And we shake it up and off, with our Friday Night Panel, docking the biggest stories of the week, and some that you might have missed, as the 11th hour gets underway on this friday night. Good evening once again. I am Stephanie Ruhle. The january 6th Committee Just made its most aggressive move yet to twice impeached former president has now been officially subpoenaed by lawmakers investigating the attack on the capitol, and efforts to overturn the 2020 election. The committees letter left no doubt, they see donald trump as fully accountable. Heres how some of my colleagues reported on this historic subpoena, and its carefully worded allegations. This new material puts trump at the center of the plot to overturn the election. And later attached to the subpoena, chairman Bennie Thompson and vice chair liz cheney right this, quote, as demonstrated in our hearings, we have assembled overwhelming evidence, including from dozens of your former appointees and staff that you, personally, orchestrated and oversaw, a multi part effort to overturn the 2020 president ial election, and to obstruct the peaceful transition of power. One of the lines that struck me the most, as ive been reading through this, in just the last few minutes, where at one point they say, you were at the center of the first and only effort by any u. S. President to overturn an election, and obstruct the peaceful transfer of power, ultimately culminating in a bloody attack on our own capitol and on congress itself. Earlier tonight, Committee Member jamie raskin discussed the subpoena with some pointed challenges to the man at maralago. The idea that somebody would ascend the highest office in the land, president of United States, and then, refused to testify about the worst domestic violent insurrection and attack on the u. S. Capitol in our history is astounding. At the very least, somebody who is willing to send other people into battle to stop the steal on the patently false grounds that the election was stolen, certainly, should not be so much of a snowflake. Its not even to come forward to state his own rationale for why he did that, and why he continues to claim against all the evidence that the election was stolen from him. Trump has now been ordered to submit documents my november 4th, and appear for a deposition on november 14th. The 1 6 committee wants to see Trumps Communications with a long list of his allies, including former strategist, steve bannon. Bannon of course, defied the panel subpoena, and today he was sentenced to four months in prison for contempt of congress. But he will not be behind bars for a while longer. The judge hooked him up, saying bannon could remain free, while he appeals his conviction. There is also new reporting about Trump White House lawyer eric herschmann. You remember that guy. He gave some very colorful testimony over the summer during the january 6th hearing. Axios has now obtained emails from herschmann, expressing concerns that the former president might sign Court Documents and verifying voter fraud in georgia. What was he concerned . Because there wasnt any. Despite that, trump signed this sworn statement anyway. The Georgia Prosecutor has been looking into possible efforts to overturn the 2020 Election Results in that state. The South Carolina senator, lindsey graham, is still trying to avoid talking to that very grand jury. Just yesterday, a court rejected his latest appeal to toss out his subpoena. And today, graham asked the Supreme Court to block the effort to force him to testify. Also tonight, a disturbing new report on those documents seized from maralago. The Washington Post says, some of which was recovered by the fbi from trumps florida club, included highly sensitive intelligence about u. S. Adversaries, iran and china. The white house refused to comment on these specifics of the report, but a spokesperson did say this. We take the proper treatment of classified and confidential information very, very seriously here. There are protocols in place that are designed, specifically, not only to protect sensitive information, but to protect our ability to continue to collect and analyze that kind of information. And lets not forget, the Midterm Election is now just 18 days away. President biden has spent much of this week, stocking up his agenda, and his administration s policies. And in an exclusive interview airing this weekend on the sunday so with Jonathan Capehart biden offered his warning about what will happen if republicans take over congress. This is a choice, a choice between what kind of country they want, between, for example, do you let do you make sure that you are able to afford Prescription Drugs for people that are elderly . Do we have a certain stance where we are able to negotiate medicare, or negotiate drug prices . The republicans have made it clear, i think they want to do is a lot of them, most of them voted against the bill to reconstruct america through the infrastructure bill, highways, roads, you know . They all voted against the inflation reduction act, which provides Environmental Security and safety. They dont have a platform other than tear down what ive been able to do, weve been able to do. And i dont know what they are for. With that, lets get smarter with the help of our lead off panel tonight. Charlie savage, washington correspondent for the New York Times and author of power wars the relentless rise of president ial authority and secrecy. Professor Melissa Murray of nyu law school. She was a clerk for Sonia Sotomayor on the federal bench before her nomination to the Supreme Court. And former Florida Republican congressman carlos curbelo. He was a member of the republican conference for two years during the trump presidency. Melissa, we gotta start with this subpoena. We waited for it for days, and if you read this thing, its like a criminal indictment. What do you think are the most important points . , well it is definitely a shot across the bow, and it puts the former president right at the center of what the committee calls a multi part effort to overthrow the results of the election, of a validly conducted election. And the really spell out the ways in which Different Cases are joined together. Its not simply the riot of the capitol, but rather, the efforts to advance slates of false electors, the efforts to overturn and find votes in various swing states, all of this was connected. All of it failed, the many different challenges that made their way through the federal courts. And then, finally, culminating in the january 6th insurrection. All of this, they note, puts donald trump at the center. He is the person who orchestrated this, who oversaw it, and ultimately, he is the one that they need to talk to. Charlie, the committee is asking for Trumps Communications with some of his closest cronies, with tony ornato, his former Secret Service guys, and for records of his legal fees. They want to know who is paying them. What else are they looking for . Well, what do they really, really want is, of course, for trump himself show up and talk about that. But theyre looking for all kinds of records about all these things weve been talking about, the fake electors scheme in various states, the efforts to reach out to groups to get them to come on january 6th. But they know that the biggest spectacle would be to actually confront trump and question him, and grill him, and see what he has to say. Interestingly, it has been reported by publications and others that trump has told he could do it, but only on the condition that you can do it live. The committee could not end it out what he says, and it would be a spectacle. He could maybe take over and make it the trump show. This is not a subpoena for him to show up and testify live before a hearing. It is a subpoena for him to shop for a deposition that would be taped, and then, they could air excerpts. So, i think, as much as he might have been, perhaps, tempted in those lawyers would have told him he will be insane to do it, that he might want to do that spectacle. They have this gigantic event with himself at the center of attention. He is not going to be interested in testifying behind closed doors, and ceding control over what gets showed to the public, which is what the committee has in mind here. So, i predicted that what he will do is try to tie this up in court, and run up the clock for the next two and a half months, if polls are right, and republicans take over the house in january, they of course will drop this committee and drop the subpoena. So he only needs legal arguments, to last two and a half months, and there is so much undecided here, its such an unusual situation, the attempt to force a former president to testify, turn over documents. There is a lot of arguments, both procedurally and constitutionally, he can easily use to get himself across the finish line in january. And make all this go away. And there is no reason for him not to run the clock. Its what he does best, and it works for him, carlos. But clearly, this is major news. This is a former president of the United States getting subpoenaed. And much of what the January 6th Committee is trying to do is and for the American People. But do you think the American People are aware, while this is huge news event was breaking, which was fox news airing . Crime, crime, crime. Crime, inflation, immigration. Thats all they do, all day, every day, just going right to the fears of the American People. What does it say that millions of americans dont even know that this is happening . Yes, steph. This work that the committee is doing is gonna be very important for history, for the safety, the integrity of our democracy. And i think its also gonna be very influential in 2024. This work is going to have an influence on the republican primaries in 2024, and maybe on the president ial election, the general election in 2024. This year, this election is going to be about crime, immigration, inflation, and abortion as a lot of democrats are making this point on the campaign trail. I dont think that what the committee is doing today is gonna have a big influence on the result in a few weeks. But if republicans win in 17 days from now what happens to the fate of all of this work . Thats right. In january of next year, if republicans do take the house this will all be over and, done with. Of course, some of this will be left to the Justice Department, and theyll still be able to prosecute those who did not, who lied to congress, or who did not show up when subpoenaed by congress, but without a doubt, if republicans take over, this committee, you can say goodbye to it. Of course, a reminder, the doj has informed the public that they need more money to continue their work on january 6th, and if the republicans do when, i get a sinking feeling they wont get it. Charlie, youve been working overtime this week. So i have to put you back on the spot. Former obama official ben rhodes he was asked today about that report that really scary report, that intel about iran and china was recovered at maralago. Watch what he had to say. People already know that these documents were in an entirely secure location. People wandered in and out of that club. Weve seen Cell Phone Videos of people getting drunk at weddings at that club. You are telling me that the Chinese Government did not try to get people it maralago. Charlie, i have gotten drunk at weddings at maralago, and photographed my husband all up and down that place. Luckily, i didnt steal any intel, and it was many years ago. But given how unsecure it is, how concerned should we be . While, especially for the documents that were marked top secret, sensitive compartmented information, that is among the highest most carefully guarded secrets of the u. S. Government has. And so, from a National Security officials perspective, that is truly hair on the fire. You know, we have been trying to figure out what these documents were, and there was some early reporting, though, they were looking for nuclear documents. That seems to at least the discussions surrounding, that seems in retrospective, have been overstated. So, i also ought to be cautious about this, because my own organization has not matched that report. But it would not surprise me that there were documents about iran and china among the 103 classified documents that the fbi retrieved in august. And so, what would be interesting about that is to the extent these are intelligence documents, documents that are based on intelligence reporting, about adversary countries like that, it would not need to say, and we know this because we have broken into the cell phones of ex people, email accounts, or the janitor, you know the president of irans office win. Weve not to be so sensitive especially name these people because often, in countries that have, where we have very little visibility, National Security officials will say that just seeing that we know this and this allows an adversary to be like, oh, it could only have been these six people who these communications have been compromised. And that means that those channels very quickly, get dry up. And so, that is why from intelligence officials perspective, if it turns out that these werethe United States states is so focused on, instead of just random classified information, i think it would be of particular concern to the government, if those who were compromised at maralago, when they were being stored in securely there. Carlos, this is not the political. National security, public safety, these are things that should matter to all americans. And frankly, historically, you would think republicans would make a big sting can deal about this. Does it surprise you that we havent heard from many . Like so many things, during the trump era, quietly and privately republicans are alarmed. They think this is horrifying. They are against it i have to stop you. When you stop, ready . When you get the job of a public official, you no longer have the privilege of private views. Isnt that baloney . Think people should speak up. What is at stake here, as you said, its serious enough for people should speak up. I get it, sometimes people are quite. They dont want to, you know, make waves, and do anything that might hurt their party. But this is more than about a party. This is about National Security. And again, republicans are saying, privately, i hope if after this election republicans are in charge, some of them would be willing to speak up, and actually say, we need to put an end to this horrifying chapter in american politics. On 1 to 10 scale, where do you put that in terms of likely happening . Unlikely, but one can still hope, but for the good of the country, i hope it does happen, steph. If this was a tape show, this is where weve got to the scene of dumb and dumber, so, you are saying, there is your chance. Because there isnt one. Melissa, lets talk steve bannon. He was sentenced today. But he was still spouting off on Tucker Carlson tonight. Our friend Andrew Weissmann tweeted this earlier quote. Key flaw and the bannon sentence today was not requiring him to go to prison now. There is no substantial issue on appeal for all his actions which is necessary to have kept him out pending appeal. Now he may never go to jail. What do you think about this . I mean, today, it just seemed like a Big Old Press Opportunity for steve bannon and his double popped collar. Well, he certainly seems smoke, as he left. It probably would have been at smoke, if he was wearing an orange jumpsuit. And andrew i think is right. This is another opportunity for him to run out the clock true to the trump fashion, while he is appealing his sentence. He can basically wait until maybe two years and if this president is back in power again, he could seek yet another pardon. And all of this would be water under the bridge. So, again, the Justice Department got some over to wanted here today. They got a four month sentence. They had requested the maximum of six. They did not get the 200,000 dollar fine. They were hoping for. Its just a 6500 dollar fine. The big thing here is allowing this to be state on appeal. That really gives bannon an opportunity to try and work the clock out. Carlos, is this a win for bannon or the Department Of Justice . He blows his nose with 6500 bucks, and now, we are talking about him. I think he made pretty well. I mean, he should be paying major consequences for what he did, and i dont know hes not even being the major fine. Carlos, thank you for being here in person.
