full story on the insurrection. meanwhile in minneapolis, protesters demand justice for a black man shot and killed by police during a raid where officers used a no-knock warrant. in new jersey, the governor there is set to lift the mask requirement for students and school employees. and canada's capital under siege. a state of emergency as thousands demonstrate against government covid policies. and we begin with a grim assessment from the u.s. about what could come next in the crisis between russia and ukraine. >>en invasion of ukraine could happen at any time. we believe that the russians have put in place the capabilities to mount a significant military operation into ukraine. and we have been working hard to prepare a response. >> a u.s. official with direct knowledge of the latest government assessment tells nbc news russia has assembled at least 70% of the forces need to launch a full-scale invasion. that assessment also says 25 to 50,000 ukrainian civilians and 5 to 25,000 ukrainian troops could be killed or wounded in the first few weeks. 3 to 10,000 russian troops could be killed or wounded and 1 to 5 million ukrainians could become refugees or internally displaced persons. as he returned to the white house yesterday, president biden was asked about what comes next. >> are you willing to send more troops to another conflict if putin has not yet? >> i'm not going to speculate on that. >> do you think there's any indication that vladimir putin is looking for [ inaudible ]? >> i think things he cannot get. >> as tensions increase, so do efforts to try to defuse the situation. right now, french president emmanuel macron is meeting with russian president vladimir putin in moscow. the french leader is expected to visit ukraine tomorrow. and later today, president biden will host german chancellor olaf schultz at the white house to talk about the situation and how to respond. with me now to talk about all of this, nbc news correspondent, erin mclaughlin in kyiv, jeff bennett, chief washington correspondent for the pbs "newshour," as well as an msnbc political contributor, sarka kopp, senior pentagon reporter for defense one, and david ignatius, "washington post" foreign columnist and associate editor as well as an msnbc contributor. erin, the ukrainian government has been telling people to stay calm, but be ready, at the same time. has this u.s. assessment that an invasion could be imminent changed the situation in ukraine? >> reporter: citizens here in kyiv are hearing these warnings. they're seeing the reports of the 30,000 russian troops amassed inside belarus, which is just hours away from the capitol. and they're preparing for the worst. yesterday morning, we were there as hundreds of ordinary people, teenagers, elderly, men and women, gathered to learn how to handle a weapon, to learn first aid, to learn how to evacuate the wounded. it was startling to see ordinary people prepare for a potential russian invasion in this way. i was speaking to one woman, she was there with her two teenage sons. she says that she's ready to stand and defend her country. take a listen. >> reporter: you scared for your family? >> we are all mortals, come on. we are all going to die some day. and the thing you can do is, you can live your life in dignity or not. >> reporter: are you ready to fight for your country? >> yes, of course, i'm ready to fight for my country. what should i do? what else can i do? what other options? >> reporter: now, as citizens are getting ready for potential war, top ukrainian officials this morning once again downplaying the threat. we heard from the defense minister saying that he believes that for today, the risk of escalation is low. they are looking at this troop buildup on three sides of the border. they're not seeing the kind of strike formations that would indicate an imminent attack. we also heard from the ukrainian foreign minister say, you shouldn't believe some of these apocalyptic predictions, he said, coming from the west. in speaking to ukrainian security experts here, there is a sense that russia does not have enough troops to hold any sections of this country. they don't have enough troops to actually hold kyiv. they may have enough to strike to invade, but not to hold. and that's why some security experts here in kyiv believe that this may be a bluff, jose. >> yeah, and david, speaking of ukraine's foreign minister, he said, there will be no concessions on sovereignty, no direct dialogue with russian occupation, and only the people of ukraine have the right to define their country's foreign policy force. ukraine is at the center of this crisis, but has not been involved in most of the talks. is there in likelihood that any of these red lines actually have any teeth to them? >> reporter: well, the ukrainians are standing firm. it must be chilling to see u.s. intelligence estimates of as many as 50,000 civilians being killed in an invasion. the ukrainians have been concerned that the west might negotiate on their behalf some kind of deal with the separatists in an region called the dunbass region organized by the russians. they don't like that, they don't want others to be dealing with their sovereignty. for the moment, this really is a standoff. ma macron's visit to see putin today in moscow is an important moment, if there's going to be some pathway forward that's going to lead to further serious discussions, we'll probably know about it by the end of the day. >> i'm wondering, david, how you see this thing turning out. you know, erin was saying that the folks there think that, you know, the russians -- sorry, don't have the troop amount necessary to keep kyiv and other places, but how do you see this turning out? >> well, obviously, we can't predict. the situation, to me, is one in which vladimir putin is on the verge of making what i think could be a really catastrophic mistake for russia. the level of sanctions that he'll face if he does invade really will be crippling for the russian economy. he's managed to do something pretty amazing, which is to unite ukraine. ukraine used to be somewhat divided on the question of its future, should it look west. the ukrainians are really angry at the russians. and he's managed to unite the nato alliance. i haven't seen nato move together in this kind of coordinated way in many years. and we remember president trump's attacks, repeated attacks on nato. so i think putin's kind of backed himself into a corner. the question is, does he now have to invade to show that he's serious, having brought this army twice in the last year to the border. does he have to now use it? we'll see. >> yeah. and tara, some of the thousands of u.s. troops that are being sent to poland arrive today. another 8,500 troops still on heightened alert to ship off any moment. could this assessment essentially change plans for eventual deployment of u.s. troops? [ inaudible ] >> tara, i think you're muted. >> thank you, sir. we actually discussed this last week at the pentagon, where the pentagon is leaving all options open to send additional forces. the 1,700 that began to filter in over the weekend, into poland, they're actually being led by major general chris donohue, who you may remember was the last u.s. soldier in afghanistan in august. so they're being led by a force that is used to a lot of uncertainty and fluidity on the ground, and the pentagon is actually posturing for that, as well. and let us know last week that this could be the first of many additional numbers of forces that are sent, depending on the conditions on the ground. >> yeah. and jeff, ukraine will be at the top of the agenda when german chancellor olaf schultz visits the white house this afternoon for the fist time since taking office. what does the white house hope will come out of today's discussions? >> well, jose, president biden, i think it's fair to say, is eager to show united western unity in the face of russian aggression. his phone call last night with macron, ahead of mmacron's meeting with putin today was part of that. and to your point, so, too, is his sit-down with germany's new chancellor, olaf schultz. but i will say, looming over this meeting is the question of schultz' resolve to really confront putin. because among the u.s.'s major european allies, germany has appeared to be the most reluctant to commit to lethal aid. you know, they added thousands of helmets, for instance, instead of sending actual weapons. and they've refused to allow another nato ally, estonia, to send german-made howitzers to ukraine. so germany has not joined the u.s., has not joined spain and france and other than allies about bolstering the troops. so there are questions about how germany is committed to this overall effort. all nato allies bring different assets to the table, but certainly, this will be among the big conversations, the primary conversation that president biden and chancellor schultz will have, as this crisis reaches a potentially decisive new phase. >> and if russia invades ukraine, the nordstrom 2 pipeline will not move forward. a pipeline that has been built, but is not yet operational. the german chancellor talked with "the washington post" before he left. he didn't want to talk in order nordstream 2. >> chancellor schultz in his interview with the post that was published this morning said he wanted to maintain strategic ambiguity and not actually come out and i that nordstream 2 would be canceled. but i think jake sullivan's commens surely must be right. if the russians invad ukraine, it's almost possible to imagine that pipeline going forward. schultz doesn't want to say it yet. we'll see if he moves that position of a speaking with biden today. >> david ignatius, tara kopp, erin mclaughlin, thank you very much for being with me this morning. still ahead, republican congressman's adam kinzinger's reaction to the rnc's decision to censure him and liz cheney. and protests in the capital of canada forces the mayor to declare a state of emergency. he says he's afraid someone will get killed. is it violent? "the washington post" reports the archives had to retrieve multiple boxes of records from mar-a-lago, raising concerns about former president trump's adherence to the presidential records act, that's according to three people familiar with the visit. the archives declined to comment on the story to "the washington post." all of this as one of the members of that house committee, congressman adam kinzinger, is speaking out on the rnc's effort to censure him and congresswoman cheney for their work on the january 6th committee. the rnc described kinzinger and cheney as, quote, participating in a democratic-led persecution of ordinary citizens engaged in legitimate political discourse, referring to the day the capitol was attacked. here's part of what kinzinger said on "morning joe". >> kevin mccarthy obviously, who i think asked about this in response, he just, you know, went after liz and i, goes to show he is the weakest leader that has ever, frankly, existed in that position. and so i think every member of the media, every citizen, every person out there needs to. it down every republican and say, do you side with what the rnc did, or do you condemn what they did? >> joining me now is nbc news capitol hill correspondent, leigh ann caldwell. leigh ann, good morning. all of this comes as florida senator marco rubio labeled the january 6th committee a complete partisan scam. what can we expect to hear from republican leadership on this? >> reporter: hey, jose. so, republican leadership has been -- there's been different views among republican leadership. for example, leader mcconnell has said that he's really interested to see what the january 6th select committee finds out, and that he's going to be watching it closely. but like kinzinger said, leader mccarthy over in the house, he has tried his best to stay out of all of this. he believes that bringing in all members of the republican party is essential to winning back the majority in the midterm elections, and also essential to making him speaker of the house. but it is true that the republican party is divided on the fact that the rnc said that it was legitimate political discourse. but i will say, most republicans up here, especially in the house of representatives, do say that the january 6th select committee is prosecutorial and it's democrats going out of control and it's become a political operation. but still, they're moving forward and they're getting a lot of information, jose. >> and meanwhile, leigh ann, on friday, former vice president mike pence said trump was wrong and he had no authority to overturn the 2020 election. pence's former chief of staff echoed that over the weekend. what's making pence speak out heroic this now? >> well, being donald trump's punching bag is never a recipe for winning an election. we know that mike pence mike pence does have presidential ambitions, and we are told, and marc short said this over the weekend on "meet the press," that he needed to push back against the former president, saying that it was mike pence's fault, that he decided, that it was up to him to flight to overturn the election. and so he decided that this was the best choice for him, most likely, politically, and i keep thinking about a recent nbc news poll that shows that more and more republicans, as time goes on, are showing that donald trump is not the equivalent of the republican party. that number keeps getting less and less as more and more republicans think that the republican party represents the party, not necessarily donald trump, jose. >> leigh ann caldwell on capitol hill, thank you very much. staying with the january 6th investigation, the house committee investigating the insurrection and what led up to it is operating unlike any other congressional committee. this weekend, "the new york times" published a piece looking at how the panel is borrowing techniques used by federal prosecutors in using their power as aggressively as possible to get full story on one of the worst assaults on american democracy. with me now is up with of the people who wrote that piece, "new york times" washington correspondent, michael schmidt. michael, you are also an msnbc national security contributor. it's great to see you this morning. this committee has no law enforcement power. why did it choose to adopt the tactics that you describe in your story? >> so the committee knew early on that they were going to phase enormous stonewalling from trump. they knew that previous investigations had failed to stop trump from behaving in the ways that he had. they thought that trump was a massive threat to the democracy. and that they needed to use all the powers and abilities they had to try and get to the bottom of this, to try to get past that stonewalling. they determined that they were going to be criticized no matter what they did. and they have employed their powers in incredibly aggressive ways. ways that we had sneempb before in theceps of going out and getting subpoenas that have swept up individual's personal phone data, records and such, using tools like link analysis, something that the fbi uses to identify terrorist networks and how people are communicating with each other, and also working several runs out from the bottom of the trump organization, not trump the actual organization, but the trump world, in the sense that there's a group of people around donald trump who are refusing to cooperate. but if you move a few rungs down the ladder, you find younger aides who have less loyalty to trump, less ability to higher high-end defense lawyers to fight the committee, and maybe more willing to help, and might have been in the room for these key moments, these key incidents that are under investigation by the committee. >> michael, we've heard several members of the committee talk about specific laws that former president trump and others may have violated. is the committee trying to send a message to the justice department? >> reporter: jose, right now what they're doing is jury selection. they're going through the normal process of interviewing potential jurors, see if there's anything in there that could prevent them from finding an impartial verdict in this case. what's going to be notable about this case versus the state trial, this is really going to examine issues of race. remember, this is a federal hate crimes case. and so while the state trial found all three men guilty of the murder of ahmaud arbery, gregory and travis mcmichael getting sentenced to life without parole, this is more so going to look at the reasons why they decided to chase him down in the first place that ultimately resulted in their death. federal prosecutors now have the burden, the responsibility, essentially, of pursuing that they were motivated by race, they were motivated by ahmaud arbery's skin color. the fact that he was a black man led them to make several decisions about him. so why this is noteworthy is that here in the state of georgia, up until last year, after the ahmaud arbery case, there was no hate crimes law on the books. it's there now, but it does not apply retroactively. so that means that the federal hate crimes statute is the only way that race can really come into this conversation here. we know that in a number of pre-trial hearings, the prosecution has alluded to the fact that there are facebook texts, social media mosts, all of which points to the fact that they say make the case that they considered his skin color when they decided to follow ahmaud arbery that day. protesters took to the streets in downtown minneapolis over the weekend, calling for accountability following the shooting death of 22-year-old emir locke. officers executed a no-knock warrant on an apartment where locke was staying last wednesday, he was not the target. locke had no criminal record. police say they opened fire after they saw a gun in his hand that was, quote, pointed in the direction of the officer. it's unclear from body cam footage if the gun was pointing at an officer. the parents of locke said this yesterday about the shooting. >> it's unacceptable. he was execute by the npd, and i want everybody to know that my son is going to make sure that everybody across the united states is going to be able to sleep on the couch without having to be worried about being executed by the police. >> joining me now, nbc news correspondent, shaquille brewster and cedric alexander. shaq, what's the latest in the investigation? >> good morning, jose. this is an investigation that's being run by the county attorney in conjunction with the state attorney general, keith ellison. they will be the ones who will determine if there will be charges against the officer involved, if they decide. and if they feel that the evidence leads to that conclusion. we also know that protesters over the course of the weekend, that have been out in the streets of minneapolis, in these frigid temperatures, they're calling for the officer involved to be fired. that officer, mark hahnemann, he's on paid administrative leave right now in accordance with minneapolis police department policy, but you're hearing calls for him to be fired and for that to be done quickly. if you look at this entire situation, there are just so many things that we don't know about what exactly what happened. for example, we know that police carried out that no-knock warrant. but we don't know why it was a no-knock warrant. this was on behalf of the st. paul police department and their origin request was for a regular warrant to be served. we also know that emir locke, he did not have a criminal record. he was not the target of the investigation, but we don't know if there was any potential connection that he had to that investigation. those are questions that just simply haven't bansed at this point. this investigation is stretching into what will become the second week, and we still have leaders and officials calling and pleading for patience, as you have so many people in the streets of minneapolis demanding accountability. >> and cedric, why do law enforcement officials continue to rely on no-knock warrants. >> well, first of all, let me say this. good morning, jose and shaq. in police departments across the country, even prior to breonna taylor in louisville and afterwards began take a look at their policies regarding no-knock warrants. the possibilities of being able to utilize that tactic, to me, from my experience, is going to be limited under certain circumstances. if you have a hostage situation, where you're trying to preserve life or property, you may want to consider that. but in most of these cases, where we're seeing no-knock warrants, i think a we're going to and see people are coming to realize and are questioning is that anytime that you wake up a person at 3:00 or 4:00 in the morning, oftentimes, they're going to be very disoriented. whether they recognize we're yelling police or not, it's going to be left up to the individual. but it put police officers at risk with these no-knocks, and it certainly does put citizens at risk. i think what has to happen here going forward is that every agency continues to take a look at this policy, and i think we need to move away from this whole primitive idea, is that we're going to surprise people on the other side of the door. and we've got to be real clear and careful about, we know where our target is. and in many of these instances, we're certain we've got to get bad guys off the street. but to get them off the street, oftentimes, we'll have to be very planful, very careful, and very methodical in our approach. and we've got to make sure if we're going to hit a particular structure, at last no collateral damage, which means that we're using high-powered weaponry, such as what we see in many of these videos, is that we have the ability to go into apartments and houses next door. so a lot of planning, a lot of thoughtfulness, and great deal of strategy and execution of those no-knocks have to be in place. but i think more departments today, jose, are moving away from no-knocks and finding other strategies in which to capture those that they're looking for, but we've got to make sure that we go after the right target. and in this case, it was the wrong target. >> yeah, i mean, and cedric, we're seeing law enforcement officials carry out a warrant, where the person they're looking for isn't even there. or someone unrelated to their investigation is killed, we saw this repeatedly. how does this happen? >> well, there's a number of reasons for it. first of all, here again, jose, we need to re-think no-knock warrants. number three, it requires this. it requires an investigation tas going to reveal to you the latest up-to-date information that we have if this subject is on the other side of that structure. and we have to take into account the environment, close proximity to other buildings or houses that we can go in, but you may have a bad guy that decides to fire and use his or her weapon and that can go and strike innocent people. so it takes a lot of preparation. in many of these no-knocks, consideration needs to be made as to if i'm looking for a murder suspect, do i need to hit his or her house at 3:00 in the morning or are there some other strategies which i can utilize to get them off the street, such as surveil them, catch them in a different environment, going in, coming out of their residence, a structure, whatever the case may be. you can be as creative as you want. but i think the general public across this country is asking for something very different, because when these no-knock warrants, we're seeing people who are being injured, who are being killed, mistakenly, and i don't care whether it's frequent or infrequent, no innocent person should lose their lives in the process of this. so on the part of police, i think police departments, many of them are taking the measure. and first of all, let me say this, too. i want to applaud mayor frye in minneapolis of putting a moratorium on no-knocks in bringing in expert that are going to help them craft a policy that's going to be beneficial to police and to the community there in minneapolis. >> cedric alexander, shaquille brewster, thank you so much for being with me this morning. >> thank you for having me. coming up, congressman jamal bowman on where things stand on voting rights and immigration in congress. he'll break it down for us next. you're watching "jose diaz-balart reports." congressman, good to see you. diaz-balart reports. diaz-balart reports. congressman, good to see youene. and lawmakers are looking to pass a stopgap bill to avoid a government shutdown. where have we heard that before? also looming over democratic lawmakers, a lengthy to-do list of legislative priorities. joining me now is democratic congressman, jamaal bowman from new york. congressman, it's a pleasure to see you this morning. thank you for your time. what more can you tell us about where things stand in the push for federal voting rights, which is something you're very passionate about. >> well, right now, things seem to be stagnant. as you know, the republican party has not worked in collaboration or in concert with the democratic party at all to help us advance voting rights. it's another example of how they've welcome more of a fascist party than a party that deals with democracy. the other thing that's really troubling is two democrats continue to stop us from doing what's necessary to move voting rights legislation forward. the filibuster, which is a jim crow relic, something that is not a part of our constitution, and something the founding fathers didn't want, continue to stand in the way. and my two democratic colleagues in the senate, manchin and sinema, don't even support a talking filibuster or debate on the issue, which is completely unacceptable. the people sent us here to govern. we have to govern. we know that republicans across the country are suppressing the vote. particularly the black and latino vote, so we have to push back aggressively, and that's why we see organizers across the country doing just that. >> so what would your message be to senators sinema and manchin? >> well, it's not just a message to them, it's a message to the american people. we have to organize. and we have to put pressure on sinema and manchin from the outside. one of the reasons why during the vyings movement, the voting rights act and the civil rights act were able to pass is because there was a movement on the outside from the american people, against jim crow and against ongoing discrimination, against war, against everything that doesn't meet the ideals of our democracy. so manchin and sinema have to understand that history is going to tell this story. and history going to inform people that they did not step up in this moment, and that they allowed our government potentially to be taken over by dangerous, fascist republicans and the corporate lobby. >> and congressman, speaking about stepping up, you know, on the issue of immigration reform, for example, there has been very little stepping up to something that quite frankly, on comprehensive immigration reform, has bipartisan appeal and support outside of washington, d.c. but it seems as though there is very little being done in washington, d.c., to get any legislative reform, immigration reform, that could make a difference for millions of people in this country. >> well, it's another example of republicans not wanting to work with democrats at all. they have complete obstructionists. mitch mcconnell has said it himself. and that's why we can't get comprehensive immigration reform across the finish line, because of republicans. but we try to include it in build back better. we took three bites of the apple, if you will, to make sure that it was a part of the build back better act, which would only require democratic sport to get it through. but this is something, once again, senator manchin did not want to support overruling the parliamentarian, which would allow us to pass so a comprehensive immigration reform, or at the very least, allow our immigrant neighbors to not be harassed and allow them to travel and allow them to live in peace for a short period of time. so, we -- we haven't stepped up. most of democrats in congress are ready to step up on this issue, it's just one or two that continue to hold us back. >> and congressman, you just tweeted this morning about the killing of 22-year-old emir locke. walk us through what you see as congress' role in preventing these kind of deathses. >> we need to pass the george floyd justice in policing act, period, full stop. we passed it out of the house almost a year ago. it's been sitting in the senate. negotiations/quote unquote, were happening to pass this bill. even the fraternal order of police supported the by, but tim scott, south carolina republican, backed away and did not negotiate in good faith, so george floyd continues to languish there. these are some of the challenges with a small majority in the senate. it's hard to pass transformative legislation, because you need a super majority, which once again is a part of something that the founding fathers did not want to have in place. we need to pass george floyd, we need to pass common sense gun reform, we need to pass immigration reform, we need to pass women's reproductive health and rights. all of this is in the senate, not moving, because of obstructionists, republicans, and in her post, which has since been deleted. >> in canada, a state of emergency in ottawa amid ongoing covid-19 demonstrations. parliamentary reporter anne bergeron joins me with the very latest. >> reporter: i'm standing here where roughly 3,000 vehicles arrived last saturday. we're now in about day ten and many of these individuals are still here. wellington is the equivalent of pennsylvania avenue. the downtown core is completely gridlocked. no cars are available to get in and out. there's been temporary encampments. the police say they are underresourced and they say this city is under siege, they are calling it an occupation. it's a sign to the provincial and federal government that somebody needs to act. this really is about covid-19 but is a lot broader. some of these protests started more than a week ago. they want to overthrow the government. they do not like the vaccine mandates imposed, they don't want any more lockdowns and they want a complete change in government. this is a big event and nobody understands how this is going to end and frustration and anger is growing, jose. >> and these have been peaceful? >> peaceful in the sense that there have not been any violent outbursts, however horns have been honking for 10 to 12 hours a night. many have moved out of the regions and many businesses have been shut down. our biggest mall has been closed for more than a week. there have been individuals wearing masks being harassed on the street. some have been almost rammed with a vehicle. there hasn't been as much violence as some had perhaps projected but full story on the insurrection. meanwhile in minneapolis, protesters demand justice for a black man shot and killed by police during a raid where officers used a no-knock warrant. in new jersey, the governor there is set to lift the mask requirement for students and school employees. and canada's capital under siege. a state of emergency as thousands demonstrate against government covid policies. and we begin with a grim assessment from the u.s. about what could come next in the crisis between russia and ukraine. >>en invasion of ukraine could happen at any time. we believe that the russians have put in place the capabilities to mount a significant military operation into ukraine. and we have been working hard to prepare a response. >> a u.s. official with direct knowledge of the latest government assessment tells nbc news russia has assembled at least 70% of the forces need to launch a full-scale invasion. that assessment also says 25 to 50,000 ukrainian civilians and 5 to 25,000 ukrainian troops could be killed or wounded in the first few weeks. 3 to 10,000 russian troops could be killed or wounded and 1 to 5 million ukrainians could become refugees or internally displaced persons. as he returned to the white house yesterday, president biden was asked about what comes next. >> are you willing to send more troops to another conflict if putin has not yet? >> i'm not going to speculate on that. >> do you think there's any indication that vladimir putin is looking for [ inaudible ]? >> i think things he cannot get. >> as tensions increase, so do efforts to try to defuse the situation. right now, french president emmanuel macron is meeting with russian president vladimir putin in moscow. the french leader is expected to visit ukraine tomorrow. and later today, president biden will host german chancellor olaf schultz at the white house to talk about the situation and how to respond. with me now to talk about all of this, nbc news correspondent, erin mclaughlin in kyiv, jeff bennett, chief washington correspondent for the pbs "newshour," as well as an msnbc political contributor, sarka kopp, senior pentagon reporter for defense one, and david ignatius, "washington post" foreign columnist and associate editor as well as an msnbc contributor. erin, the ukrainian government has been telling people to stay calm, but be ready, at the same time. has this u.s. assessment that an invasion could be imminent changed the situation in ukraine? >> reporter: citizens here in kyiv are hearing these warnings. they're seeing the reports of the 30,000 russian troops amassed inside belarus, which is just hours away from the capitol. and they're preparing for the worst. yesterday morning, we were there as hundreds of ordinary people, teenagers, elderly, men and women, gathered to learn how to handle a weapon, to learn first aid, to learn how to evacuate the wounded. it was startling to see ordinary people prepare for a potential russian invasion in this way. i was speaking to one woman, she was there with her two teenage sons. she says that she's ready to stand and defend her country. take a listen. >> reporter: you scared for your family? >> we are all mortals, come on. we are all going to die some day. and the thing you can do is, you can live your life in dignity or not. >> reporter: are you ready to fight for your country? >> yes, of course, i'm ready to fight for my country. what should i do? what else can i do? what other options? >> reporter: now, as citizens are getting ready for potential war, top ukrainian officials this morning once again downplaying the threat. we heard from the defense minister saying that he believes that for today, the risk of escalation is low. they are looking at this troop buildup on three sides of the border. they're not seeing the kind of strike formations that would indicate an imminent attack. we also heard from the ukrainian foreign minister say, you shouldn't believe some of these apocalyptic predictions, he said, coming from the west. in speaking to ukrainian security experts here, there is a sense that russia does not have enough troops to hold any sections of this country. they don't have enough troops to actually hold kyiv. they may have enough to strike to invade, but not to hold. and that's why some security experts here in kyiv believe that this may be a bluff, jose. >> yeah, and david, speaking of ukraine's foreign minister, he said, there will be no concessions on sovereignty, no direct dialogue with russian occupation, and only the people of ukraine have the right to define their country's foreign policy force. ukraine is at the center of this crisis, but has not been involved in most of the talks. is there in likelihood that any of these red lines actually have any teeth to them? >> reporter: well, the ukrainians are standing firm. it must be chilling to see u.s. intelligence estimates of as many as 50,000 civilians being killed in an invasion. the ukrainians have been concerned that the west might negotiate on their behalf some kind of deal with the separatists in an region called the dunbass region organized by the russians. they don't like that, they don't want others to be dealing with their sovereignty. for the moment, this really is a standoff. ma macron's visit to see putin today in moscow is an important moment, if there's going to be some pathway forward that's going to lead to further serious discussions, we'll probably know about it by the end of the day. >> i'm wondering, david, how you see this thing turning out. you know, erin was saying that the folks there think that, you know, the russians -- sorry, don't have the troop amount necessary to keep kyiv and other places, but how do you see this turning out? >> well, obviously, we can't predict. the situation, to me, is one in which vladimir putin is on the verge of making what i think could be a really catastrophic mistake for russia. the level of sanctions that he'll face if he does invade really will be crippling for the russian economy. he's managed to do something pretty amazing, which is to unite ukraine. ukraine used to be somewhat divided on the question of its future, should it look west. the ukrainians are really angry at the russians. and he's managed to unite the nato alliance. i haven't seen nato move together in this kind of coordinated way in many years. and we remember president trump's attacks, repeated attacks on nato. so i think putin's kind of backed himself into a corner. the question is, does he now have to invade to show that he's serious, having brought this army twice in the last year to the border. does he have to now use it? we'll see. >> yeah. and tara, some of the thousands of u.s. troops that are being sent to poland arrive today. another 8,500 troops still on heightened alert to ship off any moment. could this assessment essentially change plans for eventual deployment of u.s. troops? [ inaudible ] >> tara, i think you're muted. >> thank you, sir. we actually discussed this last week at the pentagon, where the pentagon is leaving all options open to send additional forces. the 1,700 that began to filter in over the weekend, into poland, they're actually being led by major general chris donohue, who you may remember was the last u.s. soldier in afghanistan in august. so they're being led by a force that is used to a lot of uncertainty and fluidity on the ground, and the pentagon is actually posturing for that, as well. and let us know last week that this could be the first of many additional numbers of forces that are sent, depending on the conditions on the ground. >> yeah. and jeff, ukraine will be at the top of the agenda when german chancellor olaf schultz visits the white house this afternoon for the fist time since taking office. what does the white house hope will come out of today's discussions? >> well, jose, president biden, i think it's fair to say, is eager to show united western unity in the face of russian aggression. his phone call last night with macron, ahead of mmacron's meeting with putin today was part of that. and to your point, so, too, is his sit-down with germany's new chancellor, olaf schultz. but i will say, looming over this meeting is the question of schultz' resolve to really confront putin. because among the u.s.'s major european allies, germany has appeared to be the most reluctant to commit to lethal aid. you know, they added thousands of helmets, for instance, instead of sending actual weapons. and they've refused to allow another nato ally, estonia, to send german-made howitzers to ukraine. so germany has not joined the u.s., has not joined spain and france and other than allies about bolstering the troops. so there are questions about how germany is committed to this overall effort. all nato allies bring different assets to the table, but certainly, this will be among the big conversations, the primary conversation that president biden and chancellor schultz will have, as this crisis reaches a potentially decisive new phase. >> and if russia invades ukraine, the nordstrom 2 pipeline will not move forward. a pipeline that has been built, but is not yet operational. the german chancellor talked with "the washington post" before he left. he didn't want to talk in order nordstream 2. >> chancellor schultz in his interview with the post that was published this morning said he wanted to maintain strategic ambiguity and not actually come out and i that nordstream 2 would be canceled. but i think jake sullivan's commens surely must be right. if the russians invad ukraine, it's almost possible to imagine that pipeline going forward. schultz doesn't want to say it yet. we'll see if he moves that position of a speaking with biden today. >> david ignatius, tara kopp, erin mclaughlin, thank you very much for being with me this morning. still ahead, republican congressman's adam kinzinger's reaction to the rnc's decision to censure him and liz cheney. and protests in the capital of canada forces the mayor to declare a state of emergency. he says he's afraid someone will get killed. is it violent? "the washington post" reports the archives had to retrieve multiple boxes of records from mar-a-lago, raising concerns about former president trump's adherence to the presidential records act, that's according to three people familiar with the visit. the archives declined to comment on the story to "the washington post." all of this as one of the members of that house committee, congressman adam kinzinger, is speaking out on the rnc's effort to censure him and congresswoman cheney for their work on the january 6th committee. the rnc described kinzinger and cheney as, quote, participating in a democratic-led persecution of ordinary citizens engaged in legitimate political discourse, referring to the day the capitol was attacked. here's part of what kinzinger said on "morning joe". >> kevin mccarthy obviously, who i think asked about this in response, he just, you know, went after liz and i, goes to show he is the weakest leader that has ever, frankly, existed in that position. and so i think every member of the media, every citizen, every person out there needs to. it down every republican and say, do you side with what the rnc did, or do you condemn what they did? >> joining me now is nbc news capitol hill correspondent, leigh ann caldwell. leigh ann, good morning. all of this comes as florida senator marco rubio labeled the january 6th committee a complete partisan scam. what can we expect to hear from republican leadership on this? >> reporter: hey, jose. so, republican leadership has been -- there's been different views among republican leadership. for example, leader mcconnell has said that he's really interested to see what the january 6th select committee finds out, and that he's going to be watching it closely. but like kinzinger said, leader mccarthy over in the house, he has tried his best to stay out of all of this. he believes that bringing in all members of the republican party is essential to winning back the majority in the midterm elections, and also essential to making him speaker of the house. but it is true that the republican party is divided on the fact that the rnc said that it was legitimate political discourse. but i will say, most republicans up here, especially in the house of representatives, do say that the january 6th select committee is prosecutorial and it's democrats going out of control and it's become a political operation. but still, they're moving forward and they're getting a lot of information, jose. >> and meanwhile, leigh ann, on friday, former vice president mike pence said trump was wrong and he had no authority to overturn the 2020 election. pence's former chief of staff echoed that over the weekend. what's making pence speak out heroic this now? >> well, being donald trump's punching bag is never a recipe for winning an election. we know that mike pence mike pence does have presidential ambitions, and we are told, and marc short said this over the weekend on "meet the press," that he needed to push back against the former president, saying that it was mike pence's fault, that he decided, that it was up to him to flight to overturn the election. and so he decided that this was the best choice for him, most likely, politically, and i keep thinking about a recent nbc news poll that shows that more and more republicans, as time goes on, are showing that donald trump is not the equivalent of the republican party. that number keeps getting less and less as more and more republicans think that the republican party represents the party, not necessarily donald trump, jose. >> leigh ann caldwell on capitol hill, thank you very much. staying with the january 6th investigation, the house committee investigating the insurrection and what led up to it is operating unlike any other congressional committee. this weekend, "the new york times" published a piece looking at how the panel is borrowing techniques used by federal prosecutors in using their power as aggressively as possible to get full story on one of the worst assaults on american democracy. with me now is up with of the people who wrote that piece, "new york times" washington correspondent, michael schmidt. michael, you are also an msnbc national security contributor. it's great to see you this morning. this committee has no law enforcement power. why did it choose to adopt the tactics that you describe in your story? >> so the committee knew early on that they were going to phase enormous stonewalling from trump. they knew that previous investigations had failed to stop trump from behaving in the ways that he had. they thought that trump was a massive threat to the democracy. and that they needed to use all the powers and abilities they had to try and get to the bottom of this, to try to get past that stonewalling. they determined that they were going to be criticized no matter what they did. and they have employed their powers in incredibly aggressive ways. ways that we had sneempb before in theceps of going out and getting subpoenas that have swept up individual's personal phone data, records and such, using tools like link analysis, something that the fbi uses to identify terrorist networks and how people are communicating with each other, and also working several runs out from the bottom of the trump organization, not trump the actual organization, but the trump world, in the sense that there's a group of people around donald trump who are refusing to cooperate. but if you move a few rungs down the ladder, you find younger aides who have less loyalty to trump, less ability to higher high-end defense lawyers to fight the committee, and maybe more willing to help, and might have been in the room for these key moments, these key incidents that are under investigation by the committee. >> michael, we've heard several members of the committee talk about specific laws that former president trump and others may have violated. is the committee trying to send a message to the justice department? >> reporter: jose, right now what they're doing is jury selection. they're going through the normal process of interviewing potential jurors, see if there's anything in there that could prevent them from finding an impartial verdict in this case. what's going to be notable about this case versus the state trial, this is really going to examine issues of race. remember, this is a federal hate crimes case. and so while the state trial found all three men guilty of the murder of ahmaud arbery, gregory and travis mcmichael getting sentenced to life without parole, this is more so going to look at the reasons why they decided to chase him down in the first place that ultimately resulted in their death. federal prosecutors now have the burden, the responsibility, essentially, of pursuing that they were motivated by race, they were motivated by ahmaud arbery's skin color. the fact that he was a black man led them to make several decisions about him. so why this is noteworthy is that here in the state of georgia, up until last year, after the ahmaud arbery case, there was no hate crimes law on the books. it's there now, but it does not apply retroactively. so that means that the federal hate crimes statute is the only way that race can really come into this conversation here. we know that in a number of pre-trial hearings, the prosecution has alluded to the fact that there are facebook texts, social media mosts, all of which points to the fact that they say make the case that they considered his skin color when they decided to follow ahmaud arbery that day. protesters took to the streets in downtown minneapolis over the weekend, calling for accountability following the shooting death of 22-year-old emir locke. officers executed a no-knock warrant on an apartment where locke was staying last wednesday, he was not the target. locke had no criminal record. police say they opened fire after they saw a gun in his hand that was, quote, pointed in the direction of the officer. it's unclear from body cam footage if the gun was pointing at an officer. the parents of locke said this yesterday about the shooting. >> it's unacceptable. he was execute by the npd, and i want everybody to know that my son is going to make sure that everybody across the united states is going to be able to sleep on the couch without having to be worried about being executed by the police. >> joining me now, nbc news correspondent, shaquille brewster and cedric alexander. shaq, what's the latest in the investigation? >> good morning, jose. this is an investigation that's being run by the county attorney in conjunction with the state attorney general, keith ellison. they will be the ones who will determine if there will be charges against the officer involved, if they decide. and if they feel that the evidence leads to that conclusion. we also know that protesters over the course of the weekend, that have been out in the streets of minneapolis, in these frigid temperatures, they're calling for the officer involved to be fired. that officer, mark hahnemann, he's on paid administrative leave right now in accordance with minneapolis police department policy, but you're hearing calls for him to be fired and for that to be done quickly. if you look at this entire situation, there are just so many things that we don't know about what exactly what happened. for example, we know that police carried out that no-knock warrant. but we don't know why it was a no-knock warrant. this was on behalf of the st. paul police department and their origin request was for a regular warrant to be served. we also know that emir locke, he did not have a criminal record. he was not the target of the investigation, but we don't know if there was any potential connection that he had to that investigation. those are questions that just simply haven't bansed at this point. this investigation is stretching into what will become the second week, and we still have leaders and officials calling and pleading for patience, as you have so many people in the streets of minneapolis demanding accountability. >> and cedric, why do law enforcement officials continue to rely on no-knock warrants. >> well, first of all, let me say this. good morning, jose and shaq. in police departments across the country, even prior to breonna taylor in louisville and afterwards began take a look at their policies regarding no-knock warrants. the possibilities of being able to utilize that tactic, to me, from my experience, is going to be limited under certain circumstances. if you have a hostage situation, where you're trying to preserve life or property, you may want to consider that. but in most of these cases, where we're seeing no-knock warrants, i think a we're going to and see people are coming to realize and are questioning is that anytime that you wake up a person at 3:00 or 4:00 in the morning, oftentimes, they're going to be very disoriented. whether they recognize we're yelling police or not, it's going to be left up to the individual. but it put police officers at risk with these no-knocks, and it certainly does put citizens at risk. i think what has to happen here going forward is that every agency continues to take a look at this policy, and i think we need to move away from this whole primitive idea, is that we're going to surprise people on the other side of the door. and we've got to be real clear and careful about, we know where our target is. and in many of these instances, we're certain we've got to get bad guys off the street. but to get them off the street, oftentimes, we'll have to be very planful, very careful, and very methodical in our approach. and we've got to make sure if we're going to hit a particular structure, at last no collateral damage, which means that we're using high-powered weaponry, such as what we see in many of these videos, is that we have the ability to go into apartments and houses next door. so a lot of planning, a lot of thoughtfulness, and great deal of strategy and execution of those no-knocks have to be in place. but i think more departments today, jose, are moving away from no-knocks and finding other strategies in which to capture those that they're looking for, but we've got to make sure that we go after the right target. and in this case, it was the wrong target. >> yeah, i mean, and cedric, we're seeing law enforcement officials carry out a warrant, where the person they're looking for isn't even there. or someone unrelated to their investigation is killed, we saw this repeatedly. how does this happen? >> well, there's a number of reasons for it. first of all, here again, jose, we need to re-think no-knock warrants. number three, it requires this. it requires an investigation tas going to reveal to you the latest up-to-date information that we have if this subject is on the other side of that structure. and we have to take into account the environment, close proximity to other buildings or houses that we can go in, but you may have a bad guy that decides to fire and use his or her weapon and that can go and strike innocent people. so it takes a lot of preparation. in many of these no-knocks, consideration needs to be made as to if i'm looking for a murder suspect, do i need to hit his or her house at 3:00 in the morning or are there some other strategies which i can utilize to get them off the street, such as surveil them, catch them in a different environment, going in, coming out of their residence, a structure, whatever the case may be. you can be as creative as you want. but i think the general public across this country is asking for something very different, because when these no-knock warrants, we're seeing people who are being injured, who are being killed, mistakenly, and i don't care whether it's frequent or infrequent, no innocent person should lose their lives in the process of this. so on the part of police, i think police departments, many of them are taking the measure. and first of all, let me say this, too. i want to applaud mayor frye in minneapolis of putting a moratorium on no-knocks in bringing in expert that are going to help them craft a policy that's going to be beneficial to police and to the community there in minneapolis. >> cedric alexander, shaquille brewster, thank you so much for being with me this morning. >> thank you for having me. coming up, congressman jamal bowman on where things stand on voting rights and immigration in congress. he'll break it down for us next. you're watching "jose diaz-balart reports." congressman, good to see you. diaz-balart reports. diaz-balart reports. congressman, good to see youene. priorities. joining me now is democratic congressman, jamaal bowman from new york. congressman, it's a pleasure to see you this morning. thank you for your time. what more can you tell us about where things stand in the push for federal voting rights, which is something you're very passionate about. >> well, right now, things seem to be stagnant. as you know, the republican party has not worked in collaboration or in concert with the democratic party at all to help us advance voting rights. it's another example of how they've welcome more of a fascist party than a party that deals with democracy. the other thing that's really troubling is two democrats continue to stop us from doing what's necessary to move voting rights legislation forward. the filibuster, which is a jim crow relic, something that is not a part of our constitution, and something the founding fathers didn't want, continue to stand in the way. and my two democratic colleagues in the senate, manchin and sinema, don't even support a talking filibuster or debate on the issue, which is completely unacceptable. the people sent us here to govern. we have to govern. we know that republicans across the country are suppressing the vote. particularly the black and latino vote, so we have to push back aggressively, and that's why we see organizers across the country doing just that. >> so what would your message be to senators sinema and manchin? >> well, it's not just a message to them, it's a message to the american people. we have to organize. and we have to put pressure on sinema and manchin from the outside. one of the reasons why during the vyings movement, the voting rights act and the civil rights act were able to pass is because there was a movement on the outside from the american people, against jim crow and against ongoing discrimination, against war, against everything that doesn't meet the ideals of our democracy. so manchin and sinema have to understand that history is going to tell this story. and history going to inform people that they did not step up in this moment, and that they allowed our government potentially to be taken over by dangerous, fascist republicans and the corporate lobby. >> and congressman, speaking about stepping up, you know, on the issue of immigration reform, for example, there has been very little stepping up to something that quite frankly, on comprehensive immigration reform, has bipartisan appeal and support outside of washington, d.c. but it seems as though there is very little being done in washington, d.c., to get any legislative reform, immigration reform, that could make a difference for millions of people in this country. >> well, it's another example of republicans not wanting to work with democrats at all. they have complete obstructionists. mitch mcconnell has said it himself. and that's why we can't get comprehensive immigration reform across the finish line, because of republicans. but we try to include it in build back better. we took three bites of the apple, if you will, to make sure that it was a part of the build back better act, which would only require democratic sport to get it through. but this is something, once again, senator manchin did not want to support overruling the parliamentarian, which would allow us to pass so a comprehensive immigration reform, or at the very least, allow our immigrant neighbors to not be harassed and allow them to travel and allow them to live in peace for a short period of time. so, we -- we haven't stepped up. most of democrats in congress are ready to step up on this issue, it's just one or two that continue to hold us back. >> and congressman, you just tweeted this morning about the killing of 22-year-old emir locke. walk us through what you see as congress' role in preventing these kind of deathses. >> we need to pass the george floyd justice in policing act, period, full stop. we passed it out of the house almost a year ago. it's been sitting in the senate. negotiations/quote unquote, were happening to pass this bill. even the fraternal order of police supported the by, but tim scott, south carolina republican, backed away and did not negotiate in good faith, so george floyd continues to languish there. these are some of the challenges with a small majority in the senate. it's hard to pass transformative legislation, because you need a super majority, which once again is a part of something that the founding fathers did not want to have in place. we need to pass george floyd, we need to pass common sense gun reform, we need to pass immigration reform, we need to pass women's reproductive health and rights. all of this is in the senate, not moving, because of obstructionists, republicans, and reporter: i'm standing here where roughly 3,000 vehicles arrived last saturday. we're now in about day ten and many of these individuals are still here. wellington is the equivalent of pennsylvania avenue. the downtown core is completely gridlocked. no cars are available to get in and out. there's been temporary encampments. the police say they are underresourced and they say this city is under siege, they are calling it an occupation. it's a sign to the provincial and federal government that somebody needs to act. this really is about covid-19 but is a lot broader. some of these protests started more than a week ago. they want to overthrow the government. they do not like the vaccine mandates imposed, they don't want any more lockdowns and they want a complete change in government. this is a big event and nobody understands how this is going to end and frustration and anger is growing, jose. >> and these have been peaceful? >> peaceful in the sense that there have not been any violent outbursts, however horns have been honking for 10 to 12 hours a night. many have moved out of the regions and many businesses have been shut down. our biggest mall has been closed for more than a week. there have been individuals wearing masks being harassed on the street. some have been almost rammed with a vehicle. there hasn't been as much violence as some had perhaps projected but
