public debt. the senate reacted and acted very responsibly. on two procedural votes, we got over 75 votes. on final passage, we got a majority. it was now the time is for the house to act. the house has to understand that playing ping pong politics only pings, it does not get to bottom line. we asked them to accept what we sent over so we could get into the real issues of what is fiscal '14 going to look like and how can we reduce public debt by $100 billion a year, do it in a balanced way and be able to keep our economy going, your government functioning and american people really at work. >> capitol hill correspondent kelly o'donnell is standing by and we're listening to maryland senator barbara mikulski, what's the next step? >> whats senate has been able to do with the democratic majority is critical in trying to keep the government open. they were able to keep enough votes to end the debate and put off the ted cruz effort to block this. republicans got 19 votes, nowhere near enough despite the statement democrats won that round. then harry reid was able to take another move where he would take out of the bill any effort to take away money for the health care law. big victory for democrats. they didn't want any tampering with the health care law. then they were able to pass this government funding measure. so what it does, it will keep the lights on and government operating through the middle of november. not a long time but enough to avert the crisis. now it's john boehner's problem. he has to figure out what can they do. highly unlikely they would vote on what the senate just passed and put all of this to rest. that's because so many in his conference, the tea party group especially. when i was in the senate chamber watching this unfold, there were quite of number of house republicans most vocal standing in the back watching it. there was one exchange where the senator who's in charge of trying to reelect or elect more republicans walked over to say hello to the group of house republicans and said, are you trying to intimidate me? and the response back was no, we're trying to help you. it was said in a light hearted way but it shows how much pressure they are putting on their colleagues and now the tables have turned. we think the house republicans will meet tomorrow, work on the strategy and then be able to tell us what to expect in terms of timing for a vote and can we get out of this crisis without a shutdown? the path forward is not clear right now. >> house meeting this weekend as you just indicated. there's a chance they could get back to the senate and sunday or monday, if that does then happen, that enough time for the senate to act? >> the senate has the ability if all 100 senators agree, they can move things quickly. that's where the pressure point comes up, with a ted cruise or mike lee, tea party republicans fighting so much, would they throw up a rod block. one of the ideas, could there even be a short term extension, a week or so, just to take the heat off and keep the conversations going? but would harry reid agree to that? he's saying just moments ago he will not be extorted by house republicans. so there's still a lot of pressure and still a lot of tension and really a chess game and we don't know what all of the players are going to be. it's important and the path forward, they don't want a shutdown. no one is able to describe a political solution that avoids a shutdown just yet. >> kelly o'donnell breaking it all down on hill. thank you so much. do appreciate that. bob casey joins me live now. senator casey, you're fresh off the floor there. what first of all, what's the mood like there in the upper chamber? >> i think there's some sense of relief that we've at least reached this point where the senate has done its work but now the question is before the house whether they are going to act to keep the government running or act to shut it down. but i think most americans know what's at stake here. when you shut the government down, you stunt economic growth and do real damage to the country. i hope the house will make the right decision. >> if you're a betting man, what would you bet the house would do? >> try not to bet on something like this, but this is -- i think a lot of house members in both parties understand the consequences of a shutdown. and we've had unfortunately in the not too stant path of our history, a dress rehearsal, dry run of this and it didn't go well. it was bad for the country then. we're at a point now where we have some historical context. we have the shutdown from the mid-90s and almost debt ceiling crisis in 2011. in both instances, you had an economic consequence where consumer confidence takes a hit and the economy slows down. that's not good for anybody. >> i want to talk a little bit about the time line i just posed to kelly o'donnell. if the house works through the weekend as it has indicated and the senate could get this new resolution maybe sunday, probably monday. does that even give you and your colleagues enough time to act before tuesday's deadline? >> no, it doesn't give you enough time. i hope they don't play a game with trying to jam the senate. because what should happen here is we should deal with this forthrightly. our side compromised by accepting a lower number. there's already been a good effort at compromising. we should get this done and keep the government open and get it down. then if house republicans or senate republicans whant to debate jobs or debt, we can do that in the normal course of our work. but by putting this kind of crisis at a deadline, either for the government operations or for the full faith and credit of the united states, is playing with fire and it doesn't allow us to get to where they said they want us to get to, which is an agreement on a good budget for the coming year an agreement how to turn off the sequester. every minute we're debating because of a few folks that want to impose their ideology on the rest of the country. every minute we're doing that, we're not talking about building a stronger middle class or acting on initiative to create jobs. we're not focused even on the question of debt, which they claim to want to focus a lot more attention on. >> pennsylvania senator bob casey, refusing to guess what the house will do this weekend. senator, thank you for your time. good luck. >> thanks, craig. >> four days until americans can start buying health care coverage online and the white house released a new video explaining what obama care means to you. >> what about the folks without health insurance or people who buy coverage on their own? they take the politics out of it on some level. the conversation -- i walked 200 people come up to the booth and each conversation was about health care and almost no discussion about do you like obama or obama care? that's what states are doing, taking obama care out and focusing on the health care. >> you posted an article, why the obama care resistance matters and knock that a bloc of 2 dozen republican governors are meaningfully disrupting obama care in a way that republicans in washington simply can't. most notely by refusing to expand the medicaid programs as the law calls for. what effect is that having? >> so right now we've talked a lot about ted cruz, ted cruz is only going to stop anything. if october 1st it is funded and the defund effort fails which i think it will, you'll have in a state like texas where they've said no to the medicaid money, you'll have certain families who make something -- $30,000 a year who will get pretty low priced health insurance. if you try to get texas health insurance and make $15,000 as a family, you can't get insurance because the law calls for you to get insurance under medicaid but rick perry said i'm not doing that. you have 1 million people who would have been eligible under the law but aren't because of texas governor's decision. that's happening in alet of states in the south. on october 1st, people can go online and some very low income people won't have insurance after all. >> perry bacon, we're going to continue this conversation this weekend here on msnbc. perry bacon who brought a bag back from kentucky, but presumably no bourbon. >> tomorrow. >> a florida mother will be getting a new trial after she was slammed with a 20-year sentence for firing a warning shot at her husband who she says was abusive. the story made headlines during the george zimmerman trial for what some say was a double standard in the criminal justice system. we're going to hear from her attorney. also, new comments from president obama as the u.n. security council meets tonight on a resolution demanding syria give up its chemical weapons but is that resolution strong enough to make bashar al assad comply? see who does good work and compare costs. it doesn't usually work that way with health care. but with unitedhealthcare, i get information on quality rated doctors, treatment options and estimates for how much i'll pay. that helps me, and my guys, make better decisions. i don't like guesses with my business, and definitely not with our health. innovations that work for you. that's health in numbers. unitedhealthcare. ♪ [ male announcer ] bob's heart attack didn't come with a warning. today his doctor has him on a bayer aspirin regimen to help reduce the risk of another one. if you've had a heart attack, be sure to talk to your doctor before you begin an aspirin regimen. there are new developments in the case of a florida woman accused of firing a warning shot at her husband. an aappeals court has granted alexander a new trial which forced more scrutiny of florida's stand your ground law. g gabe gutierrez has more. >> reporter: the judge ruled they made a fundamental error in jury instructions so now a case that drew national attention will once be in the spotlight. marisa alexander has a new chance at freedom. ordering a new trial after she was convicted last year of aggravated assault with a deadly weapon. >> she has no prior record and led an upstanding life. anyone can see no one was harmed here. >> reporter: in august of 2010, a violent argument with her husband at their home in jacksonville, she went to the garage and got her gun, which she legally owned claiming he threatened to kill her, alexander said she fired a warning shot into the wall to scare him off. but prosecutors argued she was aiming at her husband and missed. the jury took just 12 minutes to convict her. florida's gun laws require a minimum sentence of 20 years. a punishment even her now ex-husband thinks is too severe. >> he recognizes that she's going to be punished and wants her to be punished appropriately. >> reporter: alexander tried to claim inmunt under the stand your ground law and drew national attention in the wake of last year's shooting death of trayvon martin. they upheld stand your ground did not apply in alexander's case and did rule the jury instructions were wrong because the judge implied it was up to alexander to prove self-defense beyond a reasonable doubt. when in fact, the burden of proof falls on the prosecution. >> what the court is saying is that the instruction is inartfully worded and gives the wrong impression who bears that burden. >> reporter: prosecutors call the reversal a legal technicality and same to argue the same set of facts. a new trial date has not been set but her lawyers say they hope it happens within the next six months. in the meantime they plan to ask the court to reconsider her bail. gabe gutierrez in florida. kendall, as a former prosecutor, do you think the appellate court made the right call here? >> they absolutely made the right call. i was surprised that jury instructions that confusing made it to the jury and certainly may have contributed to the conviction. as you just described in the report, all she had to do, is create a reasonable doubt as to whether self-defense was valid. instead it was like she had to prove that she was attacking her and she had the right to use some weapon beyond a reasonable doubt. got it completely backwards. there could very well be a different result with the new trial being properly explained the law. >> one of things that struck me about this and i was down there in florida covering the zimmerman trial and a lot of talk after that trial, that perhaps zimmerman was overcharged and and that's why we got the verdict we got. are we looking at another case of that here? is this a case where the state prosecutor overcharged? >> well, the appeals court hinted that a lesser charge may make sense down the road. certainly a lot of us watching the zimmerman trial thought a charge of manslaughter may have made more sense and have been easier to convince a jury with but the key issue in these kind of cases, if the shooter kills the alleged victim, there may only be one witness and that could be the shooter. in this case, the alleged victim wasn't even harmed so he's able to come into trial and say, yeah she was trying to kill me or whatever. and that makes it tougher if you don't hurt anybody than it is for a defendant who kills the victim. >> congresswoman brown who represents jacksonville and sanford florida had this to say about the court's ruling. mandatory minimum sentences just make florida's already broken system even more arbitrary and cruel. what was certainly absent from the courtroom during marisa's trial, mercy and justice. kenda kendall, should we also be having a conversation about mandatory sentences especially since she was firing a warning shot and no one was injured? what precisely has he accomplished besides annoying a number of his republican colleagues? >> well, he raised his profile and for a lot of us it makes us pretty sure that it sounds like he's running for president. i think this is somebody who doesn't like the senate and doesn't like the process. and it seems like he's trying to raise his profile whether it's to run for president or become some kind of leader of the conservative movement who can make a lot of money at some point down the road. you're right, he has upset a lot of republicans, not just democrats and some moderates who have not liked him before this. i'm glad you didn't call it a filibuster because it's not what it was. this was this a talk-a-thon, i equate it to a guy who yells at the store when it cloeses and yells at the bricks for a while and when the owner comes back with the keys, he leaves. >> that's good. >> he didn't delay anything. that's parts of what happened here, which kind of makes you question, what was the purpose of this? and it's hard not to think it was about ted cruz. >> even if your goal is to raise your profile, even if that's the goal, do you do it at all costs? if you're raising your profile at the expense of again, you've got lies like new york corker and mccain laughing at you, you've got to wonder i suppose whether it's worth it and what's going to be the downside as well. >> you also have to look at the power of ted cruz too. the reason that people like bob corker and even john boesman from arkansas, john boseman was elected in 2010 by no means would be characterized as a moderate republican by most people. he's somebody who ousted blanche lincoln, a democrat in the -- who is a conservative democrat and upset with ted cruz because he's getting calls to his office saying he's not conservative enough even though he's voted for every defund obama care vote they could. that's what you're seeing, mainstream republicans are upset because they are getting calls from constituents accusing them and raising expectations they could do something that they believe they can't. >> before i let you go, the shutdown showdown, i couldn't get senator casey to gamble earlier on how this will play out in the house. if you had to guess, how would you say it would play out? >> i'm not a betting man. i don't like to gamble what i don't have. but i will tell you though, the fact of the matter is it's all up to john boehner here. if he decides they are going to pass something clean, then fine, but if not, it looks like they are heading to a shutdown. >> thank you so much. >> a quick note, senator ted cruz sits down for an exclusive interview with moderator of "meet the press" david gregory. if it's sunday, it's "meet the press." >> the u.n. security council is scheduled to meet at 8:00 tonight to talk about a resolution that would require syria to give up chemical weapons but with no automatic penalties if syria fails to comply. during a photo-op with india's prime minister, president obama talks about the resolution with the days of negotiation and russia, one of syria's strongest allies. >> we now have a framework that will be voted on perhaps as soon as today, perhaps over the weekend or monday that would be legally binding, that would be ver fibl and enforceable. where there would be consequences for syria's failure to meet what has been set forth in this resolution. i think is a potentially huge victory for international community. >> new york times is reporting the resolution stipulates if syria does fail to comply, the security council could take measures that include economic sanctions, even military action, but before any action is taken, the issue must go back before the security council where of course, russia holds a veto. still ahead, faith with a serious flare. >> p diddy and jaz jay-z are not the only ones who should be living in big houses. one of the new reality shows about religion is getting mixed reviews. two of the cast members, preachers right here in the studio. that's a bit extreme. >> in some of the clips. >> but what you ask, does that accurately represent us? not completely. and i think that once people actually see the show because right now some people have a perception of what they think it is and i think when they actually watch it, you're going to discover it's something completely -- >> it's going to change their minds. >> what's been the perception? you've done a lot of these types of interviews promoting the show. >> that preachers are taking folks money and living off the backs of folks hard earned money. that's not true in all cases but to be truthful there is bad leadership out there. they see this show as a target now, preachers are coming together for a tv show, we're going to get you. i think once they see the show, it's going to -- it's more than that. it's bigger than that. it really -- we take people in our lives and show them how we operate and how we handle each other and how we handle our own crisis and deal with our situations and handle our business. once you see this, you may have a different mindset about it. >> there's an editor yial in th "washington post" to talk specifically about what they wrote. quote, like so many reality tv shows before them, these programs focus on black open op ulens and make a mockery of wealth. these stereo types are magnified by highlighting prosperity ministries. >> for one, how can you make that kind of judgment when you have not even seen the show? >> again, it's actually i think a person who wrote this saw one full episode. i don't think it was based on the clips. >> i don't think you could -- you could not say that if you saw one full episode. >> in the clips -- again, this is just based on the clips i've seen, i've watched 15 or 20 min us, it's a lot of guys and ministers standing in front of very expensive cars showing off beautiful homes and it looks like the kind of reality show that -- >> do you believe the preachers shouldn't have beautiful homes and nice cars? >> that's not what i'm saying. i'm saying people are taking issue with the fact that the deck dents appears to be celebrated on this reality show about ministers and men of god. >> the reality is once you watch this show you'll take generally what we are about. none of us are about things. none of us are about the size of the bank accounts. we're about generally helping people and definitely about jesus and ministering to our community and culture, being a positive influence. that's what we're about. >> what do you think the show is going to do specifically for the image of the black church?
