It is called shoulder surfing and it is becoming a common crime at atms. The tactic is low tech. Peering over a customers shoulder while they enter their pin. No card readers. Just a set of prying eyes and these shoulder surfers have stolen thousands of dollars at those two bank branches. It is not a brazen heist. These thieves just watch and wait. This is a very prevalent crime. Reporter San Leandro Police are seeing fraudsters return to Old Fashioned shoulder surfing to steal cash at atms. They watch a user and pick up on their pass code. The second you step away with the money in your hand, the suspect jumps over the machine and they reengage your account, reopen it and they continue transaction. Reporter the thieves have struck several machines starting on may 19 when 1,300 was stolen from the bank of america on east 14th street. Then july 2, 1,600dollars was swiped. The same bank was hit again september 26 and september 27. But this time, Undercover Police were there. And arrested 33yearold blade kitral of oakland. He was seen acting suspiciously. He had 665 cash. Reporter an arrest, but the thefts continued. October 13, a thousand dollars was taken from the atm at the bank of america on fairmont drive. I always look around first to make sure there are not suspicious persons. Reporter that is what officers encourage customer to do. And be leery of anyone whose eyes are glued to your screen. For their part, cops are going to spend more times at banks. We will have undercover officers there to watch your back. Reporter tonight, i spoke with a friend of the Bank Customer whose account was accessed here. Turns out he is a tourist from ukraine and the thieves made five separate withdrawals at 200 a pop. It seems so simple to make sure no one is watching you barflies say these crimes are getting common. Reporter be aware of your surroundings. When you talk about the prevalence, it is estimated the thefts cost banks a billion dollars a year. All right, heather, thank you. Some graphic video tonight of two drivers who appeared to have intentionally hit a man who was vandalizing cars with a machete. Oh you done [bleep] up now. Someone on a balcony shot this video. It showed someone swiping a machete at a red car on international boulevard. His rant went on several minutes with the red car coming around to hit him twice. Officers arrived soon after that. Incredibly, the han with the machete suffered only minor injuries. He was arrested and is now on a psychiatric hold. Now police want to talk to the drivers of the two cars. One of them was a red or maroon four door hyundai. The white car is is a toyota camry. Now to the steel that fell at an overpass. The fencing was inspected earlier this year, so why did it sail . Jana katsuyama joins us now in the news room after talking to a witness who said someone could have been killed. Reporter when i saw all that metal on the ground today, it is clear that would have been devastating if it had fallen on someones head or gone through a windshield. What is not clear is how the structure passed a cal trance inspection. Reporter caltrans engineers inspected the 23 avenue overpass on 880 and put white concrete barriers along the raw edge where the fencing gave way and fell below. Terrifying for travelers on i 880 who watched the tons of metal fall on cars and eight lanes of traffic. The fencing for the side of the overpass just started peeling loose. It started in one section and then the rest just kind of came out like a zipper. Reporter ian was driving home from work. His car came just feet short of the falling debris. He shot photos and video of emergency crews who had to cut the debris in order to clear the road. Two people had minor injuries. In an incident that some say could easily have proved deadly. The timing was a little bit different, someone certainly could have been killed. Reporter the overpass failure caused a backup that started about 6 30 and lasted more than one hour. Caltrans says the bridge was built in 1947 and undergoes inspections every two years. This overcrossing was last inspected in february of this year. Reporter ktvu fox 2 news asks what that inspection report said. The caltrans Officials Say they are trying to locate the report. And their Structural Engineers are reviewing the overpass now to determine what caused the fencing failure. Once we find out from them what caused it, we are in a better position to talk about the repairs. Reporter our cameras got video of the fallen fence that shows rust at the base where it is attached. Inspectors closed the pedestrian sidewalk. It was just a matter of time before the bridge fell. Reporter one neighbor who didnt want his face on camera called the caltrans contractor two months ago because the fence seemed unstable. I called rtw construction and told them the fence was falling. No calls back. No response. Reporter regular commuters tell us they had concerns as well. Saying the fence had appeared bowed. The fence on the north side of the overpass is also bent after a car hit it last july. Many people now are nervous that the infrastructure they depend on might not be so dependable. It was a scary thing to know that it is possible out there that some of our infrastructure has decayed to this level. Reporter caltrans tells me that they deemed that overpass the rest of the parts safe and they expect to get a report in the coming days. They are just waiting for the engineers to complete their investigation and the overpass had already been scheduled to be replaced in 2018. Live from the news room, jana katsuyama, ktvu fox 2 news. New at 10 00, congressman paul ryan giving into pressure said today he would likely accept the job of the next speaker of the house if the Republican Party unites behind him. Ryan says the gop has a lot of problems and needs to unify. The disarray already has led to Speaker John Boehner announcing his retirement. Ryan met with members of the conservative freedom caucus. He said he would serve as speaker but only under certain conditions and he gave fellow republicans until friday to apply. I am in the job i always wanted here in congress. I came to the conclusion that this is a very dire moment. Not just for congress, not just for the Republican Party, but, for our country. And i think our country is. Many of the gop are looking to ryan to be the partys savior and unifier. Boehner couldnt get the conservative wing to fall in line and Kevin Mccarthy left because of his comments about Hillary Clintons poll numbers and benghazi. In our next half hour, the candidate ending his campaign for the democratic nomination and why he could still be a player in the race for the white house. Controversy tonight on new Breast Cancer guidelines. The American Cancer Society changed its recommendations calling for women to get screened later in life and less often. Why some doctors say the move sends the wrong message. Reporter the message is clear. Mammograms save lives. But new recommendations from the American Cancer Society says women should start screenings lateener life and get fewer of them. The bindings come after Research Shows women can produce false positive result thats lead to unnecessary follow up steps. This is video released by the organization. What we realize is there are areas where the evidence is very clear and there are other areas where there may be a tradeoff. We recommend starting the regular screening at age 45. The evidence clearly shows there is substantial magnitude of benefit. Lives saved compared to the risks of having a false positive biopsy or overdiagnosis. Reporter the acs says women should start getting mammograms at 45 instead of 40 and get them every other year at 55. This is compared to getting them every other year starting at 50. You do save the most lives at 40. Reporter chief of images dr. Bonnie jo is concerned that the new recommendations give the wrong impression to women. The risk you are weighing is survival. Whether or not you die of Breast Cancer versus coming back for a few extra pictures. Reporter it gives women a choice. If you value saving lives it is clear you should start annually at 40. Reporter this can get very confusing for women who are unsure of when to stop screening. The doctor who spoke on behalf of the American Cancer Society says the guidelines are not one size fits all. Every woman should talk to their doctor to determine what is best for them. Christina rendon, ktvu fox 2 news. The centers for Disease Control says nearly 225,000 women in the u. S. Are diagnosed with Breast Cancer each year. More than 40,000 die from the cancer. Overall, one in eight women will be diagnosed at some point and their chances increase with age. A restaurant in los gatos that reopened earlier this year after a devastating fire can add another star to its portfolio. Manressa is getting another star for 2015. A fire destroyed the kitchen of the restaurant in july of last year. It reopened on january 1 of this year after months of repairs and remodeling. There are five threestar restaurants in the bay area. They are manresa, benu, saison in San Francisco as well as the French Laundry and the restaurant at meadowwood in napa valley. Issuing a gag order like the sheriff did on his own department under any circumstances speaking with federal state Law Enforcement personnel regarding immigration to me is comical. Reporter but the board approved a plan urging Law Enforcement to not comply with ices plan to notify the feds when certain immigrants are released. My resolution is about sending a clear message in this climate that we in San Francisco are not in the business of enforcing emigration law. Reporter mayor ed lee voiced his broad support for sanctuary city but says the sheriffs gag order has to go. We have to get a sheriff who knows what he or she is doing. Then we can have a conversation about how to converse with our federal partners. Reporter they are not going to be changing city policy toward immigration any time soon. It was a sunday and the conditions were hot, dry, and windy. A fire that had not been extinguished the day before had reignited. Fire crews from across the bay area and beyond responded. At times they were overwhelmed unable to stop the flames from consumes one home after another. When the fire storm was under control, 25 people were dead. 150 others were injured and some 3,000 homes were gone. Officer randolph holder was shot in the head while chasing a suspect on foot. The Department Says holder was 33 years old and unmarried. A suspect was caught. He had a gunshot wound to the leg. He is expected to be released from the hospital tomorrow and taken into custody. Officer holder was the fourth new York City Police officer to be killed in the line of duty in the past 11 months. The number of people who got sick after eating at a restaurant in san jose has gone up to 80 and 12 of them are hospitalized in intensive care. A shigella out break is to blame and Azenith Smith says many people have it and dont know it. She wanted to try something different. Reporter their 31yearold daughter ate a shrimp cocktail at the san juan restaurant friday. She was rushed to the hospital 12 hours late. She had the chills and diarrhea wouldnt stop. Reporter their daughter one of 80 people infected with shigella. Symptoms include diarrhea, fever, abdominal pain, and irregular bowl movements that can last for months. Those infected have been linked to this one location and ate a variety of food friday or saturday. An investigation is underway to determine the source. The most important preventive measure if you have shigella, hand washing. We saw they had a major violation last month for cooling. Reporter according to the countys dine out website, employee food handler cards were not also ready available when the restaurant was last inspected in august resulting in 89 out of 100 passing grade. Those violations have been corrected. Another location received a 49 score last month. Among the issues there, food not in good condition. As for the ingrams. She wont go back to that restaurant for sure. Right now at this point, im glad the restaurant is closed down. And, i hope that whatever issue they have, that it gets dealt with. Reporter county health Officials Say this location will likely be closed for several days. Repeated attempts to contact the owner of this chain restaurant were unsuccessful. In san jose, im Azenith Smith, ktvu fox 2 news. Shell oil was slapped with a 200,000 fine for adonis air quality violations at its martinez refinery. The violations occurred in 2013. They included discharges of nitrogen oxide and carbon monoxide. Officials say shell has now corrected all of the problems. A night from a bay area diverted because of a passenger out of control. What other passengers saw when the plane made an unscheduled stop. In the city of richmond, they may be looking for a new top cop as chris magnus is up for a job in tucson. Two Bay Area Police chiefs are finalists for the job of police chief in tucson, arizona. That is surprising people in one of those two cities. Larry esquivel had already revealed he was stepping down. But chris magnus was unexpected. Paul chambers is in richmond tonight with what he has been able to learn about this. Reporter chief magnus has been the top cop here in richmond nearly a decade. But know the word is out he is looking elsewhere. Chief dont go. Reporter it was at the City Council Meeting we caught up with the vice mayor to hear what he thought about chief magnus leaving the city. He is a human being who has to look out for his career. Reporter this was news that some were not expecting. The initial response was shock, right . But im not surprised. That is because simply, that is the price you pay for being good at what you do. Reporter Community Leaders like reverend andre says magnus has made huge strides in richmond. Property and Violent Crimes have had their lowest in decades. 11 homicides compared to the nearly 50 in 2008 and 2009. This has all happened at the time we are seeing a Better Community relationships with police. Reporter but it is that relationship with the community that came into question by some. Last year, this was chris Magnus Holding a black lives malter sign. Some in the department were not happy with this expression from their leader but others say this is just what the community needed. He has done great work in the city. Reporter the chief released this statement to me saying im really happy and privileged to serve as richmonds chief. Tucson seems like a good new challenge. Either place, my goal is to focus on strong engagement between the police and the community. This is not a done deal. The chief is just one of four people in the runnings. The current chief in tucsons job is up in december so they would like to have something in place by this time. Do you get the sense this was just an opportunity that happened to pop up and so he applied or did you get the sense if he doesnt get this job he is still going to leave richmond . Reporter that is a good question. I never got a chance to talk to the chief in length. I got that statement from him. Im not sure if this is just an opportunity or something he is actively researching. People were surprised it was happening so it is hard to know which way it will goes. All right paul chambers. We also heard from the San Jose Police chief Larry Esquivel about why he would like the job in tucson. He considers it a new challenge to help a department who is facing some of the same problems he has already dealt with in san jose. You know, we have gone through some difficult times here. Bum tear issues. Staffing issues. Budgetary issues. They have budgetary and staffing issues there as well. And i think a lot of the experience and exposure i have had here, i can think would be a benefit to them. Chief esquivel also mentioned that some membersover his family may be moving in that area. He had previously announced plans to retire from the San Jose Department this coming january. Former virginia senator jim webb has pulled out of the race for the president ial nomination. But he says he may run as an independent. Many of his views are incompatible with those of Democratic Party leaders and he is concerned about the power structure of the Democratic Party. 69yearold webb says he will explore an independent bid. He complained last week that he didnt get enough questions and his candidacy was barely a blip in the polls. Two things this week could have an impact. An investigation is underway after three people were found dead in a rule part of calaveras county. Deputies received reports of gunfire in the town of railroad flat, north of angels camp. The bodies were then found in a field on private property. Gunfire is not unusual in that area, but it was the time of day they heard hate raised their suspicions. 6 00 in the morning. There is no word yet on the names of the victims. Deputies are questioning a person of interest and they say there is no risk to the public. The Contra Costa County coroner is asking for help in locateing the family of a man who was found dead along an east bay freeway. The body of 64yearold Michael Reed Smith was found last month along the shoulder of i80 in richmond. The Sheriffs Office says his next of kin have not been found. Reed is described as six feet tall, 132 pounds with gray hair and brown eyes. Searchers in Southern California have found a body inside a car buried by mud in palmdale. It is the first confirmed fatality from last weeks mud slide. Meantime, a search near tehachapi was called off because it was too dangerous. Lamar odom is now in cedar sinai hospital in los angeles. His family says he is breathing on his own. Has spoken a few words and taken a few steps. But tmz says he is still dealing with kidney failure. But Consumer Reports says overall, the model s is still the best performing car it has ever reviewed. Other results from the survey, Consumer Reports found Multimedia Systems and new transmissions were a significant source of problems across many auto makers. They gave their top reliability rating to lexus which earned top marks for all seven vehicle lines tested. Consumer reports gave kudos to hyundai and kia for the first time. Kia beat honda bay wide margin. A shortage of fresh food at californias food banks is being blamed on the drought. Rob roth visited one center that says there is a shrinking supply of fresh fruits and vegetables.
