>> yes, with a capital y. i appreciate experience. also in my children's schoolteachers. it matters to me. i don't do football. >> we'll talk much more about that later on in the newscast. we begin with political unrest that continues this morning across the country in response to president trump's controversial executive order that temporarily bans people from 7 predominantly muslim countries including iran, iraq, somalia, sudan, syria, libya. and yemen. >> also there's a four month old on allowing refugees from those countries into the u.s. with an indefinite ban from syria. the order has led to lawsuits. more than a dozen democratic attorney generals from states across the country have vowed to appose the president's order. the white house has rejected the notion that this executive order is "a muslim ban". i've also been getting a lot of reaction on twitter. i want to share with viewers personally someone tweeted me saying "safety is a primary concern of america. this is not a ban, just a delay." the tweets coming throughout the weekend using the hash tag "no ban, no wall". one tweet, the people united will never be united and no muslim ban and back east in miami, this is interesting. there's a picture of a young boy saying this boy is in miami and there's intensity in his eyes. children will be impacted by the biggest bully in the united states. back on the west coast other tweets coming in from seattle, the streets there packed over the weekend as this one person tweeted the people are out in full force, and not just in seattle but also the bay area, we have been talking about this since saturday. someone tweeted this from san francisco international. protestors were celebrating no more families detained, people singing "move trump get out of the way" and the hash tag no ban no wall. christian captain has been there all morning and he joins us live with more on this story. anymore protests so far this monday morning? . >> no protests here. you can take a look here. normal levels of activity at the international departures gate here at sfo. we're awaiting word on whether protestors are planning to return here. yesterday was a far different scene. more than a thousand protestors filled the arrival gates shutting down airport operations in the international terminal. also learning more about those detained overnight. board protection confirmed a total of 109 people were detained following the president's executive order. five were held at sfo the airport tweeting all five individuals had been released. activists say they were protesting the order and they say some of those detained were being denied due process and not allowed to speak with attorneys. many said the ban is simply discriminatory. >> it was definitely a registry for countries of certain order origins. it's new but definitely not new. is it an assault to our communities? it's a huge assault to the communities. >> for his part the president issued a statement defending the order saying there are over 40 different countries worldwide that are majority muslim not affected by the order. it's looking very like likely as this will make it to the courts as far as the supreme court. we will stay here at sfo. we will see if another protests develops over the course of the day. could it possibly impact travellers coming in and out of sfo. >> thank you for that report. donations have been pouring into the american civil liberties union after they sued the white house over the travel ban. people shattered the fundraising record over the weekend. they received more than 350,000 online donations saturday and sunday. they totalled (2) 400-0000. 24 million -- -- 24 million dollars. $24 million. joining us this morning on the nine, we welcome julia, the senior staff attorney at aclu of northern california. thank you for being here. can you tell me first about your offices actions in helping people at s fo and perhaps other airports around the country. >> yes, due to the executive order on friday there was absolute chaos for travellers and their families who are waiting for them here in the bay area. there were dozens of local advocates who jumped in including the aclu to support the families and travellers in particular, there was an aclu lawyer at san francisco airport all day on saturday and several of us were coordinating from the office and computers with the families who were calling in and other advocates. we posted our intake line so people -- well, one of the issues it was possible to get information. customs directors wouldn't share information about who was being detained and was it being applied to legal permanent residents and permanent green card holders which it was. so trying to get the information, we relied on the public to loet us know. we posted our number 415-621-248 415-621-2488 and anyone can call that if they're encountering problems with the travel ban and would like assistance. >> over the weekend a judge came out and ruled that there's mod dpi occasions to the president's executive order but it seems it didn't change with border or customs control. what have you heard? >> i would say there was some response but it took a while to come and we'll see how it plays out. we do know people continue to be removed. we have heard from colleagues in los angeles that people were coerced by border patrol to go ahead and withdraw their request for admission. but here in the bay area i know a couple instances where there was a family who had been told before the court order came out that they were on the next flight back to their home koun tru and after the court order came out we advocated our partners and others with the customs and border protection to say you cannot remove this couple. you have to let them stay. there's a court order in place. we could not get a response and this couple ended up staying in detention for over 30 hours. >> there at san francisco international right before we introduced you, we expect a constitutional show down for this. when it comes to protecting our country i have heard the judicial branch would give the president more leeway. when it comes to protecting countries that president trump may indeed get more leeway on the executive order. he's protecting our country. . >> the national security is of upmost importance to everyone including the judicial branch and it's an area where the executive is given more authority but the constitution has to apply. it applies to national security decisions and the president and in this case the executive order definitely violates constitutional rights including our strong and long held resistance to discrimination based on religion as well as the right to equal protection and due process. >> in the few seconds we have left, what is next from the aclu? >> we are continuing to work to make sure the court order is enforced and looking at other ways to challenge president trump's un-constitutional policies and executive orders. >> with the donations coming in, are you surprised? what catch phrases will start to trend. the unusual events now available for people to place money on. the trial of the man accused of killing morgan hill teenager sierra lamar is set to begin today. the key pieces of evidence we expect to come up in trial. opening statements are underway in the trial of antolin garcia-torres accused of killing sierra lamar. >> reporter: good morning, it's been five years since sierra lamar went missing in morgan hill. the trial is underway for the man centered around her death. new video into our newsroom. this is her father walking into the courthouse. he's here to see antolin garcia- torres who is charged with kidnapping and murder of sierra in march of 2012. the 15-year old girl was last seen at that time heading to catch a bus to school. her disappearance sparked numerous searches by numerous of people yet her body was never found. velth inhibitors located her belongings including her cell phone in the pants she was wearing the day she went missing. garcia has been in custody since may of 12 #20 12 after investigators found dna evidence connecting him to her disappearance including her dna in the trunk of his car. without a body or a murder weapon, prosecutors may have a tough road ahead if they hope to get a murder conviction. antolin garcia-torres claims he never met sierra and has pleaded not guilty. it's been reported that defendants attorneys may argue that she may not even be dead dead -- -- defense attorneys. he faces three charges of attempted kidnapping of three other women in 2009. stay tuned to ktvu for the latest. joining us this morning legal analyst, to talk about the case. they don't have a body or murder weapon or witness statements. they have a difficult task to get a conviction. >> i'm not so sure how difficult it is. they don't have a body and they're going in in front of a jury and saying we want you to convict him of murder. we don't have a body or a murder weapon. >> but they have her dna in his trunk. >> that's her dna and they have his dna on her clothing found near the bus stop where she went missing. they enough circumstantial evidence to get him convicted but i will tell you, as soon as the jury hears that he's also charged with two other kidnappings, and his fingerprints were found on a tazer weapon used in one of the kidnaps, this case is over. >> so the defense attorney, how do you approach the trial? >> i heard they're going to try and bring in the father who apparently has trouble. >> steve lamar. >> right, they're going to bring in and say sierra may have run away to get rid of him. will that work? >> i don't think it will work. you have the stew stacey dugard argument. she was missing for 18 years. they thought she was dead and she comes up alive. but what the da will argue is no, this case is much different. you have dna in two different places. the accused says "i never met her" well how did your dna get in her clothing? he has somewhat of an explanation for that but not a good one when he talked to the police. i'm telling you, the most damaging information that will get in front of the jury is the pieces of information pushing it over the top are the two other kidnapping that he is accused of and they can connect him to it and that alone will bring back a guilty verdict. >> so if you're the defense attorney, you have to explain why the dna was in your car and the other cases as well. >> do you not take the stand or do you take it? jury likes to hear from defendants even though the zur is not supposed to consider whether they do or not. they have it sub consciously in their minds. they talk about it against the instructions of the judge. it depends on how well he presents to the jury. they will know and talk to him and do cross xapgss with him. -- -- examingses. -- -- examinations. >> sometimes defendants don't listen to their attorneys. is antolin garcia-torres listening to them or is he saying no, i'm getting up there. >> that i don't know. usually after this long of time you build enough as an attorney ra poor with your clients where you muscle them up and say you're not going to do well. then you start crossing them in the jailhouse showing them how badly they will do in front of the jury so they say you got to stay off the stand. better off with you off the stand or better off putting you on in the penalty phase where the jury will decide life or death if they get that far. >> do prosecutors present their case quickly? like the longer this trial goes, the jury is more prone to come back and say he's not guilty or the quicker it goes, more likely to get the guilty verdict? >> that's an interesting question. district attorneys talk about that all the time. do you do a quick case? too quick the jury says what just happened? was there enough evidence? or do you dress it up and take your time with the dna and show her hair on the rope in his trunk. you show the fibers from his trunk on her clothes. >> but there's no body. >> you take your time and make it appear a bit bigger. it's paramount to put a play on it. you don't want a quick play and have the jury say what was that about? you want to drag it out a bit and show them that you do have evidence. then you can come in with the other charges. i'm telling you, i can't tell you how devastating that is to the defense. they fought tooth and nail to keep that out. you're a juror, you're sitting there and say wait a minute, no body and we know about stacey dugard so maybe she could show up. we're going to convict this person? what do you mean you were also charged with two others and your fingerprint was on the tazer and the weapon? i'm supposed to believe that you didn't kill her with that dna evidence? >> yeah, you don't know. >> watch michael, this is enough to know it's damming evidence to a jury when they hear other charges and they say wait, i'm going to let you go? call now. don't let directv now limit your entertainment. choose xfinity and get more to stream to any screen. . we talked about the dow crossing over the 2400 mark, we find ourselves below it -- -- 20,000 mark. keep watching the numbers. today's weather seems like it's another sunny day. no rain says steve but it's getting closer. >> it will be here late wednesday and thursday and friday. temperatures yesterday and today were quite warm. in fact, if you're on the coast, very nice. we'll show you the high temps. big sur at 73. watsonville, 71. gilroy, 67. redwood city checking in at 65 degrees. kind of cold for some this morning. about the same tomorrow and then bringing rain in wednesday and thursday. chris tatum took this photo in richmond. that's a beauty. a lot of high clouds last night and this morning. still getting some now. high pressure is not letting anything in for 48 hours. our system is offshore. 30s, 40s and 50s, half moon bay. 50 at santa rosa. there's our system coming in wednesday and thursday. that will give us rain but until then enjoy the sunshine. i know it's cold for some in the morning. the afternoons are nice. 60s on the temps carrying that into tuesday and cloudy wednesday. rain thursday into friday. canadian police say they are still in the early stages of the investigation of a deadly shooting at a mosque last night. we heard that only one of the people arrested is actually considered a suspect. earlier police said two suspects had been arrested. more than 50 people were inside the mosque in quebec city when the shooting started. six people died in the attack and five other people are considered to have critical injuries. people who live nearby say there's never been any trouble at that particular mosque. >> people are going to be more on edge but i'm hoping that everybody comes together on this and shows their support for the community because that's what we need at this point in time, to show them we accept them and they integrate well with society. >> the canadian prime minister condoned the shooting as an attack on all the people of quebec. we now know when trump will announce his supreme court nomination. he will announce it tomorrow night. the two most talked about nominees are neil gorsuch of colorado and thomas hardiman of pennsylvania. they could soon fill the seat that's been open since antonin scalia died almost a year ago. president trump said he wants senator mitch mcconnell to use the nuclear option and change the rules if democrats try to stall the pick. mornings on two, our coverage continues of president trump's executive order on immigration. up next, we will talk with an immigration lawyer about what the ban means and who is impacted. nearly a month long search comes to an end with what many consider an unlikely hire. more about the man hired to lead the 49ers. good morning, checking twitter for our question of the day. our question was do you agree with president trump's executive order on immigration. a lot of people ovenly didn't. they were at airports across the country protesting this weekend -- -- obviously. . >> lisa chimed in with a big no exclamation point. >> saw a lot of those. >> daniel says "safety is a primary concern of america, i agree". >> on twitter most people sort of echo what one person writes, "it's shameful and he's making america scared again". >> people are having discussions among themselves. someone replies disagreeing so a good conversation for you to join us. just tweet us and use the hash tag ktvu. more about the president's executive order, we're joined via skype by one immigration lawyer. can you tell us what your office has been doing over the weekend? >> we have been paying attention to what's going on and we are concerned about our compliants getting into the united states and the confusion the executive order has created. i think that's the biggest concern for us is that it's very confusing and it's creating a lot of chaos. airlines don't know what to do. with the cases that have been filed now. we have to see what's going to happen. >> my question was if someone gets off a plane and just pick any airport in the country -- and they're turned away and sent back on a plane to the country they originated from, do they have a right against a hearing someone in the states on u.s. soil before getting back on the plane and being sent back? >> that's exactly what is happening now. there's been 30 lawsuits filed for people who have arrived at the airport and have had valid visas to enter the u.s., nonimmigrants and refugees and they have been detained and told they need to return based on the executive order and lawsuits have been filed again, 30, several preliminary injunctions have issued saying that this executive order is not valid and they cannot detain and return people, especially lawful permanent residents and refugees and nonimmigrants. these lawsuits are going to consider the conalty of this executive order over the next few days and weeks. >> once a lawsuit is filed or injunction is asked for, how long does it take to work its way through the courts and even if a ruling is reached, let's say making an injunction, how long does it take for border protection to know it's been ruled in that way? >> well, it's immediate. as soon as the order is issued, preliminary injunctions are taken immediately to the airport and they are shown to the department of homeland security and the cvp and they are immediately to take effect. they are to release them if that's what the order requires and they are allowed to see attorneys which they were being denied access to attorneys so these orders are in immediate and in affect for seven days and some until the court has an opportunity to determine the constitutionality. it takes effect immediately and the homeland security department needs to follow it right away. >> people believed the ban was immoral. now we're learning attorneys are challenging it and it's in some parts illegal. how is the trump administration gearing up to make it legal? what are you preparing for to fight against for the president's administration? >> well, i think there's two fronts right now. congress is introducing bills to overturn the executive order and so that is the first step is an effort to overturn the executive order and those bills being introduced today. the second step is constitution alty of the executive order being challenged in the courts successfully at this point. so turning the lawsuits into a class action and an injunction on the executive order until the constitutionality can be determined were you surprised by this? it seems as the president said he campaigned on this issue and knew it was coming. were you taken back by him signing the executive order over the weekend? >> certainly we all knew that this order could potentially be coming and we saw leaks ahead of time but it's still shocking to me that such an order could have issued. there's other ways of course that our country can address any threat of terrorism and screening that we need to improve on in our system but this is not the way to address it. we have systems in place that should be allowed to work and be improved upon but banning a particular religion and people from particular countries is un- constitutional and in my opinion, immoral as well. the demolition of another pacifica apartment building on an ocean side cliff is now underway. alex savage is live in the neighborhood and joins us now. standing right across from the apartment building now. >> reporter: yeah, we are right here on the edge of this cliff where this apartment building sits. good morning, this demolition project is moving right along. you can see crews making quick work of what was an apartment complex here at 310 esplenad avenue. this project got started this morning. they have torn down a good portion of this building. it sits here on the edge of the cliff that's been determined to be unstable and in danger of collapse. that's the determination that the city made. we should point out this is challenging work going on this morning because all those pieces of heavy equipment, the foreman told me they have to stay at least 40 feet away from the edge of this cliff for obvious safety reasons. this work started just after 8:00 this morning when the demolition project started. the city of pacifica had declared a state of emergency for this building. the cliff continued to erode after several strong rainstorms this last january 1 year ago. the building yellow tagged at that time and everyone was forced to leave. although the city did offer assistance to those people who were forced out of their units. just this morning the city manager was out here taking a look at the project. she says the bluff here is still unstable but pointed out the problem didn't get worse during recent rainstorms. >> what's stabling us is feeling like we didn't have to rush the demolition quickly than we already were. we have been somewhat lucky the storms have not produced flooding we have seen before and not produced the impacts on the coastline last year. >> we have seen scenes similar to this one in pacifica just a year ago. two other apartment building also here on this avenue were torn down for the same reason because they sit on this cliff here that is slowly eroding. to bring you back out here to a live picture, they're probably having this building torn down by the end of the day today. but they're going to take another couple of days to remove the debris from the site. the city spending $330,000 for the demolition. they also need to do additional work to shore up the eroding cliff. they point out that is worth that the former owner of the apartment complex should have done knowing about the issues with the cliff that this building was sitting on. they said the owner didn't do the work so again, the city stepped in and yellow tagged the building and now one year later they're tearing the place down. >> are there any looking booths out there? this strikes me as something any little kid would like to watch? >> yeah, it's fascinating to watch. there's people popping out of their houses or taking a morning walk who decided they were going to stop and tick pak churs, escape i the kids. the kids love watching the heavy equipment at work. and the kids at heart like myself have enjoyed watching it too. it's neat to watch an entire complex come down in a matter of a few hours. >> live in pacifica, thank you alex. the 49ers have offered fox nfl john lynch their job as general manager. he has never worked in a team's front office but has connection to the 49ers. he played college football at stanford and spent four of the 15 nfl seasons under mike shanahan. his current ofgsive coordinator is expected to be named the nineers head coach after the bowl. he's signed a six year deal with san francisco. joining us now is sports anchor jason applebaum. the first thing that came to my mind was matt mill lan. he didn't work out so well. he went to be the gm of the detroit lions and they didn't do well. he didn't have experience. so i'm more of a glass half full on this one. >> the hire did come out of nowhere. we were talking about a couple other guys where terry mc down with the cardinals and they see john lynch now. they're swinging for the fences here. first year gm and head coach and what you said when you were leaning in, a six year deal for a first year guy seems like a little overboard. very aggressive. what york is saying now is we are indeed rebuilding and in it for the long hall. >> so can he not find anyone else? john lynch comes and knocks on his door. >> i don't know if john lynch knocked on his door or if it was kyle shanahan meeting with him in production meeting before the falcons game with the seahawks. he's the most prepared analyst he's talked to. he played four years for mike shanahan. i think they could get other guys. peyton was one candidate. this is a fresh face with instant credibility. among players he's someone who is prepared. as a player he was the hardest hit of his time. >> does he change the way the players play today because of how i played back in my day? >> he's the front office, not the head coach. when he talks to players and other folks they know what kind of player he was. 0 that's going to carry some weight. the last two coaches, they are in it for the long hall and they will get 2-3 years. it's just money when it comes to whether or not they let him go. >> how much of an appetite do you think 49ers fans have for a long rebuilding process the fact that they have 100 $100 million in salary cap and ten draft picks and the nineer fans are realistic and know how bad it's been they're saying let's bring in the young shanahan and see what they can do. and let's bring in john lynch and give hum a few years. we know we have to rebuild. when jeb york gets up there and don't hang division banners and championship banners after they fired harbaugh, everyone knew that didn't ring true. so i think fans know it's going to take time, one year or two years down the road and see how it pans out. >> you think he's the main guy when it comes to the draft? he's an excellent evaluator of ta len. that trans lates to college football. >> that's an excellent point. >> he does know personnel because like we said, he meets with the coaches before games and knows the players and rosters of the team. in terms of the knew answers of the salary cap, they have to bring in a guy to help him out -- -- nuances. john elway was another first year gm. they like the fact he was able to do it and he worked with john elway. it's an interesting hire. got people talking. a little excitement around the 49ers again. by the way, your new number one in men's college basketball. >> you mention this why? >> well, at first when i first got the role and we started working on it, i was shooting another film and i was in vietnam at the time. i didn't have any time difference really. we just completely different have time to get into it. that was good for me because i could discover things and learn things about erika and what it's like to do this role. i thought it would be sort of remiss if i didn't reach out to him. we finally connected and i'm so glad we did. he's just a cool dude and gave me his blessing and he's on board 100%. >> the previews looked really cool. you obviously have to use weapons and guns. how did you learn how to play the role? you have to be the tough guy here and use all kinds of weapons and do more stunts. how did you learn how to do that? >> well, i have a great schedule. it's a lot of work. it's a huge responsibility when playing members of our armed sforss and military and our soldiers. it's a huge responsibility to do that right. so i worked with my tech advisor and my stunt team eric norris, we get it in every day to bring the authenticity for the fans who know 24. >> i'm assuming you have a personal trainer. your role is so physical. you must be wiped out at the end of the day. >> it is physical. it's a lot of work. the crazy thing is i don't have time to go to the gym between shooting hours and on the weekends you're flying out and doing publicity and back. so it's a whirlwind but that's the fun of it. that's the thing -- when i look tired on screen it's probably because i am. it's all good. stunts and stuff i'm the clumsiest person. in general i'm just clumsy. i got to work hard to make him look good. >> you have a fantastic career today. were you nervous at all shooting the first scene? >> oh man, yeah. the nerves are there. they were there in the process leading up to it. once we were ot set that's when we're in our element. it's a great cast. we all have each other's support. this cast is phenomenal and we depend and lean on each other in the tougher times. we have steven hawkins who directed the first episode of 24. he's back with john so we're in good hands. i feel confident about that. >> well, i'll leave you with this. i read a review this morning and it said "spend a few minutes with you and you find yourself in the moment" sounds like quite the compliment there. thanks for taking the time and joining us and i look forward to super bowl li sunday and watching that after the big game. >> thank you guys, looking forward to seeing it. >> i am excited about it. nice guy. >> next time he's in the bay area, need to get him in the studio. >> did you watch the away game?
