continues over the arrest of ray mcdonald. janine de la vega obtained dispatch recordings that helped shed new light on what happened. janine. >> reporter: we are here in front of levi stadium. everyone is wondering if ray mcdonald is going to play on sunday's game against the dallas cowboys. the 49ers are not saying what will happen to them but fans that are here for stadium tour say they are still faithful to the team but disappointed to hear about mcdonald's arrest. our cameras were there yesterday when mcdonald bailed out of the county jail in san jose after being arrested for domestic violence. he was holding a dead cell phone and trying to hail a cab. police were called to the 29- year-old's home just before 3:00 sunday morning on a report of domestic violence. there was reportedly a party going on there. as you listen thousands recording of police radio traffic, you can hear the dispatcher relay information to officers about the alleged assault. >> >> reporter: the sacramento bee is recording mcdouble's fiance showed officers bruises on her necks and arms. other 49er players were at the home during the understand accident. this is what mcdonald told our crew. >> you could come out. everybody knows the kind of person i am. >> what kind of person are you? >> i'm a good hearted person. >> reporter: the 49ers general manager trent bulky issued a statement saying quote the 49erss or is aware of the recent report regarding ray mcdonald and we take such matters seriously. sports analyst says mcdonalds arrests were test new policy on players conduct when it comes to domestic violence. last week the commissioner roger goodell implemented a six- game suspension far first offense and a banishment for a second offense. here's who one niners fan told us. >> it's not a good image. it's not good for people who look up to the players as role models. and as fans. it's very disappointing to just hear of another arrest. especially days after the nfl came out with a new role about domestic violence. >> reporter: the team is off today and we are still waiting to hear from coach jim harbaugh on what he has to say about this matter. mcdonald's court hearing is set for september 15th. reporting live janine de la vega ktvu ktvu channel 2 news. >> thanks janine. new details from an nfl tracking data base. ray mcdonald was the tenth arrest since the beginning of 2012. others included line backer aldin smith who was suspended for the first nine games of the season. in march-quarterback chris capitol very was arrested on suspicion of hit and run. they have also all had run ins with the law. san francisco police are investigating the shooting that may have been sparked by road rage between a driver and a man crossing the street. it happened on golden gate avenue around 2:00 in the afternoon. investigators believe the two got in an argument after the driver nearly hit the man crossing the street. the argument escalated and the driver began shooting before driving away. the injured man is in critical condition and police are still searching for the shooter. a search is under way this afternoon for the hit and run driver that hit and struck and killed a woman. alex savidge spoke with the woman's family and has more on what they are saying about the victim and the driver that hit her. >> reporter: the violence collision happened along willow pass road just before 7:00 last night. police say a pickup jumped the curb here and plowed into a woman who was pushing a cart along the sidewalk. the victim has been identified as 50-year-old michelle braz. >> she loved all living beings. >> this morning her husband and mother visited the memorial that was set up at the crash site. this is where braz was left to die last night as the driver that hit her sped off. >> i just spray this person is caught and justice is served. for a perp that does something like this and runs doesn't deserve to be out in public. he's a danger to everyone. >> reporter: braz was married with one daughter. she wasn't working but was well known in the neighborhood because she walked the streets collecting cans and bottles to recycle. her mother is heartbroken. hoping police can track down the driver. >> i hope they catch him. i really hope they catch him and do exactly to him what he did to her. kill him. >> reporter: the truck involved in this collision also took out a light pole tracking it for a couple of blocks. police say that pickup was a silver late model chevy. investigators are continuing to look for witnesses and if anybody knows anything about this deadly hit and run crash, they should put in a call to pittsburg police. alex savidge ktvu channel 2 news. police in santa rosa are investigating the the shooting at a motel. it happened just before 8:00 last night at the bagabon inn. when officers arrived they found a 21-year-old man who had been fatally shot inside of a room. one man who has been staying at that hotel for a week says he saw a red car leaving the scene. >> car was circling the building here a little bit. all of a sudden it pulled up real fast. busted up this room and ran in there and popped the guy with a few shots. jumped in the car and took off. >> reporter: until arrests have been made. anyone with information about the shooting is being asked to contact santa rosa police. oakland police are investigating the city's 50th homicide of the year after a deadly shot shooting. that happened about 1:00 yesterday afternoon near interstate # 80. one person was killed but have not released information about the age or gender of the victim. however, a woman says the victim was her 22-year-old son hector arube. he may have been breaking into a car when he was shot by a security guard but police have not confirmed that report. [speaking in foreign language] >> it doesn't matter what he was doing. they don't have the right to kill him. >> until arrests have been -- no arrests have been made. the red cross has set up an emergency assistant center for earthquake victims today. that is at the napa valley marriott. many of the people most severely effected by the quake are still without basic service like power, water and gas. others are just getting those services back. ktvu news spoke to some of the people today. they have been living in quake damaged homes without much access to information. and they are worried about another earthquake. >> and i haven't been able to sleep. i've been sleeping by the front door on the couch. >> lots of after shocks. my girls have been scared to death. they don't want to stay in the apartment anymore. >> we still want to sleep with our ma'am. so we've been sleeping with our mom this whole time. >> people are meeting individually with caseworkers that are handing out food and other necessities. the red cross says it has received generous donations to help earthquake victims financially. the mayor of napa says the community spirit is helping his city rebuild. there is still a lot of visible damage 2349 downtown area and many businesses are not allowed to reopen. but some are helping each other out. in one case the owners of a mens clothing store invited the woman owner of a woman's clothing store to share her space. >> i knew i had friends to do it. barb was a good friend. >> this is a great opportunity to have a clearness sale. >> reporter: the mayor adds having tourists and locals supporting local businesses will help keep the city strong. the shaking continues just after 9:00 this morning. there was a 3.5 magnitude earthquake in gilroy. that hit about 9:10. several ktvu viewers reported feeling that shaking but so far there have been no reports of any major damage. president obama touched down in wisconsin on his way to speak at the annual labor fest in milwaukee. mr. obama pointed out some accomplishments of the labor movement. >> a 40 hour workweek. over time bay. a minimum wage. weekends like this one. all that didn't happen by accident. it happened because america's workers organized for it. fought for it. >> the president also used the occasion to highlight improvements in the economy and push for a higher federal minimum wage to stimulate hiring. that is proposed by republicans that says a higher minimum wage will lead to layoffs. and says they need to companies more tax breaks. biden addressed the crowd at the annual labor day celebration there. the event recognizes the achievements of the states working men and women and the union. in his remarks he said american workers owe a lot to union workers and credited unions with building america's middle class. here in the bay area local law enforcement agencies are cracking down on drunk drivers. the labor day holiday enforcement will be in place at 11:59 tonight. several arrest for dui have already been made. last year the chp made more than 1200dui arrests and more than 49 people were killed on crashes. patrols targeted sonoma county roads with a history of speed related crashes. one driver was clocked going 88 miles an hour. hundreds of homes under mandatory evacuation orders and hundred more threatened by a wild fire that continues to grow. the latest on an every port to put out fires burping in the northern part of our state. >> the fog is laboring. working hard to keep us cool on this hot labor day. >> and iraq pleads to the u.n. with help in dealing with the isis militants. president obama remains under fire for his stance at the u.s. has no strategy for dealing with isis militants in iraq and syria. iraq is calling for the united nations to take action. >> reporter: iraq is now asking the u.n. human rights council to look into suspected crimes against civilians at the hands of isis militants. the 47 nation body taking up the has been trying to get the word out with electronic signs. adult fairs are $2.25. instead of $2. muni monthly passes up $2 from $66 to $68. and if you want that monthly pass that includes part and muni will cost you $80. right now the northbound lanes of 280 are closed from highway 101 at that interchange to king street. they have been closed since thursday and expected to reopen at 5:00 a.m. tomorrow morning. large sections of the road are being removed in order to install new hinges. those will allow the road to expand and contract during an earthquake. more than 2000 firefighters are working to put out a series of fires that continues to grow in the national forest. as many as 11 helicopters are working to contain the happy camp complex fire that is burning in cyst cue county. >> if the resident does not the want to leave, then it's up to them at this time and we'll let them know that the fire is coming that it's too dangerous for us to be in this situation and we as firefighters have to leave top protect ourselves. >> it's so steep and rugged, it's not safe to put crews in there. we can put crews in there and they can work. but if something goes wrong, it's very difficult to get the injured person out. >> the fire has burned nearly 64,000 acres and only 15% contained since it broke out three weeks ago it was sparked by lightning back on august 11th. firefighters are hoping to have that fire contained by september 8th. there are also reports of smoke from the fire in knapp park sonoma, lake and sonoma counties. a little bit of fog trying to hold on to parts of the san mateo, santa cruz coast. not much of a breeze has died off this morning. picking up a tiny bit. there is some of that fog. made it to half-moon bay. after that it said that is as far as we are going. but it's not stopping temperatures from warming up quick. we do have a system that is developing up in northwest canada. that is about to make its move south. as it does that will tap into what was at one time a category five hurricane marie. but the mere fact they will come together and move toward us will increase the fog, give us a big cool down starting tomorrow. more so as we go into wednesday. that is not in walnut creek. livermore is 88. concord 84. 87 fairfield. 81 san jose 70s oakland. everyone is warming up here pretty nice. above average temps. there is a little hipt of a breeze. fairfield is five. very calm out in port chicago. a little offshore for some. novato showing a little easterly breeze. 65 warm degrees. point rays came down two degrees. but even with these 60s it's on the mild side. on their way to 99-100-degrees. it's a cooker down in oklahoma city. watch the thunderstorms pop up like popcorn. the main line going through the great lakes down to memphis it looks like things are much, much calmer here today. they had a wild thunderstorm complex there yesterday. you can see that fog again santa cruz down to monterey. it looks like it's peeling off most of the coast. the fog and low clouds are rearing to go. they will leave a little punch and that will be coming in tonight. warm today. warm labor day weekend to hot. cooling trend begins tuesday. warm to hot today unless you are right by the waters edge. mid oils for some. some coastal fog but it's only patchy at best. we find 70s and 80s to 90s to almost 100. brentwood 98. concord 94. we will go 80 east to 90 to the santa clara valley. 60s and 70s and 80s to near 90 on the peninsula. today is the hottest day of the week. we start a little cooling trend tomorrow and even more so a lot of drizzle with clouds coming in wednesday, thursday, friday, slight bump up on the weekend but it looks like september here. expect for the first. it will be a little bit on the cool icloud and the way the victims are responding. for an investigation is under way after nude photos surfaced by hackers accessing apples icloud storage system. >> reporter: hacked celebrities are firing back after a slew of nude photos of jennifer lawrence and other celebrities appeared online sunday night. the photos were leaked on the website and were obtained through a massive online hack. a publicist for lawrence confirmed the authenticity and released a statement saying the hack was a violation of privacy and added the oscar winning actress plans to seek legal action. other celebrities also spoke out including mary elizabeth who lashed out on twitter saying quote for those looking at the photos i took with my husband years ago in the privacy of my home, i hope you feel great about yourself. knowing those photos were deleted long ago i can only imagine the creepy effort that went this. feeling for everyone who got hacked. hackers also posted photos allegedly showing olympic gymnast, singer arrijana grande all though they have all denied the photos were not real. in 2012 a man was sentenced to ten years in prison for hacking into the accounts of scarlet johanson and posting their private pictures online. >> model and actress kate upton is said to be a victim. kraft is recalling thousands of cases of one of its most popular products after concerns about improper storage. that recall effects several versions of kraft american singles pasteurized cheese products. but there were until reports of anyone getting sick. this recall involves more than 7,000 cases of kraft american singles because of a suppliers out of standard storage temperatures. all recalled products has a best used by date of february 20th or 21st of 2015. for more information you
