go back to palm beac once again to be with th president. and so, you know, i think it kind of encapsulates the wider issue of they don't have, or did not have, any informatio about some charges they until late april, after th holidays was that a likely scenario for you? was that messaging unintentional misdirection and if the latter, why would the da's office want to keep things under wraps >> yeah, we just don't know an it's all so soon in the tsunam of actual indictment remember that long hiatu announcement did come from the court, and the court administration was just sort o on the calendar. brag, you know, the table ha been fully set for ten days an people were scratching their heads, including me, because i did seem that there was no way he was going to back out doing it suddenly, i think, di kind of make it, in some ways, less tumultuous than i could've been. we have the, you know, it went from, what solid security doing? to an indictment in about half hour. i doubt this moment. you know, his mood has fluctuated in recent weeks he's gone from real ange towards the fact that he was going to get indicted, to this resignation that if he was going to get indicted than, yo know, might as well come to ne york and he wanted to be handcuffed, and he was ver specific to aids about, yo know, he wanted his hand behind his back and so he coul project -- >> hang on a second. wait, wait he wanted his hands behind his back we don't even see that anymore don't we see people with handcuffed in front? so, he wanted to take the extr dramatic step to show himself, like, oh, you know that's strange just saying. >> no, he was very specific in that instruction and he kind o took his aides by the surprise they did not anticipate this level of insistence from trump certainly when he then said, you know, i don't care if it's a security concern, i want t be a martyr, i think tha solidified in that moment what trump wanted then at the indictment, when i actually came down, hi response was much more muted and he was trying to take it i think it's one thing to be - potential indictment and i think harry would agree that once you actually get hit with an indictment, that's completely different story and -- was actually designed to - >> yeah, reality can b sobering so, harry, nbc reports tha trump is facing about those 30 counts of falsifying documents but the specific charges wer made remain under seal presumably until he' arraigned. any likelihood under the charges he will face, give what you know about the case >> yes, i mean, basically that number of charges, alex, suggests that the separate 1 checks to michael cohen in the stormy daniels chaos are all being conceptualized as crime. they wouldn't have to be, bu that is how bragg is treatin it, and maybe has multiple crimes, depending on whether there are tax consequences o business false reporting consequences, as well. in addition then, i'm dustin off my high school math to divide by three and see if there's one left over, because there may also be a lot of everything, a conspiracy count involving not just trump, bu possibly david pecker, the las witness in the grand jury. and that's what we will see. the numbers are little deceiving in that way, but whether there is a conspirac and the exact legal theory everyone's going to be ver interested >> pecker being the former owner of the national enquirer when all of this was going down okay, so von, i know you are talking about the difference in the arraignment process for trump. who's behind all that? i mean, is there some kind o negotiation? do you know what's going on to try to make this palpable fo both sides, the da and trump's team >> right, surely after the indictment was issued from the grand jury, at that point is when the district attorney's office placed a phone call t trump's attorney, to notif them of course, donald trump still, himself and his attorneys, don't even know the specific charges. but that's where the conversations began, as to wha day he would be arraigned. ultimately, it appears tha this is going to work the easy way. of course, the concern was tha donald trump would not comply. he will not voluntarily fly to new york for this arraignment. at that point, there would'v had to be negotiations between law enforcement in new york, a well as here in florida. and between the governor's offices and ran desantis had already suggested that he woul not go as far as to extradit donald trump but based off of trump's own attorneys here at this point it appears that he will, o monday, fly out. at that point, it's in the hands of the nypd, as well a the secret service we are told that secret servic will be with him every step of the way, and they're a integral part of this, part of the reason why he's not to b handcuffed and also part of th reason why it appears, at this point, there's no public display of donald trump out in the streets in manhattan a this point because they want to keep hi out of the public eye. alex >> let's face it trump is the type of guy you typically takes his ow council. so it is still possible but he may decide, yeah, i don't go o monday, and who knows them but denise, relative to th business from washington, ho much might all of this be wing on the dealings of congress? how much of a distraction ha trump's indictment become? >> well is clearly a topic tha is going to be coursing throug congress and reporters are going to be asking lawmakers about. it yard have house speaker kevin mccarthy saying that he' going to hold the da brad -- rack accountable what that actually, means we will see we are have three republican led committees in the hous investigating that the investigation that he's doin here you have also democrats ar saying that it's dangerous territory for congress to be seen as politicizing and meddling in a prosecution, a possible prosecution indictmen of the former president. so it is really i think it's always going to be a tough topic for congress but i am not sure how an lawmaker, and all of this goin on in new york, how an lawmaker is not gonna be questioned about this daily. because if you know, just an covering former president trump, knowing who he is. he's gonna be out there talking, he's gonna be releasin statements, he's gonna b fundraising. and every single time you have that happen, you have reporter like, me like vaughan, so many of our colleagues asking republicans in particular, whe you make about this latest think when you make of thi latest development not to mention that there are number of other legal issues that could be percolating alon the way. as new york's case along so a lot definitely to tal about here in washington and a lot to deal with a lawmakers try to do some business with congress, alex >> totally true. last question to you, i woul appreciate a quick answer, how long might take to get to th trial, and is this a guarantee it goes to trial, as there any chance of a pretrial settlement, and the bargaining for discharges in a case like this you know me, after 1 million questions, but you can g succinctly >> yes, no pretrial settlement it >> yeah, that's right, alex. most democrats are saying, let this investigation play out. nobody is above the law. not even a former president. and a former president who, by the way, just happens to b running for president again in 2024 so, all of this coming to head here. as you've heard a lot of reaction pour in fro republicans. most of them, uniting behind the former president and i it's not the former presiden himself that is uniting them it's the fact that they believ this investigation i political. this indictment from manhattan da, alvin bragg, is politica in nature. you're already seeing that pla out in the house with thre house committee chairs launching investigations trading letters with the manhattan da, trying t investigate the investigation. that all another direction speaker mccarthy, who called for that two weeks ago, when the former president initially put out a truth social pos teasing his arrest and indictment,. i want you to take a listen to what benny thompson, the chairman of the january 6t select committee, had to say about last night, specifically about the protests piece because remember, that's something the former president called for he tees death and destruction. that's a direct quote from mr. trump. take a listen to what benn thompson had to say. >> the potential for a january 6th style situation exists when you talk about breaking windows, hitting policeman coming, obviously, on tuesda to do whatever is to be done there are some real sick peopl out here who are easil persuaded to do bad things and you would expect members o congress to be more responsible. in what they say >> well, we know at least on member of congress, trump ally congresswoman marjorie taylo greene, is planning to head to new york on tuesday to protest the indictment she tweeted saying, quote, w must protest the unconstitutional witch hunt. just quickly here, other republicans are spoken to, including senator capito, told me last week that a protes could be dangerous of course, everyone has constitutional right and fre speech to protest. but in the wake of the forme president is suggesting it her and what they lived through on january 6th, that's a little bit nerve-racking for some o them >> yeah, absolutely. okay, julie tsirkin, thank you so much from the capital joining me now is pennsylvania congresswoman, summer leah democratic member of the house oversight committee. welcome it's good to have yo on the broadcast so, from marjorie taylor green saying that she's going to protest tuesday, to lindse graham saying trump should smash some windows, suggesting he will immediately be released, what is your response to wha we're hearing from you republican colleagues? how much other various republican sentiments affectin the dynamic there on capitol hill were you guys even able to get any sort of bipartisan wor done with this tenor of things >> let me say, i mean, the tenor of things isn't even right. this is been the tenor, we lived through an insurrection, right? i was not there, but colleague of mine were running afraid fo their lives. you know, because of the rhetoric of donald trump and this party so, the tenor is not new, but do think it's funny that, yo know, a party of people who sa that they are for law and orde are suddenly not, right? what we're really realizing is that the whole time, the point was that people like the aren't supposed to have thei behavior criminalize, right? it's supposed to be people lik me, people from communitie like mine, where our behavio is colonel eyes. so, this is a whole shift in their hypocrisy. so, unsurprising, but -- you know, they have the powe to do things for america people we could focus on the budget we could focus on the crises that we have before us, bu there are two things that lead us to the distraction an they're choosing it for reason >> we have not these as office as you well know, they'r pushing back against three house gop chairman for what it calls unlawful political interference in a new letter in response to requests for information and testimony, rags general counse urge him to quote use th stature of your office t counter these attacks. and urged respect for th fairness of our justice system and the work of the impartia grand jury and so the gop led committee that you are on is among those trying to compel testimony fro the da, you heard the response from bragg's office. why are your republica colleagues not respecting th way our system of justice works? why are they demanding information in the ongoing criminal prosecution from legal arena outside the federa government >> because for ages, they have used the system of justice t meet their ends. their political ends their economic ends. this is outside of the norm fo them they are accustomed to be able to do this, right? but da bragg's under sen right. this is a political and corrup requests that they are making. they know, that and that's why the overseers of the oversee and judiciary committees did not ask for committee subpoena they know full well that the do not have the right to interfere in states usua process. >> okay. let's talk about something ver sobering as well this week the debate over gun control, certainly growing this wee after monday's tragic an deadly shootings there and tha church school in nashville on the house floor and wednesday, you asked her republican colleagues to start putting their politics over ou children's lives your cosponsor of the assaul weapons ban in 2023. have you heard from an republican colleagues, privately even, about this is there any when you think yo might support? indictment influencing overall the republican race, and wha are democrats watching for >> so, i have a very interesting perspective that i have been on a debate with wit people, not on television, but i will say it here this is actually >> and to b honest, it might clinching the nomination, which is very scar for the republican party because they would have to follow him however, if he still happens t be the nominee, there are so many people in this country, democrats, independents, i some republicans who would not want him to be president o united states. and so there are so many reasons
