Weisulberg was granted immunity in order to testify in the Michael Cohen investigation. The man they describe as the most senior person in the organization thats not a trump. Well, according to bloomberg, weisulberg is deeply familiar with the Trump Organizations financial housekeeping, was privacy to decisions that the house was never able to take part in. Eric trump, both executive Vice President of the organization. Ivanka trump was also an executive Vice President before she went to work at the white house. So cooperating with federal prosecutors should maybe be illegal. It. This whole thing about flipping, they call it. I know all about flipping, for 30, 40 years ive been flippers. It almost ought to be outlawed. You Say Something about donald trump and youll go down to 2 year s s or 3 years. In all fairness to him, if i were him i would do it. Its called flipping and it almost ought to be illegal. Today is another bombshell in a seemingly mushrooming of legal problems for this president. Michael flynn and extrump lawyer Michael Cohen are both already cooperating with federal investigators. And ami ceo david pecker was also given immunity so that he could talk about helping trump hide an affair with lauren mcdoingal. All of this comes on the heels of the ultimate betrayal, Michael Cohen, telling a federal judge that donald trump directed him to legally bind the silence of two women who allegedly had an affair with him. According to the Associated Press again, the president was under siege and his aides have become accustomed to being smacked with bad news when they look up at the television. Johnson la mere, White House Reporter for the Associated Press. Kim weld, a former federal prosecutor, and and jonathan al. Lets start with you, allen. Tell us about weiselberg, it seems we got the chief bookkeeper, the chief Financial Officer, hes so close to the family, hes the only one not a family at the top of the Trump Organization. Whats his immunity, give him the allowance to tell without prosecution and also makes him basically vulnerable. He cant take the fifth anymore. First off, weiselberg, this is a guy whos been at the Trump Organization since fred trump was running the show. When Donald Trump Took Office he turned over the running of the government to three people, donald trump jr. Michael cohen and weiselberg. Its not entirely clear what he told prosecutors. But what we do know is, with Michael Cohens plea deal, prosecutors said they had witness testimony to back up what he was saying, what he was admitting in court, and now were learning from that testimony, that it was david weiselberg and michael cohn. Youre donald trump, you are president of the United States, thats a big deal. But at the same time, offsetting being a big deal and being president of the United States, you have this coming at you, everybody thats done business with you, it seems, that knows everything youve done wrong is about to spill it. We saw Donald Trumps initial defense with Michael Cohen, he said that Michael Cohen admitted guilt to crimes that are not crime. Thats not up to donald trump to decide whether these are crimes are not. Michael cohen was sort of hes trying to claim that he was swindled into making this agreement, admitting these crimes to face the potential of less jail time. Hes going to try to use the pulpit of being president to push off this oncoming storm. Lets go to john on this. What does he do now . He must wonder, hes a man of enormous ego and selfconfidence and hes been through a lot of stuff in his life. And it seems to me the vulnerability of his family. Sure, thats always been considered his achilles heel, the way he faicares for his adu children. There certainly is a battle stations mode there in the west wing, aides are accustomed to these negative headlines after negative headlines. And the president feels prosecuted. Its not a full meltdown yet. Hes fuming to his aides about what happened, but still feels like we can fight this, we can escape this. But this is also a president that declares time and time again that loyalty is the most important to him. Not the people around him. Loyalty to him is not just a oneway street. We have seen here, some of the closest people to him have already turned. It started with omarosa last week, and now we have pecker, cohn and weiselberg. The reason they turn is because they feel theyre vulnerable to prosecution. They know or sense they did something wrong that can be used to put them in jail for a long time. So hes surrounded himself with people who feel theyre vulnerable to federal prosecution. Sure, and thats not a great trend. Weiselberg at least someone reporting at the ap testified about cohen, there may be one of trumps sharpest critics, the husband of kellyanne conway, George Conway weighed in today tweeting, it means that individual 1 needs a real lawyer. Individual 1 is the way trump was referred to in Michael Cohens plea deal. Hes president of the United States, he probably cant be indicted while hes president. Thats his one ace in the hole. But he can be indicted down the road. His kids, it seems whos he got on his side in terms of evidence. Who is going to testify on behalf of this president on any question of fact. There seems to be one holdout that seemed to have a question of reasonable doubt as a notion. But he may not get another juror like that for a while. Your thoughts . Im not so sure that he cant be indicted, i mean if he went around assassinating political rivals and congress would be in fear of their own lives before they can stand impeachment process. Do you think kavanagh would say that . We can talk about that another time. But the koonconstitutions flex on this point. Option two is impeachment. Democrats are worried about midterms in november. And option three, thats the most realistic option here, its not just trump himself, we have got the organization, which he cares a lot about. He cant hide behind executive privilege for that, he cant argue obstruction of justice didnt apply to me, thats outside of it. And of course he also has his children. And these prosecutors are being smart kind of moving in, outflanking him in some places and at some point hes going to be left standing alone, and the idea behind not indicting a president , is that under article 2 the executive power would be interfered with by an ongoing criminal investigation. I think this insanity were living through is the ability for the executive branch to function. We have to ask ourselves, how is the government even functioning at this point . Heres a guy who got every break in the campaign, i mean all the states we watched Election Night in 16 went his way, he didnt get minnesota or north carolina. He got everything that was in play. And they all broke lost in the last week or so. Hes been the beneficiary of good luck in his life i would say. It does seem that its evening out, the bad luck is catching up with the good luck. What a week for this guy. Thats the understatement of the century that trump has benefitted from good luck. And youre right, i think its turning. On a political level, when you zoom out from this a little bit. This is so dangerous for donald trump. Hes now got Michael Cohen, whos pleaded guilty to these crimes and said the president directly would do that. This is a very different scandal today because than it was just a few days ago, because what was abstract and static is now very much real. And very much closing in on him. And the problem politically is its going to hang out there for a while. Were going to see more developments out of Michael Cohens cooperation with prosecutors, we may see more out of weiselberg and david pecker, were going to see more in the next manafort trial, it will be more and more and more. And his problems are going to mount not fade, and of course as you know in politics, when theres a problem out there, its very toxic politically, especially if it bears fruit. Kim, your thoughts about how much he will be used . Now the fact that hes cooperating with the Southern District of new york, the Southern District, the fact that he is given immunity there, how does this work for mueller . We dont know the scope of the immunity, even though if its relating to cohen, we know cohen has said in open court and fingered or pointed his finger at the president as the one that actually directed that he make a violation of the federal Election Campaign statute. This is someone, as we have said, goes back for many, many years, he knows about what goes on the tax reasons, hes been involved in all the Financial Transactions from day one, he knows all about what donald trump knew and when he knew it. And so all of this attack and this notion of a witch hunt is not going to apply. It was Jeff Sessions who was actually in charge of the Southern District of new york. And if he lets session goes, not only do you have a political response, but Jeff Sessions presumably has some contact with the hes really getting cornered. We were a little bit close to check mate mode with this president. And the question really becomes how do we as a country get through this and heal from this . And hopefully, i think the rule of law will hold out, but then the fallout comes and the question is, whats going to happen to his base, i think, because were on that path. Allen, every progressive i know practically wants to know why doesnt the government have trumps tax returns. Now they got something even better, they got the guy that put them together. He knows every deal with russia, if there was any money laundering, if anything went on with russia, anything with collusion and money and why he would do it. This guy, weiselberg knows it. He knows it all. Whats really interesting is that prosecutors wrote in the Michael Cohen plea agreement that reimbursements wither counted as legal fees that is not tax deductible. If they did deduct it from their taxes, that could be a violation of the law, and if theyre breaking tax laws thats sort of the avenue in to breaking open the books there. We know that manhattan opened up an investigation into the Trump Organization. Is he scared now . Trump, is he finally scared . Theres been a sense around him for a while that cohen presented more of a potential problem than even mueller. Because they opened up, they got all the records when they raided that place. And it dates back more than a decade, not just some interactions during the campaign. And its born out, hes waving his arms in the air and saying, please, i want to do this. Well see if mueller considers him a trust worthy witness and can cohen prove anything . Well see that down the road. But weiselberg, if he knows something as well, this is double trouble for this president. Jonathan, allen smith, great reporting for us. Women wailly, your analysis, great stuff. And coming up, President Trumps war with the justice department. He praises and pardons his friends, of course, while instructing Jeff Sessions, remember him . Hes attorney general, to go after his political enemies. Hes telling him to go after the democrats. Just like he told the russians to go after hillarys emails. This is kind of a chief executive officer of the United States, thats the president sort of. And best selling author craig under joins us to tell us about donald trump and the russian maf mafia. But when everybody sees whats going on in the justice department, i always put justice now with quotes, its a very, very sad day. Jeff sessions recused himself, which he shouldnt have done. Or he should have told me. Even my enemies say jeff sess n sessions should have told you that he was going to recuse myself or you wouldnt have put him in. I gave him the job and then he said im going to recuse myself. What sort of a man is this . President trump escalating hiss attack on Jeff Sessions. Sessions firing back at trump saying while i am attorney general, the actions of the department of justice will not be improperly political. In a tweet, President Trump mocks sessions statement about refusing to politicize the department. This is great, jeff, whatever the president wants. So look at all the corruption on the other side. So trump listed the political opponents he wanted the department to investigate. Compare that with trumps tweet yesterday, when he said i feel sorry for Paul Manafort and his wonderful family, justice took a 12yearold tax case among other things and applied a tax fraud case to him. According to axios, that type of disconnect affidavits trumps family legal system. Noting, trump wants a top Law Enforcement official, his attorney general to be far more sympathetic to his views on laws and loyalty. A source close to trump said, the expectation of unwavering loyalty is an operating principle for trump. Charlie, this is pretty overt, isnt it . The president basically, like he told the russians to go after hillarys emails, now hes telling his attorney general to act like the old time attorney generals and start going after his political enemies, doing it just that way . Its hard to overcome the contempt the rule of law or the department of justice. But i keep thinking that if donald trump is saying out loud, what Richard Nixon might have said in private. Were seeing this attitude of using the department of justice, using the legal system as a kugel to attack your enemies, and hes saying it in public, not caught on tape, hes saying it on cable television. It really is extraordinary. And Jeff Sessions is the trumpiest member of the trump cabinet. He lacks the one thing that really matters to donald trump, this glandular unthinking personal loyalty to the president. It seems to me thats right, his anger against Jeff Sessions is not that hes not tough on illegal immigration, theyre both tough on illegal immigration, his problem, according to trump, is he didnt protect trump from prosecution. Thats his problem. Thats right. And what you see with Jeff Sessions is somebody whos very loyalty following trumps agenda. He doesnt care that sessions is banning muslims and stopping people at the border, and reviewing peoples citizenship status, all these things that are really outside of the american norms, all he cares about is that this attorney general is settling scores about who trump cares about. He wants it to be very personal to him. Thats not what we have seen historically. We have seen attorneys general take on political agenda, but not a personal agenda. He knocks the head and kills the guy off one of his guys. Why doesnt the president just why doesnt he just get rid of Jeff Sessions, fire him, tomorrow morning, tonight at midnight, just fire him, why not do it . I think hes been warned by all of these Close Associates that if he fires Jeff Sessions hes really going to have an uphill battle. Worse than he is . Yeah, because one of the things he cant afford to have is to have the House Republicans turn on him and vote to remove him from office, because all of that immunity that hes getting as the sitting president wont apply anymore. Hell be able to be prosecuted because he wont be in office. Yesterday, south carolinas senator Lindsay Graham said he expects sessions to be fired after the midterms, after november. Politico reports that tennessee senator bob corker echoed that sentiment saying its apparent that after the midterms he will choose somebody to do what he wants to do. Heres nebraska senator ben sasse. The attorney generals job is not to be a political hack. The attorney generals job is to defend the constitution and follow the rule of law, and thats what Jeff Sessions is doing. The notion that Jeff Sessions will be fired because hes not a political hack is a very, very bad idea. Its a bad idea for the constitution, its a bad idea for the department of justice and frankly its a bad idea for the president of the United States. Is corker and Lindsay Graham the majority or is ben sasse the majority, are they on the trump side or are they on the side of Jeff Sessions . I think theyre standing there with their finger in the wind trying to see which way all this blows. Republicans are divided on this, but ultimately it will come down to them, it will come down to whether or not they will draw a bright line. What i thought was stunning about the president s comments was the timing, you have a president thats acting like a mob boss, expressing his contempt for the rule of law, it seems that his do not exercise the nuclear option. Do not try to decimate the leadership of the department of justice. He not only didnt do that, he appeared to give a green light to something that would set off a firestorm and a political crisis. I really get a sense that folks have not completely internalized all of the events of this week and what they mean. The threat to the president , how things have changed this week. I dont think that voters have fully you know, have taken it on board and i think that members of congress are still waiting to see what the fallout is going to be, because, look, this was trumps worse week, but its going to get worse. Thank you, i agree. Up next, trump has repeatedly denied any connections with russia. A lot of people thought i owned Office Buildings in moscow. I dont have property in russia. I had the Miss Universe pagtd th pageant that i owned, i had it in moscow quite a long time ago, but other than that, i have nothing to do with russia. Of course while the president has repeatedly denied he has any ties to russia, a new book puts that claim in question . House of trump house of putin, craig ung erks rrker writes, ito imagine donald trump had no knowledge whatsoever about what was going on. Craig unger joins us right now, i thank you not just for being here, but for writing a book that answers any question that i have had for months now. What is this thing he wants to have Miss Universe, he wants to have otel over there. He wants to have meetings with russia, his kids show up. I think i have dealt with two russians in my life. What is this guys link to russia. You know Michael Cohen who happened to be Donald Trumps lawyer, and he was also a lawyer for the italian mafia, and in the 80s they began making a lot of money, and they needed to launder it. And there was a man with ties to the russian mob, he went into trump tower, he met donald trump and handed him 6 milli 6 millio ca cash. So the russians have a lot of money, they make ill gotten gains, since the fall of the soviet empire, they have made a lot of money off oil and everything else. Why do they have to launder it . Whats their motive . Theres a trillion dollars in flight capital from russia wince Vladimir Putin has been president. Thats a lot of money to launder. The russian mob and the oligarchs seized the property of russia. So theyre looting that country . Theyre looting that country and they need to launder it somewhere. And the best way to launder money is real estate. There are almost no regulations in real estate, in terms of you can buy it anonymously, through Shell Companies, pay all transactions, bam when you sell it, its laundered. Trump has a record in your book, can you document that he bought real estate with cash . This is, you know, i cant penetrate all the Shell Companies and this is one of the interesting thing today with Allan Weiselberg flipping. Obviously i dont have subpoena power, but i think youre going to find that those records are going to be opened by the prosecutors now. So if youre Vladimir Putin, if he read this book and he know what is you know. I think he would know more than you know because he knows everything. Whats he got on trump . Hes got a lot up trump, when he went to new york city, he was 4 million in debt, and koutcout get a loan anywhere. And then a Company Called bay rock, that has russian ties and they started doing business with him and they brought him back to life. A guy thats 4 billion in debt is not going to be elected president. Why did he say to lester holt that he didnt have any dealings with russia . Its just a lie. Why does he say things that are provably not true. Where is this all going to lead, a lifetime of dealings with russian mafia, bailing himself out, how is that going to turn out to be a bad decision on his part . I think hell be forced out of office, or hell be forced to do extra constitutional measures that are pretty horrifying. Youre a serious writer and its a serious book, im glad we finally got it on record here. The book is called house of trump house of putin. Go to the bookstore this weekend and get it. And i think that for us to pass it off as republicans as no big deal, thats just not right. This is a big deal. And we ought to treat it seriously. And it cant be dismissed. So well move ahead. Welcome back to hardball. That was Arizona Republican senator jeff flake yesterday summing up the state of the Republican Party. But as is times pointed out today, for those wondering if the latest disclose yours from the trump legal file are finally weighty enough to cause top constitutional republicans to break with the president , the answer is no. Eight years ago to 10 years ago, trump was not what i consider to be a pillar of virtue. I think he has changed a lot of his life once he was elected. I think trump is a much better person now than he was then. Lets bring in tonights hardball round table. Thank you all. Assessment of the Republican Party. We have been looking at them. Are they breaking with them or holding with them . The leadership has given their folks out in the field who have tough races permission to break with him, albeit delicately. So what were going to see from now through the end of october, is a lot of running away. Is trump a great president . No, he is not a good president , whatsoever. Did you vote for him . Of course not. Okay, i have a big remember here. Were trying to balance this thing out and im looking for somebody. Im one of the few in the Republican Party who say lets go along with this guy. The base is absolutely in love with him. And the house is scared of the base. Theyre taking the calculation of if we stand up and Say Something against President Trump, were going to have a hashed time in t hard time in the midterms. If we just keep our heads down, well wait it out. He fell in love with somebody when he was married, but trumps behavior, is that falling in love with somebody. Theres no love with this guy. If they dump sanford like a bad habit, and then your president gets away with everything. Its absurd, devin nunes is running up to the white house saying what can i do to help you . Its fear of the unknown. Because hes so unpredictable. Nobody wants to be lashed out at. Are they afraid of a nick dm name . Theyre absolutely afraid of getting a nickname. Theyre afraid of losing the house now, absolutely theres fear. And i think theyre getting hip to that, so they can worry about their base all they want, but in some of these districts. Youre missing one thing, President Trump doesnt have the selfdiscipline to muzzle himself when republicans go after him. In the congressing district david rice said he stood up to trump. Thankfully he hasnt said anything yet. If you see anything in these districts, oh, that trudonald trump, im going to put a muzzle on him. Meanwhile account for republican congressman Duncan Hunter who was inditded this week along with his wife for misuse of over a quarter Million Dollars of Campaign Money is blaming his wife has if he had nothing to do with it. Lets listen to this gentleman. When i went to iraq the first time, i gave her power of attorney and that continued when i came home and ran for congress. She was also the campaign manager, so whatever she did, that will be looked at too im sure, but i didnt do it. Theres me too and then theres not me. What is going on here, hes blaming her . What a class act, theres no wonder that this guy was one of the first to hug donald trump. Clearly hes disloyal, hes disgraceful, and hes throwing his wife under the bus. Shes going to prison, according to his testimony, shes the one working the checkbook. Evan, youre laughing. This is outrageous. From a p. R. Perspective, its a nightmare, from a legal perspective, i assume the couple has separate attorneys, it not me, its her, hes trying to stay out of jail. Hes still favored to by quite a large margin. So he gets elected, and step two, they deal with the legal thing . The thing is theres no real mechanism in california right now to get him off the ball lot so even if he going to jail, he could be reelected. We have a lot of congressional districts which are rotten buou boroughs. What message does it send to women when we already have a problem with women, and theyre organizing marches all across the country. 56 of white women are still voting republican. I think it gives new meaning to the word prenup. Dont plame me. As mr. Trump faces his own mushrooming legal troubles, hes taken to using a vocabulary that sounds uncannily like that of john gotti. I have had many friends involved in this stuff, its called flipping and it almost ought to be illegal. You take your hits like a man and you learn the two greatest things in life. What . Never rat on your friends and always keep your mouth shut. He says in a tweet, the New York Times did a piece today, sayi saying that one of the reasons i respect Paul Manafort so much, is he went through that trial, you know, they make up stories. Unlike cohen, he tweeted, manafort refused to break, make up stories in order to get a deal. For you, youre my older brother and i love you. But dont ever take sides with anyone against the family again. Well, the president seem i dont think its a story about headlines in the tabloids in the 70s, 80s and 90s, when he was reading about other peoples names, this mob stuff, not saying hes directly connected with it. Though there have been incidents that have been proven. But this is the Business World and the business lexi con that he came up with, hes not used to talking like a politician. I always read the philadelphia enquirer on saturday just so i could get the latest on the mob killings. You know, joey two times, timmy two times, all these nicknames. It sounds like trump talks in this guys and dolls language. Heres the thing, its not just how he sounds, hes not just talking the talk. Hires the thing, if it looks like a duck and it quacks like a duck, its probably a duck. You think its a mobster . Looking at his entire career, all of his real estate was built essentially by the mob, he has low ties with the kennedy family. Who are you saying what is your authority . Youre saying he has gotten money from the italian mob . The sicilian mob . It has long been documented that these are folks that have long been connected with the mob. It takes about 5 of a construction job to move something in new york. It takes a little bit of juice to move something. There was a random piece yesterday about donald trump and the mob. I was the guy you had to run to for concrete and drywall and i have stories to tell you about donald trump, the cushmans, and this was the 8 0s, the 70s whn donald trump was coming up. He has made it known that he will work with shady characters. You ever went to a restaurant before they had ice in the old days before they had refrigeration . The mob controlled the ice and this is concrete. We should look at the larger picture here, which is how you do business, the way you run an organization, the Trump Administration or the white house, and the way he talks about these things, suggests that this is very similar to the way some of these criminals were saying. Now i know youre thinking, i dont want to hear about insurance. Cause lets be honest, nobody likes dealing with insurance, right . Which is why esurance hired me, dennis quaid, as their spokesperson because apparently, im highly likable. I like dennis quaid. Awww. And they want me to let you know that, cue overdramatic music, theyre on a mission to make insurance painless. Excuse me, you dropped this. They know its confusing. This is the end of the commercial where i walk off into a very dramatic sunset to reveal the new esurance tagline so that youll remember it. Esurance. Its surprisingly painless. Were back with the hardball round table. Aisha, tell me something i dont know. Well, donald trump ive never heard anybody say well. Well, right now the Trump Administration and the white house is holding up a bipartisansupported bill to deal with election meddling. And so instead of saying, well, we know that russia was involved, we know that something nefarious was happening, lets figure out how to safeguard our actual election system before we go into the election, the midterms, what theyre saying is were going to wait until after the midterms to even think about it. Why would anybody oppose stopping meddling . Thats a good question, chris. Thats the question we all continue to ask, is why is this president not more aggressively engaged in but republicans always want to make sure nobody cheats. Thats their big thing. All cheating in the big cities. Yet they dont care about the russians. They just care about the big city ethnics. Things that make you go hmm. Evan. Well, Foreign Investors are not really investing in United States businesses right now. Weve seen a decline since trump took office. Theyre worried about trump tweeting about them. Additionally Foreign Investors are not buying u. S. Treasuries because they are very concerned about the budget deficit and the expanding national debt. Whats the interest rate, 1 . They really are concerned that Credit Rating agencies are going to downgrade us from aaa to aa. Wonderful. Heres something i think you know about but the vast majority of people in america might not know about but they really should not treat this as a niche issue. This weekend in chicago leaders of the Democratic National chit are meeting. Tomorrow morning theyre going to basically have to come to some sort of conclusion about the issue of superdelegates. Whos going to win . I think whats going to happen is theres going to be less of an influence of superdelegates in the next president ial dont they have to cut some kind of compromise . They will likely and thats where they are. Zlu know how i know that . How do you know that . My wife is chair of the Democratic Party in maryland. I knew you knew it. Thank you, aisha mills, Evan Siegfried and gabe de ben deti. When we return my thoughts on the great senator john mccain. Please stick around for in. Its real. Youre watching hardball. Better life. This is not a screensaver. Game. This is the destruction of a cancer cell by the bodys own immune system, thanks to medicine that didnt exist until now. And today can save your life. Let me finish tonight with something that senator john mccain said in the final weeks of his 2008 president ial campaign. It concerned a man he was up against, his fellow senator barack obama. I dont want it getting out of this room, but my opponent is an impressive fellow in many ways. Political opponents can have little trouble seeing the best in each other. But ive had a few glimpses of this man at his best and i admire his great skill, energy, determination. Its not for nothing that hes inspired so many folks in his own party and beyond. Senator obama talks about making history, and hes made quite a bit of it already. There was a time when the mere invitation of an africanamerican citizen to dine at the white house was taken as an outrage and an insult in many quarters. Today is a world away from the crude and prideful bigotry of that time, and good riddance. I cant wish my opponent luck, but i do wish him well. Well, put that in a time capsule, proof there was such a time when american political leaders spoke that way about their rivals. Better yet, put it in your brain and lock it there as we will continue to endure the lack of Mutual Respect in american politics. This country has been sustained over the generations by a characteristic flaw. Weve sometimes only a trickle of national greatness. Of this john mccain is now a part. And thats hardball for now. Thanks for being with us. All in with chris hayes starts right now.
