university hospital. diana rocco is live there for us tonight with the latest breaking details. diana? >> reporter: chris, at this hour that shooting is still under investigation. but what i can tell you that 26 year old trooper david kedra was pronounced dead shotly after his arrival here at temple university hospital. and win the last hour, there were some very somber moments as his family and comrades saluted him as he was taken to the medical examiner' office he is cored by police motorcade. not a word was spoken as the body of 26 year old pennsylvania state trooper david kedra taken from temple university hospital before his distraught family and motorcade and under the salute of his physical low comrades and loaded into awaiting hearse. he was shot in the chest during a training exercise tuesday at the montgomery county public safety training campus in conshohocken. the incident happened around 4:45 in the afternoon. chopper three overhead as he was removed from the facility and airlifted to temple where he was pronounced dead. police investigators guard the scene in the back of the training facility waiting for the montgomery county district attorney to arrive. as her office now investigates. and he was with the skippack barrack. he was a member of troop k. and he's been with the pennsylvania state police since june of 2012. we're life outside temple university hospital, diana rocco cbs-3 "eyewitness news". >> all right, diana, thank you. now to developments we're learning about tonight in the first case of ebola diagnosed in the u.s. the patient who flew from liberia is hospitalized in dallas tonight. health reporter stephanie stahl is live in the sat center with the very latest. stephanie. >> that patient is seriously ill but communicating and this is exactly what health officials had been fearing. someone infected with this deadly virus gets into the united states undetected. the unidentified ebola patient is in isolation at texas health presbyterian hospital dallas. >> it's a severe disease which has a high case fatality rate even with the best of care. >> officials will only say the patient who's not a health care worker in texas to visit family. the patient flew out of liberia on september 19th and arrived in texas on saturday the 20th. there do in the app per to be direct flights. it's unclear what other cities the person may have traveled through. on september 24th, symptoms developed. two days later on the 26th the patient sought medical care and was sent home. on sunday, the 28th, he went to the hospital and was placed in isolation. >> i wouldn't say there's no concern. we're certainly going to track all the people who had contact with him and we're going to watch them and monitor their health. ebola can be spread through body fluids once symptoms appe appear. there are four days after the flight before being hospitalized when the patient had symptoms and would have been contagious. >> it is a little scarier now. it's right here in dallas, and what are you going to do? it makes you kind of wonder. >> it requires a close contact. so just rolling by somebody is not dangerous. >> reporter: dr. eric stander and the emergency department at hahnemann hospital back in august showed us how u.s. hospitals are equipped to quickly isolate and treat any contagious disease. >> the bottom line here is that i have no doubt that we will control this importation or this case of e bowl la so it does not widespread in this country. >> and health officials stress that the medical situation in this country is better and frankly a lot more sophisticated than what's happening in africa. as for the patient, we don't know nationality or itch and it hasn't been determined yet if that experimental treatment would be appropriate. live in the sat center, i'm instead of know stall cbs-3 "eyewitness news". >> all right, stephanie, thank you. there's much more about the ebola case in texas and the outbreak in africa on our website. it's cbsphilly.com, also there we've set up a link to the cdc just click on links and numbers. >> well two year old boy in delaware is fighting for his live hours after he shot himself with a gun that was found in his home. "eyewitness news" reporter todd quinones is live in claymont, delaware, and todd, you spoke with this boy' family tonight. >> reporter: chris, tonight that family is identifying this little two year old boy as aj graves. he is listed in critical condition tonight but his family tells me he is showing signs of improving. the two yeared boy apparently was playing with gun inside his home when it accidentally went off. shooting hip in the head. tuesday night the boy's older brother spoke brief toll reporters. >> he's doing good. he better. he in icu right now. he went over to. cu. he getting better root now. >> when police and emergency personnel arrived on the scene, they began life performing measures. >> the two year old and his mom were only the ones inside the residence at the time of the shooting and he's been trance poured to ai dupont by helicopter. >> reporter: the boy was shot in the head just after 10:00 a.m. at the valley run apartments in claymont, delawa delaware. police collected evidence from the victim's home. the shaling has stunned neighbors. >> the baby -- he was cute. sweet as he could be. used to play out there with his dad. >> next door neighbor bill jennings allowed police to conduct part of their investigation in his app. jennings says he used to own gun when his kids were young, but realized the danger. >> because so many kids find their parents guns and accidents happen. that's the reason why i got rid of my gun. >> reporter: and at this point it's still not exactly clear how this little two yeared boy got his hands on this gun in the first place. it's not clear where this gun was being kept inside the home here. tonight we've learned that authorities are reviewing this case to determine if any charges should be filed. reporting live to into clay mount, delaware, todd quinones cbs-3 "eyewitness news". >> todd, thank you. >> philadelphia police are searching for a suspect who attacked a woman along a popular trail near the wissahickon creek. this attempted rape happened in broad daylight under the mccallum street bridge and forty three dame police say the attacker walked past the vick testimony with a friendly greeting them suddenly turned and through her to the ground. she fought the man off and called 911 today. we talked to other women who use the trail. >> it's very sad. very shocking. i'm alarmed. it's terrible. it's just horrible. the to think that you can't even come out and have an enjoyable evening. relax. and without someone attacking you. >> police describe the attacker as a black male 6 feet tall, 25 to 30 years old wearing a red polo style shirt and tan pants. tonight authorities searching in the poconos for the accused cop killer eric forty nine find pipe bombs in the woods. >> i am calling on you, eric, to surrender. you're clearly stressed. you're making significant mistakes. >> these are the pipe bombs that they found. they say that they could have been rigged with explosives that would have -- with a trip wire or a fuse. authorities also say there have been at least one -- there has been one credible sighting of frein in the past 24 hours but from about 100 yards you way. frein has been on the loose for money two weeks now after investigators say he shot two pennsylvania state troopers killing one. an indictment today for the man accused of jumping over a fence and running into the white house. omar gonzalez has been charged with entering a restricted building and carrying dangerous weapon. prosecutors say that he had a knife with him when he stormed past secret service and into the white house east room. the charges were announced today as lawmakers on capitol hill grilled the secret service director about this security breach. >> it's clear that our security plan was not properly executed. this is unacceptable. and i take full responsibility. i will make sure that it does not happen again. >> i wish to god you -- you protected the white house like you protecting your reputation here today. >> lawmakers also recently discover the secret service took several days to realize that someone had shot at the white house residence back in 2011 hitting it several time. >> comedian tracy morgan is firing back after wal*mart partly blamed him for the injuries he suffered in the new jersey turnpike crash. back in june, a wal*mart truck slammed in a van carrying morgan on his way home from show in delaware. in response to a lawsuit filed by morgan over the accident, wall march says the occupants were not wearing seat belts and that contributed to the injuries. police say the truck driver did not sleep for more than 24 hours before that crash. in a statement morgan said "i can't believe wal*mart is blaming me for an accident that they caused. my friends and i were doing nothing wrong. i'm fighting hard every day to get back ". >> one of morgan's friends died in that crash. >> starting in just a few minutes now, at midnight the warning period will be over and red light violates in abington will get tickets. the fine for running the red light $100. the cameras are at three different intersections. old york and susquehanna roads. old york and old welsh roads and fitzwater town and moreland roads. >> also taking effect at midnight, philadelphia's $2 a pack cigarette tax. governor tom corbett recently signed that measure new york. investigators say that he was drunk when he allegedly robbed a swedish tourist and then ran down the street into that building. an initial police cherry hill search of the building came up empty but the man was later found by some people who worked there hiding in a fifth floor bathroom. >> new jersey governor chris christie is criticizing president obama for the way he's handled the threat posed by is isis. christie sat down with cnn. >> i was disturbed, um, by the 60 minutes interview, um, on sunday night when he said, um, they underestimated isis. it should be we, mr. president. it's your administration. and when you're the leader, you have to be held accountable to war they do. >> when asked what he would do if he were commander in chief christie said then he doesn't have to answer the question because he's not the president. >> voters in elk and franklin townships said yes tonight to some major repairs and delsea he john high school. there is significant roof damage and students and staff say every time it rains water pours in. photos show the magnitude of that problem. under referendum approved tonight about $20 million will be spent on the high school and middle school and that means new roofs and improvements to heating and air-conditioning. the state will kick in about 10 until i don't know dollars worth of funding. >> now to a scam that went on for years. as another executive involved in the scheme faces sentencing here in philadelphia plea on your side consumer reporter jim donovan introduces to us victim who was determined to get justice. >> something was not right in river city. >> reporter: ingrid robinson smelled a rat. just week after paying remington financial group a $10,000 advance fee. the company's ad promises connections to hundreds of investors that fund business projecprojects. ingrid had plans for a multi million dollars resort in california but those connections were bogus. >> the first time i saw that rejection letter i felt like someone had punched me in the stomach. >> reporter: she ex changed e-mails with remington executives demanding an explanation. she finally reached one on the phone. what he said, made her furious. >> ingrid you sound like you're a hysterical woman. we don't know what we're missing here, because we're trying to do everything we can to fund your deal. i heard that and i said if you think i'm hysterical now, just wait. i will become your worst nightmare. >> reporter: ink grid went online and found hundreds of other victims who paid advance fees of 10 no $25,000 and never got financing. >> i was talking to victims everywhere, russia, everywhere. everywhere. and nobody would connect the dots. nobody wanted to do the work. >> reporter: u.s. attorney's office in philadelphia and the fbi were investigating remingt remington. part of the scheme included instructing employees not to let truth get in the way when pitching their services. six people including remington founder andrew, pleaded guilty to bilking 1900 victims out of $26 million in advance fees. a seven executive matthew mcmannis went on trial and was convicted earlier this year. mcmannis operated remington's philadelphia office and lives in this million dollar home in montgomery county. when we rang the bell people were home but no one would come to the door. mcmannis is scheduled to be sentenced next tuesday in federal court. she's pushing congress to go after brokers who get fees for leading victims to bogus invest many companies. >> there are literally tens of thousands of commercial brokers around the world and all of them can do this and there's nothing illegal. but if you cut off the head of the snake, the snake will have harder time wiggling. >> reporting for three on your side, i'm jim donovan. >> all right. well it look like fall is gradually make its way to the area. it is. >> arrive with bang it look like. cold front after cold front will progressively get cooler. we have one that is approaching the region right now. we're seeing some showers moving toward the delaware valley. not everyone will see them. but they will be bringing in some cooler air. take a look outside. where we do have calm conditions temperatures in the 60s. quiet right now in center city philadelphia. on storm scan3 that's not the case to the west. you can see a line of some yellows and oranges. some thunderstorms through harrisburg and extending down through the maryland border going through baltimore right now and washington. a lot of this is losing a lot of its strength over the course of this past several minutes and as you see it moving further to the east forward lancaster some showers few lightning strikes and slowly moving more toward the north than toward the east. i do think that will make it toward our northern and western suburb in the form of some showers during the overnight period. but not heavy rain. we're looking for scattered showers even making it into philadelphia. a light easterly wind, and then toward the morning, we're looking at areas of fog as well. so please be aware of that come tomorrow morning when you head out the door. today we made it to 79. the average high 72. we'll watch our temperatures gradually go down and bottom out over the weekend with much cooler air really feeling like october. tomorrow the first day of october we'll watch our front move on through. bringing in a few more showers. the flow around this area of low pressure counterclockwise bringing in atlantic moisture as well. spotty afternoon showers expected temperatures will be in the 70s. once this system exits, we get a bit of a bonus day on thursday. parly sunny, temperatures in the 70s. then we watch our next system move in. this will hold off till friday night. friday will be beaut p full day. increasing clouds. rain at night into saturday morning. and after that, it gets much cooler. temperatures right now in the 60s in the poconos in the 50s with a few showers. out to the west, this is a cooler air i'm talking about. temperatures in the 40s and the 50s. in canada we have some 30s. that cool push of air is going to be singing down through the midwest over the next couple of days and make it into our region by the weekend. with some morning lows in the fours. even in philadelphia. overnight, clouds, shower asking areas of fog will develop. the low 60 in the city. cooler in our suburb. overnight lows mainly in the 50's to the north and west and to the south and east. wednesday some morning fog a chance of a shower. otherwise mix of clouds and sun. on the exclusive eyewitness wet weather seven day forecast. thursday 73. friday 75 for the holiday. rain at night into saturday. then we clear it out. here's that cool air coming in. sunday only 66. monday more showers. tuesday 65 degrees. look at that morning low. sunday morning. 49 and that is in the city of philadelphia. ouch! we want to remind everyone
