an arrest.>> rob malcolm is in santa rosa with the latest on the investigation.>> reporter: an update to the story. we got a word that santa rosa police do have a suspect in custody. we are waiting on who the suspect is. we can tell you how the story unfolded. it was an unprovoked attack that left a 61-year-old man with a stab wound to the neck. the suspects tattoos led to an arrest.>> nearly a week after april stabbing residence and this south santa rosa neighborhood remain nervous. >> i come here a lot with my fianci. that is scary. i bring my kids.>> reporter: brenda florez reacts. thursday night the man in this surveillance video according to santa rosa police is wanted for stabbing a 61-year-old man in the neck while he sat alone inside lobos market. he is described as a hispanic male 30-40 male and weighing 160-180 pounds. with close cut black hair and wearing a dark green jacket. who after words fled the restaurant on foot. he spoke with santa rosa police. we spoke with santa rosa police. they said the attack appeared to be unprovoked. both men were customers of the restaurant and it doesn't appear to be gang related. they say they are working on good leads they received wednesday afternoon. police revealed further information on facebook.. witnesses described the suspect as having a tattoo similar to the one you see here. described as it being a tattoo of the grim reaper. or commonly knows --. that is very popular.>> everybody has it on their shoulder arms or chest. seeing that face it might be easier. i haven't seen it.>> reporter: witnesses say the suspect might live in the area and work in landscaping. the victim of the stabbing is recovering from his injuries. brenda who frequents the restaurant is now being careful.>> we come on saturdays and sundays. i will be more aware of my surroundings. with my back to the wall.>> reporter: back here live a reward of up to $2500 was being put out for the arrest of the suspect. by the sonoma county take back our community. police telling us moments ago they do have a suspect in custody. we are waiting for updates on who that person is.>> do we know where this person was taken into custody or any other details? >> reporter: we were down at the lobos market and that is where the suspect was apparently taken into custody. we are waiting for confirmation of that arrest tonight.>> that man who was stabbed in the neck in life-threatening condition. accident involving a google bus has left a motorcyclist dead tonight. it happened before seven shoreline boulevard near plymouth. a witness said a motorcyclist slammed into the side of the bus at the intersection. the man on the motorcycle was pronounced dead at the scene. a woman driving behind the bus pulled over to called 911.>> very upset. when i was on the phone with the 911 i was telling her people are running over to the individual and trying to help him. at that point someone tried to turn him over and there was a screen.. it is unclear who is at fault for the accident or if there were passengers on the bus at the time. the bus driver remained at the scene and appeared to be cooperating with police. authorities in san francisco on alert ahead of the new year's eve celebration. there is no credible threat to san francisco. a new emergency text alert system is in place just in case.>> reporter: peer 39 in san francisco was crowded with tourists on any given day. you can imagine the scene on a night like new year's eve with waterfront views and the free fireworks display it could easily attract 200,000 people. after learning of a thwarted attack plan on christmas day a large celebration is bound to bring some anxiety for people but not stopping others.>> this iconic city.>> reporter: the department of emergency management is giving residents and service peace of mind. alert.>> we set up a special new year's eve registration code for our emergency text message system. alerts a -- if they are coming to celebrate new year's eve in san francisco they can text the phrase and why e sf 17. 88877.>> a one-time code so visitors can sign up without the hassle of receiving alerts after new year's eve. then messages will be pumped out of the emergency operation center filled with representatives from various departments.>> as the department finds credible threats we will be sharing that information with our state local and federal partners so we can make our streets safe as possible during the new year's eve festivities.>> reporter: it is one helpful tool. having a plan is another.>> response to the massacre in las vegas. a man is behind bars facing attempted murder charges after crashing his car into a market and leading police on a chase. it happened in concorde yesterday afternoon at the farm bureau or market. it ended a mile away at fifth street and the alameda. the suspect david gopi of concorde saw someone he knew in front of the market and tried to run the person over. he missed and crashed into the market. he tried to speed away and police started to chase him. he was eventually taken into custody with help from a police k-9. the person he is accused of trying to hit has not been identified and a motive is unclear. marijuana business says the chp illegally seized almost 2000 pounds of marijuana from two of their employees. old kai distribution said two workers were transported -- transporting the marijuana last friday they were pulled over by the highway patrol in ukiah. they said it was illegal to transport that amount until the new laws are recreational marijuana take affect statewide january 1. the business disputes it because they say they are a licensed medical marijuana dispensary. old kai is demanding the highway patrol returned the 1900 pounds of marijuana. and drop the charges against their employees. chp so far has not commented permit a touching tribute at chp headquarters in west sacramento for the chp officer killed in a crash is suspected dui driver on christmas eve. andrew kim larry was on duty on interstate 880 in hayward when a car plowed into the back of his patrol suv. candace shows us how the fallen officer was are trying to determine if the deliveryman looks face charges for burglary and grand theft or petty theft. el cerrito man who survived as a prisoner of war during world war ii has died. he was 100 years old. he was one of 70,000 american and filipino pows forced to take part in the death march in 1942. that is when japanese soldiers march the pows for 60 miles to a military base in the philippines with no food or water. killing thousands along the way. he escaped the death march and later moved to the bay area. the work is a civilian but for the u.s. military. he passed away officials are worried not inviting trump could strain the medic relations between the uk and the u.s. from recreational marijuana to guns. a number of new laws go into effect january 1. a look at been talk about the changes coming with the legalization of recreational marijuana. what else are we in store for? >> reporter: elections immigration housing and guns. legislators were busy. we broke down the important changes.>> reporter: starting january 1 anyone convicted of a hate crime will not be allowed to own a firearm for 10 years. anyone who purchases ammunition online or elsewhere must do so through a licensed vendor and pick it up in person. pay more to the dmv when registering and renewing your vehicle. transportation improvement fee which is based on the value of your car and will cost anywhere from 25-$175. the fees are to pay for maintenance and roadwork. another part of the gas tax. staying with vehicles drivers of rideshare companies will be required to have a blood alcohol played -- level below .04. if they violate the law they could face suspension and other penalties. that law goes into effect july 1. on that same day people who ride buses with seatbelts are required to wear them. the election reform bill passed in 2016 will go into effect. give people more options when casting ballots. registers of photos -- voters will be sent ballots 28 days before the election. they can return it by mail taken to a drop off location which will be open for weeks before election day are casted at a bold center. which will replace pulling centers. california will become a sanctuary state. with the values act officers cannot inquire about someone's immigration status or detained them unless they have been convicted of a major crime. will not stand in the way for eyes agents from doing their own work. californians who work in businesses with 20 or more employers -- employees. within the first year of the child's birth adoption or false -- high school students will no longer have to take an exit exam to graduate and receive their diploma plan first-time students and rolling a state community college will have their first year fees wait as long as the state set aside enough money in the budget to do so. a $15 minimum wage in 2023. employees at companies of 26 or more get a small boost of $11 per hour on monday. the states new marijuana laws are causing some concern about people driving while high. tom descartes tells us about the marijuana detection device police will be using in the coming year.>> reporter: the san francisco police say one in every four drivers they pull over is stoned. even before it legalization. the california office of traffic safety says the drug impaired drivers in fatal accidents have skyrocketed.>> went drivers in fatal crashes have been tested for drugs other than alcohol in their system back in 2006 it was little over 26%. in 2015 it was over 43%.>> it is not just alcohol. there is a combination with any other type of drug. prescription or cannabis. an increase on drugs. and driving.>> reporter: please use traditional field sobriety test to verify intoxication. for police the problem is making sure the person is truly impaired. as opposed to simply having thc in their blood at a legal level. thc the ingredient and cannabis can be in your bloodstream for hours or days. that doesn't mean you are stoned. thc must be measured in the breath by parts per trillion which means detectors must be incredibly accurate. several marijuana breathalyzers are coming out on the law enforcement market to find impairment on the spot.>> our system will provide evidence to support an officers opinion.>> reporter: open position found -- a company that has developed instantaneous thc breathalyzers. he says the stone level normally in a person for just a couple hours right after using. and says -- if it is not detectable in your breath odds are you are not impaired to drive.>> everybody is getting behind this notion of a marijuana breathalyzers that can truly differentiate that person who was stoned right now versus the person who might just have it in their system.>> reporter: many agencies have yet to acquire the detectors. made many detectors awaiting certification. in the coming days and weeks traditional screening methods will do just fine catching those abusing cannabis and driving. dozens of tourists stranded. the major power outage in disneyland that closed several attractions. we have the forecast. a chilly one tonight. the big story is there is some rain and the long-range forecast. it is being called the flight to nowhere. had it not and for famous people on board it probably would have not have gotten as much attention. it was from los angeles to tokyo. it was diverted after a still investigating the incident. the flight was rescheduled and took off this morning for tokyo. disneyland apologizing to visitors after a massive power outages stranded people on a number of rides during the busiest time of the year.>> we were in the small world. all the lights went off.>> it is disappointing. >> some say they had to wait to be escorted from stalled rides. no one was hurt. they blamed the issue with the transformer the supplied power. some park visitors voice complaints and ask for a refund. the power was restored about six hours after the initial blackout. fewer americans are going to the movies. despite blockbusters like the new star wars movie and beauty and the beast ticket sales for 2017 were down 2 1/2% compared to last year. to about $11 billion in all. attendance fell 4% in north america to its lowest level since 1995. they blamed competition from streaming services like amazon and netflix.. you have more content on more platforms available than at return. rn dozens of bats are flying free once again after they were rescued and then released from a home in palo alto. workers at the house discovered 83 bats behind a wooden mural. the peninsula humane society and the spca were able to release them back where they belong.>> reporter: at this home a power washing crew made a discovery. behind a panel depicting st. francis -- were 83 animals. a whole colony of mexican bats. >> they are nocturnal. they were sleeping and being accidentally disturbed by the workers. they started sliding down the side of the house and falling on the ground.>> reporter: the crew called the humane society and spca. officers came and collected them and brought them to their facility. while they usually treat one or two bats a month they have never had this many before.>> to have 83 at one time come in. that is a record.>> reporter: by that point all 83 were angry about the move. otherwise they seemed unharmed.. we gave them some oxygen and warm them up. carefully evaluated every one of them. they were perfectly fine. the decision was made to return them back to where they were found.>> reporter: they are insect eaters and are 3 1/2 inches in length. a species of special concern because their habitats are dwindling. this colony had its home restored. they put the mural back on the side of the house before they left.>> they flew right back to the mural. that is their home. hopefully they won't be disturbed again.>> reporter: they are settling back at the home. the homeowner is fine with it. since they are good at pollinating flowers and eating insects. we are checking your weather. it has been cold across the country. talk about the flight delays earlier. not too many now. we could see a few tomorrow as the snow continues in the northeast and far east costs. lots of cold air. as we look out west a high- pressure ridge stays with us essentially true the next 72 hours. it starts to break down towards the early part of next week. it
