That is eastbound 580 on the hacienda onramp to the freeway. This is a live picture. West lanes taken away on eastbound 580. A truck driver lost control of his rig and ended up with the truck on its side and took down a light pole, eastbound 580 after the hacienda ramp to the freeway. The driver told chp he lost control of the vehicle after he had some sort of loss of consciousness after eating snacks there. Maybe he was choking. We dont know. Theyre trying to get this rig right and its going to take a while. Eastbound 580 is not a huge delay right now, especially since eastbound is the traditional noncommute direction. Most people are driving the other way at this time of the morning and thats the commute direction. Lets take a look at other things we have here. We have a look at this same general area and you will see traffic is not really a big problem here. We look at the tracy commute, we already do have slow traffic here on 205 and 580 west. Interstate 880 in oakland, traffic here looks good, if youre trying to catch a flight out of oakland international, should have no trouble. Across the bay bridge looks good into San Francisco. A water polo player at San Jose State University is accused of sexually assaulting two women. The player is no longer on campus and may have left the country. Janine de la vega . Reporter the student has now been banned from campus, and that is while this case is being investigated. The paper is reporting that two female students came forward in september to report that a freshman water polo player raped them at an offcampus party over labor day weekend. San jose state issued a temporary suspension which prevents the student athlete from coming on the campus or participating in any campus event, including polo practice. He has not been arrested, but the District Attorneys Office is reviewing the case. The student has reportedly left the country and the university did not issue a crime alert for this, because Campus Police who interviewed him did not think he posed a danger. The Department Faces a review of its operations. The mayor asked the u. S. Justice department to analyze the Police Department following last decembers deadly shooting of mario woods. Theres a News Conference scheduled for 11 00 this morning for release of that assessment. Two people who have seen the report tell the examiner it accuses the Police Department of disproportionate use of force and shooting people of color. The assessment found the police union has too much sway over the department, and the report has about 200 recommendations, including supporting the use of stun guns while banning a type of police neck hold on suspects. The examiner also reports the Police Commission will meet tonight to select three to five finalists in the police chief search. The names are not expected to be made public. The commission interviewed 11 semi finalists a couple of weeks. Mayor lee will pick the chief out of the pool of finalists and according to the paper, a decision could come as early as tomorrow. Weve been following those for you and today we take a look at the two tax measures and the move to legalize recreational marijuana. Reporter the extension of a personal income tax release prop 55 would extend that income tax by 12 years, but only for californians earning more than 250,000 a year. Its estimated it would generate between 4 and 9 billion a year for Public Schools and 2 billion a year for health care for low income patients. Prop 56 would also help fund the states medical cal program by increasing the tax on a pack of cigarettes from 87 cents by 2. You might think this is steep, but actually california has one of the lowest cigarette taxes in the country. In new york the tax per pack is 4. 35. An equivalent tax would apply to other Tobacco Products and e cigarettes. Tobacco companies have spent 56 million to defeat prop 56. If it passes, the measure would bring in an additional 1 to 1. 4 billion to state coffers during the next fiscal year. If prop 64 passes, california would become the fourth u. S. State to legalize the use of recreational marijuana. It would allow adults 21 and older to possess up to an ounce of marijuana and would allow individuals to grow as many as six pot plants. Voters turned down a similar measure in 2010. This time the initiative was partially bank rolled by former facebook president shawn parker. A 15 sales tax would generate more than a billion dollars annually for youth programs, environmental protection, and Law Enforcement across the state. Monty francis. Happened on interstate 580 several hours ago. Still affecting things, though. Lets check in with allie rasmus. How does it look out there trafficwise . Reporter trafficwise it doesnt seem to be impacting eastbound traffic on 580 at all. Traffic is moving pretty smoothly. But this is the big rig were talking about, eastbound 580, the hacienda onramp. Its a ups truck. They have made some progress. They have attached the cables. See the orange inflatable bags underneath the trailer . Those are airbags theyre using to lift the trailer of that truck up, presumably without damaging the trailer and packages inside. This happened around 1 00 this morning so crews have been working on this several hours. The driver said this happened while he was eating a bag of pretzels. He said he lost consciousness while he was eating and the next thing he knew his truck overturned. No, wasnt necessarily choking. Kind of hard to describe. Was eating food and felt like it got stuck and i dont know if he panicked a little bit and sort of started getting a little anxiety from it, i dont know. It caused him to veer off to the right.
