podcast. welcome joyce, good to hav your insights here how valuable of a witness to think stormy daniels is at thi point and will michael cohen b more critical to the da's case >> so, we are all working little blind alex in the sense that vaughn hillyard jus reminded us that we have not seen the charges yet we don't know precisely what evidence will need to back the up if those people expect the charges to center on the payments that were made to stormy daniels in a last-ditch effort to keep her from sharin the story of her affair with the former president on the ev of the 2016 election, then i is possible that the prosecution will need her to take the witness stand they might also be able to mak the case for documents without subjecting her to that experience one thing prosecutors will d is that they will make a ver cut and dry decision about which witnesses are essentia to provide direct testimony on topics that are critical t obtaining a guilty verdict that means is very likely that will see michael cohen as corroborated witness on th witness stand. >> there has been thes concerns that the case could b hard to prove, but michael cohen's lawyer says there is actually a pretty cure paper trail, take a listen >> it is tremendousl documented they don't have a clue he knows nothing about the evidence that is being compiled by pounding away and michael cohen, even though know the charges but would the defense team b in the dark about the evidence >> i think that they would b in large part because there is no realistic project that he would agree to plead guilty. there's no motivation fo negotiations here. look at alex, it is very important for our viewers to understand, we are not hearing anything from prosecutors abou their case this indictment is still sealed, they are prohibited by the court from discussing anything other than the fact that a indictment exists. what we during right now is back and forth between trump and witnesses, trump and other politicians. none of this is authoritative, none of this really gives offs any kind of insight into wha those charges are and what evidence will be necessary something that i think that we can take away, at least in regards to michael cohen i that because he has prio convictions and thos convictions include fals statements that he mad previously, prosecutors will need to corroborate all of thi testimony. it makes sense to me that ther would be a strong paper trai so that jurors could listen to his testimony and then hav some objective evidence that helps them appreciate that h is telling the truth in this trial, whether he told or no in the past. >> you know joyce, you wrote that while others may have suggested that the charges are in significant, you don't thin there are, why >> you know, there is a certai irony here that we are looking at possibly for potentia criminal cases against a forme president. the conversation that we are having is, will these charges, they are not very important. this is four separate potentia instances of criminality by sitting president of the unite states i think that is something that is getting lost a little bit i the conversation as to the manhattan charges, this comes out of an effort by donald trump, perhaps hi earliest want to manipulate an investigation. it is 2016, the election i almost upon us the access hollywood tape ha been >> hey, alex as you can imagine, all of you have been able to see online how people are reacting, but w were certainly curious to se how people on the ground are reacting we had a chance to do that ove the last few days, including today, and i think the results what you are about to hear i just a moment, will not be surprising ultimately, what we are seeing is it's really not changin opinions, but the opinions d have our strong ones >> yes, i heard about it i think everybody deserves a second chance. >> no one is above the law let the chips fall where the should >> at this point, pointing towards action - and the former president really shows that okay, we wan to keep people accountable >> i voted him, he's a goo president, and i don't think it's right >> do you think you are goin to vote for him next election? >> yes, definitely >> so, i think that last bit there is a very telling opinio that we are hearing among an of his supporters here which is, if anything, they ar questioning the intentions behind the charges it's not changing thei opinions on the former president, certainly, ahead of 2024 many of them saying that the are still going to vote for him, and they have questions on why the charges were even place to begin with but in terms of where things stand in a broader context here, i want you to take you to this quick poll do this week abou whether or not charges in this indictment would change thei opinion on whether he should b able to run for president. you can see, roughly 60% sai it should disqualify him, an roughly 40% said it shouldn't. and when we look at who wa saying what's, alex, some thin that we are not surprised by the overwhelming majority, democrats say, you should be disqualified for its and those gop voters, bu majority of those who ar saying that it should not make a change or whether or not w could see him in the 2024 race alex >> that's extraordinary. three out of four republican say, it makes no difference. okay thank you, marissa, for that we heard from voters let's now turn to members of congress are reacting, or, i some notable cases, no reacting to all of this. nbc's julie tsirkin is joining us from capitol hill another welcome to him, we'v heard a lot of republicans i all of this, but not all o them what can you report for us >> the silence is deafening, isn't it, alex we haven't heard from thos prominent republican here in the senate, that is mitc mcconnell, the minority leader of course, he's been recoverin the last few weeks after suffering a fall he hasn't said anything abou the indictment of the former president. and he is, of, course in a ver public and private tense relationship with mr. trum over at least the last two years. i am told that we probably won't hear anything from him until we see what thos documents say, those charges until they come to light and the indictment itself is unsealed we also haven't heard from a handful of republicans, some o whom voted to convict th former president during th second impeachment trial, afte january six. that includes folks like senator romney and senator cassidy. we haven't heard from that they told us, even two weeks ago when the former presiden posted on truth social, he's i his arrest, that i will no comment until this process plays out. we also have heard, though, of course on the flip side, for many republicans who are allie of the former president, eve if they aren't united in supporting the former president, including his next reelectio bid, they are united behind th fact that this is political. they think it is politically motivated. i think that the, alvin bragg' case here, and charge here o the hush money payments is overblown. you are seeing that in the tweets on your screen. speaker mccarthy, the most powerful republican in d.c., h charged three house committees with actually investigating an looking into the matter. they traded some letters wit the manhattan da last week trying to investigate th investigators. so, just a lot going on here i the capital, as democrats on the flip side, say, let this investigation play out nobody is above the law. , so a lot to watch here for u as the main show is in new york it will eventually make its wa up here on capitol hill, whe more of these lawmakers ge back into town after their recess we will continue to press them for answers to these questions of whether this disqualifies the former president or not in this 24 race >> got to tell you it's, kee an eye on your toes, m friends. for which we thank you for all your reporting, julie tsirkin. i want to bring my panel int the conversation danielle moodie, host of wok af and the new abnormal podcast, and susan -- republican strategist was also an msnbc political analyst ladies, welcome to you both. danielle, i want to start with you here on this one we hear a lot of republicans say this is great news for trump politically, especiall in the primary fight did we really expect a competitive race wit candidates like nikki haley or wrong desantis, as they bu heads with trump he is far ahead of them, a both of you know so, let's aside the primary fo just a moment. it's getting charged as -- he's got a criminal indictment against him. is that a positive thing for the former president considering if he wins the primary, he still has a genera election to worry about? >> now i can't imagine that being a criminally indicted is a positive thing for anyone. let alone for donald trump it's obvious from that cal that you just showed tha republicans just don't care. this is who they are with. for everyone else, we believ that, you know, a criminal indictment is something that matters. and he would think that th party of quote unquote law and order would actually want to see this and see trump vindicated and go through th process, and they don't even want to do that. , so contrary to what they believe, donald trump will nee some democrats in order to win in that general election so, i don't see how this works in his favor at all. >> but circle back to get into how this plays in that primary with you, susan. here's how the washington post -- here's a quote the debate about whether thi helps or hurts trump's fight for the gop is beside the point, when it comes to any would b republican standard bearer, th mantra is clear. we are all trumpian's now. really all republicans are all trumpy and now, susan >> well, i'm not so, there's one. in all seriousness, no, that's not the case as a matter of fact, when yo look at that opinion poll, i looks like it's about 25%. i would bet that number woul be higher if the indictment wa a different charge meaning, not from the hush money payments >> you know, it's time - there's time for other indictments to come through. >> we -- >> are more serious points >> yes that is what i was going t say. this is how it stands as o now. let's not forget that -- opinion poll was in fact taken before the indictment, because the indictment doesn't happe until tuesday. we'll find out, everyone wil do a review of how they feel and we'll see if that number changes. i'm happy you have that up because that independent number, 55% to 36%, that tells me ther is no way in heck that donal trump can win election in november. this indictment does not hur him so much in the primary a of today, with this indictment however, going forward, it's like, you pick donald trump an you say, republicans are sayin i am falling on the sword fo donald trump i don't care if biden gets reelected. that's what they are saying, because trump winning th primary going forward loses to biden, hands down. >> you know, like othe republicans, danielle, rhond santas is jumping at the chanc to defend trump. he did so earlier again today. but all the while, the trump campaign is on the air with th ads attacking the florid governor this doesn't seem like a place to be if you are ron desantis, but does he have any other options?
