Tragedy. Sheriffs deputies opened fire on a 13yearold boy, and we have new information now on how all of this happened. Good afternoon, everyone. Were on early today because the world series begins in just a short time. Im frank somerville. The death of 13yearold andy lopez has a lot of people asking questions about the gun, the deputies and the shooting. Just in the past 15 minutes here, investigators updated the investigation. Mike has been in santa rosa all day. What new information do you have for us. Reporter i just walked out of there a couple of minutes ago and here is the new information. We now know two deputies and one patrol car first spotted the teenager. We also know only one of the deputies opened fire multiple times. Folks in the neighborhood tell us they heard at least 7 shots but police said that andy lopez, the 13yearold struck and killed, was hit at least once. Today in that neighborhood, many folks remember in the 13 yearold as a very wellknown young man. Flowers in hand, one at a time. He was a great kid. He wasnt in gangs or drugs or anything like that. I just feel really sad as a parent. Reporter they came to pay their respects and vent their emotions. Shot seven times. I dont think thats right. You have to be on drugs to shoot a 13yearold seven times. Reporter Sonoma County sheriffs departments shot and killed the teenager in a barren field after they say the teen refused to put down what they described as a replica rifle. Immediately after the 13year old identified by the sheriff as andy lopez was shot and killed by the deputies. Santa rosa police is the lead investigative agency. I know deputies told the subject to drop the gun. His statement is he did not drop the gun but instead turned toward him with the gun. Reporter by midafternoon, the crime scene tape was back up as santa rosa detectives searched the field looking for bullets. Friends are remembering andy lopez and reflecting on the shooting that took his life. Were not going to let this one slide. Enough is enough. I mean its time for a change. Reporter lopez lived and attended school not far from where he was shot and killed. The superintendent of his School District told ktvu one of lopezs former teachers described him today as well rounded, a good student. He had no behavior issues and was well liked at school and on his basketball team. Again, to recap, two deputies first responded, one deputy opened fire, killing 13year old andy lopez. Live tonight here in santa rosa, ktvu channel 2 news. The sheriff released a statement, quote, i cant imagine the grief this family is going through. This is a tragedy on many levels for the terrible loss of andy lopez, his family, the familys loved ones, friends, our community and members of the sheriffs office. A busy section of bart tracks was shut down today as investigators reenacted the accident that killed two bart workers. Were in walnut creek with more on the reenactment and what it could tell investigators. Reporter investigators wrapped up their work here 45 minutes ago. We have seen passenger trains running on this section of track again. But as one expert explained to us, doing a reenactment means investigators tried to recreate the same conditions present the day of the accident down to the last detail. News chopper 2 was overhead as a fourcar train left the walnut creek bart station going 75 miles an hour. It traveled the same speed and direction as the train involved in saturdays deadly accident. At 1 50, the time the accident happened, the train passed a spot where the two men were stuck on the track. The train hit the brakes. Next to the track were two life sized mannequins. Todays reenactment is the latest step for the investigation into the deaths of two men checking out this section of track saturday afternoon when they were struck and killed by an oncoming train. The people behind the controls were going through a training exercise. Aviation expert has participated in three ntsb investigations in his career. Even though it was aircraft investigation he said the re enactments are the same. You have to have recreated as best as man kind can an exact duplication of the conditions in which the incident or accident, whatever you phraseology you like to use, occurred. Reporter he says every last detail is taken into account. Having people sitting in the same exact seat, possibly even the same size of individual. They try and recreate it to a t. Reporter while the re enactment took place there were no passenger trains running on this section of track. At the lafayette bart station, hundreds of people shuffled on to buses to get them to walnut creek and Pleasant Hill. Some passengers said it was an inconvenience but one they were willing to endure so they can get some answers. Its important to find out what happened. Its very troubling. Preventing any future accidents like that. Its hard to understand how it actually happened. Reporter and bart had 1015 buses running between the lafayette and Pleasant Hill stations while the track was out of service. A bart spokeswoman says they transferred about 300 passengers every 15 minutes on those buses this afternoon. Live in walnut creek, ktvu channel 2 news. A muni bus may have been lacking a piece of equipment at the time of a fatal bike accident last friday. They concluded from viewing this ktvu footage that the bus did not have whats called an s 1 guard. The bumper is meant to keep pedestrians or cyclists from being run over by the rear tires. Generally speaking, muni buses are equipped with the s1 guards but its not a, quote, regulatory requirement. Police are investigating the death of a man hit by an amtrak train this morning about 9 00 in the area near washington avenue. Amtrak says theres no designated crossing there at the intersection. The man was pushing a shopping cart across the tracks when the train hit him. Authorities have not released the identity of the person killed. Amtrak set up a bus bridge to take passengers around the scene. The threat of an a. C. Transit strike is on hold at least 60 days after a judge issued an order for a cooling off period today. That came during a brief hearing in Alameda County superior court. Governor brown asked for a coolingoff period after he received a report from an Advisory Panel he appointed to look into the dispute. Neither side opposed the coolingoff period. Union members twice rejected contract offers that were endorsed by their negotiators. New developments in the case of a San Francisco park worker charged with fatally running over a mother. Ktvu David Stevenson live in the courtroom. You were in the courtroom and they presented different versions of what happened that day. Reporter yes, and were getting insight into how both sides may present their cases if this goes to trial. 58yearold thomas bronowski is charged with felony vehicular manslaughter and hit and run. Prosecutors say he veered from a paved path in a truck and ran over a woman as she lay sunbathing with her baby in holly park. This afternoon his friends and family packed half of the courtroom for his arraignment. His attorney answered a not guilty apply plea and told the judge the San Francisco father of six swerved to avoid hitting an unleashed dog. His lawyer said he felt a bump but observed a dog running away and later notified his supervisor. The judge granted the defense plea, lowering his bail from 350,000 to 100,000. Its obviously more reasonable than 350,000, and he has a lot of supporters and im sure that they will come together and provide some kind of help for him. Immediately when i heard the charges, i said, oh, my gosh, that was an accident absolutely. Reporter prosecutors describe him as reckless, telling the judge the park worker violated rules by taking a shortcut along the lawn where she lay. The prosecutor said he later told the supervisor, quote, i hit something. Maybe a dog or a child. The right thing to do would have been to come to a stop, not to go over the line, and certainly not to continue to drive over the lawn, and after you feel the bump and you run over something to stop and see what was going on. Reporter prosecutors say he had to be forced to return to the park and allege that he made a move to obey Police Officers once he was there. He will be back in court monday morning for a status hearing. The family of the victim did not appear in court today. Reporting live in San Francisco, David Stevenson, ktvu channel 2 news. The last of the people injured in the Asiana Airlines plane crash last july has now been released from San Francisco General Hospital and transferred to a rehabilitation center. Her release came after 15 weeks in the hospital during which sheunderwent 30 surgeries. The family asked the hospital not to release her name. The woman suffered spinal cord injuries, road burns and intestinal injuries. Santa clara supervisor anowfnsed he is joining the mayors race for 14th. This will be cortesis second bid for the job. Hes now expected to compete against vice mayor madison wynn and three members of the city council. Supervisor says one of his priorities is to get more Police Officers on the payroll. This is the safest big city in america five years ago. I want to help bring it back to that level once again. Its going to take a lot of work and healing and its going to a take a lot of trust. He served as a school board member, a City Council Member and vice mayor before he became a county supervisor. He says that kind of experience makes him uniquely qualified for the job. The 49ers have a lot of faithful fans here in the bay area. But looks like they have some equally loyal fans overseas in england. My favorite moment, i know he gets ridiculed but i thought i really liked that. Favorite player is justin smith. I was on my knees praying that they would get a touchdown, because there was no time left. My favorite player is lot. He was a hero of mine as a kid. I thought he was a superman. My favorite game is the new Orleans Saints game in 2012. I was in the stadium for that. The whole fourth quarter, backwards and forwards. Then alex smith at the goal line was incredible and the whole stadium was shaking that day. My voice didnt recover for two days after that. To actually be in the stadium for that day was incredible. Reporter we are at the new stadium. State inspectors are re examining the circumstances at a death that happened in the summer to see what might have led to the deadly accident. Osha has been here twice, first for the death of an elevator mechanic in june and a week ago when a worker was killed unloading steel bars. Reporter many workers were surprised to hear that cal osha reopened its investigation into the first death of donald white on a ladder in an elevator shaft when he was struck by a counterweight. On october 14th, they informed the Schindler Elevator Company there was no violation in the death but after an internal review, the notice was taken back. Some on questions arose and for that reason yesterday a notice of no violation rescission was sent to schindler and the investigation is now ongoing. Cal osha wont say what questions arose though she said the worker killed was talking with the elevator operator prior to the accident and was aware the elevator was functioning but for some reason didnt get out of the way of the counterweight. A lot of people want to know if it was himself that did it or someone else that hurt him. I contacted the shippedler Elevator Company but did not get a return call. California Law Enforcement officers paid tribute today to canine companions killed in the line of duty. [ bagpipes playing ] a procession of 75 officers and their canine partners all attended the ceremony at the u. C. Davis faithful partner monument. The name of two canines were added to the monument today. One died in the line of duty in Southern California 23 years ago. His handler still misses him and offered a few stories about his dogs amazing talent. Redirecting the dog to search the house where im looking for bad guys, and he constantly would come bang to this throw rug and paw at it. Ultimately i pulled the throw rug and it was a trapdoor. Underneath the trapdoor was my suspect. The other was max from the l. A. County sheriffs department. Canine officers say these dogs provide an Invaluable Service to the community. Their ability to sniff out trouble and their phenomenal sense of loyalty. Santa clara leaders say theyre worried about mosquitos that carry yellow fever getting into their county. They say mosquitos have been discovered near Sanford University about 800 feet from the Santa Clara County boundary.
