these workers on the ground. you can probably watch them live here. they will hook up one of those giant sandbags to that cable that's below the helicopter and then this chop era long with all the others out here doing this -- taking part in this operation. they will lift that sandbag and then place it right there in the area of the emergency spillway that is erod ing and causes so much concern. that helicopter just lifted off taking another sandbag. this operation has been going on nonstop throughout the night and this is important work. they are working here with in a very narrow window. they know that more rain is coming on thursday. the other aspect of this operation is trying to got as much water as they can out of lake orrville. state water officials are releasing millions of gallons of water a minute over that main concrete spillway. we have to look at it from down below early this morning. that spillway is damaged but the damage not as bad as what is going on with the emergency spillway. they are trying to reduce the lake level. it came down at least a dozen feet overnight. they would like to bring it down. maybe 25, 50 feet if possible. we are told that is a tall order. in the meantime evacuation orders remain in place for nearly 200,000 people living downstream but a the lot of people -- they have stayed behind here in orrville and other communities. many of them live in elevated area that are aren't at risk for flooding. they say they didn't get evacuation notices and those people are struggling to try to get food and supplies here in the middle of this zone. there are only a few restaurants open in orrville and at the lake side supermarket that we just visited many of the shelves are bare. they barely have anything in the way of food, no meat for people to buy and the manager said delivery trucks aren't allowed past the checkpoints. >> we are hunkering down. we have plenty of water and my pantry is full. we may get to a lot of chicken noodle soup. >> if he we don't get any supplies long term there is no answer to that. we end up shutting the doors. we can't -- if we don't have food to provide for people or fuel or propane even there is nothing we can do. we can't help. >> reporter: and there is been no timeline offered in terms of when all those people who are now staying in various shelters may be allowed to return to their homes. the governor meantime has asked for federal financial aid to help with this ongoing crisis. we are learning today that according to a report in the sacramento bee that the federal energy regulatory commission has ordered already an independent review of the orrville dam to it figure out what caused these two failures. the damage to the main spillway and the really concerning damage and erosion to the emergency spillway. also we are learning today that there -- there have been red flags back in 2005 environment groups and local elected officials raised fears about a failure with that emergency spillway and the possibility for flooding but nothing was done to reinforce that emergency spillway any further at the time. now we are in the situation that we are in. work is happening around the clock. its going to continue going on and on like this. the helicopters just coming in. nonstop. picking up the sandbags. putting them in place and trying to shore up that emergency spillway that has we saw has some very serious erosion issues. >> compared to 24 hours ago a lot of activity behind you. do you get that there is more of a sense of urgency today compared to yesterday? >> reporter: yeah. i mean i would say just in terms of the number of choppers we have in the air. they are coming in nonstop. we have three of them. we have two -- this one are you looking at here. this is a private helicopter and private company that's been called into take part in the operation. there is another private helicopter and i believe the third one we have been seeing, doing work is a cal fire helicopter. one of those helos that's picking up the sandbags. we have seen the pick up other items as well. they are bringing some of these large concrete k rails in and they are putting those in place as well. they also are still taking these huge bags of boulders and rockinghams and dropping them on the emergency spillway. the emergency spillway. we are on the south side of the or are rville dam and so the spillway is on the far north side of the dam itself. the dam itself which we should point out water officials say is sound is here in the foreground. as you look off in the distance first you have that main concrete spillway where water is rushing down at incredible rates as they try to lower the lake level and beyond that is where all the work is focused right now. that emergency spillway nothing more than a dirt hillside. when water crested over it on sunday afternoon it started to eat away. that erosio of o northbound that concrete lift. if that were to give away it would be a disaster. let's go to rosemary now. the levels continue to fall. a good newsa heaved the rain that could be 36 hour as way. let's take a look at the levels at this hour reported, 887, 53. down about 14 and a half feet from where it was when it peeked on sunday. the out flow right now has been increased over the last couple hours. that's good news there. we will continue to trackt. here is a look as we track the first system expected to move in to the bay area and lake orrville. late wednesday night into early thursday morning there is that first system there and they keep coming after that. here is saturday and now it looks like the models showing a break on sunday. so yesterday, we had acies temperature living on sunday. now it looks like it may be late sunday night into monday. still thursday, friday, a bit of a break during the weekend with that next system. now early estimates two to four inches expected for the lake orrville area. could see a little more than that in the feather river basin that contributes to the lake. we will track between now and then. that's the latest. was very been reporting as many as 188,000 people remain under evacuation orders. >> we were at one of the ten evacuation centers and shows us the scene at the yolo county fairgrounds. >> reporter: those who spent the night here say they have been keeping one eye out for any news about the repair updates on that spillway. the other eye on any of the weather forecast so they know what is going to be in store. several hundred stayed the night here grabbing what they could. having just hours to gather what they could. family members, important documents and some cases there wasn't even enough time for space for family pets. something that can be hard for a 9-year-old to understand. >> the only really hard thing was having to leave my dog because my parents wouldn't bring him. >> reporter: yeah? >> that hurt me a lot. >> reporter: while many slept in the shelter others spent the night this their cars, trucks or trailers. >> i drove down. it took me four hours just to get outside the airport and i parked on the side of 99 and spent the night there and then found out from another station this was open. i came down here. >> reporter: they say that they are desperate for information, wondering they can return home. >> i want to know when we can bail. when it's safe. i figure its like kids playing with mud puddles. they don't know what the heck they are doing. >> reporter: some say they are pulling together like a small town. >> several of the restaurants in town. i own father patty's irish pub. lot of the other restaurants in town have all just decided this is something we want to help with. help people out. what we do. >> reporter: they are saying they are wondering what the next week will hold for them. in woodland. ktvu fox 2news. and we are expecting a news conference this start there in orrville in less than an hour. at one. when register. the money will go to the american red cross for relief efforts. here in the bay area the drive includes foodmax stores. the white house said that the president is keeping a close eye on the situation there in orrville. the white house press secretary said the condition of the dam spillway social spillways is a good example of why more money should be spent on the structure. >> it's an example of why we need to pursue a major from construct package in congress. dams, bridges, roads and all port around the country have flannen fall fallen into disrepair. . >> he said that the president is in contact with congressional representatives here in california and that the white house is working alongside fema and other agencies to make sure everything is being done to help. the house. he resigned last night after reports found that he may have broken protocol before the inauguration and then lied to the vice president and the president about his conversations with the russians. >> that really was the lynch pin here that he either forgot, couldn't fully recall or misled the vice president and others when he was talking about a conversation he had. i think that the issue -- the situation became increasingly unsustainable and he resigned many. >> reporter: he is believed to have illegally discussed possibly lifting captions against russia imposed by president obama. now the lieutenant general keith kellogg is the acting supervisor. democrats calling for an investigation. >> there is important unanswered questions about his ties to russia but it's my hope the administration will pick a competent national security advisor. >> reporter: some republicans calling foul on the whole thing. the president asking this morning why there are so many illegal leaks coming out of washington and lawmakers wonder requesting information on flynn's phone calls were leaked to reporters. >> leaks of this nature are damaging to america. to our national security and we need to look intot. >> reporter: the president must appoint a new national security advisor. three possible names are lieutenant general kellogg, harvard and again petraeus. still ahead as concerns rosemary for details on the next round of rain expected to hit us here in the bay area. >> and it caused quite a buzz on social media early this morning as people spot aid bright light streaking across the sky. after the break what we learned it was. . we heard from so many viewers who spotted a very bright light in the sky this morning. this in fact is some of the video sent to us. >> many were unsure of what they were seeing. we have more on the answer. >> it was one of two test missiles fired off a submarine off the coast of san diego. it was a clear night. there was no fog so that's why so many people saw it along the california coast. it was around 6:20 when most saw it. shortly after it was spotted a united states navy spokesman confirmed the navy launched two missile this is morning as part of what they called their frequent tests of their nuclear deterrant system. we spoke to a viewer who saw it. he stopped to get video and said based on the brightness and shape and pattern of the light he knew it was not a meteor. >> the plume changed direction. quite a few times. quite erratic. it almost looked like a rocket that lost guidance control. it was obviously a rocket. given everything that's happening in the world one has to ask the question. i was very interested to see what it was going to do and relieved when i saw it gain altitude and fizzle out. if a statement the navy said why they do these tests. he said a credible effective deterrant is essential to national security. test flights weren't done in response to any ongoing world events or as a demonstration of power. he explained the missiles flew over and landed in the sea. they never flew overland and he said they were not armed. >> could we see more of these and how do you know it's a missilel? >> we could. we know the navy does them regularly. when it comes to determining what exactly it is in the sky we got information from unexpert at the science sensate and he said that any time when you see a light with a fan shaped tail moving slowly, maybe changing directions it's most likely a missile. he said meteors are -- they move quicker through the sky. you can only see them morning. by thursday night it tapers off but round two on its heels for friday. friday looks like a wet day. if you have planning expect to have the umbrella into the evening hours. saturday morning a few scattered showers to start the day and looks like we will get a break. saturday afternoon into sunday afternoon. it looks like we will be mainly dry. that's what the models predicting into monday the next system rolls in. looks like it could last into tuesday, maybe even into wednesday. as far as rainfall amounts two to four inches expected. all said and done but a look at through monday where we are looking at from two to two and a half for portions of the bay area and then we look into this area for lake orrville and as i said at the top of the hour from two to four inches expected there. groups say they have been worried for years. >> and people at shelters trying to make the best of a bad situation. how residents came together to help a boy celebrate his birthday. . back on the coverage at the orrville dam as the repair effort continues. still almost 200 people remain under evacuation. they are still waiting to find when they can go back home. while the water level has dropped crews working to repair the spillway are racing against the clock against the next round of rain. >> we have more on the repairs and the people evacuating. >> reporter: 180,000 people still under evacuation orders as engineers assess the tallest dam in america. after it was found erosion chewed through the spillway creating a massive hole. now thousands of people are stranded at hotels and shelters and it's still not clear when they will be allowed to return home. >> some people are very, very shocked and a little scared because this is their first disaster. the first time they have been told to evacuate their home. >> reporter: they are working on repairing the dam. dropping big boulder s with the help of dump trucks and action pending the order until they know more. >> i would like to know everything that they know even if it's bad news. tell us. tell us. let us know. >> reporter: as water levels in the lake continue to drop some shops have decided to stay open and people who either didn't or couldn't evacuate are rushing in to stock up. with more rain in the forecast business owners say they won't be taking chances when the water starts to rise. >> it'll flood that's for sure. if it does -- even if the water comes through fast enough it'll get some flooding in here. >> reporter: the next storm moves in to the area on thursday and officials are running to reduce the water levels in the reservoir. the challenge of course isn't just to make room for the rain arriving week but also in the week as head, not to mention all the snow run off coming this spring. at the orrville dam in northern california. fox news. it's not just the red cross and community centers near orrville that are making people feel welcome. a temperature until west sacramento welcomed families forced to leave their homes. it took at least one the family eight hours to get to that temple but they said that it immediately felt like a second home. the temple said it means a lot to them that people feel welcome here for any person. even if they haven't set foot in a temple before. >> they help every person. a big home for any kind of people. doesn't matter black, white or any race. >> from sunday night until the evacuation orders are lifted it'll provide food, shelter and showers to people of every race and religion. the chp brought happiness to a shelter yesterday up in shared on the facebook page. they say this moment showed their devotion to provide safety, and security no matter when or where. it's not the first time that concerns have been raised about the orrville dam's spillway. >> environmental groups predicted the failure of the spillway, even filed a motion with regulators asking for that hillside to be covered with concrete. >> reporter: the possibility of a disaster at the orrville dam related to its emergency spillway comes ascanio surprise to ron stork with a group called friends of the river. >> turned out that looks like we were right. >> reporter: for more than 13 years stork has been warning that if the emergency spilllway was ever used that massive floods could follow. >> it's heart breaking to not have been successful. it's -- it was quite a scare last night when they told people that failure was going it happen. >> reporter: in february of 2005 stork's group along with the sierra club and the south yuba citizen's league file aid motion with the federal energy regulatory commission saying in part at present the ungated spillway at orrville dam consists of a spillway lip only and uses a hillside. this has the possibility to cause severe damage downstream. the environmental groups wanted the feds to require state and local water agencies behind the project to reinforce the emergency spillway with concrete so that it wouldn't be just a bare hillside. they argued that a breach could be a disaster saying with well over 100,000 people at risk for flood damage we are concerned that the zone of impacts may not reflect the true downstream impacts. firk said the spillway was designed safely adding that the likelihood of a or rville dam is low. so low that such a possibility is not quantified. while the oville dam isn't in danger of failing the spillway is. today when asked about the concerns raised more than a decade ago the acting director of the state department of water resources deflected the question. >> we are going to get into recommendations or concern that were voiced in the past but right now we are focused on maintaining public safety not just during this event but the spring runoff period. >> state and local water actions rejected putting concrete on the emergency spillway because of the cost, $100 million. now repairs alone are expected to cost that much at least. in sacramento about 30- miles the state capitol there is a warning that a levee is on the verge of breaking. the most at risk area is a place known as tyler island. south of the community of walnut grove. about 20 homes have be told to evacuate so far. we have video now of the repair workt. shows crews using heavy machines placing down boulders and sandbags to shore up the levee. officials aren't calling a breach or break but are saying that the island and parts of walnut grove could be flooded. rains have left fields soaked for a month. in santa clara a water release is underway at the anderson reservoir. 3100-gallons of water a second are flowing out of the release valve. the district said the next round of storms could push water levels onto a spillway adding thousands of more gallons to the water already rushing in to coyote creek. >> no room for the storm. whatever nature the you're brings us will flow into that spillway and end up in the creek below. >> this was the 11th time since the reservoir was built in the 50s that it's reached 100% capacity and forced the release of the water. the highway patrol is investigating a deadly accident involving a car and a woman walking near an east bay neighborhood park. the woman was hit by a honda civic just before seven this morning near meek park at hampton and boston road in alameda county near haywood. she died at the scene. with reworking to learn more name and age. the driverrer of the honda stayed at the scene. the c hp has yet to say what may have happened. a homicide investigation is underway in the the city of oakland. police say this happened around eight last night at an apartment on east 21st street at 20th avenue. so far officers have not released information about the investigation or the name of the victim. bay area family asking for help in finding who is responsible for the hit and run death of a 72-year-old woman. they were driving south on the freeway through haywood when the -- when the chp said another car hit them. the wife died at the hospital. 12 hours after their car crashed in to a sound wall. the chp is investigating this as a hit and run crash. the other driver must have known there was a crash. the family is devastated. >> i have hate that i have never felt before. the way i can forgive or forget. the way -- to know who did it. that person brought to justice. >> amy is survived by her husband. the chp is investigating a report that the war was a black and white mustang. stanford is responding to allegations that an attorney who has been working with sexual assault victims was fired because she was critical of the shouldn't. hundreds have signed a petition in support of her. the group that launched the investigation wants her reinstated. she was participating in a pilot project to provide legal advice to those involved in assault investigations. each case requires a vote by a three person panel, with all agree force discipline to take place. the lawyer said the process takes to long and it's difficult to get all three to agree on a vote. >> the first e-mail that was sent to her to terminate her listed her criticism and basically the lack of confidence in the the process. very been through the process and i know how stanford responds to criticism and this was not surprising. >> according to stanford she was not terminated out of revenge. they said that she was let go because of her attitude about the results of the process and other concerns about her work. more lawsuits have been filed with homeowners and government agencies battle over san francisco's tower. the latest lawsuit was filed this past friday by a group of nine homeowners. they claim the developer was warned in a 2005 report about the rate that the building was settling. the lawsuit alleges they withheld that information. another group of 20 homeowners filed a lawsuit in january. the partners said the allegations have no merit. san francisco pet stores could be banned from selling puppies and kittens under an ordinance being considered by the board. they say its designed to halt the practices of large scale breeding operations. it shouldn't stop responsible breeders and direction between scott's valley. crews continue to work on repairing part of highway 37 in nevado that's flooded three times. they are working around the clock to raise the road bed before the next evening rush hour. >> highway 37 is critical connection for people between sonoma and marin. ace train service is expected to remain shut down through tomorrow flooding forced freight trains out on to
