[slap] or popcorn nuggets. now get out there and have fun! woo, let's go! it's finger lickin' good! live from the cbs broadcast center in philadelphia, this is cbs3 "eyewitness news" at 11:00. wound asked turkey. a delaware county man was among the victims of yesterday's deadly night club massacre. and tonight, his family speaks exclusively to "eyewitness news." a cell phone may very well have saved his life. i'm natasha brown. the gunman accused of killing at least 39 people at an istanbul night club remains on the loose at this hour. 70 others were injured. so far, there's been no claim of responsibility. jake raak's family spoke out earlier. joe holden picks up the story to he here. >> reporter: he was inside that night club when a loan gunman came and in started firing. he's recovering tonight in an istanbul hospital. >> germany tv captures jake raak being loaded while explaining to reporters what happened inside an istanbul night club. the raak family confirms he was among the wounded. shot once the bullet ricocheted off his cell phone and hit his leg. sunday evening he spoke to his younger brother, >> i'm just happy my brother is ok so he could come home. really sad with the rest of the world and what the going on. >> reporter: family first contacted cbs3 about jake after word came an american was minute re among the wounded in a deadly new year attack in an istanbul night club. the death toll. innocent people. jake's family says after he was shot, he remained motionless on the ground playing dead in hopes he would survive. jake's mother who did not want to appear on camera told us he made a spontaneous decision to travel to turkey to meet up with friends on friday. >> guys doing ok? "eyewitness news" here on the scene of a fatal hit-and-run early sunday morning. police say the accident happened around 1:30 at chew avenue and marvine street in olney. the driver left the scene and the victim died. police caught up with the driver few blocks away. that person is facing dui and other charges as well. president-elect trump will have upgraded equipment when he does take office
