580 westbound as you drive-thru. you can see traffic is moving along okay. if you're driving on 580 through livermore but it's slow if you're making it through the altamont pass and on 205 as well. we have slow traffic throughout area, driving on 680 and still looks good heading into san jose. there have been no problems on san jose in the freeways; how far, moore park at cypress, it's a good area to avoid moore park avenue, you know, pretty much parallels 280 in the west valley here and cypress to have a closure for a deadly crash that san jose police are involving. let's move along and look at interstate 880. a live picture here. we had a report of flat tires on 880 northbound at marina. chp said that is gone and traffic is moving again with no major issues on 880 near marina. the bay bridge westbound, you can see traffic here is still light. at 5:03, let's go back to the desk. and now from overnight, police are looking for a missing baby girl. they issued an endangered missing advisory for four month old madeline wallen. investigators said she is with her father, 45-year-old michael leopard wallen. there is a picture of the two of them. we reached out to police but they have not commented on whether he has legal custody of the baby. she weighs 15 pounds, brown hair and hazel eyes. there is a closer photo of her. she was last seen wearing a white top and pink ballerina outfit. wallen is described as 6'2", 220 pounds, brown hair, brown eyes and last seen wearing a warriors t-shirt. he has tattoos throughout the body and on his hands. they were last seen in a blue four-door toss thousand dollars nissan altamont with paper plates. the front has front- and back- end collision damage. anyone with information, call mountain view police. new from overnight, the chp is investigating a deadly accident near the dunbarton bridge. it happened on westbound 84 before the thornton avenue overpass in fremont. there are reports the problem may have started with a wrong- way driver, but the chp is not commenting on that now. all westbound lanes of 84 were shut down for several hours, but the highway is back open. this morning, the san jose police department is investigating a deadly crash near interstate 280. the officers say they were called to the corner of cypress and moore park avenues just before 4:00. they located a white pickup truck that had hit a sound wall. the driver was found inside the truck. he was pronounced dead at the scene and his name is not being released until relatives are notified. moore park avenue remains shut down while a crash is under investigation. a manhunt continues this morning in the east bay for the suspect accused of killing his ex-girlfriend in front of her children. the victim, 29-year-old franklin, was driving two of her three children to school yesterday morning. a neighbor surveillance camera recorded avillever ser-- a silver mercedes pulling up and blocking the path. witnesses identified her estranged boyfriend, 43-year- old lawyer mcbride of walking out of the mercedes, arguing with franklin, and shooting her. the neighbor later came by and walked franklin's two sons away for protection. >> i miss my mamarks he said. he called my mama. and i miss my sunshine. that is what he calls his mom. >> franklin's family said she was in cosmetology school, dreamt of opening up her own nail and hair salon. she was with mcbride for about a year before their relationship ended, but they say he had been stalking her. police say this was a targeted attack. law enforcement agencies in napa are not releasing the name of the man shot to death by deputies yesterday afternoon. the deputies went to the west napa neighborhood after receiving several calls of someone firing a gun there. there were reports of an argument between two neighbors earlier in the day. officers arrived on scene saying a man in a silver honda civic drove out of his garage and toward them. >> he left the area and as he drove out of the area, he began to shoot at the police officers. it really comes down to he fired at the officers and there were many shots that were fired by him. >> and i saw him drive by at a normal speed and then he didn't stop for the police officers. they started firing at him. >> the car slammed into a tree and the driver's body remained in the vehicle until late last night. the west park school, which is two blocks away, went into lockdown and student his to stay late until police gave the all-clear. no one at the school was hurt. california moves a step closer to criminal justice reform. the state senate committee approved a measure that could eliminate the bail system. the defendants are released from jail now after posting bail. those unable to pay the amount remain locked up. under the bill, defendants not considered serious threats and expected to show up for court dates will be released. supporters of the legislation said the current bail system is biased against the poor. critics warn that public safety could be at risk and california is one of it regarder -- eight states considering bail reforms. a federal appeals court ruled a 1964 civil rights act protects lgbt employees from workplace discrimination n. a decision, the 7th u.s. court of appeals in chicago broadened a scope of the 53-year-old law, which sets up a likely battle before the supreme court. the supporting judges said changing norms called for the expansion and set denting -- dissent ising -- [ indiscernible ] to have the laws. and considering legislation to close the wage gap between men and women. a recent analysis said california women make 86 cents per every dollar paid to men. a member of the board of supervisors introduced legislation that would prohibit employers go back to the desk. >> and you. the investigation into an officer-involved shooting in napa continues this morning. rob malcolm is joining us live and, rob, this may have started because of a dispute between neighbors? >> that is what we're hearing. the city of napa, police headquarters. there is still more questions than answers. this is a multiagency investigation with the chp and also the sheriff's department involved in this. this is what we're hearing. this unfolded yesterday afternoon around, shortly before 2:00 p.m. the police were called to this moment in the 2300 block at bo in, o street after getting reports fired and the weapon woke with the bomb. they set up a perimeter. at the same time, while they were setting up, backed out of his garage and fired at police as he tried to flee. and he was shot and killed on linda vista avenue just about a block away. his bullet riddled honda civic was crashed into the tree and two blocks away, west park elementary school. the girl placed on lockdown, the neighbors watching us unfold in the middle of a busy afternoon. >> i saw him drive by at a formal speed and when he got to the police officers, he didn't stop. >> and he fired at the officers. there are many shots fired by him. >> back here live via, police say the deadly force was unavoidable. the major crimes task force and da's office are investigating as to what led to the goodly force. the officers involved in the shooting just ask for regular protocol are on leave. live in napa; and back to you. >> all right, thank you, rob. >> alameda county officials have identified a third victim from last week's deadly fire in west oakland. the coroner's office said the 41-year-old wilson is one of the four people who died in the transitional housing complex on san pablo avenue. the name of the fourth person has not been released because relatives have not been most notified. edward anderson and cassandra robinson were the only other two people killed in the fire. some of the firefighters who were called to the fire are new talking about their experiences. >> i can smell it from blocks away as we were approaching. you can see the embers in the air. jot young crew from station 1 in oakland was familiar with the building. the firefighters knew it was traditional housing and as many as 100 people could be living there. >> as soon as we stepped off the truck, there were people yelling at us that there were people trapped and people in the windows. >> the lady reached out and i pulled her trying to pull over the railing. the next was the gentleman that reached out and i pulled him. >> you want to be able to save everyone, you know, it's upsetting when you can't do that. >> firefighters did save 20 people who were trapped inside and say they did all they could that day. they also say they don't want to be praised for what they do. that i say they were doing what they were trained to do. and this morning, a temporary shelter for the survivors of the fire is closing. about 70 people who lost their homes in the apartment fire moved into the temporary shelter at the oakland youth center last week. all but 11 of them have found other places to live. the city of oakland said the shelter would only have a temporary solution and the youth center needs the space back. residents told us they have nowhere else to go. >> this is causing -- closing and the people are homeless. that is all -- we're sold out. the people of oakland business black people of oakland, they're trying to clean us out. >> city leaders said they're working to find longer-term housing for the people who are still there at the shelter this morning. more rising tensions in the sea of japan as the u.s. confirms north korea has fired another ballistic missile this morning. officials say the missile was fired from north korea's eastern coast and it travelled about 37 miles into the east sea. this happened as south korea and u.s. troops are conducting annual military drills the north views as invasion rehearsal. the united nation's security council is scheduled to meet in an emergency session about the suspected chemical attack in syria that killed at least 72 people including 11 children. witnesses say the attack was carried out by jet carecraft operated by russian and syrian forces. the target was in a rebel-held town in northern syria. experts say the symptoms indicate a gas attack. the doctors rushed to save lives as victims struggle to breathe. today, the u.n. secretary- general condemned the attack as he attendas i meeting in belgium, focused on ending the conflict in syria. >> the horrific events of yesterday demonstrate that unfortunately war crimes are going on in syria. the international law remains being violated frequently. >> today, russia's defense ministry said a syrian airstrike on the rebel workshop producing chemical weapons was responsible for the death. san jose city leaders and safety advocates are joining forces to try to stop the rise in pedestrian deaths on city roadways. the most recent hap -- happened saturday night when a man was killed on monterey road in san jose. the 10th pedestrian killed and the 12th related traffic death. 18 pedestrians -- pedestrians were killed in soap hasay all of last -- in san jose all of lasted year. >> most of the 12 fatalities that occurred this year so far are behavioral related. so it's very important that we address the behavior of drivers, cyclists and pedestrians. >> and the goal of the vision we havery programs reducing the number of deadly accidents to zero. the safety ideas include improvements in busy roadways, like adding barriers to bicycle lanes to protect them from traffic. city leaders are studying a controversial idea aimed at helping heroin users. the supervisor is looking at opening what she calls a safe injection site. the idea is to give addicts a safe place to inject drugs where counselors and health officers would be close by. the san francisco mayor worried that such a center would enable addiction in a city-funded place and now he said he's keeping an open mind. >> if i have health experts on site at the farm reduction sites, then they're not about free injections. they're about reducing the harm on the long-term basis. that is what i am supportive of. >> if you're sick enough, you're going to do it here in the sidewalk. >> injection sites would make them feel more comfortable talking to counselors and taking the shame away from publicly displaying the addictions. if the city approves it, a safe injection site could open by the end of the year. court records show neurosalmon is not fighting her extradition to florida and will be transferred for her trial. right now, she remains in custody in dublin. salon plead not guilty to charges of helping her husband plan the pulse nightclub attack and lying to investigators after the shooting. no word when she will be transferred to florida. it was in front of the truck here. but, a white pickup truck has crashed into the sound barrier wall and poa neighbor heard the sound of the crash and called 911. he ran out to try and help. >> i ran down the street in my slippers. and my neighbor was on the phone with law enforcement and he said that there was no pulse. i wanted to double verify. >> did you check? >> i checked for a pulse. there was no pulse. >> reporter: the driver has not been identified yet, waiting for the next of kin notification. this is the 13th fatal collision this year so far. traffic investigators are out here on scene.
