reaction. republicans are saying this is a fantastic bill, it is going to help people. republicans, you heard nancy pelosi saying that solve for the american people. >> this is sort of the climate we're in. when you have a bipartisan approach to something everybody has some pain, but the gain is enough for everybody. here it's very stark. the democrats think this is a disaster. the republicans feel like we've got a victory. >> let's talk about the victory and president trump and that celebration today in rose garden. a little too preliminary, in your opinion? was it sort of putting the cart before the horse in regards to the fact that it hasn't even cleared the senate yet? >> i guess if you are celebrating that it got over the first hurdle, okay. but it is sort of like the reaction to the democrats around the budget. we got more out of it than the other guys, and it's rah-rah for our guys. the american public is getting tired of this devicive era. the people aren't getting the victory. >> have we crossed a threshold by the vote being approved in the house that at some point down the line we are going to see the affordable care act, president obama's affordable care act, repealed and replaced? >> i think so eventually, but it is going to take awhile. this next move, or next stop with the senate, is a huge deal. and there is going to be hearings and lots of debate. so we've got a ways to go before we see what this looks like at the end. but i think everybody admits that the current plan or the current law is not sufficient. it's got a lot of holes in it. now the question is whether the new law that's being talked about after it gets through the senate will be the real ticket. we will see. >> you talked about the changes that the senate is expected to make. this thing could ultimately look completely different than right now. >> could be totally he' eviscerated. >> do you think there will be some democrats crossing the aisle? in the house not one democrat voted in favor of it. >> i think if this bill is going to reflect what is needed to fix it, it is going to have to have some dems voting for it. the razor slim margin between republicans and democrats in the senate require that. not all republicans are going to vote for this, so they are going to need democrats. in that fact is the strength of the democrats being able to profoundly affect this piece of legislation. >> all right, obviously politics involved here, but we are talking about people and their healthcare, something that everyone is going to be following. >> that's the things debate including reaction here. that's coming up on ktvu news at 6:30. police are providing new details about the shooting deaths of three people. investigators say an officer shot and killed a man who had just killed his ex-girlfriend's parents. the gunfire took place last night in the 1000 block of lauren villa lane. >> we could hear all this screaming. yeah, that's pretty much what we heard. and then later we heard a couple of more pops. >> reporter: frightened neighbors say the gunfire started at 9:00. police rushed to find the 20- year-old son of the victims outside of the home saying man had broken in and shot his parents. >> it's just a tragic incident perpetrated by evil. i don't know how else to put it. >> reporter: patrol officers arrived to find the armed barricaded suspect inside the home. hostage negotiators tried to talk the 24-year-old man into surrendering. >> at one point we did hear him say -- the cops say, just let the boy go. >> reporter: oh my god, that's terrifying. >> it was very scary. >> reporter: suspect did release the 13-year-old son of the slain couple but he wouldn't turn himself over to police. at one point he raised his gun toward police and that's when one officer fired one time killing the suspect. officers then entered the residence and located the adult male and adult female homeowners deceased. chief eddie garcia says it appears the suspect was distraught over a breakup with one of the victims' daughters. the twin killings could have been retribution for the breakup. investigators say the sapped criminal past and a history of mental illness and violence. unnerved neighbors trying to return to normal after a dose of reality entered this quiet cul-de-sac. >> it's unfortunate. i think it will happen anywhere if the happens in willow glenn. >> reporter: the officer who piled the trigger killing the suspect has been placed on paid administrative leave. that's standard procedure. additional the d.a.'s office and the homicide unit are doing a joint investigation into what happened. in the willow glenn section of san jose, jesse gary, ktvu fox 2 news. meantime weir learning more an -- meantime we are learning more about another deadly officer involved shooting. police identified the man killed as 28-year-old joseph torino. investigators say police were responding to a report of a family altercation. when torino charged at an officer while holding a large knife over his head, that's when officer mario martinez opened fire. a preliminary hearing got underway today for the man accused of shooting and killing a hayward police sergeant. cameras were not allowed in court for today's hearing for the. thee these are file pictures when the man was first arrested. he is charged with killing scott lunger during a traffic stop in 2015. today the backup officer who witnessed sergeant lopinger's killing -- sergeant lunger's killing the horror he felt as he watched his close friend and colleague shot to death. he said just before the officer was killed he said whoa, whoa, whoa. >> scott lunger is a member of our family. his family sour family as well by extension, and it is important for us to show our commitment to the case and a also to the criminal justice system in general. >> the judge is deciding if there is enough evidence to hold mark estrada for trial. he is charged with murder with special circumstances. that makes him eligible for the death penalty if convicted. for the first time in 20 years the city of oakland is getting new fire trucks to fight grass fires. the new trucks come just in time for this fire season. >> reporter: stepping into the modern age of fire safety -- ?iewn like other departments that are strict sel metropolitan based we have to be capable to do it all. >> reporter: the city of oakland purchased these new trucks specifically to battle wild land fires. >> it's been 20 years. we're still using those apparatus but now it's time to upgrade our apparatus. >> reporter: back in 1991, the oakland hills fire was the largest wildlife urban interface fire in the bay area's history killing 25 and destroying thousands of homes. shortly after that the city purchased this and similar trucks but now the department is trading it and other trucks for state-of-the-art trucks with updated bells and whistles. >> we're getting a better ride. better radios, better lighting, better ground clearance. just a lot of features that make at more well rounded apparatus. >> reporter: the old trucks were made to only seat two. however, the new ones not only doubles that number, it also provides added safety. >> we can be more effective and' fish shunt if we get into those areas with all our personnel and not just half of our personnel. >> should situations change we were going to have to squeeze four people into a cab. now we have the ability to put all four people into one apparatus. >> reporter: they will be used for when a protest turns destructive. the fire department will also be putting graffiti-proof signs like these out on trail access gates. it's similar to a mile-marker or an address. that way if a person needs help they can tell the fire department where they are located. >> just another way for us to get more information so we can pinpoint and send the right apparatus and be able to help mitigate the emergency quicker. >> reporter: on top of that the department is trading in its old school map system for these new color ones so the crew can bert see where canyons and valleys are when they travel off road. just in time for fire season which is a few weeks away. in oakland, paul chambers, ktvu fox 2 news. four albany high school students disciplined for their connection to racist pictures on social media are now suing saying their free speech was i am pedded. the controversy goes back to march when administrators learned of racist images posted on a student's private instagram account. those images included nooses drawn around the necks of some black students. students who comb meant on or liked those pictures were suspended. >> there's also students who just followed the account who didn't post anything or like anything. so almost they have been branded, essential they have been given a scarlet letter, guilt by association. >> i think you should after certain degree of freedom of speech but when it includes an image of lynch ago black person, and then a person at our school, i think that really crosses the line. >> the controversy set off protests on campus. according to the lawsuit the supreme court has found that schools can only prohibit speech when it is carried out at school and disrupts school activities. in a statement the albany school district said it will defend its act shins court. still ahead, new developments to tell you about in the officer involved shooting in san francisco. what we've learned about the victim's condition as well as that stabbing suspect's identity. but first, a sculpture that's been in the emeryville mud flats for more than 25 years has now crashed into the buy. the irony behind it all and what's next for this piece of art. bill, you remember that, driving along 80? >> that was the best one. i remember when they put that up. oh my gosh, that's how old we are, frank. outside we had temperatures up there. we had numbers that were, well, in the 70s. we dropped 10 to 15 degrees. it is going to continue to go down as we go into the weekend with more clouds. a famous sculpture of the red barron that's flown in the emeryville mud flats since the mid '70s has unfortunately fallen into the ocean. >> ktvu's alyana gomez joins us with the story. >> it took 42 years for the dueling characters to reach this level of defeat but the red barron finally lost this fight. if anybody is confused will all make cains second. the bottom line here is that the destruction of the sculpture is putting the mud flat momentum back in motion. >> reporter: if you have ever taken frontage road or interstate 80 heading into san francisco, then you have probably spotted the dueling planes at the end of the pier. they are mud flat sculptures created in 1975. if you took a closer look at them, would you find famous peanuts character snoopy and the red barron. but now only one is left standing. >> snoopy shot down the red barron. i don't think anyone in emeryville is unhappy about that. >> reporter: the weight of the rotting wood gave way, crashing into the bay. emeryville's mayor and vice- mayor along with public works took it upon themselves to salvage the icon. >> we're trying to liberate the red barron from the sand and muck. >> reporter: and it was no easy feat. the plane's tail was stuck so they tried digging it out and hoisting it up. >> i think if we lean this way, we can lift it up and carry it out. >> reporter: all without breaking it. well, it wasn't flawless. >> i eve got mud in my mouth. >> reporter: but still intact. what's next finding it a permanent home and keeping the tradition alive. >> the emeryville mud flats have been a very longstanding tradition here in the community, and it has evolved over time. there used to be dozens of mud flat sculptures here in the city. >> reporter: the mayor says with a city full of artists, continuing that production shouldn't be a problem. >> bay area sculptors, get down here, we want your creations. it would be marvelous to have more. >> reporter: the city vem reiville is competing with other cities right now to have a designation as an arts community. the state council has named emeryville with that designation. the mayor and vice mayor tell me they hope to showcase the red barron and its story. >> you are way too young to remember this, but as a kid growing up in berkeley it was so fun to be driving along 80 at the macarthur maze and see these sculptures, because there were always people out there building things out of driftwood. there were some really creative pieces. you were always wondering, i wonder what we're going to see now. they would go up, they would go down. that was one of the most famous, the red barron and snoopy. >> hopefully we will see more mud flats coming. >> i hope so because it really game emeryville an identity. >> reporter: and i think they're looking for that as an art community. she's been on the job for nine months now but today san jose official inaugurated their new president. she became the university's 30th president during a ceremony on campus today. during her inaugural address, she spoke about her late mother's influence on her and about the school's future. >> the true greatness of san jose university is revealed in its people, in each of you. our people are our legacy. >> she is the third woman to lead san jose state. previously she served as president of connecticut state university in new haven. frank, let's talk about those sculp tiewrks buddy. >> isn't that fun? >> these are temperatures from today. yeah, those sculptures were huge. >> i remember there was a long train out there. >> there was a train, almost everything out there. at one point it got so dilapidated, they just all started falling in on each other, but that was an interesting time. that was one of the first times i had ever seen art displayed that way. they took these mud flats, which were not -- it was mostly duck blinds. remember the old duck blinds? >> i remember those, too. >> they used to hunt ducks. so when those came down they started making stuff out of the duck blinds. so frank and i have fond herms. >> that's what happens when you're 59, you remember stuff. >> you can see the bridge as traffic is moving slowly. tomorrow is going to be cooler still. we dropped off 20, 22 degrees. tomorrow we're going to cool a little more. it's still nice. 60s pretty much everywhere. 70s, low and mid 70s will be the exception. definitely a cooler day for your bay area tomorrow. >> thank bill. i and one final chance to convince the jury before deliberate raightsz began. up next, the latest on the murder case of the man accused of killing sierra lamar. we have new information tonight on that deadly officer involved shooting yesterday in san francisco. police say an officer killed 26- year-old nicolas flusche after he stabbed a worker in a sandwich shop. police say they will hold a town hall meeting to provide more information on that shooting. ktvu has learned that the officer involved in that shooting is the same officer who shot a san francisco resident who kicked and punched officers four months ago. tara moriarty with details about the men and the officer who now connects them. >> reporter: a go fund me page to cover funeral costs has now been set up for 26-year-old nicolas, the man who witnesses say stabbed a subway sandwich shop worker in the head after an argument over a sandwich. his facebook shows he originally hailed from texas, part of large family. the officer who allegedly pulled the trigger is the same officer who shot and injured a man on the steps of his own home. that officer, responded to a call at sean moore's home. >> he's gun happy. he likes to shoot. he needs to be trained. he needs to learn how to take care of people that are in distress. >> reporter: moore faces charges for aggravated assault on a police officer. last week a judge actually dropped eight of those 10 charges, and today the judge released moore on his own recognizance. no cameras were allowed in the courtroom. it remains to be seen if this new information has any berg on moore's case. >> to met's troubling it's the same officer, but at the same time i don't know the fact of what happened yesterday. >> reporter: the district attorney's office won't comment and is pushing forward on the charges. >> we have two different rulings from two different judges. both of them are contra dick tore real. we're seek clarity from the bench in order to determine our next steps. >> reporter: he says moore is happy to get out of jail after 118 days behind bars. his next court appearance is may 10th. in san francisco, tara moriarty, ktvu fox 2 news. the fate of accused murderer antolin garcia-torres is now in the hands of the jury. jurors now to have determine if garcia-torres is guilty of kidnapping and killing 15-year- old sierra lamar. the morgan hill teen disappeared more than five years ago. although her body has never been found prosecutors say her dna was found in garcia-torres' car. if he is convicted, he could face the death penalty. ktvu news at 6:30 is coming up next. he is the first official candidate in san francisco's race for mayor. it doesn't happen until 2019. coming up in minutes the issues mark leno says plans inside of a home at laura ville lane at about 9 last night. the suspect released the 13- year-old son of the slain couple but refused to surrender. he raised his handgun towards the lease, and that is
