first lady greeted the pope as he arrived. >> he is the leader of the roman catholic church with an estimated 69 million followers right here in the united states. good evening everyone i'm heather holmes. >> and i'm frank somerville. pope francis has a packed schedule in the united states . they say he immediately rolled down the windows so that those in the crowd could easily see him. the pope is in the united states until sunday. we begin his historic visit with rich edson. >> good evening from poverty to climate change and religious freedom, pope francis is bringing his message to dc and the united states. he's only been here a few hours though he's already seen large crowd. he's here. for the first time pope francis is in the united states. landing this afternoon at joint base andrus near washington, d.c. where the president greeted him. >> he's very happy to be here now. and he received a very good welcome from the president and the presidential family. >> reporter: now after the welcome, 18 addresses in total including the first by a pope to congress. and with such a historic high profile visit, tight security. >> new york will have thousands of officers assigned just like philadelphia and washington will. you hope that presence will curtail any sort of action. >> reporter: the the president of homeland security is leading efforts for the pope's visit. it involves several other units including the federal bureau of investigation. the pope's security has also accompanied him to the united states. including the swiss guards, the 500-year-old a army who had taken oath to protect the pontiff. the meetings begin tomorrow when pope francis arrives in the white house to meet with president obama. he will address congress on thursday. the un in new york city on friday. go to philadelphia for the weekend and return to rome sunday evening. back to you. >> rich with all that security that you talked about, why is it that they would allow the pope to get in a fiat then roll down the window. couldn't that possibly be a security threat? >> reporter: of course; that's always the balance that security forces face with someone like the pope who likes to talk to folks. he will have a jeep wrangler for the majority of his trip. but it was the pope who wanted to climb into a fiat instead of a limo. san francisco arch bishop is among bishops. he says pope francis has a unique ability to make people feel at ease. >> he has this amazing ability to accomplish a personal connection with people. cut through filters, cut through media, cut through spin. >> reporter: tara moriarty also in washington for the pope's visit. she fills us in on tomorrow's agenda including the first ever canonization on u.s. soil. >> reporter: the pope will be on the go when he meets with the president at the white house and 20,000 fans will be gathering to see him on the streets. he will be in his pope mobile. at 10:15 we have the canonization by serra. serra founded nine missions including mission dolores in san francisco. thursday he will be the first pope to address the joint session of congress. instead of eating lunch with lawmakers francis chose to eat with homeless people in washington, d.c. his next stop will be new york city then philadelphia. tara moriarty, ktvu news. thousands of people are expected to gather in carmel as the pope names father serra a saint. at 1:00 p.m. our time there will be a live broadcast of the pope's canonization mass and it will be shown on a jumbotron. but protesters will also be attending. >> i think it's important to understand that being declared saint is. it doesn't mean that someone was perfect. we know the intention was there for blessed serra to evangelize, to bless. but i'm sure there were mistakes. and for that, he apologizes. >> reporter: father serra founded nine of the 21 california missions. and stay with ktvu. we'll be this carmel and have coverage from washington, d.c. the one souvenir that is selling fast. new at 10:00 tonight, caltrans says a woman was slightly injured between a train and car at san m ateo this evening. a car was hit by northbound caltrain on south railroad avenue. the woman in the car was taken to sanford medical center. about an hour after the accident, trains were moving in both direction again but with delays of 30 to 35 minutes. and the council were debating whether limiting alcohol sales at levi's stadium is a good idea after several incidents. >> reporter: this is a controversial issue and so far appears the city council is split 50/50 if controlling excessive drinking at football games is the answer. the super bowl will be at levi's stadium and they're getting a bad wrap after the beating of a fan. up for debate banning alcohol sales after halftime. limiting tailgating hours or not allowing intoxicated fans to enter the stadium. >> yes, i think it's totally unacceptable behavior. st. clair is the patron of our community. st. clair and st. francis, and we're having one of st. francis' followers. they try to teach us about a different way of life and i just really don't like to see people beating up on each other. i just don't think that kind of use of alcohol is healthy. >> reporter: tonight the santa clara police chief says his officers made roughly 25 arrests per game. the majority of them involving intoxicated fans. he feels strongly that cutting alcohol isn't the answer but enforcing a zero tolerance policy is. council member dominic caserta agrees. caserta says the three fans were arrested within 24 hours and were charged with assault. assault that left a fan with a concussion. >> this represents less than .1% that visit the stadium. i'm not willing to take a knee jerk reaction over one isolated incident. >> reporter: i'm told the city council must first consult with a city attorney. as for the 49ers they had nothing to share about this topic at this time. heather. >> do we know if this halftime beer ban exists at any other stadium in. >> reporter: yes, i'm told it does exist at met stadium in new york. i'm also told there's some sort of controlling booze at the san diego chargers stadium. whether or not they've been successful i don't know but there are other stadiums that implement this. >> we'll yet to see what happens at levi's stadium. calfire says a thorough survey show that is 2,000 structures have burned including 1,200 homes. containment is now up to 79%. the lake county sheriff department says there's still no sign of two men missing since the start of the valley fire. they're 66-year-old robert fletcher and 61-year-old robert litchman. both of their homes were destroyed by the fire. but a search of their property by cadaver dogs showed up nothing. the people still at the evacuation center will have to find a new place to move. such as fletcher, she was homeless before, turns out they lost their vehicle which had all of their possessions. >> we're going to go to livermore valley because we have an animal. we're going to go there and start on the resources again there. >> reporter: for others there's not many rentals available in lake county. some people are living in trailers donated by friends. one realtor figured it could take one year or two for people to rebuild. on wall street a wave of selling sent stocks selling today. the dow lost 179 points. the nasdaq was down 72 and the s & p dropped 24. a slump commodity prices added to concerns of the global economy. an suv slams into a gym and traveled 60 feet into a building. the accident that killed a schaaf tomorrow. the building has been undergoing about $40 million worth of renovations. the san francisco business times reports that uber will likely take up the entire building. this is a departure for uber that is located in san francisco. six members of the board of supervisors announced today that they support a measure allowing bicyclists to roll through stop signs. amber lee is live with the lobbyists that say it carries a benefit. >> reporter: tonight evening commute at steiner saw plenty of bicyclists peddling through stop signs and admitting to it. >> that's what all the other bicyclists do any way so why not legalizing any way. cyclists are still required to yield to pedestrians and when it comes to traffic, the right of way still applies. >> cyclists who don't yield will still have to be held accountable for behavior that is not safe on our streets. >> reporter: this 36-year-old single mother of two was struck by a speeding cyclist this morning at golden gate park. virginia melter was taken to the hospital where she was treated for her injuries. >> in pain, i'm in pain. i can't walk properly, i can't move my shoulder. my head hurts like crazy. >> reporter: though the cyclist who struck her wasn't going through a stop sign, melcher opposing the bike yield proposal. >> look at me right now, no they can't do that. >> reporter: why do you think that's a bad idea. >> even though they have laws right now they don't respect them. imagine when they don't have that. it's going to be crazy. >> reporter: and police say melcher is far from being alone. >> just this district alone, this is just for the park district. >> reporter: captain john sanford showed us this binder filled with complaints about bicyclists compiled in the six months he's worked in the district. >> by giving cyclists the opportunity to just roll through stop signs can be very dangerous. >> reporter: captain sanford says officers will continue to follow the law. >> it depends on what they did. whether you just blast through an intersection. >> reporter: if approved it could be in effect the beginning of next year. what is not known is whether the mayor will veto it. >> reporter: it strikes me that this law goes against state law which observes that bicyclists must follow the same laws as motorists. >> they hope it will stop police from singling out bicyclists for enforcement. >> we'll have to see what happens at the november meeting, thank you. that teenager from texas who was put in handcuffs and detained when he brought a clock to school visited google this week. he was invited to attend the annual youth science fair hosted by google. you will recall police detained him, put him in handcuffs at a school near dallas last week after his teacher thought his homemade clock was an explosive device. ahmed has since been pulled out of that school and will soon start at a new school, according to his family. a bronze bell rings marking pope francis's arrival. it rang for five minutes. the historic bell is in moraga. ktvu's christina rendon spoke to parishioners who are clearly excited about the visit. >> and i welcomed him with open armed. >> reporter: at the cathedral of christ people bowed their head in prayer a sacred time when they asked parishioners to pray for the pope. >> i think the pope will benefit from our prayers to bless him on his visit to the united states. >> reporter: catholics are excited. >> he's going to do a canonization here in the united states for the first time ever. >> you just want to make him part of your family and he makes you feel like you're part of his family. >> reporter: a commemorative candle is selling fast. >> we didn't carry t-shirts or things like that. just a candle. >> in his humility, in his friendship with the poor. >> reporter: parishioners believe anyone catholic or not can identify with pope francis because he embraces jesus's true message to love one another. a message they hope is evident during his historic visit. >> i hope that more families come to our church and our church reaches out to those families. >> reporter: they're tracking a significant cool down around here. the marine layer has significantly pulled up. temperatures in the inland valleys 15, 20, 25 degrees cooler than they were yesterday. you noticed it. it really felt like fall out there. tomorrow the lawrence livermore national lab was killed today -- national lab is in mourning tonight. >> reporter: around 6:30 a.m. a mercedes suv crashed through the front win -- window of the lifestyle sx gym. >> it does hit close to home. i never experienced anything like this. >> reporter: six people were injured and kathie baker of livermore was killed. >> terrible. it's a terrible shock. i mean you can't prepare for something as tragic as this. i mean, it's just something that happens in the blink of an eye. and the rest of us are left to deal with it. so it's going to be a hard road. >> reporter: one of bakers friend talked to us without showing his face. >> kathie was a good person. she came to the lab about 15 years ago. >> reporter: the crash happen when the 80-year-old driver was just trying to park her suv and she suffered what is called pedal confusion. >> when you think your foot is on the brake and you push it harder to stop, that's probably what happened. >> because then it goes 70 feet into the building. >> correct. >> reporter: baker was chief financial expert. baker's friend also works at the lab. >> very well liked by the people that work for her above and below. that's a rare commodity when you like someone who's liked from all sides. >> reporter: we spoke to the family of the driver and they say she is devastated about what happened. police tell us that she was told not to drive and that her license will be suspended. lawrence livermore lab released a statement late this afternoon that said today we grieve the loss of one of our own. cfo kathie baker killed in a tragic police accident. thank you for your condolences. a man opened fire in an alley off of highway 238 in san leandro. he was a suspect in a drive by shooting in oakland that injured one person and an attempted carjacking. a chase followed and the man drove the wrong way on the freeway then ditched the car. he fired on the chp officer but the bullet hit a passing car instead. the man had a long violent criminal history. a santa clara judge today admonished both sides in a lawsuit involving the behavior of an autistic boy. the two families used to live on arlington court in sunny vale. one family sued the other saying that the autistic boy was so aggressive he was a public nuisance. they said he slapped and kicked other children and bit an adult. but the judge thought the case was better resolved outside of court and advised mediation which both sides agreed to. the theft at a bay area school that has robbed students of a beloved program. becoming a lawyer without going to in theory it can go all the way up to the california supreme court. >> he passed the bar exam but the state bar of california still won't let him in. >> this is a fascinating story. eric rasmussen has been following up on steven decaprio. this isn't the first fight that could put this man on the spotlight. >> reporter: it is not, he went into a house and became the legal owner without ever paying mortgage. now he is trying to become a lawyer and is one of the few people being blocked on moral grounds. stephen decaprio, knows what it's like to come out on both sides of the law. >> what we're standing on here was kind of a big hole. >> reporter: dicaprio first showed ktvu around this home. he broke into the abandoned property and started paying the property taxes eventually making him the legal owner through an old law called adverse possession. >> it has taken us years to get to this point. >> reporter: once homeless, dicaprio became an activist for housing rights then squatters. then got career advice from a friend. >> you're in and out of court, why not study for the bar and become an attorney. >> reporter: and that's exactly what he did. >> i took the bar exam and i failed. then i took it again and i got the notice that i passed it. >> reporter: it must have felt downhill from then. >> that's what i thought that's the big hurdle. >> reporter: but he received a letter from the bar saying they denied his application. >> they're concerned with the organizing work i've done. the housing advocacy. the fact that i use adverse possession. >> reporter: the court sited another case when dicaprio was arrested for trying to occupy this home in 2004 and was convicted of misdemeanor trespassing. ktvu asked to speak with somebody from the state bar of california head quartered in this building. the bar board refused to go on camera but sent us this statement. a misdemeanor does not mean that you cannot be a lawyer. out of the more than 8,000 people attempting to become attorneys in california last year just 62 came out on the wrong side of the bar's moral character evaluation. >> my approach to them is your kidding right. >> reporter: john segel agreed to help dicaprio set up an appeal. >> i think the board would find that stephen's activities fall well within the boundaries of people who have been admitted and who became successful lawyers. >> reporter: segel should know, the state bar refused to admit him after his days of demonstrating in berkeley in the late 60s. >> segel says he's one of only three lawyers in history to take his appeal to the california supreme court and win. he says dicaprio's case isn't all that different. >> i think this case is 100% about stephen's political activity. >> reporter: while he works on his appeal, dicaprio continues his housing activism and has microfarms like this one. another fight he says he should be legally take on as a card carrying attorney. >> this is where i belong, this is my home. >> reporter: i just checked back with dicaprio and segel today they said they're waiting on the state bar to schedule the hearing on the merits of dicaprio's appeal. >> this is so interesting. the guy passes a bar exam but never went to lawsuit. >> there's a way to do that. he went through a program and he wonders if that had an effect on their decision. he's waiting to see. fake signs were removed today. it certainly looked real. the signs were posted right under real signs. whoever is responsible could face a fine for putting up a fraudulent sign. city officials say the money will go toward restoring 14 firefighter positions and other efforts to minimize station brown outs. the funding comes through the federal emergency management agency program that is called safer or staffing for adequate fire response. this is the third such grant san jose has received since 2010 for a combined total of almost $27 million. actor sean penn accusing the creator of empire of defamation. the [snoring.] take the roar out of snore. yet another innovation only at a sleep number store. a shut down of the federal government is looming in eight days unless democrats and republicans can work out an agreement. the senate has a vote set for thursday on a decision to keep the government operating. but it also blocks funding for planned parenthood for a year. that organization is right in the middle of political debate because of videos on fetal tissue being used for research. >> this dealing with the horrific activity depicted in these planned parenthood videos. you would think the first goal would be to keep our government running. and yet now we're still facing a republican shutdown. democrats are expected to block the measure that includes defunding planned parenthood. today democrats blocked a bill banning most late term abortions. hillary clinton took a stand today on the controversial keystone pipeline project. she says she opposing it because it distracts on work on climate change. >> unfortunately on my perspective one that interferes with our ability to move forward to deal with all the other issues therefor i oppose it. >> reporter: for months now clinton had put off a decision on keystone. the project has been on hold for years under president obama. it is designed to move canadian oil from alberta to the gulf of mexico. the head of volkswagen is apologizing. volkswagen admits more than 7 million of their cars had technology that allowed the car to cheat emissions test. the brand is now tarnished, says the ceo. >> many millions of people across the world trust our brand. i am sorry we betrayed the trust. >> the company is being investigated in the united states and several other countries and analysts say it could cost the ceo his job. actor sean penn is suing empire creator lou daniels over a comment that suggested penn was a wife beater. daniels compared him to empire star terrance howard during an interview. penn says he will no longer stand for this reckless behavior. turing pharmaceutical raised the cost of daraprim. the company jacked up the price to $750 a pill. the ceo defended the move saying the money is needed to make a better drug. the company has not said how much the price of that drug is coming down. another warm up in our weather. our chief meteorologist bill martin is back with the forecast for the first few days of fall. >> an east oakland charter school hit by thieves. we'll tell you how the theft has harmed the program that helped those in need. new at 10:00, thieves hit a charter school and put in jeopardy a beloved program that helps students help the community. the bike club at east bay academy lost a dozen bikes or so after the break-in. ken, this burglarly took an awful lot of effort. >> reporter: the parking lot here is typically chained off at night. the school itself is surrounded on three sides by heavy woods so it's not easy to get in here and it's not easy to get out with what was such a large hall. at east bay invasion academy the students learned math, science, they are creative. and they learn to be problem solvers. >> the spokes of the wheel, this is what basically holds the wheel together. >> reporter: one problem learning how to fix a bicycle. >> basically in bike club we would fix these kind of bikes. >> reporter: sixth grader jalen mitchell and artimus edison were two students in the bike club. >> really cool. it's like being in school but not because it's really fun. >> reporter: but the bike club has another problem to solve. >> this is our unit and you can tell they broke off the lock to it. >> reporter: one or likely more people broke into this once locked shipping container on the school's playground and stole more than a dozen bikes. it's a problem artimus didn't know she had. >> no i didn't know that. when were they stolen? >> reporter: the bikes were taken over the weekend not only was the lock on the shipping container busted but the chains on two gates were cut. the bikes were identical to this one. a yellow citizen breezier's worth $500. and each one has the words lockheed martin below the handlebar. they were once owned by that company. the thieves also took 10 bike tool boxes worth about $150 each. >> they were locked up but we thought they would be totally fine. >> reporter: bike club instructor says the school year had just started and are now scrambling to repair the bike program. >> i just don't like the fact that somebody stole it. that was very rude. >> reporter: it is not just the students who are hurt. once repaired the bikes were to be donated to the community. >> why would you take it when you can just ask us because after we finish fixing them, we give them to people in need. >> reporter: these bikes were donated to the school just a few weeks ago. so these students could work on them and return the favor by giving them back to the community. the teacher says he cares less about punishment and would like to have the bikes back so they could continue their program through the school year. in oakland, ken pritchett, ktvu channel 2 news. tomorrow's going to end up being the first day of fall. but it felt like first day of fall today. temperatures dropped off a good 20 something degrees in the inland bay valleys. these were the numbers from today. if you were with us yesterday and certainly on sunday and saturday you saw temperatures in these inland bay valleys were in the low 100s. 103, 104 area. temperatures today a good 20 or 25-degree cooler. there's low clouds out there. not picking up here because the marine layer stretched out enou that it's not real dense. you're not seeing the low clouds. there's plenty of low clouds and they'll be moving into the neighborhood tomorrow morning. that will keep temperatures where they were today but slightly warmer. today was the big cool down. very active pacific. we've been talking about that. we have fog along the coast. we'll see plenty of fog probably getting into some of the inland bay valleys tonight but a quick burn off tomorrow. so more sunshine tomorrow, right. and temperatures a few degrees warmer. that's really the big change here. a little more sunshine, a little more warmth. 32-mile an hour sustained winds at fairfield. gusting to 38. that's pretty windy almost 40- mile an hour out there in the delta. cool air is being ushered into the sacramento valley on those winds. sfo is going 9 miles per hour. northwest winds tomorrow is going to be a mild day. certainly warmer than today. but this low is going to mitigate any real warming until we get toward the end of this week. the low is going to hang out and that's the same low. it's sitting there in the winter months november, december, january. that's the one that's going to bring us a ton of rain if it goes down. right now it's just enough to cool us down. you see cloud cover. let's go into tomorrow night. i wanted to show you this. watch between, it's 11:00 tomorrow night and watch all the clouds. subtropical moisture streams through. till tomorrow, till thursday afternoon. thursday is going to be a partly cloudy day. fog comes back as we head into bay area friday. and temperatures warming. it gets back and it's pinching down a little bit. what it means is it's going to be warming up. it has a tendency, you can see that and you can see the warming valleys will be warmer. 85 in brentwood, nice looking day, air quality is fine. tomorrow starts sort of that warm up and you will see that in the seven day forecast. it's not a massive warm up but out of the mid- and upper 80s out into the upper 90s. by saturday and sunday, temperatures just sort of moderating. >> the bottom line is we can sleep tonight because our house will be cool. >> thanks bill. giants versus padres could it put the former world champs in contention?
