lower port finding blocking the president's ban on the six majority muslim countries. >> reporter: a huge win for president trump and the high court striking down the lower or decisions that prevented the president from blocking travelers from six muslim majority countries for 90 days. >> in the interim, and with the support of the supreme court rules, the president travel ban will stay in effect in all court rulings that have interfered with the travel ban are null and void as of today. >> reporter: the court agreed to hear the full arguments on the ban in october but expect changes for travelers soon in the meantime. the president said that within 72 hours of the supreme court go ahead that the ban would be implemented.>> reporter: another issue is whether justice anthony kennedy will retire now that the decision is over and perhaps giving president trump another chance to leave a lasting imprint on the court. >> if president trump nominate someone in the nature of judge neil country . >> reporter: initially several lower courts including the ninth circuit in san francisco blocked the ban on travel from six mostly muslim countries but the court has reinstated much of the travel ban until the high court here's the arguments later in the year. the supreme court said the trump administration can stop travel to the u.s. by foreign nationals that cannot prove they have a connection or relationship with a person or entity in the country. our legal analyst says that remains to be seen what that means in practical terms. >> this ban has the allowance for people to come in from countries if they have "a bona fide connection" with say an american university because they are coming in as students, or the american business enterprise because they have a job waiting for them. >> reporter: enforcement of the order could be an issue and in fact in the opinion, justice clarence thomas said he is worried this decision will put an unfair burden on federal officials while they try to figure out whether the person trying to come to the u.s. has a bona fide relationship with someone in this country. the high court will hear arguments on the revised travel ban this october. the supreme court also agreed to hear the appeal from the owner of the colorado bakery that refused to make a wedding cake for the same-sex couple in 2012. jack phillips, the owner of the masterpiece cake shop told a gay couple they would not make the wedding cake due to his religious beliefs. the couple filed a discrimination complaint and the colorado court ruled against phillips and they have petition the supreme court claiming the ruling violates his freedom of speech, and the case will be heard in the fall. some senate republicans are expressing doubt about holding the bill on the healthcare and waiting for the nonpartisan congressional budget office and so far five republican senators oppose the health care plan and more than enough to kill the republican proposal. there >> reporter: on interstate 80 in berkeley the rule is three people are more in order to drive in the hov high octane vehicle lane. the bay area transportation officials have confirmed what many drivers know all along is that a lot of people simply do not follow the rules. the carpool lanes are more crowded than ever. there are more people than ever driving the clean air vehicles and the drivers are legally allowed to use the carpool lane if they get the state issued decal. the number of plug-in hybrid and electric vehicles have grown by 200% in the bay area in the last two years. add that to the hov lanes and they have gotten clogged or >> that is one fourth of the customers in the carpool lane and they really ought not be there.>> reporter: the bay area metropolitan transportation commission broke down the worst highways, 880 in fremont with 16 to 20% of the vehicles having solo drivers. in the east bay as they approached the san mateo and dumbarton bridge as many as one third of the vehicles are carpool cheats. and highway 101 in san mateo during commute times with up to 40% of the vehicles driving in the carpool lanes without extra passengers. >> they degrees for some and happy to say for those of you that thought it was too hot, this clear pattern started on the weekend. it took a while to get inland but today is the day of toward lake county, eastern celano or contra costa, it was still hot over the weekend but today much cooler. breezy to windy and even with the sunshine the fog burning from the south to the north with temperatures settling into slightly below average. taking that into tuesday and as you know last week was ridiculously hot. up to 105-110 but that is backed off. patchy fog tonight and low clouds lifting way up. 60s, 70s and 80s for most with this onshore breeze. the low pressure is moving in with this weak system moving through up through midwest california which is enhancing the onshore breeze. temperatures their average and slum -- some are slightly above average. that cloud deck burns off getting temperatures to jump up a little bit but still running below where we were. west southwest, even north in novato but that delta breeze, once it kicks in at 25 to 35, even sacramento will cool down. due west oakland, sfo and hayward. even vacaville getting the west southwest for this time of year which is a good sign we get the seabreeze. water temperatures coming up at 54 to 58 and 10 days ago it was 49-41 and it probably won't go any warmer with that high- pressure system moving off. we could get a northwest breeze which would help. thunderstorms popping up over the sierra and also up in northeast california. with that system coming in that will push it out of the area. we will see lots of sunshine today if the low clouds of their they will burn off soon with temperatures in the 60s for most, 70s closer to the water with a few upper 50s and 60s. instead of 100 to 105 we get 70s and 80s out toward antioch in brentwood. nice into tuesday and wednesday looks like temperatures will be average for just about everybody with inland temperatures warming up thursday through saturday. we will
