Strictly in the mold of donald trump. Joining me now for his First National tv interview since his concession is tallahassee mayor andrew gillum. Mayor gillum, good morning. Good morning, joy. I hope youre doing well this morning. I am. Thank you very much. The video you and your wife put out started circulated around. I started getting Text Messages about it from friends in florida. A lot of people, i have to say, were really, truly heart broken by the results of your race. You, indeed, had coat tails that helped a lot of democrats win in the state of florida. A lot of people cannot understand how, with a consistent polling lead, you still didnt win. One of the things that people are, of course, speculating on is whether it was race. Whether it was people lying to pollsters and saying they would vote for you when they ultimately didnt. What is your take on what happened . Yeah. Well, i mean, obviously, were still trying to assess what all of that meant. But one of the things that i think, and you know this, joy, because i was on your show early on when improbable was not the right way to describe my race. Most people thought impossible was the right term in the primary where we literally raised the least amount of money, moved around the state, and my car traveling to every corner of the state of florida, red, blue, purple areas coming out of that democratic primary, spending six million to my opponents 90 million, a lot of people didnt see that coming. And rj and i, again, tried to express yesterday how prod we were of not just the general election race, but from the very beginning to where we were able to get to. Now you know probably better than most, and i said this rather frequently on the trail. Forget about the polls. The only one that matters is the one on election day. And florida voters, the typical turnout in the Midterm Election is about six million voters. The high watermark in the president ial election is almost nine million. We had 8. 2 Million People show up and vote in the Midterm Election here in the state of florida and voted in the race for governor. I will tell you, we fought hard. I went to every single hard of this state. We left it all on the field, and that was my commitment to leave it all on the field. And what i think mr. Desantis certainly should know coming out of this election is that basically the difference between us and an 8. 2 million person is elect elect electorate is a rounding error. I hope that he takes that to mean that hes got to be willing and open to hearing from half of the state, half of the people in my state who had a different vision around where we wanted to go. I want to stay just for a moment with the results. You mentioned the polls, and youre right. Especially in florida, dont go by the polls. When you look at florida races, dont go by that because it is really like eight states, right . But there is exit polling that a lot of people may have been wondering if there was Voter Suppression or Something Weird going on. One of the weird results in the exit polls is the statistic that 86 of black voters cast ballots for you, but 90 for nelson. 90 of voters blacked president obama in 2008 and 2012. Its that nelson got an overvote over you even in the one majority black county in north florida. Its weird. I mean, there is certain counties where you would assume there would be a higher africanamerican vote. No aspersions on senator nelson, but he didnt vigorously campaign in the africanamerican community. He said that the amendment that would restore Voting Rights for people that committed felonies would be its own selfmotivator. A lot of people cannot understand why the exit polls are showing that. Has your campaign started to think about whether there is some Voter Suppression or Something Else that went on . Well, ill tell you, i dont have a whole bunch of faith in those exist polls, particularly as it related to black women. Yeah. When we saw that. I will tell you, the point is not lost on me that in certain parts of the state of florida, we saw where senator nelson overperformed my race. I think in total he may have gotten 40,000 more votes than we got. If this were an ideological vote, you got to believe that i probably have a lot more in common with senator nelson than maybe ron desantis has. And the truth is it doesnt take my saying it. There was some people who may not have found comfort in voting for me for any number of reasons. But i will tell you, ive got confidence that we really performed well within communities of color, within younger communities, even within White Communities around the state of florida. On the suppression piece, our suppression, you know, what happened here in the state of florida is different than what happened in georgia. In the state of florida, the suppression tactics are enshrined in law. The rules are all diverse and different than how elections are done. The fact that in my state you could have a signature rejected by someone who is not trained to interpret whether or not there are rule differences in signature and to have a persons vote completely invalidated because of that. The process for curing votes are very different between different counties here in the state of florida. And that really is what i hope will be some of my work in the coming in the coming, you know, weeks, months, years will be how it is that we transform the state of floridas election system into a 21st century system. Were the Third Largest state in america. 67 counties can act as 67 countries when it comes to voting. And this is no disparaging to the e Election Officials in those areas. But more to making sure that we have those departments resourced in a way that reflect that voting and democracy matters. The fact that we dont show that right now in the state of florida is a huge indictment to the legal and legislative process that we dont have better rules to ensure that every single vote cast legally is counted. And Broward County obviously became a huge part of the spotlight. Well, Palm Beach County with machines so old they overheated. These are such large counties and coincidentally democratic leading counties. What do you make of the debacle that happened in broward. One, it is a question of resourcing. Youre talking about miamidade, broward and palm beach. Those counties have got to make sure that those supervisor of elections offices are well resourced. And in early voting sites, we have to make sure we have more machines available so folks arent spending an hour or whatever in line waiting to cast their vote. That is another form of whether it is intentional suppression, it has a suppressive impact because, especially for working people, who go and vote who are working, trying to make ends meet and are spending, you know, an inordinate amount of time trying to cast their votes, it certainly can have the impact of turning those voters away. We need a statewide overhaul here that takes into account the fact that many of these counties, many of those counties in south florida where you have high democratic participation are not resourced in a way theyre able to have 21st technology to count the votes and to ensure that those who want to vote early have access to it and dont have to wait for extended periods of time to cast their ballots. Yeah. Im hopeful that the Florida Legislature would take up this issues this session because im tired of florida being the National Embarrassment when it comes to counting votes and casting votes. As somebody that lived there 14 years, same here. Thats right. Lets talk about the elephant in the room because the person who is now going to be the governor via a very, very slim margin in the state, the only thing most people knew about him before he ran for governor was that he was a very frequent Fox News Contributor and the way he opened his campaign, the monkey up comment and other associations that came up during the campaign that you brought up. I want to bring a moment that became emblemmatic of this race for a lot of people, and then i will have a question for you on the other side. First of all, he has neonazis helping him out in the state. He has spoken at racist conferences. When asked to return that money, he said no. Hes using that money to now fund negative ads. Now, im not calling mr. Desantis a racist. Im simply saying the racist believes hes a racist. We saw and noted that there were members of the Proud Boys Group that has done some violence that has been called the fasist side joining in protests about the vote count. I dont think they were out there supporting you or bill nelson. How does i mean, first of all, what is your assessment now of whether this incoming governor, ron desantis, how is he going to govern such a diverse state . How is he going to be the governor of all these different diverse backgrounds when that is what most people of wcolor know about him. If i had advice for mr. Desantis, it would be very quickly to bring in a divert set of people. I was disappointed to see him appoint matt gates to the transition committee. This is somebody who invited a known, you know i dont know if it is a known neonazi, but someone whose values are inconsistent with my state. Mr. Desantis, i hope, will take this as an opportunity to acknowledge that half the people in this state voted differently, and they wanted a different outcome and that if he really means to be the governor for all of the people of the state of florida and not just those that voted for him, that hes going to have to make some outreaches and lean into some of the issues that we talked about. The fact that i believe an ov majority of people in this state believe they should earn a wage with just one job to make ends meet. Teachers are paid the 45th lowest salary out of all 50 states, that ought to stir in him, that ought to stir in the administration hes building. It is my hope and if i can be helpful to make some of those to ver churs possible, so long as it is not a photo op and more of a sincere opportunity to have Diverse Voices at the table, then im willing to do that. But regardless, i will tell you, i know that there is an energy out there in our state that folks recognize that it is not a time to lay down. It is not a time to retract from this process. Yes, maybe we didnt win the election in this individual transaction, which obviously is an important one. But our work still continues. 1. 4 Million People now have their right to vote in the state of florida. The opportunity to have their right to vote. What are we going to do to help politicize that 1. 4 million where they could be transformational to the future of politics in the state of florida . The mission is much higher than just an election. We have real work to do and real change to create. And my message to the people who supported me and my vision is that they stay in the game, that they stay in the fight, that there is a lot of work to do and together we can get it done. And, you know, i should note that ron desantis, according to the New York Times, told the white house to tone it down, which maybe led to the abnormally friendly tweet to you by donald trump. He also gets to appoint a bunch of Supreme Court justices. That is notable. I have to ask you because a lot of people do want to know your plans, mayor gillum. Do you have ambitions potentially to run for Higher Office . Would you consider running for president . Oh, joy. I want to stay married. I owe my wife a big vacation. And i also owe my kids a couple of trips on saturdays to the soccer meets. Honestly, its been 21 months of just a labor of love and passion, trying to compete to be the next governor of the state of florida. Nobody wanted it more. But i have to say, i said that this thing wasnt about me. It was about the people in our state. I talked often on the trail about what it meant growing up in a household with my mother drove a school bus and my dad was a construction worker and watching them have to trade between which bills they could pay before something got cutoff. Thats still the lived experience for 44 of people in my state. My eyes will be right here on florida, on what it is that we try to do to expand medicaid, what we do for these 1. 4 million folks reentering society who want a chance to be heard in this process and then for whoever is running for president , i want to make sure we have an electoral system that is fair, that is balanced, where every legally cast vote is counted so that florida can really become a state where people have Election Integrity and believe that if they go out and do the work of casting their vote that it would be counted so that we get a fair shot of flipping this state blue in 2020. A lot of people are worried because the secretary of state is elected by the governor. This is basically donald trump in absentia. There is some buzz out there among people who are upset about this result who say that you may be taking your family out on a vacation, but they dont want a vacation in florida. A lot of people say no more florida, that they want to boycott the state. What do you make of that . I would want them to know that there is a resilient movement of people in this state who want to do things like see stand your ground go away. I campaigned and i talked about that when i was running across this state. There is a Resilient Group of people who want florida to stop being a back of the pack state and to lead again. I want you to know that were really a great state. Great people call this place home. What we got to continue to fight to do is to see that our politics and the elected form reflect the true richness and diversity of this state. I understand some of the concerns, and weve got to do the work here in the state of florida to lessen some of these issues and concerns with the state of florida. But were a good state. Joy, you know it. You called our state home for many years. My job is to see more good hearted People Choose florida so these elections dont have to be so close every time when we run statewide and also nationally. Please let mrs. It is not one thing. It is a lot of things. Donald trump got a firsthand look at the devastation brought by the deadly fires in california on saturday. The death toll has now risen to 79 with an astonishing 1,276 people still listed as missing. Trump pledged federal assista e assistance, despite last week threatening to withhold funds and blaming the deadly fires on forest management. Something i should add is the job of the federal government which owns 60 of the states millions acres of forest. Trump also doubled down on his solution to the problem that the solution to preventing forest fires is not on combatting Climate Change but doing more raking. You have to take care of the floors of the error eforest. The president of finland called it a forest nation, and they spent a lot of time on raking and cleaning and doing things, and they dont have any problem. What it is, it is a very small problem. Joining me now is the congressman. I want to start by asking you how those in your district are fairing this morning. Thank you for your question. My heart goes out to the victims affected by the wild fires and the first responders. I have had a chance to visit shelters. It was well stocked. Were now repopulating areas of malibu. And it really was a pretty devastating wild fire. My hope is that we would come together and work on a bipartisan approach to make sure we mitigate wild fires in the future. Of course, there were two different areas. Donald trump visited them both. If you think about Something Like 12,000 structures gone, an entire town, paradise, california, basically wiped off the map. Are there federal funds already being directed from congress to make sure that theres some way of trying to restore peoples lives or the ones who or their ability to live in their communities . So Congress Members and i spent a letter asking for a major declaration letter and donald trump did declare that, which got us additional federal funds. We sent a separate letter asking for additional appropriations for these wild fires. And, so, we hope when Congress Comes into view in january with House Democrats control, we can get additional control for these house fires. We just saw the video of donald trump standing with Governor Brown and the governorelect, the looks on their faces when he was talking about raking the forest floor being the solution and saying in other countries they dont have forest fires i dont think is actually true. Donald trump added to that by doubling down on his apparent disbelief in Climate Change. But i think most scientists believe this is what makes these fires worse than they should be. Here is donald trump asking whether or not, viewing this disaster zone, changes his view on Climate Change. Take a listen. Does seeing this devastation change your opinion at all on Climate Change, mr. President . No, no. I have a strong opinion. Were going to have forests that are very safe because we cant go through this every year. Were going to have safe forests. Do you understand what that means . He wants great climate and were going to have safe forests. What does that mean . It is unfortunately that we have a president that doesnt appear to believe in science. If preventing wild fire was as easy as raking leaves, we would have done that by now. But it is a very complicated issue. Climate change does play a large role. Decades ago, scientists predicted that because of Climate Change, we will have more extreme weather events. Thats what were seeing how. We have hotter weather, drier weather. We have santa ana winds that caused these fires to be more directive. I hope the president consults experts and stops believing these bizarre theories that you have. I want to change tactics for a moment because you have been speaking about not only whats happening with the fires but also whats happening in washington with the department of justice. Donald trump has a report that hes placed an acting attorney general in place, mr. Matt whitaker. And you tweeted the following about him. Dear acting ag, matt whitaker, you can stone wall, we will get the info you are hiding when the house changes your control. And we will call you before the house. Can you expound on what you were talking about there, sir . Sure. He still has not released his Financial Disclosure forms. That is unheard of. Hes breaking precedent. And if he wants to continue to stone wall, he can do so until january. And then democrats get subpoena power. We will subpoena his finances. We will call before the judiciary committee. We will subpoena him to appear and make him testify under oath on the American People. He can do this the easy way or the hard way. I hope he stops stonewalling and discloses to the American People who everybody else has disclosed. We know of course the company that he was associated with as being investigated by the fbi, a certain toilet that he was a part of the patent for. But the fact that he does have strong opinions about the Mueller Investigation, meaning he doesnt think it should go on or it should be squawked. Heres donald trump talking on fox this morning about matt whitaker. I did not know he took views on the Mueller Investigation as such. And when you found that out . I dont think it had any effect. If you look at those statements, they really can be viewed either way. Well, he says there is no collusion. Chris, ill tell you what, hes right. What do you do when a person is right . There is no collusion. I realize the house has not changed hands yet, so the democrats do not yet have the gavel. But do you believe donald trump when he says he didnt know Matt Whitakers views before he appointed him acting ag . I do not believe donald trump at all on this issue. Jeff sessions and donald trump were in lon step on policy. The only thing they disagreed on was a russia probe. For donald trump to remove jeff sessions, it was because of the russia investigation. And, to me, that looks like obstruction of justice because hes trying to interfere with the Mueller Probe. Marsha fudges potential run for House Speaker may be dividing some members of the caucus. Even though prominent members are throwing their support behind nancy pelosi. However, pelosi is unphased. I have overwhelming support in my caucus to be speaker of the house and certainly we have many, many people in our caucus who could serve in this capacity. I happen to think that at this point im the best person for that. Still, House Speaker is not the only position up for grabs. There are six other leadership positions, including Democratic Caucus chair. And congresswoman fudge is not wrong when she says that black women, as the Democratic Party most loyal voters are not seen the fruits of that boern out in actual power within the party leadership. Joining me now, california congresswoman barbara lee. As you are in california, i want to check in on your district and check in on whether the fires are impacting your constituents. Yes. First, joy, the fire is about 150 miles away, and our thoughts and prayers are with the community and with the families and victims. This is horrific. And my district is working every day to make sure that the resources that are there for the victims and families, but also as an appropriator. Im going to do everything i can do to make sure the federal resources are there to help this community recover. But it is impacting my district because people are advised to wear masks. The pollution and air quality is who i ha horrific. We must step back and look at whats takes place and talk about Climate Change. Its real. This is the new norm. Weve got to do something and weve got to do it fast. This planet cant survive whats taking place. Climate change is real, despite the fact that some people dont want to believe it. Lets talk about this leadership race. A lot of people just think about speaker or minority leader. But of course there are a lot of other jobs. People understand you have the speaker, of course. You have got the minority leader who current currently. You have got jim c. , who is the leader. You have got all these different people that are below the level of the speaker of the house. At the moment none of those top leadership positions is occupied by an africanamerican woman. I dont think there has been an africanamerican woman in the house. Am i wrong about that . You are absolutely correct. Africanamerican woman have been the most loyal and consistent voters. We really in many ways have propelled these wins throughout the country. And, so, its time. Let me just give you a bit of history. The First Congress was seated in 1789. Since then, and i was elected in 1998. Okay . Im the 20th africanamerican woman elected to Congress Since 1789 and when i was elected in 98. But having said that, there have been zero africanamerican women elected to a leadership position. The congresswoman whos legacy and life we honored 50 years ago, she was elected on november 5th. She actually ran in the mid70s. She ran against tom foley. She got probably about 100 votes, and they actually created an appointed position as secretary. But people are stunned when i tell them this. They cannot believe that africanamerican women in the house Democratic Caucus have been really locked out. All of these years have never had a seat at the table. The public wants change. They want new ideas. Black women helped broaden the perspective for the country in terms of an agenda that will speak to the aspirations of the American People. Marsha fudge is making that point as she contemplates whether she will run for the speakers position. But i think the point is obviously there is not just one job that people can run for. Can i ask, first of all, what do you make of this fight over speaker, very quickly . Im on record supporting saying that im going to vote for nancy pelosi. But what i want to say is that, you know, people in the Democratic Caucus have witnessed Speaker Pelosi to be leadership. But marsha funnedge, i witnesse her leadership and experience upfront. She helped us take back the majority. Shes strategy, smart, former mayor. So there is so many people who could mount this leadership role. But congresswoman marsha fudge has not decided as to whether or not shes going to run. Leader pelosi is the only person running for speaker. But im telling you, i have been so focussed on my race for Democratic Caucus chair that this is a member to member kind of race, and thats what my job has been because i want to win this race because i think black Women Deserve a seat at the table to bring new ideas and a new perspective. You are getting some support. The black Women Leadership rising, they have now issued a letter supporting your run. And it includes some pretty prominent people in new york. The founder of the metoo movement, aj williams and lots of people supporting you. Tell us about what this job would be and why you think its garnering so much support, particularly from africanamerican women. Sure. I have major support from the congressional black caucus, including our great hero and icon, congressman john lewis. This is an important position because what this job does is really organize our Democratic Caucus to make sure that our agenda is a consensus agenda as we move forward we can make sure that we reduce the cost of prescription drugs, that we ensure that there is affordable, Accessible Health care for everyone and we protect the Affordable Health care about, that we put forth an infrastructure plan to create good paying jobs in communities that have not necessarily seen new bridges and new roads, broad band. Also what we have to do is pass the Voting Rights act. We see what is taking place in our country in terms of voting suppression. Voting rights should be one of the first bills as we move forward. We need to convene everyone, to make sure that all ideas are heard, to make sure that the Democratic Caucus is inclusive, that people do not feel shut out, that all ideas and experiences are included, and we move forward unified on behalf of the American People because this is the job that helps organize our work for the people. Yeah, absolutely. We know you are running against a congressman who was talked up as a potential candidate for new york city mayor. There is lots of stuff going on. Yeah, joy. I announced in june that i was running right when we learned that this position was open. He decided to run against me about ten days ago, and this is a really interesting race because were able to talk to a lot of members and really pick up what their desires are in terms of the Democratic Caucus and their aspirations in terms of their leadership for everyone who has a path to serving their constituents in the country. I think her book really gives her an opportunity to tell such an honest and revealing story about her life, you know, beginning as a young girl growing up in a working class neighborhood on thewo south sid of chicago, parents who believed in excellence, sent her to the best schools in our country, and then the challenges and opportunities of falling in lovi and having children and their struggles and pressures and then triumphing as the most popular person in our country just about. And having a chance to interview her, it was like i said on stage, look, normally we have our shoesor off and were chattg on the couch privately. Now were having the conversation in front of thousandson of people and she w so authentic and down to earth that i think the crowd just really enjoyed her story. Look, i think she has a strong and resilient basic core and the reason why she wanted to open up and be so honest about the challenges is to show people that you can get through it, but also to say that those words hurt and they have an impact and we should all be mindful when were in these positions that were role p models and we shou be trying tod bring out the be in people and that what happened toe her was painful. But yet she persevered. Shes also very open, joy, in the book about some of the challenges that she had getting pregnant,ge miscarriages, havin to use ivf where she and her husband had to go to counseling. Ten days after the polls closed Stacey Abrams ended her campaign for georgia governor with a strong rebuke of the states electoral system saying the state and the secretary of state who doubled as its republican candidate for governor failed the states voters. In the end be she received about 55,000 fewer votes than brian kemp in a contest marred by clear signs of widespread Voter Suppression that disproportionately impacted africanamericans. Kemps office had 53,000 Voter Registration applicants still pending. 70 of whom were africanamerican. Many of those perspective voters may not have even known that their registrations were on hold. Abrams said that she will continue to fight to make sure all georgians get to vote. Stacey abrams joins me now. Good morning to you. Good morning. So first of all, a lot of people were the results on Election Night were very mixed. Really strong result, great blue wave but there was a lot of anxiety and depression among democrats about your race, Andrew Gillums race and so many, over 1 million voters, had been suppressed if you add up all the people who were denied the opportunity to even register. A lot of people felt like the result was not legitimate. Do you consider the result in georgia to be legitimate . I think that its legal. I think its wrong. I think that what happened is that we have watched systematic erosion of our democracy and over the course of time that was overseen directly by my opponent in the race who also happened to be responsible for the administration of fair elections, and he didnt do so. And thats why im pushing for fair fight georgia, because this wasnt simply a partisan issue. It most i think was most notable because of my race, but on december 4th theres going to be a runoff for actually, not a runoff, a redo of an election because of a flawed ballot in a republican district. Depending which county you lived in you might have gotten your absentee ballot counted. This is a systemic erosion of our elections and it started and became perfected by brian kemp. Youve been really in a battle with brian kemp since ive known you, since 2014. We met as fellow guests on this very hour when you were trying to register voters in and out of court with him. You put them on, he takes them off. This has been a longtime battle between the two of you. I think a lot of people around the country dont understand how it can be legal for the same person whos in charge of deciding who gets to vote to also be running. A lot of people dont understand how that can even be possible. Was it statutorily made possible by the legislature of georgia that brian kemp could do both of those things . Well, and thats why i think its important to use the right terminology. What he did was legal. That does not make it right. And it began long before he and i engaged in 14 with the erosion of section 5 of the Voting Rights act, with the systemic disinvestment in communities across the state of georgia. We have seen a wholesale collapse of the authenticity of our elections, and thats why this is so important, because i dont want this to be considered a battle between me and mr. Kemp. Thats not what this is about. This is an Inflection Point in a long standing approach to erosion of democracy. Using our democratic laws to try to actually erase freem our democracy, and thats wrong no matter whos doing it, no matter who takes advantage of it. Yes, the law said that he could be secretary of state, but morals and ethics say you dont oversee your own victory. The law says that you can remove voters for inactivity, but that inactivity should be grounded in Something Like them moving away or dieing but not simply the fact that they used their democratic right not to vote, not to make a choice. And so he used legal apparatus to disenfranchise, to disinvest and to grossly mismanage these elections and not simply my election but election after election for the last eight years. And, of course, georgia is a very particular state. The south is the south. Its where most africanamericans still live. 32 of the population of your state is africanamerican. Kemp squeaked in with a 55,000 vote margin out of, you know, nearly 4 million votes cast. You also have when you break down the results by ethnicity, he got 74 of the white vote, which is 60 of the population. You got 93 of the africanamerican vote, 62 of the hispanic latino vote. It annoys me that people cant figure out how to get data to count asianamericans but there we are. How does somebody like brian kemp, who ran the way he did, and who did the things that he did, govern a state as diverse as georgia . Hes going to have to try hard and i think thats part of the opportunity that we have and the aftermath of this election. Im actually proud of the fact that i increased the number of white voters in the democratic column by a factor of at least we increased it by at least 4 . The average has been 23 . Hillary clinton got 21 . So to get 26 is i think a strong showing, but whats more important is that we turned out new voters, new voices because his diminution of democracy didnt just hurt africanamericans, it hurt latinos, asianamericans, a lot of whom were first time voters, who were told their new citizenship wasnt valid. It hurt young voters if you arent home on this date even if you sent for an absentee ballot, were not going to count your vote. If you are in the Atlanta University center, you have to stand in line for hours to cast a provisional vote that may not count. What we saw is a change in georgia. By changing georgia we changed the south. We are now a purple state. That margin was so small as to be in terms of the 2020 contest, in terms of the next elections inconsequential. They are going to have to fight to stay in power and im going to make certain its a fair fight by making sure our electoral system works. Thats why were filing a lawsuit and thats why were going to work across the aisle and across Party Divisions to make sure no matter who wins the next election, it is a fair fight. I have Cheryl Eichel of the naacp Defense Council standing by. Youre filing a lawsuit. Please tell us the grounds of that lawsuit and what you hope to accomplish. Fair fight georgia is designed to say we have to have strong legal remedies to what has been a broken system. That means votes have to be counted no matter who theyre cast by if theyre eligible voters. That we have to have uniformity in our system of absentee ballots. That we have to fix our broken machines and that we have to have enough of them. Theres been systemic disinvestment and theres a pending case saying the machines themselves are flawed. We want to solve all of these problems and were going to start using the judicial system. Were going to use the system and were going to fight every vote. Stay there. Im going to bring you this. If, lets say, the lawsuit being filed by fair fight georgia that Stacey Abrams is leading, if what came out of that lawsuit were proof that there was systematic disenfranchisement of people of color, could that suit result in putting georgia back under preclearance . It was gutted by john roberts and the Supreme Court in 2013, but could they end up back under preclearance. First of all, let me salute Stacey Abrams and for her nonconcession concession speech which really lifted up all of the these issues and the need for us to keep doing this work. Heres the deal. If, in fact, this lawsuit, and i havent seen the contours of it. It was a lawsuit brought under the Voting Rights act and its determined and found that georgia engaged in intentional discrimination in the various schemes that we saw in the year leading up to this election, it is possible for the parties to ask for georgia to be bailed in, and the bail in provision remains untouched by the Supreme Courts decision in the Shelby County versus holder case, and that part of the Voting Rights act allows parties to ask that a state or a county or a jurisdiction be placed under preclearance for a violation of the Voting Rights act and under that bail in procedure the judge then has continuing jurisdiction so that if the jurisdiction seeks to make any voting changes, they would essentially have to do what they would have had to do under preclearance. Its not been done often. I was involved in a case in arkansas in which bail in was effective. It was recently done for the city of pasadena in texas. It is a possibility, but there are many possibilities of litigation coming out of georgia and not only georgia, other states as well. Yes. We should remember after 2000 we passed the help america vote act. Hava. It was supposed to deal with all of the issues of the Voting Machines that provide federal dollars that provides certification of election machines. We saw them failing in south carolina, texas, georgia. What happened . What is the Election Assistance Commission doing about that . So i think this is a time to really scrub this election across multiple states and figure out what were the violations of law, local, state, federal and figure out how we lean in and deal with an election system that across many states is broken. Stacey, in your state there were machines that didnt have any they didnt have the plug in, they couldnt even be plugged in. Exactly. In your view should georgia go back under preclearance under the Voting Rights act . I believe that is one of the remedies we should seek, and i think sharylin is absolutely right. The challenge that we have in georgia is this is not about just one election. We have a republican who lost his primary because they gave out the wrong ballot. He had to pull out a plat map and individually proof that there were more than 1,000 voters left out of his district. That shouldnt have to happen. So this is about the larger conversation about the administration of justice through our election system. And we are going to seek every legal remedy possible because our courts are there for a reason. I am proud to be both an attorney and a former legislator and i understand that all of the mechanisms of our democracy, the executive, the judicial and the legislative branch have to be involved in fighting for our democracy and thats what i want to be a part of. Are you going to continue registering voters . The thing that triggered the backlash and the suppression was the number of voters, the volume of voters that your organization helped to register. We know that there are still maybe half a million of unregistered voters in georgia. Are you going to continue that process . Im a Small Business owner and a civic leader. I started the new georgia project. Its now standing on its own and its going to continue to do work. My next organizational challenge, my next Small Business adventure is going to be fair fight georgia because we have to be in the business of defending our democracy. Thats going to be my focus now because we want to continue to do the registration piece. It worked. It didnt work as well as it needed to because while we were adding, he was subtracting, but we are going to continue to add and there are a dozen organizations across georgia that are going to keep doing that work. The next piece is making sure that once their work is done, it is recognized and protected and thats why fair fight georgia is so critical. I invite people to go to fair fight georgia. When you look at what happened in georgia, its hard to believe there is any Voting Rights act . Oh, there is. We continue to litigate under that. We won a case challenging judicial elections in louisiana. Youll remember the North Carolina omnibus Voter Suppression law that was won in the fourth circuit. Were still actively using that. Its the preclearance provision, the provision that allowed us to get out ahead of some of the practices. You said youve been seeing Stacey Abrams and brian kemp for a year. Why . Because thats a year after the shelby kemp. We saw the Supreme Court decide the husted case out of ohio. The ability to purge people for nonvoting. Theres a back and forth thats happening. Its not just happening in the United States in georgia, you have to take it up to the Supreme Court. They need to provide the means for people like what mr. Kemp did. Stacey abrams, the secretary of state will be decided on the 4th. Thats a huge race. Who will have the powers that brian kemp exercised. We know the super bowl is coming. We know there is a huge tv and Film Industry in your state. There are people who were talking about boycotting the state of georgia over what happened in this election. Do you support the idea of either a boycott or of industry pulling out of georgia as a result of what they believe was brian kemps messing with the election . I believe boycotts are essential. Ive supported them in the past. Right now there is no immediate action that can be taken other than the lawsuit were filing and the civic action so i would ask everyone of good conscience, do not do an economic boycott because right now theres nothing to boycott. The election is over, but what can happen is that we can use the same energy to engage and hold him accountable. To hold everyone in power accountable. There are going to be other conversations to be made slug the conversation about whether religious freedom has been passed. There are Economic Issues that will be important. The very fact that he ruled that they had to give jim acosta his pass back says that in some way this is a public space, this belongs to the people and that, therefore, news media cannot just be arbitrarily held out. But i still think we have reason to worry about what these rules of decorum are going to be because it looks like hes inviting the white house to create rules and if you can never ask a dwhae a president doesnt like, youll be back to square one. Its one reason why fox news joined this suit. They know some day theres going to be a democratic president and theyre going to want to ask him or her some very hard questions. Absolutely. This is what donald trump is all about. The problem is that on november 6th people voted to stop this type of hateful rhetoric, this type of hateful thing that donald trump does. Yeah. And to come back just to the table for a second, the daily call did an interview with him. It was done in the style donald trump prefers. This is going to be something that happens with repeated need insight the white house. Who do you feel are disrespecting the white house, sir . This kind of vibe is what donald trump is going for. President s of the United States dont get that. He has the built in advantage of having this incredibly expensive right wing media infrastructure. Just last summer a former fox news anchor bill oreilly said he wished he had fought back harder against the Sexual Harassment allegations that ultimately led to his firing. Then in october of 2017 he seemed to do just that when he threatened to sue a former new jersey lawmaker for 5 million for writing a Facebook Post about his former girlfriends allegations against oreilly. One year later oreillys lawyers have announced that their famous client is dropping his claims. Joining me now to discuss is attorney lisa bloom, civil rights attorney for the bloom firm who represents oreillys would be lawsuit target. Good morning. I represented Michael Panter, the one that oreilly sued. Lets talk about that for a second. What was Michael Panter being sued for . He was being sued for defamation, joy. A year ago when the me too movement started up thought to himself as a man what can i do to support the women in the me too movement. I can talk about bill oreilly who was denying he had sexually harassed anyone, even though reportedly hes paid more money to settle Sexual Harassment cases than anyone ive known of. He did a little Facebook Post to his 400 followers and said i support the women and he said i have witnessed Sexual Harassment against bill oreilly against my girlfriend. It was over the phone. I was on the phone. He was shocked to learn that bill oreilly sued him. Bill oreillys very litigious. Hes reportedly worth up to 100 million. He dragged his exwife through the courts for many, many years. Then sued his exwifes attorney. Michael was scared. I thought, hers heres a man who stood up in the me too movement. We announced that we were going to represent him. We were going to fight his case. We immediately removed the case to federal court where we thought we would get a more fair hearing. Guess what, bill oreilly went strangely silent and just last week we told the court we were going to move to dismiss the case. We waited for the statute of limitations to run. Its one year. Bill oreilly miraculously quote, unquote, dismissed the casement its a complete and total win for our side. Of course, the exgirlfriend of mr. Panter had an nda. Some of the disclosures that came about were apparently a person from hr at fox after consulting maybe with bill schein who we know worked at the white house tried to get dirt about other accusers. Can you explain that . Michael panter says on those phone calls between oreilly and the exgirlfriend he overheard oreilly asking for dirt about another accuser. Oreilly has so many accusers its hard to keep them straight. That was part of what he alleged. He chose not to only file this case a year ago but to publicize it. He talked about it on his show, on his social media where he has many millions of followers and he went on glen becks show and announced he was going to vigorously prosecute this case and fight and sue anybody else who chose to speak out against him. In my opinion, hes a bully. The best thing to do with a bully is to stand up to him. We forced him to back down. Michael panther released another statement. He used this as his own Public Relations tool hoping these challenges would scare me away. They didnt. He has withdrawn his case after seeing our case and knowing he was one week away from answering thefl. Bill oreilly has been aggressive. He thinks he should be more aggressive. I think for a lot of women who look at the me too movement as checking some of his behavior, he seems quite unchastened despite the settlements. Youre absolutely right. We hear a lot of bad news all the time and we get demoralized. We are achieving so many victories for women and men during this exciting me too time that if people will stand up, if they will fight back, if they will say no to a bully, if they will at least talk to a lawyer about their Sexual Harassment or Sexual Assault claim, most of the time we are winning these cases. Its a very, very exciting time for victims. Bill oreilly isnt the only bully that were getting to back down. Everybody, i really strongly encourage you to reach out to somebody and stand up for your rights. We live in a time, lisa, when the secretary of education is changing the rules on campuses to essentially protect people who are accused of Sexual Harassment saying under her rules the schools will be responsible only for investigating incidents that are part of campus programs and activities that were properly reported. It makes it its making it more difficult. Give us some advice right now to people who are victims of Sexual Harassment. What should they actually do . First thing is to immediately reach out to an attorney because the laws are very complicated. We do a lot of cases in education as well as employment, fortune 500 companies. Often i will advise people to immediately complain in writing, keep a copy. Send it to your personal email. If its an employment case your work email may get cut off. It is important to complain in writing so later on somebody doesnt deny you did that. Keep copies of any important documents. Talk to witnesses. Reach out and get legal advice because when you stand up for your rights you can win. Mr. Panter was having to have a go fund me to fight this case against a multimillionaire.
