's one way of putting things, do you believe this indictment is weak, a way to bring someone down i guess. >> it is not weak, it's a farce. it is an embarrassment for the prosecution. you have people on the left and right saying it's preposterous. >> i think it's fascinating and we're going to look at both angles. >> it's not what it appears.
>> last night things got so bad in ferguson that now they're bringing in the national guard. we'll give that a second and talk about your weekend. how was mommy, daddy, and baby girl. going off to college. >> i do feel like i'm missing something right now, i feel like i left my heart there, but it went well. it was a lot harder than i thought it would be. it was really a lot harder than i thought it would be. we put together a little piece, it's fine for the kids, they're fine. i was like a 2-year-old. and i think i say once a week i can't believe he is going to college in 16 years. and my husband is like, we hope.
>> we overpacked. i think there was nervous packing going on on the part of all of us. that's everything. we'll have more on that. it's actually a right of passage for kids and parents for sure. let's get to the news. violence rushed to the streets of ferguson last night. just hours ago jay nixon ordered the national guard to the state to help restore peace and order. demonstrators and please were involved in heated clashes. they fired tear gas at hundreds of protestors. they say that it spirals out of troll and police had no choice. >> there was shootings, looting, vandalism, and other acts of
violence that clearly appear not to be v been spontaneous , but premeditated acts. designed to hurt people and provoke a response. >> there they have a son of the city that's brought back in, they're going to try to do all of these things. they had a day of moving religious services. they said we're not looters, we're liberators. but it keeps getting worse and worse. officials have gone from apologizing to having to bring in the national guard. >> remember we had reverend sharpton on on friday, and it was a night of relative calm and
peace. there was some self congratulation there. and he said we're not through this yet. and he proved to be right. what have you seen last night as compared to say the last week or so? >> i think what we saw last night was a hot night here in ferguson punctuated by tear gas. one group is protestors coming out to fight for michael brown. another group seems to be imboldenned by the confrontations. people are planning attacks on the police. and there are sorries of protestors trapped between police firing tear gas and
people firing at police. >> we read reports and i'm sure you heard it yourself an awful lot there, there was people who came from out of town, the "new york times" said one couple came from out of town to pay their respects to a family. they came out and felt like their lives were in danger and clearly like most of the good people of the ferguson were just outraged at the violence that i guess they stormed the -- the looters tried to storm a shopping center, they took over a mcdonald's. >> at the heart of the problem were the police, right? so the more police you have the more of an opportunity for c confrontation. the police tried to step back
and give people some space and it seemed like it worked. the later you get in the evening with police stepping back, there is a sense of chaos and lawlessness, but people are still here trying to protest the name of michael brown and they're trapped in chaos. >> at ta point the governor has no choice. >> the tension is so ratcheted up. >> when you have, like i said shopping centers where the police officers are setting up their head quarters being attacked. that mcdonald's being completely taken over, they have to step in. >> so many controversies that had to it the release of the video tape. now overnight, a preliminary autopsy conducted on blaf of michael brown's family show that the 18-year-old was shot at
least 16 times. there was no gun powder on his body would could indicate that he was not shot close to his body. >> unfortunately this autopsy, like every other part of this story, is inconclusive. they don't have the clothes. they think the shot in the top of the head was the fatal shot. it's still just another big question mark. >> yes, the gentleman that conducted the autopsy said it is inconclusive. the president comes back today and i'm trying to be optimistic about where we are. people need to be able to protest and exercise their rights, but there has to be order restored.
i'm optimistic. i think there will be a real effort. >> why do you say that? because last night was the worst night of violence there has been. >> because i think the authority is moving more towards people that understand the right balance between civil liberties and order. >> i thought that's why they brought in ron johnson. the state officials have been on an apology four for the last three or four days. everybody steps in and last night was the worst night of looting and lawlessness yet. by the way if you're at home and you're sitting there thinking the cops are terrible people, horrible and what happened is horrible, i certainly agree with you there is such an unbalance. we have taken the ferguson cops out of the equation. it is underrepresented.
i have not seen the poles, but i would say the majority of jay nixon's constituents are saying bring horder to this place. we don't want mcdonald's taken over. we don't want small shops looted. i would think this would stop to get a lot tougher, a lot faster. politically the danger here at the end is allowing lawlessness to break out for weeks and weeks. >> now for another story with very broad implications. rick perry says an indictment issued for him for abusing his power is, itself, an abuse of power. he said we don't settle political differences with indictments in this country. it's outrageous that some would
you par san political theatrics to rip away at the very fabric of our state's constitution. the agency is run by democrat rosemary lundberg. she plead guilty to a dwi and served 45 days in jail. sheer how kxan reporter covered the story when it was released. >> the night of her arrest, district attorney rosemary was uncooperative. she was placed in a restraint chair and had a spit mask put

and on the other side -- >> david by the way said that it was sketchy. >> and they said there is no legal grounds for what they have done indictmenting him for the clearly stated -- >> republicans caught a lot of flak this summer for suing the president. not personally, not -- i mean, but having a constitutional question about the powers of the white house. what the white house can and can't do. then you have impeachment. that's the next level when you try to remove someone from office but not put them in jail. i have said that's stupid. in this case, the austin district attorney is trying to put rick perry in jail for doing something that i think a lot of
