the roads? >> right now. people trying to get out on tuesday. that's the new trend and all over the country and more people are going to be on the road this year and according to triple a the biggest rush on cars since 2007. i want to show you pictures. people on the road and a lot of times this afternoon commute on the tuesday, not the wednesday becomes the major one and tomorrow. people are going to get on the road at about noon so if you thought that maybe you could sneak out about noon and have pancakes and get on the road. i don't advise it. if you going to go, go early during the morning or go after 7 because a lot of people go on the roads right now. this is 880, you can see the traffic is slow in both directions here. another thing i want to tell you the three plain exits 80 through vacaville and 580 the altamonte pass and gilroy area are packed. if you are going a slow distance we have traffic. and a short distance i would advise you to go on thursday morning. if you are driving from hayward to vacaville there is no traffic on thursday morning. doing it for 20 years, i never see traffic on thursday morning if you are going to short distance if you can wait that long. julie and frank, go back to you. sal can you don't think that a lot people will go i will wait until thursday and go on thursday and then all of a sudden you get traffic on thursday. >> never have seen it in the 20 years of doing it. on a thursday morning there is tumbleweeds at the toll plaza. if it happens this year for the first time anything is possible. but i don't think it will. >> thanksgiving weekend. travel one of the busiest days and one of the deadliest. triple a says 6 million people in california will be traveling 50 miles or more from their homes and most of them will be driving. the chp says all available officers will be on patrol duty starting at 6:01 p.m. tomorrow. each officer focusing on a myriad of subjects. aiding motorists that are stranded and lost and focusing on aggressive driving and reckless driving and impaired driving. officers say the best way to be safe is to buckle up and be vigilant and especially to have a designated driver if you are couldn't stop crying. cristina rendon is outside the church and it was emotional day in court. reporter: yes, julie it was. the family members of gerardo injury ortaz was visible upset. he did look to family members and at times had to be calmed down by his defense attorney and translator. his arraignment happened this afternoon but a judge said before any criminal procedures move forward he needs to be evaluated about i a doctor. deputy district attorney says that ortaz was arraigned on three charges. >> we have three counts of homicide. >> today we got our first look at the baptismal pool. this is where ortaz is accused of drowning his daughter sunday night. he allegedly walked across the street to the police station and found naked holding his daughter and screaming for help and his 9 year-old son was a witness to the crime. earlier we learned from the sonoma county sheriff's office that little girl is identified as maria jose ortaz. we talked the relatives that are too distraught to talk. and are working on a go fund me account to pay for her funeral. >> could we know anything about the father's past. we know he has four children plus one on the way. >> as far as any criminal history, police were tight lipped about it and it doesn't appear there were problems whatsoever. from everything that we are hearing from relatives, he was loving and they were a tight family so this is a shock to everyone. >> was the wife in court today cristina? >> i don't believe she was. the family members were cousins so i don't believe that she appeared in court as well. i think it was too commuted the sentences of one thousand prison inmates and today the president shorten the the prison sentences of 79 additional inmates, mostly nonviolent drug offenders. the prison commutations are more than the last 11 u.s. presidents combined. president obama has repeatedly called for an overhaul of federal sentencing laws for drug offenders. and we have wet weather headed your way in the next probable see froze advisory in some temperatures near freeze. we got rain to contend with and scattered showers in the bay area and about ten or 11:00. the scattered showers will be heavy for a little while but they should basically taper off quickly before the morning commute. there it is outside. boy, it does look like an inclement shift. rain at 11:00 and that is real rain that will come down maybe a half-inch and see how quickly it translates through. wednesday morning. maybe a scattered showers and that's your morning commute. i think the biggest thing will be valley fog and a lot of valley fog in the central valley and maybe patches of fog in the north bay. by wednesday afternoon's commute that is big travel day. valley fog is gone and the clouds are gone and it should be a pretty easy travel day. we get rain. for the next five days because i talked about tonight's system and we got another system friday night and saturday and sunday as we go to the next five days look at the numbers, they go up to saturday and you have over an inch and a half in santa rosa and by saturday night you are up to a inch and a half in san francisco. you get the picture. a wet weather pattern. thursday remains dry at this time. we do have a wet period. tomorrow morning's commute should end up being wet. daytime highs in the upper 50s, low 60s and the five-day forecast, good thing it has worked out. sal will tell you that everybody is driving to get out of town. there is that chance on wednesday morning. the real rain will be tonight in the next few hours and then wednesday morning drying and clearing and maybe valley fog and then friday and saturday and sunday back into the wet. thanksgiving at this partnership looks dry. >> catching a break. >> isn't that good? >> mayor of san francisco says that he plans to have a new police chief by the end of the year. three weeks since the police commission handed mayor lee the names of three finalists. that after many meetings with the public. now the mayor's job to make the final choice. this morning he told ktvu the new police chief will face a series of complex issues and he wants to make sure he is choosing the right person for the job. >> we got many issues. officer-involved shootings and safety in the neighborhood and we got deployment. and nowadays we have challenges from the federal government about where the money may come from. sanctuary status as we talked about this morning. >> interim chief tony chaplain has been running the department since former chief greg suhr stepped down and mayor schaaf gave up an update on her search. mayor schaaf says the selection committee has excellent candidates to pick from and so far no word on how many candidates will be interviewed. oakland has not had a permanent police chief since sean wentz stepped down in jail. >> the contra costa sheriff's department says 31 dan porter kelly of richmond is facing robbery and murder charges following his arrest. he is accused in the beating and shooting of 28 year-old william sims whose body was found on a street ten days ago. the two other suspects remain at large and no word on any possible motives. >> a san jose student was taken to the hospital this morning after being exposed to pepper spray in class. the fire department was called to the silvervan middle school near center road after a dozen students complained about feeling sick. first responders say one person in particular was complaining about skin and eye irritation. >> we had to treat this hazardous materials incident. the team came out and located a pepper spray canister and pepper spray was spread on the air and one of the walls in the classroom. >> the student taken to the hospital is expected to be fine. the classroom was evacuated for are a time until the pepper spray dissipated. police say they are investigateing to find out who is responsible. >> still to come here. their dog needed his nails trimmed and a bay area couple took him to a groomer. >> we have no way to know. that this could end his life. >> the lawsuit that has been filed against the national pet store chain and what the dog's owner will hope will change. a bay area chiropractor convicted of abusing a patient is back at work. >> the search is on in oakland after the school superintendent abruptly left for a new job. a bay area chiropractor convicted of inappropriately touching a patient is back at work just months after receiving a two year jail sentence. we have more with what developed in this story in past hour or so. maureen. reporter: well, julie basically the chiropractor convicted of the felony sexual battery of a patient was allowed to resume work because his license was active and when we called the state licensing board to check in on the case, they said they were pretty much unaware that they were seeing patients again. >> four months after this chiropractor was convicted of felony sexual battery the 49- year-old was back at work with his good life chiropractor office. manford alcos was arrested in 2013 and last year convicted of sexual battery after a 21-year- old woman says she was inappropriately touched in an office vis. >> it there is concerns about putting a person, regardless of who it is back into a position where they committed the crime. >> several patients committed their love for the doctor. we searched the chiropractor licensing record and found that he still had an active license making hill legally allowed to practice. the attorney is appealing the conviction and requesting that he keep the license during the appeal just with supervision and to not practice in a private room. >> the worse thing is to take away a man's livelihood when the case is on appeal. >> he was sentenced to two years in prison and released credit for time served. >> my name is maureen naylor. >> when we called the state board earlier they say he has the right to due process and could legally practice for another month. but late this afternoon called back to say they are seeking to revoke his license. >> were you aware that he was practicing. >> we were not entirely aware of that at the time. and so now we are moving forward and using that in our investigation. >> the temporary suspension of his license expired when he finished his sentence and they thought his sentence would last longer. >> with the sex crimes division. they said it is ridiculous that state board was unaware of the conviction and questioned why they didn't take action sooner and in the meantime the chiropractor could still see patients until the board takes action. i reached out to his attorney and he says if the executive director of the board knew the facts he would see it differently and plans to address that next month. live in campbell, back to you. a teenager is dead and another under arrest after a high-speed police chase that started in san francisco and ended with a horrible crash. police began to chase two robbery suspects in the city. the chase continued to highway 101 and ended in sunnyvale when the suspect crashed near el camino. the car hit 5 parked cars before flipping over. the highway patrol says the honda was going over 100 miles per hour an. the 19 year-old suffered injuries and the 18-year-old passenger died at the scene. >> he was moving. we have had this bad in the parking lot and the driveway is a launch ram and it is what happens. you see parts down the parking lot to the street. the c hp has identified the driver as 19-year-old za ne from san francisco. booked for vehicular manslaughter and evading police and driving under the influence of drugs. the superintendent has made it official. antwon wilson heading back east for a job. we have reaction. ted. reporter: the head of the oakland school board is calling the dee partial of antwon wilson a big loss for the city. wilson will head to washington in february at a news conference in dc this morning. wilson said he is proud of what he will be leaving behind in oakland. >> i can see myself as having an opportunity to serve the families of oakland and during that time we were able to do important work and the district is well positioned. to continue moving forward on behalf of young people. >> the oakland school board pointed to a number of successes during less than 3 years on the job for wilson including rising graduation rates and the first new multi labor contract since twine and the oakland initiative focusing on tripling college graduates. >> we are in the position we must continue to move on. i can say to you today that as a city we don't have time to lament and time to be sad. we have to stand here strong for our children. >> the board will work on an interim president and replace him probable next monday. antwon did have critics because of the addition of charter schools. they make up a proportion of the population with 50% of students attending charter schools. and ted, often times when the person in charge leaves others follow. are you hearing anything about that. a big concern raised and the president says he knows senior staff will remain in place in oakland. >> a dispute from the city of santa clara could go nuclear. financial leaders that city leaders are not using city money to operate the stadium. some of that information is propriety and refusing to hand over the documents. jesse gary has more. what is the scenario. reporter: auditors have been here at the stadium for much of the day and depending on what they find could determine whether this ends up in a court of law. >> the san francisco 49ers are added into battle with a foe and this time it is the front office fighting. >> this building is independently audited and signed off from the 49ers. >> team presidential guido says he will show the city council his case of the interworkings of levi stadium should not be turned over to the city but available for auditors. the mayor tired of this tussle is threatening legal action. >> the management agreement the documents are to be delivered to the stadium authority. it is a matter of possession. >> the football team acting as the company books levi for acts such as concerts and the shows bring in millions that go in the general fund. turning over the documents would make it public information and weakening negotiating power with artists and lower in profitability. a section of it say as much. it will be propriety. >> we believe that is critical maintaining successful businesses. >> that means more money in our coffers which means rebuilding roads and infrastructure. >> dominic caserra wants to bridge the divide between the bridge and city leaders before it goes to the courtroom. >> there is no reason why they signed the contract to say they will supply them to us. they need to supply them to us. >> and you have to have it physically. >> that's what the contract calls for. we are not asking for tonight the heart broken dog owners take on a pet store chain to make sure that pets are safe. imagine if you took your dog to the groomer and you picked him up he was dying. that happened to a couple from san mateo that say that is what happened when they took their puppy to a pet smart. tara moriarty tells us they are suing pet mart for negligence. >> terry and steffen say a trip to this pet mart to get their puppy's nails clipped turned deadly this last may. >> she was spewing blood and i was helpless. >> we have no way to know that just taking a pet in could cost him his life. >> henry was crushed while in the care of this man, 38-year- old grouper juan who criminal charges are pending. >> he went in for a routine nail trim and came out within seconds with two broken ribs and a punctured lung. >> peacock was traumatized. >> it was like if i was going in for a pedicure and i died doing it. >> henry was returned to the hospital where he died and cremated before the couple could say goodbye. >> i called the san mateo p d because this was egregious. >> this is a long history of pets being seriously hindered or killed while being groomed at pet smart. >> there has been four ranging from blunt-force trauma and strangulation to heat exhaustion to dogs being left unattended in dryers up to 135 degrees. the groomer never apologized and there was never an explanation provided for why henry was crushed and died. >> the couple's attorney hopes that this lawsuit will not only force pet mart to change policies but will force an overhaul of the grooming industry. they say at this point there is no government oversight. >> we never had children together. so i hope people can understand these are our children. >> they say what happened at pet mart should never happen to anyone else and that's why they are suing. pet mart declined to comment saying it can't comment because of pending litigation. tara moriarty, ktvu fox 2 news. a small plane crashed into the san bernardino national forest killing the pilot. the single engine cherokee was missing at five a.m. the wreckage was discovered at the foot of mount balding in san bernardino county about an hour later. the officials say the plane was on its way to riverside. the pilot was the only one onboard. the cause of the crash is under investigation tonight. still ahead. mattresses and trailers and fuel cans and much more. we showed you how all of these things are illegally dumped. we found a group of kids. some as young as 8 years old that decided to do something about the trash problem in their neighborhood. plus the emotional goodbye to a deprivation killed in the line of duty. >> coming up. one last salute. the deputy dennis walls. we are just a few hours from some more rain around here. i'll detail the timeline that you can expect for your tonight and tomorrow morning. illegal dumping in oakland is a persistent problem costing the city millions. ktvu investigative team went undercover and it didn't take people long to see people dumping trash. it is in front of a business run by john beckwith. he says it is one of the worse dump spots. >> another spot is right in front of a public school on east oakland holly street. the students say since the students are not doing anything they are taking matters in their own hands. >> kids as young as 8 went out to pick up trash. >> at the charter school in east oakland small hands are helping to fight an enormous problem. trash dumped at the school's front door. >> really disgusted to see all of the trash that is around where we -- where some of the teachers live and where we eat and learn. >> the problem of dumping is so bad that students from the prekindergarten through 8th grade charter school break in to teams and do their best to right a wrong and they find garbage by the bag full. >> i don't feel happy to see my street looking like that. >> why don't they dump garbage in their neighborhoods. >> there is something that the students shouldn't touch such as this leftover construction material dumped across the street from their school. >> and around the corner there was household garbage, the type to attract rodents. >> a part of a car and mattresses. >> this is a what students are exposed to and rather than wait for the city to clean it up. the school leaders turned it into action. teachable and they form the clean-up. >> i want them to take responsibility that when you look outside your fence and you see trash that you can do something about that. >> if you want to make your community vibrant and beautiful you have to go out and do it yourself. >> the school is looking to buy high quality surveillance camera to capture video of people dumping and talking about long lasting solutions. until then the students will leave clear classrooms and clean up. >> nobody care about the commune. >> in oakland, rob roth. fox 2 news. i think it is great that they care but they have to be careful about what they pick up. >> i love that little girl saying if you want to do it, you have to go out there and do it. good for them. >>let look at the weather. bill, what about the rain. >> the next few hours, showers and we end up getting wet. not so much for the morning commute but when you get home and get ready for bed you should hear raindrops. it is a vigorous little weather system. it is not -- i mean it is going to rain and then move through quickly. what will hand you see the cold air coming behind it and that is interesting. dropping temperatures wednesday night and thursday morning. you can see freezing conditions and frosty conditions. lowering the snow level and so lake tahoe. they have a winter weather watch and snow levels down to 5000 feet that is low for this time of year and we will see just kind of a cooler day tomorrow. here is the next system over the horizon. that one gets in here friday, saturday and sunday. we get a break. and then what we have coming on friday. so there's the system i'm tracking and it is in eureka and you can see how threadbare the bottom half of the front is and that is where we are going to be in the lower end. outside we had a pretty sunset and winter weather advisory and you can see it here. that's for the lake tahoe area. snow levels down to 5000 feet as we head into tomorrow morning. and you know maybe six inches of snow at 5000 feet and maybe over a foot of snow in the higher elevations. it will be easy to get a foot of snow at donnor and summit. earlier i showed you the model, the higher resolution model and now i want to show you through your holiday weekend. here we are tuesday at 5:00 right now and watch what happens. we go through here and here we are tonight, there is the system and a break. thursday night you start to see this guy show up. and then there is your friday and so thursday's dry by the way. thanksgiving is dry and there's the friday night into saturday morning. still raining into saturday afternoon. still raining into sunday. and then a little bit of a break monday afternoon and then it starts to dry out but you will see valley fog return. that is the unsettled pattern. the next five days getting rain and here is the rough model forecast but you know monterey can get over an inch and see over two-and-a-half inches in santa rosa. none of this would induce flooding hopefully. i can't imagine how it could without those lower amounts. but it will put rain in the reservoirs. especially northern california. snow in the mountains. i think it would be easy to get a foot of snow. by the time it is done getting two to three as we go beyond the weekend. that's got people going to the mountain. >> big holiday weekend. >> thanks, bill. coming up, a final salute can't imagine it happening in this area. hundreds and hundreds of people line the streets to pay respects to fallen deputy dennis wallace. kill at point range earlier investigating a suspicious vehicle. joined the department in 1997. he was remembered today for his kind-heartedness and his self- less acts. >> under soft light, friends and family and fellow officers said their heart felt goodbyes to sheriff deputies dennis wall list. >> dennis loved being a law enforcement officer and especially loved kids and this is where he shined. >> at the funeral service in modesto. police detective dave wallace shared how humble his procedure was. >> i know that through this dennis would want us to smile and laugh in time we will smile. we will laugh again and we will heal. >> unable to have children his 34 nieces and nephews were his kids and they shared memories of their uncles on vacations and at football games. they shared their family's sense of humor. >> he sacrificed his time and invest the in our lives because he was permitted to be a presence there and committed to everything but his dad. >> deputy wallace will be remembered for kindless acts. a 20 year veteran that operated in san mateo on a busy road and especially right across the street from sierra high school and tonight we are learning that human trafficking may be suspected in this case. >> for the past 3 weeks neighbors had their eyes on this home in san mateo and so did police. suspicions were confirmed after an investigation lady to a raid and the arrest of two san francisco men for possession of a controlled substance. >> it was consistent with traffic and the suspects going through the house at all different items. >> money and condoms among the items found inside. the online ads soliciting the roads? >> right now. people trying to get out on tuesday. that's the new trend and all over the country and more people are going to be on the road this year and according to triple a the biggest rush on cars since 2007. i want to show you pictures. people on the road and a lot of times this afternoon commute on the tuesday, not the wednesday becomes the major one and tomorrow. people are going to get on the road at about noon so if you thought that maybe you could sneak out about noon and have pancakes and get on the road. i don't advise it. if you going to go, go early during the morning or go after 7 because a lot of people go on the roads right now. this is 880, you can see the traffic is slow in both directions here. another thing i want to tell you the three plain exits 80 through vacaville and 580 the altamonte pass and gilroy area are packed. if you are going a slow distance we have traffic. and a short distance i would advise you to go on thursday morning. if you are driving from hayward to vacaville there is no traffic on thursday morning. doing it for 20 years, i never see traffic on thursday morning if you are going to short distance if you can wait that long. julie and frank, go back to you. sal can you don't think that a lot people will go i will wait until thursday and go on thursday and then all of a sudden you get traffic on thursday. >> never have seen it in the 20 years of doing it. on a thursday morning there is tumbleweeds at the toll plaza. if it happens this year for the first time anything is possible. but i don't think it will. >> thanksgiving weekend. travel one of the busiest days and one of the deadliest. triple a says 6 million people in california will be traveling 50 miles or more from their homes and most of them will be driving. the chp says all available officers will be on patrol duty starting at 6:01 p.m. tomorrow. each officer focusing on a myriad of subjects. aiding motorists that are stranded and lost and focusing on aggressive driving and reckless driving and impaired driving. officers say the best way to be safe is to buckle up and be vigilant and especially to have a designated driver if you are couldn't stop crying. cristina rendon is outside the church and it was emotional day in court. reporter: yes, julie it was. the family members of gerardo injury ortaz was visible upset. he did look to family members and at times had to be calmed down by his defense attorney and translator. his arraignment happened this afternoon but a judge said before any criminal procedures move forward he needs to be evaluated about i a doctor. deputy district attorney says that ortaz was arraigned on three charges. >> we have three counts of homicide. >> today we got our first look at the baptismal pool. this is where ortaz is accused of drowning his daughter sunday night. he allegedly walked across the street to the police station and found naked holding his daughter and screaming for help and his 9 year-old son was a witness to the crime. earlier we learned from the sonoma county sheriff's office that little girl is identified as maria jose ortaz. we talked the relatives that are too distraught to talk. and are working on a go fund me account to pay for her funeral. >> could we know anything about the father's past. we know he has four children plus one on the way. >> as far as any criminal history, police were tight lipped about it and it doesn't appear there were problems whatsoever. from everything that we are hearing from relatives, he was loving and they were a tight family so this is a shock to everyone. >> was the wife in court today cristina? >> i don't believe she was. the family members were cousins so i don't believe that she appeared in court as well. i think it was too commuted the sentences of one thousand prison inmates and today the president shorten the the prison sentences of 79 additional inmates, mostly nonviolent drug offenders. the prison commutations are more than the last 11 u.s. presidents combined. president obama has repeatedly called for an overhaul of federal sentencing laws for drug offenders. and we have wet weather headed your way in the next few hours. showers showing up and as we head in here as we get to ten or 11:00. you can see the activity in the pacific. we will set up friday and saturday and sunday night wet. we got this system to slides through which is will tonight. it will deposit cold air. that means tomorrow's daytime highs in the 50s and the overnight lows on wednesday night and thursday morning down into freezing levels. probable see froze advisory in some temperatures near freeze. we got rain to contend with and scattered showers in the bay area and about ten or 11:00. the scattered showers will be heavy for a little while but they should basically taper off quickly before the morning commute. there it is outside. boy, it does look like an inclement shift. rain at 11:00 and that is real rain that will come down maybe a half-inch and see how quickly it translates through. wednesday morning. maybe a scattered showers and that's your morning commute. i think the biggest thing will be valley fog and a lot of valley fog in the central valley and maybe patches of fog in the north bay. by wednesday afternoon's commute that is big travel day. valley fog is gone and the clouds are gone and it should be a pretty easy travel day. we get rain. for the next five days because i talked about tonight's system and we got another system friday night and saturday and sunday as we go to the next five days look at the numbers, they go up to saturday and you have over an inch and a half in santa rosa and by saturday night you are up to a inch and a half in san francisco. you get the picture. a wet weather pattern. thursday remains dry at this time. we do have a wet period. tomorrow morning's commute should end up being wet. daytime highs in the upper 50s, low 60s and the five-day forecast, good thing it has worked out. sal will tell you that everybody is driving to get out of town. there is that chance on wednesday morning. the real rain will be tonight in the next few hours and then wednesday morning drying and clearing and maybe valley fog and then friday and saturday and sunday back into the wet. thanksgiving at this partnership looks dry. >> catching a break. >> isn't that good? >> mayor of san francisco says that he plans to have a new police chief by the end of the year. three weeks since the police commission handed mayor lee the names of three finalists. that after many meetings with the public. now the mayor's job to make the final choice. this morning he told ktvu the new police chief will face a series of complex issues and he wants to make sure he is choosing the right person for the job. >> we got many issues. officer-involved shootings and safety in the neighborhood and we got deployment. and nowadays we have challenges from the federal government about where the money may come from. sanctuary status as we talked about this morning. >> interim chief tony chaplain has been running the department since former chief greg suhr stepped down and mayor schaaf gave up an update on her search. mayor schaaf says the selection committee has excellent candidates to pick from and so far no word on how many candidates will be interviewed. oakland has not had a permanent police chief since sean wentz stepped down in jail. >> the contra costa sheriff's department says 31 dan porter kelly of richmond is facing robbery and murder charges following his arrest. he is accused in the beating and shooting of 28 year-old william sims whose body was found on a street ten days ago. the two other suspects remain at large and no word on any possible motives. >> a san jose student was taken to the hospital this morning after being exposed to pepper spray in class. the fire department was called to the silvervan middle school near center road after a dozen students complained about feeling sick. first responders say one person in particular was complaining about skin and eye irritation. >> we had to treat this hazardous materials incident. the team came out and located a pepper spray canister and pepper spray was spread on the air and one of the walls in the classroom. >> the student taken to the hospital is expected to be fine. the classroom was evacuated for are a time until the pepper spray dissipated. police say they are investigateing to find out who is responsible. >> still to come here. their dog needed his nails trimmed and a bay area couple took him to a groomer. >> we have no way to know. that this could end his life. >> the lawsuit that has been filed against the national pet store chain and what the dog's owner will hope will change. a bay area chiropractor convicted of abusing a patient is back at work. >> the search is on in oakland after the school superintendent abruptly left for a new job. a bay area chiropractor convicted of inappropriately touching a patient is back at work just months after receiving a two year jail sentence. we have more with what developed in this story in past hour or so. maureen. reporter: well, julie basically the chiropractor convicted of the felony sexual battery of a patient was allowed to resume work because his license was active and when we called the state licensing board to check in on the case, they said they were pretty much unaware that they were seeing patients again. >> four months after this chiropractor was convicted of felony sexual battery the 49- year-old was back at work with his good life chiropractor office. manford alcos was arrested in 2013 and last year convicted of sexual battery after a 21-year- old woman says she was inappropriately touched in an office vis. >> it there is concerns about putting a person, regardless of who it is back into a position where they committed the crime. >> several patients committed their love for the doctor. we searched the chiropractor licensing record and found that he still had an active license making hill legally allowed to practice. the attorney is appealing the conviction and requesting that he keep the license during the appeal just with supervision and to not practice in a private room. >> the worse thing is to take away a man's livelihood when the case is on appeal. >> he was sentenced to two years in prison and released credit for time served. >> my name is maureen naylor. >> when we called the state board earlier they say he has the right to due process and could legally practice for another month. but late this afternoon called back to say they are seeking to revoke his license. >> were you aware that he was practicing. >> we were not entirely aware of that at the time. and so now we are moving forward and using that in our investigation. >> the temporary suspension of his license expired when he finished his sentence and they thought his sentence would last longer. >> with the sex crimes division. they said it is ridiculous that state board was unaware of the conviction and questioned why they didn't take action sooner and in the meantime the chiropractor could still see patients until the board takes action. i reached out to his attorney and he says if the executive director of the board knew the facts he would see it differently and plans to address that next month. live in campbell, back to you. a teenager is dead and another under arrest after a high-speed police chase that started in san francisco and ended with a horrible crash. police began to chase two robbery suspects in the city. the chase continued to highway 101 and ended in sunnyvale when the suspect crashed near el camino. the car hit 5 parked cars before flipping over. the highway patrol says the honda was going over 100 miles per hour an. the 19 year-old suffered injuries and the 18-year-old passenger died at the scene. >> he was moving. we have had this bad in the parking lot and the driveway is a launch ram and it is what happens. you see parts down the parking lot to the street. the c hp has identified the driver as 19-year-old za ne from san francisco. booked for vehicular manslaughter and evading police and driving under the influence of drugs. the superintendent has made it official. antwon wilson heading back east for a job. we have reaction. ted. reporter: the head of the oakland school board is calling the dee partial of antwon wilson a big loss for the city. wilson will head to washington in february at a news conference in dc this morning. wilson said he is proud of what he will be leaving behind in oakland. >> i can see myself as having an opportunity to serve the families of oakland and during that time we were able to do important work and the district is well positioned. to continue moving forward on behalf of young people. >> the oakland school board pointed to a number of successes during less than 3 years on the job for wilson including rising graduation rates and the first new multi labor contract since twine and the oakland initiative focusing on tripling college graduates. >> we are in the position we must continue to move on. i can say to you today that as a city we don't have time to lament and time to be sad. we have to stand here strong for our children. >> the board will work on an interim president and replace him probable next monday. antwon did have critics because of the addition of charter schools. they make up a proportion of the population with 50% of students attending charter schools. and ted, often times when the person in charge leaves others follow. are you hearing anything about that. a big concern raised and the president says he knows senior staff will remain in place in oakland. >> a dispute from the city of santa clara could go nuclear. financial leaders that city leaders are not using city money to operate the stadium. some of that information is propriety and refusing to hand over the documents. jesse gary has more. what is the scenario. reporter: auditors have been here at the stadium for much of the day and depending on what they find could determine whether this ends up in a court of law. >> the san francisco 49ers are added into battle with a foe and this time it is the front office fighting. >> this building is independently audited and signed off from the 49ers. >> team presidential guido says he will show the city council his case of the interworkings of levi stadium should not be turned over to the city but available for auditors. the mayor tired of this tussle is threatening legal action. >> the management agreement the documents are to be delivered to the stadium authority. it is a matter of possession. >> the football team acting as the company books levi for acts such as concerts and the shows bring in millions that go in the general fund. turning over the documents would make it public information and weakening negotiating power with artists and lower in profitability. a section of it say as much. it will be propriety. >> we believe that is critical maintaining successful businesses. >> that means more money in our coffers which means rebuilding roads and infrastructure. >> dominic caserra wants to bridge the divide between the bridge and city leaders before it goes to the courtroom. >> there is no reason why they signed the contract to say they will supply them to us. they need to supply them to us. >> and you have to have it physically. >> that's what the contract calls for. we are not asking for tonight the heart broken dog owners take on a pet store chain to make sure that pets are safe. imagine if you took your dog to the groomer and you picked him up he was dying. that happened to a couple from san mateo that say that is what happened when they took their puppy to a pet smart. tara moriarty tells us they are suing pet mart for negligence. >> terry and steffen say a trip to this pet mart to get their puppy's nails clipped turned deadly this last may. >> she was spewing blood and i was helpless. >> we have no way to know that just taking a pet in could cost him his life. >> henry was crushed while in the care of this man, 38-year- old grouper juan who criminal charges are pending. >> he went in for a routine nail trim and came out within seconds with two broken ribs and a punctured lung. >> peacock was traumatized. >> it was like if i was going in for a pedicure and i died doing it. >> henry was returned to the hospital where he died and cremated before the couple could say goodbye. >> i called the san mateo p d because this was egregious. >> this is a long history of pets being seriously hindered or killed while being groomed at pet smart. >> there has been four ranging from blunt-force trauma and strangulation to heat exhaustion to dogs being left unattended in dryers up to 135 degrees. the groomer never apologized and there was never an explanation provided for why henry was crushed and died. >> the couple's attorney hopes that this lawsuit will not only force pet mart to change policies but will force an overhaul of the grooming industry. they say at this point there is no government oversight. >> we never had children together. so i hope people can understand these are our children. >> they say what happened at pet mart should never happen to anyone else and that's why they are suing. pet mart declined to comment saying it can't comment because of pending litigation. tara moriarty, ktvu fox 2 news. a small plane crashed into the san bernardino national forest killing the pilot. the single engine cherokee was missing at five a.m. the wreckage was discovered at the foot of mount balding in san bernardino county about an hour later. the officials say the plane was on its way to riverside. the pilot was the only one onboard. the cause of the crash is under investigation tonight. still ahead. mattresses and trailers and fuel cans and much more. we showed you how all of these things are illegally dumped. we found a group of kids. some as young as 8 years old that decided to do something about the trash problem in their i'll detail the timeline that you can expect for your tonight and tomorrow morning. illegal dumping in oakland is a persistent problem costing the city millions. ktvu investigative team went undercover and it didn't take people long to see people dumping trash. it is in front of a business run by john beckwith. he says it is one of the worse dump spots. >> another spot is right in front of a public school on east oakland holly street. the students say since the students are not doing anything they are taking matters in their own hands. >> kids as young as 8 went out to pick up trash. >> at the charter school in east oakland small hands are helping to fight an enormous problem. trash dumped at the school's front door. >> really disgusted to see all of the trash that is around where we -- where some of the teachers live and where we eat and learn. >> the problem of dumping is so bad that students from the prekindergarten through 8th grade charter school break in to teams and do their best to right a wrong and they find garbage by the bag full. >> i don't feel happy to see my street looking like that. >> why don't they dump garbage in their neighborhoods. >> there is something that the students shouldn't touch such as this leftover construction material dumped across the street from their school. >> and around the corner there was household garbage, the type to attract rodents. >> a part of a car and mattresses. >> this is a what students are exposed to and rather than wait for the city to clean it up. the school leaders turned it into action. teachable and they form the clean-up. >> i want them to take responsibility that when you look outside your fence and you see trash that you can do something about that. >> if you want to make your community vibrant and beautiful you have to go out and do it yourself. >> the school is looking to buy high quality surveillance camera to capture video of people dumping and talking about long lasting solutions. until then the students will leave clear classrooms and clean up. >> nobody care about the commune. >> in oakland, rob roth. fox 2 news. i think it is great that they care but they have to be careful about what they pick up. >> i love that little girl saying if you want to do it, you have to go out there and do it. good for them. >>let look at the weather. bill, what about the rain. >> the next few hours, showers and we end up getting wet. not so much for the morning commute but when you get home and get ready for bed you should hear raindrops. it is a vigorous little weather system. it is not -- i mean it is going to rain and then move through quickly. what will hand you see the cold air coming behind it and that is interesting. dropping temperatures wednesday night and thursday morning. you can see freezing conditions and frosty conditions. lowering the snow level and so lake tahoe. they have a winter weather watch and snow levels down to 5000 feet that is low for this time of year and we will see just kind of a cooler day tomorrow. here is the next system over the horizon. that one gets in here friday, saturday and sunday. we get a break. and then what we have coming on friday. so there's the system i'm tracking and it is in eureka and you can see how threadbare the bottom half of the front is and that is where we are going to be in the lower end. outside we had a pretty sunset and winter weather advisory and you can see it here. that's for the lake tahoe area. snow levels down to 5000 feet as we head into tomorrow morning. and you know maybe six inches of snow at 5000 feet and maybe over a foot of snow in the higher elevations. it will be easy to get a foot of snow at donnor and summit. earlier i showed you the model, the higher resolution model and now i want to show you through your holiday weekend. here we are tuesday at 5:00 right now and watch what happens. we go through here and here we are tonight, there is the system and a break. thursday night you start to see this guy show up. and then there is your friday and so thursday's dry by the way. thanksgiving is dry and there's the friday night into saturday morning. still raining into saturday afternoon. still raining into sunday. and then a little bit of a break monday afternoon and then it starts to dry out but you will see valley fog return. that is the unsettled pattern. the next five days getting rain and here is the rough model forecast but you know monterey can get over an inch and see over two-and-a-half inches in santa rosa. none of this would induce flooding hopefully. i can't imagine how it could without those lower amounts. but it will put rain in the reservoirs. especially northern california. snow in the mountains. i think it would be easy to get a foot of snow. by the time it is done getting two to three as we go beyond the weekend. that's got people going to the mountain. >> big holiday weekend. >> thanks, bill. coming up, a final salute
